Syftet med studien var att undersöka om barns perspektiv och barnperspektivet, ges utrymme i förvaltningsrättens beslutsunderlag om omhändertagande enligt LVU. Vårt fokus i studien var att utforska om och hur barnets rätt att komma till tals överensstämmer med lagstiftning och tillämpning i domslut. Vår studie är empirisk med en kvalitativ diskursiv ansats och vi har använt oss av en kritisk diskursanalys. Det analyserade materialet består av tio domar från förvaltningsrätten. Resultatet visar att barns rätt att komma till tals i förvaltningsrätten följer rådande lagstiftning. Lagarna lämnar dock ett stort tolkningsutrymme för den vuxne, vars uppgift är att skydda barnet. Resultatet visar även att barnets ålder påverkar hur barnperspektivet och barnets perspektiv tillgodoses. I vilken utsträckning barnet är i fokus beror på om barnet omhändertas på grund av hemmiljön eller sitt eget beteende (2 eller 3 § LVU). / The aim of the study was to investigate if the child’s perspective and the childrens perspectives were given capacity in the Swedish administrative courts decision support about judging youths to compulsory care (LVU). The focus of the study was to discover how the children’s right to be heard is according with legislation and application in the judicial decision. The study is empirical with a qualitative discursive approach and we have used a critical discourse analysis. The analyzed material consists of ten verdicts from the administrative court. The result shows that children´s right to be heard in the administrative court corresponds with legislation. The legislation leave a big discretion for the adult, whose purpose is to protect the child. The result also shows that the age of the child affects how the child´s perspective and the childrens perspectives are being met. The focus of the child depends on if the child is judged to compulsory care because of the home environment or its own behavior (2 or 3 § LVU).
