The impact of the Namibian judiciary system on the child witness

In this study focus is placed on the Impact of the Namibian judiciary system on the sexually-abused child witness and recommendations were made to criminal justice professionals. A literature study was undertaken to establish a grounded theoretical perspective. A single case study was done to evaluate how the Gestalt Play Therapy Process can be applied to mitigate some of the negative effects the judicial system has on the child witness. An empirical study was done and a qualitative approach was utilised. Semi-structured interviews were conducted with children, their parents and criminal justice professionals. Major findings of this study are that the Namibian criminal justice system leads to further traumatization of the sexually-abused child witness and that the Gestalt Play Therapy approach can be applied to make the court proceedings less traumatic and even therapeutic for the child witness. Recommendations were formulated for criminal justice professionals / In hierdie verhandeling is gefokus op die impak van die Namibiese regstelsel op die seksueel-misbruikte kindergetuie en daar word aanbevelings gedoen aan professionele persone in die kriminele regstelsel. 'n Literatuurstudie is gedoen om 'n grondige toeretiese perspektief daar te stel. 'n Enkele gevallestudie is uitgevoer om te evalueer hoe die Gestalt Spelterapieproses toegepas kan word om die hofverrigtinge vir die kind minder traumaties te maak. 'n Empiriese studie is gedoen en 'n kwalitatiewe benadering is gebruik. Semi-gestruktureerde onderhoude is gevoer met kinders, hulle ouers en professionele persone wat met seksueel-misbruikte kindergetuies werk. These constructions served as a base on which the researcher construed further constructions of the adult survivor of sexual abuse. The study focuses on the 1 ong term effects of the child abuse with specific reference to the effect on • the physical behaviour of the adult; • the nature of the sexual relationships of the adult; and • the nature of the interpersonal relationships of the adult. The strategies of the adult in surviving with these long term effects are also highlighted in the discussion. The healing process through which the adult survivor passes in healing the sexual trauma according to his or her own pace, is fully discussed. In the empirical research the theory is applied to describe the effect of sexual abuse on the lives of adults as well as on certain events of the healing process. A critical analysis of the procedures followed in child rape cases in Mpumalanga Province

This study reflects a critical analysis of the procedures followed in child rape cases in Mpumalanga Province and in the process to enhance investigative capabilities with sound detective development. Empirical research was conducted with a literature review, docket analysis and interviews as methods to obtain information where the following important aspects were addressed: an overview of the field of forensic investigation, the shortcomings with regard to child rape investigations and correct procedures for conducting child rape investigations formulated. The study found that generally rape cases were not properly investigated, correct procedures were not followed (biological/physical evidence was not readily identified nor correctly handled) and applicable directives pertaining to child rape investigations not complied with. Investigators had a narrow understanding of the concept forensic investigation. In child rape investigations it would be of more evidential value and reliable to collect physical evidence such as blood, semen, vaginal fluids and saliva as the child’s testimony at court might not be reliable, particularly when subjected to cross examination. Rape is both a contact crime as well as a psychologically motivated crime and both aspects of the trauma needs attention during the investigation process. Crimes against women and children are also a national concern, thus making child rape a priority crime for the South African Police Service. For any successful prosecution it is necessary that policy and correct procedures are not compromised but rather strictly adhered to. The Locard Principle in relation to physical evidence such as body fluids at the crime scene needs to be focussed on during the investigation process. The research suggests that the current standing operating procedures be amended to include the critical aspects of child rape investigation such as processing of the crime scene, the search for biological evidence as well as the packaging and preservation of biological evidence. / Police Practice / M. It is referenced in the critical theory of education and in the multicausal and interdisciplinary approach of the phenomenon of domestic violence against the child and the adolescent in its most silenced profile: the intrafamily sexual violence. The research was carried out with inspiration in the methodology of the critical-collaborative action research. It was accomplished through two stages of training conducted in the Municipal Network of Education of São Paulo. The first stage consisted of a round of training meetings with the teams of the Núcleos de Apoio e Acompanhamento da Aprendizagem (NAAPA) - Support and Learning Monitoring Centers - of 11 regional groups, reaching, in addition to the center teams, teachers, principals, assistant principals, pedagogical coordinators, supervisors and members of the social protection network, in a total of approximately 1,970 participants involved. The second stage consisted of a course organized in two regionals, with three groups composed mainly of teachers, but also of supervisors, principals, assistant principals and pedagogical coordinators, totaling 188 participants. The collected data were grouped into categories using content analysis. The analyzed context is marked by curricular public policies of neoliberal character, which are forged from international, national and local impositions (city of São Paulo). These policies proved to be prohibitive and/or cause difficulties in the construction of an emancipatory education aimed to social quality. This work points to the pursuit of curricular justice as an aid to the