Previous issue date: 2016-08-24 / A dissertação teve como objeto o direito ambiental do trabalho, problematizou e refutou os fundamentos da doutrina clássica: no âmbito individual, por não dialogar com os demais saberes sociais, construir versão analítica voltada, exclusivamente, ao interior das organizações e concepção dogmática dirigida ao cumprimento das normas gerais e especiais de tutela; no âmbito sindical, por não dialogar com os novos movimentos sociais e as teorias correlatas, deixar delado a possibilidade de retomada dos movimentos
reformistas/revolucionários. Com base na teoria social e jurídico-trabalhista crítica, identificou a formação dos espíritos do capitalismo, para afirmar que: as relações de trabalho, contraditoriamente livres e subordinadas, não são fenômeno trans-histórico, mas datado, e o adoecimento é fruto da modernidade centrada no Modo de Produção Capitalista e na subordinação da força de trabalho ao capital. Por meio da teoria organizacional crítica, identificou a evolução e a transformação do adoecimento até chegar ao momento atual – captura da subjetividade/alma, elevados índices dos rituais do sofrimento, mortes lentas no trabalho, que o adoecimento não atinge apenas o trabalhador, ultrapassa limites da fábrica e afeta seus relacionamentos e a sociedade, que a poluição transborda este limite e atinge o meio ambiente como um todo. Admitiu a necessidade de o sindicalismo ir ao encontro dos novos movimentos sociais, ampliar sua pautar reivindicativa, e promover, junto com eles, luta contra-hegemônica versus o ultraliberalismo global, responsável pelas misérias e injustiças sociais presentes. / The dissertation has as object the environmental labor law, problematized and refuted the fundamentals of classical doctrine: the individual, not dialogue with other social knowledge, build focused analytical version exclusively to the interior of the organizations and dogmatic conception directed to compliance of general and special standards of protection; in the trade union context, not dialogue with the new social movements and related theories, leaving aside the possibility of resumption of reformist / revolutionary movements. Based on social theory, legal and labor critic, identified the formation of capitalism spirits, to say that: labor relations, contradictorily free and subordinate are not trans-historical phenomenon, but dated, and the illness is the result of modernity centric Capitalist Mode of Production and subordination of capital to labor. Through critical organizational theory, identified the evolution and
transformation of the illness until the current moment - capture the subjectivity / soul, high levels of suffering rituals, slow deaths at work, the illness affects not only the worker exceeds limits plant and affects their relationships and society, that pollution overflows this limit and reaches the environment as a whole. He admitted the need for the unions to meet the new social movements, broaden their vindictive guided, and promote, along with them, the counter-hegemonic versus global ultraliberalism, responsible for the misery and social injustice present.
