Most jurisdictions have over the past two decades experienced reforms with regard to arbitration law. These include England, America, France, Germany and the Netherlands. These reforms were necessary as the trend in the modern era shows that businessmen situated in different countries usually prefer to have their disputes resolved by arbitration as opposed to court litigation. To have disputes resolved effectively, it is surely a desirable thing to have laws that would promote the use of arbitration as an alternative dispute resolution. This would also ensure progressive international trade which is an important aspect of development in the South African constitutional state. One aspect of the law that would ensure a speedy and effective resolution of dispute by means of arbitration is the incorporation of the doctrine of separability in a country's law. The doctrine of separability provides that an arbitration agreement is a separate and independent contract from the main contract in which it is incorporated. Antibiotic usage in South Africa: a longitudinal analysis of medicine claims data / Winifred Esther Agyakwa

The main aim of the study was to determine the prescribing patterns of antibiotics with an emphasis on fluoroquinolones in the private health sector of South Africa. The empirical study followed a quantitative, descriptive, observational method using retrospective, longitudinal medicine claims data provided by a nationally representative Pharmaceutical Benefit Management company (PBM) from 1 January 2005 to 31 December 2012. Penicillins, cephalosporins, carbapenems, aminoglycosides, chloramphenicol, fluoroquinolones, macrolides, tetracyclines, sulphonamides and trimethoprim were considered in the study. A total of 5 155 262 (44.8%) patients received at least one antibiotic prescription out of the total number of registered beneficiaries included in the database. The average number of antibiotic prescriptions per patient per year ranged from 2.22 ± 1.89 (95% CI 2.22-2.22) in 2005 to 1.98 ± 1.62 (95% CI 1.98-1.99) in 2012. The number of antibiotics per prescription per year remained fairly constant at 1.05 ± 0.19 (95% CI 1.05-1.05) in 2005 to 1.06 ± 0.21 (95% CI 1.06-1.06) in 2012. The prevalence of patients receiving antibiotic prescriptions decreased from 46.1% (n = 789 247) in 2005 to 38.2% (n = 480 159) in 2012. Antibiotics were mostly prescribed for females (54.9%, n = 2 831 686) and in patients aged 0 to 18 years (26.5%, n = 1 366 824) and least in patients above 65 years (9.5%, n = 490 496). The prevalence of patients receiving antibiotic prescriptions was highest in Gauteng (41.9%, n = 2 159 360) and lowest in the Northern Cape (1.7%, n = 87 720). Antibiotics were mostly prescribed during the winter period. Penicillins were the most prescribed antibiotics (43%) and carbapenem the least (0.1%) out of the total number of antibiotics claimed. No practically significant association was found between antibiotic prescribing and gender, age, province and season. A total of 1 983 622 prescriptions for fluoroquinolones were claimed in patients older than 18 years. The average number of fluoroquinolone prescriptions per patient per year ranged from 1.45 ± 0.92 (95% CI 1.44-1.45) in 2005 to 1.31 ± 0.71 (95% CI 1.31-1.32) in 2012. The highest prevalence of fluoroquinolone prescribing was observed in females (64.1%, n = 850 253) and in patients between 45 and 65 years (38.6%, n = 511 542). The total fluoroquinolone use by the study population decreased from 2.85 DID in 2005 to 2.41 DID in 2012. Norfloxacin was the only first-generation fluoroquinolone prescribed. The second-generation fluoroquinolones accounted for more than 50% of the total DID, with ciprofloxacin being the most used active ingredient in this generation. Moxifloxacin was the most prescribed third-generation fluoroquinolone; its use ranging from 0.51 DID in 2005 to 0.44 DID in 2012. Between 2005 and 2012, a total of 57 325 prescriptions for fluoroquinolones were claimed by patients 18 years and younger. The prevalence of patients receiving fluoroquinolone prescriptions decreased from 3.6% (n = 8 329) in 2005 to 2.9% (n = 3 310) in 2012. Fluoroquinolones were mostly prescribed to females and in patients between 12 and 18 years. In all age groups, prescribing was mainly done by general medical practitioners. Ciprofloxacin was the most prescribed fluoroquinolone, followed by levofloxacin. In conclusion, this study established estimates on the prevalence of antibiotic prescribing covering an eight-year period. Secondly, baseline estimates for fluoroquinolone prescribing in adults using the ATC/DDD methodology were determined. A needs analysis of adventure activities in South African National Parks / Zacharias Johannes Bosch

