A Constituição Federal garante aos particulares o direito de propriedade e a livre iniciativa da exploração da atividade econômica como bem lhe aprouver. O objetivo do particular, ao explorar determinada atividade econômica possui um único fim, qual seja, a perseguição do lucro e aumento de seu patrimônio pessoal. Contudo, no afã da busca do lucro, sabe-se claramente que estes mesmos empresários não hesitam em violar direitos de outras pessoas, inclusive da coletividade. Neste momento, deve o Estado interferir na atividade econômica, de forma a manter a ordem e os direitos sociais. Quanto mais relevante o objeto social explorado pelo particular, mais aguçada será a perseguição do lucro. Exemplos clássicos são as atividades que até então eram exploradas pelo Estado e que, através de privatizações, passam ao domínio do particular. A Golden Share é um meio muito eficaz para o Estado controlar estes abusos. Porém, tais ações têm que ser utilizadas para manter o interesse público nestas atividades de maior relevância econômica e não como meio político de interferir na iniciativa privada. Aqui surge a necessidade de pesquisar e estudar os limites destas atuações, para que a faculdade conferida ao ente Estatal não seja utilizada com outra finalidade, tal como a política acima citada

Among them, the generation of employment and income growth and domestic demand for goods and services can be verified over the years. In this process, the demand for products of the sugar industry was stimulated initially by demand for sugar and subsequently the demand for ethanol. The development of this sector in the country and its expansion in the Central / South, particularly in the State of Goiás, conditioned some dynamics in relation to agricultural land use. Thus, the aim of this study was to analyze the expansion of this sector from the expansion of formal employment in the municipalities of Goiás. Through the differential method, we seek to identify structural factors that influenced the dynamics of the expansion of this sector and stimulated the creation of jobs. Search results considering the timeframe 2001-2005, 2006-2010 and 2001 - 2010 in relation to structural variation, indicate that the expansion of the sector has been influenced by the dynamics of national activity. However, from 2006 locational factors such as tax incentives, presence of activities related to agriculture and the presence of industrial processing of sugar cane may have influenced the competitive dynamics that contributed to the performance of the activity in the state. / A urbanização e industrialização da sociedade brasileira promoveram alterações no perfil da economia nacional. Entre elas, a geração de emprego e renda e o crescimento da demanda interna por bens e serviços podem ser verificados ao longo dos anos. Neste processo, a demanda por produtos da indústria canavieira foi estimulada, inicialmente pela demanda por açúcar e posteriormente pela demanda por etanol. O desenvolvimento do setor sucroalcooleiro no país e a sua expansão na região Centro/ Sul, particularmente no Estado de Goiás, condicionou algumas dinâmicas no que diz respeito à ocupação do solo agrícola. Dessa maneira, o objetivo do trabalho foi analisar a expansão do setor sucroalcooleiro a partir da expansão do emprego formal nos municípios goianos. Através do método diferencial-estrutural buscamos identificar os fatores que influenciaram na dinâmica da expansão do setor sucroalcooleiro e estimularam a geração de empregos. Os resultados da pesquisa considerando o horizonte temporal 2001-2005, 2006-2010 e 2001 – 2010, em relação à variação estrutural, indicam que a expansão do setor foi influenciada pela dinâmica nacional da atividade. No entanto, a partir de 2006 fatores locacionais tais como incentivos fiscais, presença de atividades relacionadas à agropecuária e presença de unidades industriais de processamento de cana-de-açúcar podem ter condicionado as dinâmicas competitivas que contribuíram para o desempenho da atividade no estado.

This diploma thesis focuses on aspects related to the share and enterprise transfer. Although both transfers seem to be similar from economic point of view, their consequences are different. The first chapter introduces a legal concept of "share" and "enterprise". These terms are introduced not only from the current legislation perspective, but also from the perspective of their content. This leads to general differentiation of both terms, which is very important regarding the following analysis of their transfers. The second and third chapter are separately focused on analysis of the share and enterprise transfer, i.e. on conditions of the transfers and their consequences for entrepreneurial activity. The analysis specifically focuses on legal requirements regarding the approval from the side of relevant corporate bodies and determination of formal and material terms of a transfer contract. The chapters also cover the extent of transferor's guarantee and processes of registration into public registers. Both chapters also mention tax duties regarding the transfers. Furthermore, since not all parts of the entrepreneurial activity form an enterprise and the transfer of an enterprise has certain influence on the entrepreneurship, a special subchapter is dedicated to this issue. Employee share ownership in the UK bus industry