analysis and possibility of overcoming the curricular violence practiced by the hegemonic proposals of curriculum in coping with ISV. This search presupposes that the curriculum includes two fronts of action with regard to the theme: the preventive actions carried out by the teaching and learning of the rights and the proper referral of each case of ISV, which in turn requires adequate training of school staff and of all the agents of the network for the protection of children and adolescents. As a result of this trajectory, it was observed that the school staff are more sensitive to detect signs of violence, to increase the visibility of the problem and to understand the complexity and multi-causality of ISV, as well as the possibilities of constructing coping actions through the school curriculum. It is also pointed out the socialization of the knowledge built in the training process with all the school staff and the planning of actions / Esta pesquisa objetiva construir conhecimentos sobre a presença da Violência Sexual Intrafamiliar (VSI) no âmbito da escola em suas implicações para o currículo escolar de modo a aprimorar o atendimento de crianças e adolescentes em situação de aprendizagem. Está referenciada na teoria crítica da educação e na abordagem multicausal e interdisciplinar do fenômeno da violência doméstica contra a criança e o adolescente em sua face mais silenciada: o da violência sexual intrafamiliar. A pesquisa foi realizada com inspiração na metodologia da Pesquisa-ação crítico-colaborativa. Concretizou-se por meio de duas etapas de formações realizadas na Rede Municipal de Educação de São Paulo. A primeira etapa consistiu em uma rodada de encontros formativos com as equipes dos Núcleos de Apoio e Acompanhamento da Aprendizagem (NAAPA) de 11 regionais, alcançando, além das equipes dos núcleos, professores, diretores, vice-diretores, coordenadores pedagógicos, supervisoras e membros da rede de proteção social, em um total aproximado de 1.970 participantes envolvidos. A segunda etapa consistiu em um curso organizado em duas regionais, com três turmas compostas majoritariamente por professores, mas também por supervisoras, diretores, vice-diretores e coordenadores pedagógicos, totalizando 188 participantes. Os dados coletados foram agrupados em categorias utilizando-se da análise de conteúdo. O contexto analisado está marcado por políticas públicas curriculares de caráter neoliberal, que se forjam a partir de imposições internacionais, nacionais e locais (município de São Paulo). Essas políticas mostraram-se impeditivas e/ou dificultadoras para a construção de uma educação emancipatória que visa a qualidade social. Este trabalho aponta a busca da justiça curricular como auxílio para análise e possibilidade de superação das violências curriculares praticadas pelas propostas hegemônicas de currículo no enfrentamento da VSI. Essa busca supõe que o currículo inclua duas frentes de atuação no que diz respeito à temática: a das ações preventivas realizadas pelo ensino-aprendizagem dos direitos e a do encaminhamento adequado de cada caso de VSI que, por sua vez, exige formação adequada dos trabalhadores da escola e de todos os agentes da rede de proteção da criança e do adolescente. Como resultado do percurso, observou-se maior sensibilidade dos trabalhadores para detectar sinais de violência, a ampliação da visibilidade do problema e da compreensão acerca da complexidade e da multicausalidade da VSI, assim como das possibilidades de construção de ações de enfrentamento por meio do currículo escolar. Educator's knowledge of and opinions on child sexual abuse

Sexual abuse of children occurs at a very high rate and most of the victims are young children who have never been taught about the possibility of being abused. Victims of abuse are not equipped with appropriate knowledge and vocabulary to enable them to explain properly when they experience abuse. Acquisition of a vocabulary and understanding of the concepts of sexuality would assist children in recognizing, resisting and reporting sexual abuse. The young age at which abuse occurs makes the study at primary school level important and relevant. There is little literature on how child sexual abuse can be identified, addressed and handled by schools or what unique role the school should play in the management of child sexual abuse cases. Educators are in a position to identify sexually abused children because of their close and ongoing contact with school-going children. Therefore, young children place a great deal of trust in their teachers and look to them for protection when they feel unsafe. Teachers are trained to observe changes in the appearance and progress of individual children. Therefore, they can also assist in uncovering and reacting appropriately to disclosures of abuse. The study was conducted in poor, disadvantaged, rural primary schools in a part of the North West Province. There is a limited access to social work services in rural areas and therefore, educators are considered to be appropriate people to educate children about sexual abuse issues because children spend most of their time at school. There is a relationship between educators, parents and children which creates a proper channel of communicating information about sexual abuse of children. That is, educators are in a position not only to educate but also to reinforce what children have learnt at home. Educators' role have been limited in the identification and dealing with sexual abuse cases and therefore, there is a need to empower them with appropriate knowledge and skills to enable them to handle sexual abuse cases at school level successfully. / Psychology / M. Text in Afrikaans / This study is about the provision of a prototype court preparation programme for the primary school child that had been sexually assaulted. The programme is developed from a Gestalt approach. Literature regarding several existing court preparation programmes was studied and compared in order to identify certain themes for the child's preparation. Knowledge regarding the court, procedures and the functions of the various role players was conveyed to the child with emphasis on the child's role as witness. The research strategy