Adventure tourism is currently regarded as one of the fastest growing forms of nature-based tourism within the alternative tourism industry. Historically, adventure was only considered a by-product on journeys of discovery and exploration as travellers sought new land, wealth and knowledge. As the uncertainty surrounding travel diminished and more people began to travel further in search of new and exciting pursuits, the term adventure tourism began to take shape. Those who travelled further to remote and exotic nature-based settings to participate in unique and adventurous activities become known as adventure tourists. These travellers may be thought of as being the first adventure tourists, although modern-day adventure tourism has its origins in numerous historic themes in travel and ways of thinking, including those of explorers and adventurers, pilgrims, travel writer adventurers, merchants and traders, trekking, Outward Bound and World War periods. Although being a much debated topic amongst scholars, adventure tourism is described as travel to a remote, exotic or nature-based destination with the purpose of participating in adventure activities. Adventure activities are usually associated with risk, challenge and danger and are pursued for their ability to provide the participant with unknown outcomes, constricting emotions, educational opportunities, and novel, thrilling, stimulating, exciting and adrenaline rush experiences. Adventure activities also differ in respect of their requirements to competently overcome different levels of challenge. Challenges posed by adventure activities can range from the routine to the extreme and are therefore divided into two categories, namely soft and hard adventure activities. Soft adventure activities require little to no previous experience or skills as they only contain perceived levels of risk, whereas hard adventure activities are regarded as highly challenging activities that require great mental and physical effort to perform. The bulk of the adventure tourism market consists of soft adventure tourists. This is also true of the visitors who participate in adventure activities in national parks, as most adventure offerings in the parks consist of soft adventure activities, such as safaris, game drives, camping, and trail walking, to name but a few. A great number of these adventure activities are centred on family groups and more mature audiences, as they make up the majority of the market of visitors visiting South African National Parks. In other words, from the over 80% of funding that is self-generated by South African National Parks, these markets are considered primary contributors to park income. Unfortunately, it was estimated that by 2022 operational cost would have exceeded tourism profits due to the constant increase in conservation costs and land management costs. A feasible solution to this problem was identified; connecting a broader South African society with national parks to help support and protect the natural heritage of the parks. This included the development of new adventure activities for current and potentially new markets that will respond to both the adventure and wilderness lore of national parks. Therefore, the primary objective of this study was to determine tourist needs for adventure activities in South African National Parks. A literature analysis of adventure tourism and adventure tourism product development, which provided the background for the empirical study, was conducted. A quantitative research approach was followed by means of an electronic questionnaire that was posted on the SANParks web site under the sub-link 'Media & News', allowing for convenience sampling. Respondents had access to the questionnaire during the months of April and May 2014, from which 387 usable questionnaires were obtained. Data was analysed using descriptive and exploratory statistics for arriving at the empirical results. The socio-demographic profile of the majority of respondents who completed the questionnaire was found to be as follows: almost an equal number of females (51%) and males (49%) spoke English as a home language, married, obtained some kind of diploma or degree, averaged an age of 49 years, and resided in Gauteng or the Western Cape. Thirty-four percent (34%) of respondents included children in their travel party of which the majority were between the ages of nineteen to twenty-five years. It was also identified that respondents visited national parks an average of 8.54 times over a five-year period and stayed an average of two to seven nights, while most respondents were owners of a Wild Card. Most respondents indicated that they participated in adventure activities but felt that current adventure activities in national parks were sufficient. Respondents were also willing to pay for adventure activities in national parks, ranging from R101-R300 for an activity per person. Respondents were offered the opportunity to identify the level of importance between a list of soft and hard adventure activities for national parks, as well as motives for participating in adventure activities. Three factor analyses were conducted on these lists from which eight factors were identified for the soft adventure activities (water-based, interpretive, wildlife interaction, heritage, consumptive, trail/trekking, self-executing and team-based), three factors for the hard adventure activities (adrenaline rush, wilderness training and survival courses, and adventure sports) and two factors for adventure participation motives (internal and external