The aim of this thesis was to generate a series of propositions identifying the elements most likely to be found in 'durable' employee-owned organisations. Previous studies in the field had often been marked by the assumption that benefits associated with employee share ownership, including reduced 'social divisions' between employees and their managers and a greater propensity among the former to work harder, would follow in all employee-owned enterprises, Few researchers had addressed the 'empirical reality' and 'diversity' of individual employee share ownership conversions and the circumstances in which systems had been created, implemented and subsequently managed by organisations.' Areas covered by the thesis included an examination of employee participation structur'es in different employee share ownership environments and 'feelings of ownership and commitment' among employee shareholders. The thesis also considered whether the 'traditional' trade union role would be undermined by new forms of representation and participation resulting from the introduction of employee share ownership programmes, Applying an extensive 'multimethod' approach, quantitative and qualitative data were collected over an eighteen-month period from six organisations in the UK bus industry -regarded by the mid 1990s as the most important locus of employee-owned companies. In 1994, some twenty-five UK bus companies were defined as 'employee-owned', generally consisting of non-managerial employees holding at least 25 per cent of the equity in their work places, Results from the investigation revealed that 'direct monetary investment' by employees and extensive information and communication programmes were among the elements characterising durable employee-owned organisations, Preservation of the 'traditional' trade union role was also evident, with employee shareholders generally content to participate in company matters through their union, More broadly, the thesis concluded that recognition in future research of the interplay of different variables was essential to increase understanding in relation to employee commitment, participation and industrial relations outcomes.

The prevalence of cancer in the world continues to grow, faster in economically developed countries. According to current scientific knowledge, at least one third of cases could be prevented by adopting a healthy lifestyle. The present thesis therefore sought to analyze the prevalence of cancer in connection with the lifestyle of the European population, of 63,772 respondents of the SHARE study (The Survey of Health, Aging and Retirement in Europe) in fact. The work contains the theoretical description of the problem and the analytical part. The differences in the prevalence of the diseases of the respondents from 16 European countries were monitored in the empirical part. The relation between the incidence of cancer and the groups of diseases defined by alcohol consumption, smoking, obesity and the lifestyle of the respondents was analyzed by the method of binary logistic regression. The survey was expanded by the summarizing indicator of Healthy Lifestyle Index, compiled from smoking, alcohol consumption, physical activity, body weight, and consumption of fruit and vegetables. The analysis, among other things, showed that with the decline in the healthy lifestyle index, the risk of malignancy in both men and women increased and is more pronounced in males. In the first chapter the author describes a change introduced by the Act on Business Corporations that allows creation of different types of shares in a limited liability company. Different rights and obligations may be connected with such shares. Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / This work has the main objective of assess the competitiveness of pork meat exports from Brazil and its most important competitors on the international market (Germany, United States, Denmark and Canada), from 1990 to 2012. To this end, the Constant Market Share (CMS) method was used, comprising three effects: world trade; destination; and competitiveness. In order to better capture the changes in exports during the time, five sub periods were chosen, 1990/1993, 1994/1998, 1999/2002, 2003/2008 and 2009/2012. The analysis has demonstrated that United States are the most competitive country during the analyzed period, followed by Brazil. Although United States are more competitive, the growth percentage from Brazil was higher, 4,449.53%, while United States had 2,055.96% of growth. For both countries, ninety percent of this growth occurred due to increasing competitiveness. Denmark was the second country in pork meat exports in 1990, while Brazil and United States were not even among the ten larger exporters. However, Denmark presented the lowest percentage growth and the main reason was the decline of the competitiveness, not showing any positive competitiveness effect in the sub periods. Despite of been less competitive than the United States and Brazil, Germany is by now the largest exporter, with 704.45% of growth. Competitiveness was key to this growth in the complete period, but the increase in the imports of its most important importers was more relevant than in the other analyzed countries. Canada was the only country were most part of the exports growth was due to world trade growth of this product. The country also outstands because of its negative growing tendency at its main trade markets, especially the United States, which has become one of the larger players of world pig farming. / Este trabalho tem como objetivo principal avaliar a competitividade das exportações de carne suína do Brasil e dos maiores competidores no mercado internacional (Alemanha, Estados Unidos, Dinamarca e Canadá), no período de 1990 a 2012. Para isso, utiliza-se como método o Constant Market Share (CMS), decomposto em três efeitos: comércio mundial; destino; e competitividade. Para captar melhor as mudanças nas exportações ao longo do tempo, foram definidos cinco subperíodos, 1990/1993, 1994/1998, 1999/2002, 2003/2008 e 2009/2012. A análise demonstrou que os Estados Unidos são o país mais competitivo no período analisado, seguido pelo Brasil. Apesar dos Estados Unidos serem mais competitivos, o crescimento percentual do Brasil foi maior, 4.449,53%, enquanto o dos Estados Unidos foi de 2.055,96%. Para ambos os países, mais de noventa por cento desse crescimento ocorreu devido ao aumento da competitividade. A Dinamarca era o segundo país que mais exportava carne suína em 1990, enquanto o Brasil e os Estados Unidos sequer estavam entre os dez maiores. No entanto, a Dinamarca apresentou o menor crescimento percentual e o principal motivo foi a queda da competitividade, não apresentando nenhum subperíodo com efeito competitividade positivo. Apesar de se mostrar menos competitiva que os Estados Unidos e o Brasil, a Alemanha é o atual maior exportador, com crescimento de 704,45%. A competitividade foi fundamental para esse crescimento no período todo, mas o aumento nas importações em seus principais mercados se mostrou mais relevante que nos outros países analisados. O Canadá foi o único país onde a maior parte do crescimento ocorreu devido ao crescimento do comércio mundial desse produto. THE POLICY-TECHNOLOGY NEXUS FOR MITGATING PASSENGER ON-ROAD TRANSPORTATION GHG EMISSIONS: E-BUS, E-RIDE-SHARE, OR OTHER ALTERNATIVES / ASSESSMENT OF TRANSPORTATION GHG MITGATING SOLUTIONS