utilised in the study was that of the intervention research and specifically the D&D-model that comprises six phases. The study incorporates the first three phases plus the first step of the fourth phase. Semi-structured interviews and focus groups were utilised to establish which themes could be addressed to support the child towards being a credible witness. The problem of this study is localized around the issues of sexual abuse perpetrated by father against children. Based on issues and concerns caused by the clinic listening to children and adolescents involved in situations of sexual violence and their families aimed to study, within the psychoanalytic perspective, the impact on family dynamics, the development of intra-family sexual abuse and the implications for the child. Participated in the survey the mother of a child who suffered sexual abuse by her biological father and revealed the fact to mother after almost two years, referred to research by the Interprofessional Reference Center on Attention to Children and Adolescents Victims of Violence of Capital / Court of Justice of Pernambuco [TJPE]. We adopted for the collection of data the semi-directed psychological interviews, within the clinical-qualitative approach, observing the ethical guidelines for research with human beings; for the analysis of the data we use the Content Analysis[AC], grouping the interview fragments themes to then understand them in their core sense. Our research has shown that disclosure of child sexual abuse is a slow and gradual process that requires an intense psychic work for the child and unfolds in his narrative. We found that the revelation of incestuous sexual abuse does not necessarily promote early relief and can be lived in a threatening and painful for the child / adolescent, associated with anxieties and fantasies, being able to be more difficult than the experience of abuse. Both the child and family members when deciding the complaint, are asked to talk about what happened in different instances, mostly disjointed, forcing members to share, countless times, how was the abuse by setting up a true via-crucis for children mainly. We also note that the data analyzed in the interview show that in relation to the family, the process of revelation leads to a destabilizing period requiring the emotional disposition group for the development and transformation. It can tell that our study corroborates findings from previous research, with regard to maternal reactions to the disclosure, evidencing the psychological suffering that mothers have to take notice of the fact, and must receive equal attention and care in the course of revelation, noting that occupy a significant place in this process. As regards the disclosure in the clinical context, we emphasize the importance of clinical work and Therapist figure mediating the child relationship with his experience of abuse, offering a safe environment for creating senses. Thus, we hope that this research has contributed in some way to broaden the discussion around the issue of child sexual abuse assistance in the field of clinical and academic circles. / Considerado um grave problema social e de saúde pública, a violência sexual contra crianças se expressa de diversas formas incluindo o abuso sexual intrafamiliar. A problemática deste estudo circunscreve-se em torno das questões sobre o abuso sexual perpetrado por pai contra filhos (as). Respaldadas em questões e inquietações provocadas pela escuta clínica de crianças e adolescentes envolvidos em situações de violência sexual e suas famílias objetivamos estudar, dentro da perspectiva psicanalítica, as repercussões na dinâmica da família, da revelação do abuso sexual intrafamiliar e as implicações para a criança. Participou da pesquisa a mãe de uma criança que sofreu abuso sexual praticado por seu pai biológico e revelou o fato à mãe depois de quase dois anos, encaminhadas à pesquisa pelo Centro de Referência Interprofissional na Atenção a Crianças e Adolescentes Vítimas de Violência da Capital/Tribunal de Justiça de Pernambuco[TJPE]. Adotamos para a coleta de dados as entrevistas psicológicas semidirigidas, dentro da abordagem clínico-qualitativa, observando os cuidados éticos para a pesquisa com seres humanos; para a análise dos dados utilizamos a Análise de Conteúdo, agrupando os fragmentos da entrevista em eixos temáticos para, então, compreendê-los em seus núcleos de sentido. A nossa investigação mostrou que a revelação do abuso sexual infantil é um processo lento e gradual, que demanda um intenso trabalho psíquico para a criança e se desdobra na sua narrativa. Verificamos que a revelação do abuso sexual incestuoso não necessariamente promove alívio de início, podendo ser vivida de ameaçadora e dolorosa para a criança/adolescente,associada às angústias e fantasias, sendo capaz de se tornar mais difícil do que a própria experiência do abuso. Tanto a criança como membros da família quando decidem pela denúncia, são solicitados a falar sobre o que aconteceu em diferentes instâncias, em sua maioria desarticuladas, obrigando-os a contarem, inúmeras vezes, como se deu o abuso, configurando-se numa verdadeira via-crúcis para a criança, principalmente. Observamos também que os dados analisados na entrevista demonstram que em relação à família, o processo de revelação leva a um período de desestabilização exigindo do grupo disposição emocional para a elaboração e transformação. É possível dizer que nosso estudo corrobora achados de pesquisas anteriores, no que se refere às reações maternas perante a revelação, ficando evidente o sofrimento psíquico que as mães apresentam ao tomar conhecimento do fato, sendo necessário que recebam igual atenção e cuidado no decurso da revelação, lembrando que ocupam um lugar significativo neste processo. No que se refere à revelação no contexto clínico, destacamos a importância do trabalho clínico e da figura do terapeuta intermediando a relação da criança com sua experiência de abuso, oferecendo a ela um ambiente seguro para criação de sentidos. Dessa forma, esperamos que esta pesquisa tenha contribuído de alguma forma, para ampliar o debate em torno da problemática do abuso sexual infantil intrafamiliar no campo da clínica e da academia.