motives). The most important soft adventure factor with the highest mean value was interpretive (safari/game viewing, night drives, bird watching, stargazing, guided walks and hot air ballooning), with self-executing (guided and unguided 4x4 trails and campsite camping) in second place, heritage (archaeological tours, historical tours, geographical tours and botanical tours) in third place and trail/trekking (backpacking, cycling routes, hiking and horseback safaris) in fourth place. Self-executing was also considered the only factor that had a positive small effect correlation with visits over the past five years, meaning that if visitor visits increase so does the importance of self-executing activities. Wilderness training and survival courses (field-guide training, wilderness camping, survival and wilderness training, and survival games) were considered as the most important hard adventure factor. Regarding adventure participation motives, respondents considered external motives, such as getting in touch with nature, spending time with family and friends, educational reasons, escaping routine and exploring a new destination, to be the most important reasons for participating in adventure activities. The profile of visitors who were most likely to participate in adventure activities was below the age of forty years and not a Wild Card member. It was also identified that males generally had a higher preference rate for adventure activities, including respondents that were either single or living together. In conclusion, this study found that there is a need for a variety of adventure activities in national parks and visitors are motivated by the social and environmental aspects of adventure activities, rather than by the performance thereof. South Africa‟s current energy sector places undue reliance on fossil fuels to fulfil the country‟s energy requirements. The use of these non-renewable energy resources are unsustainable, as millions of tonnes of harmful emissions are released and estimates are made that these resources will be depleted within the next 100 years. Therefore the country has to source alternative energy resources. Renewable energy resources (for example solar energy) are considered to release little or no harmful by-products and have an infinite supply. Therefore the South African government has to promote the use of renewable energy as part of its commitments to address climate change and to ensure sustainable energy resources. Some of the most popular regulatory tools that a state uses to control human behaviour, is through command-and-control instruments and fiscal instruments. The latter promotes behavioural changes by rewarding desired behaviour which ultimately advances the user‟s own best interest. Because of the nature of renewable energy governance, energy users can not be forced or compelled through commandand- control instruments to use renewable energy. They should rather be encouraged or persuaded to use this form of energy through market-based instruments. This is also the central hypothesis of this dissertation. The purpose of this study is to determine the extent to which the South African legal regime makes provision to promote the use of renewable energy resources through fiscal instruments. Therefore the various energy-related white papers, policy papers and legislation will be analysed. This study found that South Africa‟s legal regime only partly makes provision to promote the use of renewable energy resources through fiscal instruments. Stereotypes in the South African mining industry : an exploratory study / Irene Yolandi Berreneace Da Gama

Since the first democratic election in 1994, the South African labour force has undergone various changes. As a result, a number of laws were implemented, which helped ensure the diverse nature of the South African labour force. Within a diverse workforce, stereotypes are more likely to occur, which is also the focus of the present study. This study explored not only the meaning and origin of stereotypes but also the prevalent stereotypes and the manner in which employees experience these within the South African mining industry. A qualitative research design from a combined phenomenological and hermeneutic approach was used for the purpose of this study by following a case-study strategy. A combination of both purposive and convenience sampling was used and participants’ responses were obtained by making use of semi-structured interviews. The population consisted of participants (N = 15) from different departments within a particular organisation in the mining industry in South Africa. The representation of the population was diverse and included male, female, various age groups, and different racial groups. Interviews were transcribed and thematic analysis was used to analyse the data. Themes, sub-themes, and characteristics were extracted from the data and direct quotations of participants’ responses were analysed to support the findings. It was found that participants of this study are aware of and understand the meaning of stereotypes. Generalisation was the most prominent theme that was evident when asking