The passenger transportation sector is notoriously difficult to decarbonize. In this thesis, two distinct and novel methodologies to estimate the environmental impact of alternative and conventional transportation technologies are developed. In Chapter 2, a provincial fleet policy-driven linear programming model is developed to minimize the cost of three passenger vehicle electrification policies in Ontario under a 30% GHG reduction target by 2030. Provincial life-cycle emissions and total-cost-of-ownership associated with policy allocation is estimated. The results highlight that electrification of on-road passenger transportation will not be sufficient to meet the 30% reduction target despite Ontario's low-carbon electricity grid. Instead, reductions of between 24% to 26% are forecasted at an annual cost (for ten years) of between CAD 0.29 to 0.3 billion annually indicating that additional policies are necessary to realize a 30% reduction target. In Chapter 3, a trip-level vehicle framework is developed to determine under what operating conditions transit buses and passenger cars will be environmentally beneficial across the dimensions of technology, service mode, and power source pathway. The well-to-wheel energy consumption and GHG emissions are simulated for over 450 operating scenarios. Emissions are then normalized through passenger-trip emission thresholds to facilitate equivalent comparison across all dimensions. The results indicate that the most beneficial solution are fuel-cell electric car-share, battery electric car-share, and battery electric bus all powered by low-carbon intensity power sources at average occupancy (7.9-19.7 gCO2e passenger-service-mode-trip-km-travelled-1). Furthermore, transit bus technologies have the potential to reduce up to 2.3 times more GHG per passenger-trip than comparable ride-share passenger cars at average occupancies. The results of Chapter 2 and 3 highlight that technology alone may not be sufficient to achieve significant GHG reductions; policy which leverage local operating data and target GHG reduction associated with passenger-trips are critical to informing under what conditions a mobility solution is environmentally beneficial. / Thesis / Master of Civil Engineering (MCE) / There is a dire need to evaluate the effectiveness of transportation GHG mitigation policies as alternative mobility solutions are being adopted and the pressure to respond to climate change intensifies. This work evaluates the effectiveness of policy optimization and vehicle-level simulation techniques to inform GHG mitigation decision-making. A two-step approach is adopted herein. At the strategic level, a cost optimization model for passenger vehicle electrification policies in Ontario is calibrated to identify the optimal allocation of provincial policy to achieve a 30% GHG reduction by 2030. Next, a micro level focuses on the energy consumption of eight vehicle technologies over 450 operational scenarios is simulated and trip-level passenger emissions are estimated to reveal the environmentally beneficial mobility option, corresponding passenger thresholds, and extent of variability associated with local operating conditions. Overall, optimization and trip-level vehicle simulation can be used to demystify optimal decision-making related to mobility solutions.