participants about the meaning of stereotype. During the study it became clear that stereotypes exist within the mining industry and that individuals do entertain stereotypes of other individuals employed in this industry (out-groups), and also about themselves (in-group). The most prominent in-group stereotypes that individuals experienced are racially oriented. These stereotypes were experienced by White individuals, Black individuals and Coloured individuals, and it was mostly negative. The most prominent out-group stereotypes that individuals hold of others in their workplace were found to be occupational stereotypes. During the present study most stereotypes turned out to be negative in nature. Findings of this study also indicated that employees experience stereotypes on three levels, namely emotional, cognitive and behavioural. Participants of this study experienced stereotypes mostly on an emotional level. The study’s findings did show various origins of stereotypes and participants indicated that it originated mostly from secondary exposure. In these instances influences can be a result of factors such as affirmative action, apartheid, social interaction and upbringing. Cloning and evaluation of expression of the open reading frames of a South African G9P[6] rotavirus strain encoding rotavirus structural proteins VP2 and VP6 in bacteria and yeast / Louisa Aletta Naudé

Rotavirus infection causes severe gastroenteritis, affecting all children under the age of five regardless of hygiene or water quality. The currently licensed vaccines succeeded in reducing diarrhoea worldwide, but they still have shortcomings, especially the efficacy of the vaccines in developing countries. One of the main reasons for this can be due to the difference in strains, since the strains used to develop the currently licensed vaccines (RotaTeq and Rotarix) were selected from strains circulating in the developed world (G1, G2, G3 and G4), while the main strains present in Africa (G8, G9 and G12) were not included. A second shortcoming of the currently licensed vaccines is the cost of these vaccines. The vaccines are very expensive and most developing countries cannot afford the vaccines as well as the fact that the manufacturing companies cannot produce enough vaccines for all the countries. An attractive alternative to the currently licensed rotavirus vaccines is the non-live vaccine candidate, virus-like particles, which can provide a possible cheaper, safer and efficacious alternative or complement the currently licensed vaccines. Therefore, in this study a South African G9P[6] rotavirus strain, RVA/Humanwt/ ZAF/GR10924/1999/G9P[6], was used to determine whether or not co-expression of the structural proteins VP2 (genome segment 2) and VP6 (genome segment 6) was possible in bacteria and yeast. The South African GR10924 G9P[6] neonatal strain was previously obtained from a stool sample and the nucleotide consensus sequence was determined for both genome segment 2 (VP2) and genome segment 6 (VP6). Bacterial codon optimised coding regions or open reading frames were used in this study. The open reading frames (ORFs) of the genome segments encoding, VP2 and VP6, were cloned into the expression vector pETDuet-1, which allows for the simultaneous expression of two genes in bacteria. The ORF of genome segment 6 was purchased from GeneScript and the ORF of genome segment 2 was obtained from Dr AC Potgieter (Deltamune (Pty) Ltd R&D, South Africa). Compatible restriction enzyme sites were used to sub-clone the ORF of the bacterial codon optimised genome segments into the expression vector. Only the expression of the VP6 protein in bacteria was observed with Coomassie stained SDS-PAGE. The ORFs encoding VP2 (genome segment 2) and VP6 (genome segment 6) of the wild type GR10924 G9P[6] strain were cloned into the wide range yeast expression system vector, pKM173, which allows for the simultaneous expression of more than one gene. Several yeast strains were used in this study namely Kluyveromyces marxianus, Kluyveromyces lactis, Candida deformans, Saccharomyces cerevisiae, Yarrowia lipolytica, Arxula adeninivorans, Hansenula polymorpha and Debaryomyces hansenii. Expression of both proteins was not detected in the several yeast strains, as seen with western blot analysis. DNA extractions were done on two colonies of each yeast strain that were used for western blot analysis to evaluate successful integration into the yeast genomes. Only a few of the colonies contained either both of the genome segments or only one of the two genome segments of interest. To summarise, the simultaneous expression of VP2 and VP6 from rotavirus GR10924 G9P[6] was not successful in bacteria or yeast, but it was possible to soluble express the bacterial codon optimised GR10924 G9P[6] VP6 in bacteria using the pETDuet-1 as expression vector. / MSc (Biochemistry), North-West University, Potchefstroom Campus, 2015

Work-family enrichment : development, validation and application of a new instrument within the South African context / Marissa de Klerk

Over the past few decades it has become evident that the work/family interface is a much broader concept that does not only stress the negative side of the relationship, but also include a positive side. This refers to the process by which participation in one role (e.g. work role) is made better or easier by virtue of participation in the other role (e.g. family role). South Africa is a multicultural society, which consists of four groups (i.e. Black, White, Coloured and Indian), speaking eleven official languages. All of these groups are faced with unique and different circumstances. Apart from cultural, ethnic and linguistic differences, other divergent elements may exist (i.e. values and norms). Therefore South African employees may experience the positive side of the work/family interface differently from employees within other countries. To add to the problem, it is not clear how South African employees‟ experiences of enrichment between work and family domains compare to the experiences of employees in other countries. Furthermore, to date no measuring instrument to assess the enrichment between work and family domains in both directions (work-to-family and family-to-work) exists, that is unique to the South African context. This could pose potential problems for organisations and for future studies on the positive side of work/family in South Africa. The objectives of this research were 1) to determine how the positive side of the work/family interface, particularly work-family enrichment, is conceptualised according to the literature; 2) to develop a new work-family enrichment instrument that is suitable for the South African context and that addresses conceptual and measurement issues relating to previous positive measurements of the work/family interface; 3) to investigate the psychometric properties of the newly developed work-family enrichment instrument; and 4) to assess antecedents and outcomes of work-family enrichment among employees within the South African context. The study consisted of four phases. During the first phase, following an extensive review of literature covering the positive side of the work/family interface, a theoretical framework was proposed for the study. Thereafter, a new instrument that measures work-family enrichment was developed based on the proposed theoretical framework. The instrument was tested via Rasch modelling with a pre-limenary study (N = 527), in order to overcome some of the measurement limitations from the previous positive work-family instruments. This test was followed by investigating the psychometric properties (i.e. construct validity, discriminant validity, convergent validity and external validity; N = 627) of the newly developed MACE Work-Family Enrichment Instrument. During the final phase, antecedents, work-family enrichment and outcomes were assessed in the South African context. In both phases 3 and 4, the following instruments (accompanied by the new instrument) were utilised, namely the Work Resources Scale, Home Resources Scale, Utrecht Work Engagement Scale, Family Engagement Scale, Job Satisfaction Scale, Career Satisfaction Scale, Life Satisfaction Scale, Family Satisfaction Scale and the Work-family Enrichment Scale. During the first phase, the literature revealed that the positive side of the work-family interface is presented by various concepts (i.e. work-family enhancement, work-family facilitation, work-family positive spillover and work-family enrichment). The review also revealed that, to date, the work-family enrichment concept has been the only concept in literature on the positive work/family interface that is grounded in a properly developed conceptualised theoretical model. The fundamental thinking behind the work-family enrichment model is that work and family each provides individuals with resources (i.e. skills and perspectives, psychological and physical, social-capital, flexibility, material) in the one domain, that may help the individual improve the quality of his/her performance in the other domain. These resources thus enable improved performance in the other role either directly (i.e. instrumental path) or indirectly (i.e. affective path). During the second phase a new work-family enrichment instrument was developed, namely the MACE Work-Family Enrichment Instrument. This instrument was based on the proposed work-family enrichment theoretical model for both directions (i.e. work-to-family and family-to-work). Initially 133 items were developed that the researcher obtained from the existing literature, and 161 items were self-developed. During the evaluation study, various problematic items were eliminated by using the Rasch measurement model. The third phase included the validation study in which the psychometric properties of the new MACE instrument was investigated. The results provided evidence for construct validity, discriminant validity and convergent validity, and showed significant relations with external variables. Adequate internal consistency was also found for the proposed scales. The final number of items retained after this phase in the development and pilot study of the MACE Work-Family Enrichment Instrument were 34. During the final phase, various relationships were pointed out between antecedents (i.e. various work resources and home resources), work-family enrichment dimensions, as well as dimensions and outcomes of this type of enrichment. These included work-engagement dimensions, family engagement dimensions, as well as satisfaction-dimensions for work, career, life and the family environment. The results of these relationships were found to be in accordance with other literature on the positive side of the work/family interface. The present study provided evidence for the psychometric properties of the new MACE instrument, which researchers and managers can use to investigate the specific enrichment between work and family domains of employees in a South African context. The results give researchers and managers insight into the specific antecedents (e.g. work resources) and outcomes (e.g. job satisfaction) that play a role in work-family enrichment. This insight can be used as basis on which interventions can be developed to deal with these issues currently. The competence of the foreign representative in cross-border insolvency matters : a comparison between South Africa and Australia / Ella Mouton

The world is continuously becoming a smaller and smaller place. It has become a global community of sorts merely divided by imperceptible borders that are easily transversed by ever-evolving technological advances in the fields of business, travel, communication and such, each regulated by its own set of domestic laws and regulations. Hordes of South Africans immigrate to Australia annually due to, among others, economic and political uncertainty. These ex-patriots generally leave behind assets and creditors in South Africa whilst acquiring new ones wherever they choose to establish themselves. This serves as basis for potential future cross-border insolvency issues. Furthermore, entities such as companies trading internationally, and multinational companies with branches and offices in more than one state, have property and creditors in many different jurisdictions. Should such a company be liquidated, it would give rise to questions of jurisdiction, the procedures to be followed, the appointment of a liquidator(s) and the distribution of assets, to name a few. The absence of a universal cross-border insolvency law leaves room for much uncertainty and confusion. What is of importance for purposes of this research is to clarify all prevailing uncertainties regarding the rights and obligations of the foreign representative and the foreign creditor in cross-border insolvency matters. The foreign representative is the person or entity appointed to administer the reorganisation or liquidation of the insolvent debtor’s assets in a foreign proceeding. The inconsistency in cross-border insolvency regulations between South Africa and Australia has the consequence that there is no guarantee that a foreign creditor in one state will be treated the same as a foreign creditor in terms of the domestic laws of the other, as the Model Law aims to do. The situation would have been significantly less complicated had the South African Cross-Border Insolvency Act been in force at present and had Australia been designated as a state to which this Act would apply. In that case, the treatment of foreign representatives and foreign creditors would be of a reciprocal nature. This dissertation attempts, through an investigation of the South African and Australian domestic insolvency laws, to ascertain the position of the foreign representative and foreign creditors pre and post incorporation of the Model Law. Globally an estimated 33.4 million people were living with HIV/AIDS by 2008 (UNAIDS, 2009a:7). One of the main challenges facing the Republic of South Africa (RSA) today is the HIV/AIDS epidemic (NSP, 2007:17). By mid-year 2011 an estimated 5.38 million people (10.6% of the total population) were living with HIV/AIDS in the RSA (Statistics South Africa, 2011:2). Currently South Africa has the largest number of people enrolled in the Highly Active Antiretroviral Treatment programme (HAART) in the world (WHO, 2008:59). The objective of this study was to determine retrospectively the medicine treatment patterns of HAART at a district hospital in the North West Province of South Africa. The study was conducted at Thusong hospital in the Ditsobotla sub-district of the North West Province of South Africa. A non-experimental, retrospective, cross-sectional, drug utilisation research methodology was used to obtain the data. The target population included patients of all ages who visited Thusong hospital pharmacy during the data collection period, which commenced on 01 February 2012 and ended on 31 March 2012. The data of three hundred and ninety nine (N=399) adult and one hundred and sixty one (N=161) paediatric patients on HAART were used. The adult female patients accounted for almost 70% (n=276, 69.17%) and the adult male patients for only 30% (n=123, 30.83%). The male paediatric patients represented just over 60% (n=97, 60.25%), whereas the female paediatric patients comprised less than 40% (n=64, 39.75%). The majority of adult patients were unmarried (n=323, 80.95%) and this group of patients were also the youngest group (μ=36.38 ± 8.98 years) on ARV treatment. Almost 86% (85.96%, n=343) of adult patients were registered as unemployed. Ninety two (n=92, 23.06%) adult patients and fifty eight (n=58, 36.03%) paediatric patients defaulted treatment during the defined period. The investigation into the adult medicine treatment patterns revealed that more than half (52.38%, n=209) of all the adult patients were receiving regimen 1atn (EFV, TDF and 3TC), followed by 20.80% (n=83) on regimen 1a (EFV, D4T and 3TC). Most paediatric patients (n=73, 45.34%) were on regimen P1c (EFV, D4T and 3TC) and the second most (n=45, 27.95%) were on regimen P1a (D4T, 3TC and LPV/r). The average weight of adult female patients was 57.18kg (± 15.78kg) and the average adult male patient weighed 55.87kg (± 10.17kg) on initiation of HAART. The average adult male patient was initiated on HAART with a CD4 count of 130cells/mm3 (± 99.45cells/mm3), while for adult female patients it was 160cells/mm3 (± 96.52cells/mm3). The average male child was initiated with a CD4 count of 509.1cells/mm3 and the average female paediatric patient with 477.3cells/mm3. The average viral load for adult female patients on initiation of HAART was 103046copies/mm3 (± 189146copies/mm3) and for adult male patients it was 416600copies/mm3 (± 439746copies/mm3). The difference between the viral load of adult female and male patients were described as statistically (p=0.0006) and practically (d=0.713) significant. The average viral load for female paediatric patients on initiation of HAART was 242207copies/mm3 (± 709133copies/mm3) and for male paediatric patients it was 329734copies/mm3 (± 674532copies/mm3). Adult patients that received HAART at more than 12 consultations revealed an average weight gain of 3.43kg (± 8.11kg) from initiation of treatment. This group also showed an average increase of 214.71cells/mm3 (± 248.24cells/mm3) in CD4 count and an average reduction in viral load of 170944copies/mm3 (± 191854.69copies/mm3) from the day they started HAART up to the last date of receiving treatment. The paediatric patients on treatment for more than 12 consultations showed an average weight gain of 6.56kg (± 3.75kg) from initiation of ARV treatmentup to the last date of receiving treatment. They also showed an average increase in CD4 count of 396.63cells/mm3 (± 594.53cells/mm3) and a very encouraging average decrease of 538369.37copies/mm3 (± 948634.46copies/mm3) in the viral load. / MPham (Pharmacy Practice), North-West University, Potchefstroom Campus, 2014

Maintaining order in the community may be considered one of the fundamental obligations of the contemporary state. It requires the policing of society in accordance with the law and therefore entails one of the most comprehensive manifestations of state power. It is aimed at protecting the state and the community against crime so that the individual member of society is not burdened with self-protection. It is, however, essential that the state engages in legitimate powers and force in order to provide stability within the community it polices. The traditional approach to policing requires that a state authority be appointed to maintain order in the community, to apply and enforce the law and to utilise legitimate procedures to protect the community. However, through the ages it became synonymous with oppressive and politically driven state authority. This created a wedge between the state and society and resulted in a crisis in police legitimacy. Before 1994 South Africa‘s policing system was based on the national security of the state that ensured absolute state authority through oppressive political practices. The democratisation process deviated from this approach by striving for the limitation of state power and the protection of the individual by means of fundamental rights. This democratisation process also had an impact on the policing system, which was required to transform accordingly, in order to reflect the democratic state, as well as the constitutional values, fundamental rights and legitimate state authority. The South African police therefore had to transform on both a structural and material level, but seems to have done so without the juridical basis. This re-established a crisis in legitimacy which caused society to view the police as an oppressive, corrupt and hostile state authority. It created a feeling of contempt and distrust in the police and undermined the police‘s role in society. To counter this lack in legitimacy the community reverted to a form of self-protection and took the law into their own hands, which resulted in the undermining of public order and the law in general. This study investigates the juridical foundation of the contemporary policing system in South Africa. It studies the structural and material composition of South African policing and whether it can really be considered a constitutional policing system. It endeavours to provide juridical answers to the current concerns in the legitimacy of policing, in order to harmonise the traditional policing approach with that of the constitutional era. / PhD (Law), North-West University, Potchefstroom Campus, 2014
