La presente tesis doctoral, que lleva por título La ambientalización del Derecho internacional humanitario, tiene como objeto analizar la protección que recibe el medio ambiente en tiempo de conflicto armado conforme al ordenamiento jurídico internacional actual. Dadas las limitaciones existentes, se propone la ambientalización del Derecho internacional humanitario, entendida como la incorporación de normas, principios, estándares y/o mecanismos propios del Derecho internacional del medio ambiente en las normas del Derecho internacional humanitario. La idea principal de esta investigación es que el Derecho internacional público ha evolucionado hacia una estructura esencialmente comunitaria, transformando al ordenamiento jurídico internacional en un sistema normativo complejo en el que los diferentes regímenes internacionales se han de integrar y relacionar de manera coherente y armónica. Es responsabilidad de los diferentes operadores jurídicos promover y garantizar el principio de armonización que debe imperar en el Derecho internacional público contemporáneo utilizando para ello todas las herramientas y técnicas disponibles en este sistema normativo. / This thesis, entitled The greening of International humanitarian law, aims to analyze the protection it receives the environment in times of armed conflict under the international legal system. Given the existing constraints, the proposed the greening of International humanitarian law, understood as the incorporation of norms, principles, standards and/or mechanisms of the International environmental law in the rules of International humanitarian law. The main idea of this research is that Public international law has evolved into an essentially community structure, transforming the international legal order in a complex regulatory system in which the different international regimes have to integrate and relate coherently and harmoniously. It is the responsibility of the different legal operators to promote and ensure the harmonization principle that should prevail in contemporary Public international law using all the tools and techniques available in this regulatory system.

Los derechos de las personas con discapacidad en el marco jurídico internacional y europeo

Según estimaciones de Naciones Unidas, más de 650 millones de personas en el mundo tienen algún tipo de discapacidad. Pero más que un grupo "hipotéticamente vulnerable", las personas con discapacidad constituyen un grupo "sistemáticamente vulnerado" en sus derechos humanos, quedando en muchas ocasiones excluidas de sociedades que ni aceptan ni valoran su diferencia. Ante esta situación, el Derecho, y en particular el Derecho internacional, a través del reconocimiento y la protección de verdaderos derechos subjetivos, se ha convertido en instrumento necesario para superar los obstáculos que habitualmente encuentran estas personas. Es evidente que, como seres humanos, las personas con discapacidad son titulares de los mismos derechos que cualquier otra persona. Sin embargo, sus especiales necesidades o sus particularidades en el ejercicio de estos derechos han motivado que la regulación jurídica de los mismos haya estado vinculada a un tratamiento específico. Esta tesis doctoral tiene por objeto el análisis jurídico de los derechos humanos reconocidos a las personas con discapacidad en la normativa internacional. Del mismo, además de constatar el tránsito hacia el modelo social de la discapacidad, se aprecia la existencia de unos derechos con un contenido específico por razón de discapacidad, que amplían el contenido clásico de diversos derechos humanos.

Moving from the margins : migration decisions amidst climate-and environment-related hazards in Bangladesh

Bangladesh is a country at the heart of debates about climate change and migration. This thesis probes to what extent climate- and environment-related hazards influence decisions of villagers in Bangladesh to stay or move out of their place. It considers their experiences of hazards such as cyclones, droughts and floods as proxies of what might happen in the future as a result of changing climate; and probes how they respond when their livelihoods are affected by these stresses and shocks. The qualitative analysis in this thesis shows that villagers from three hazard-prone districts of Bangladesh –Nawabganj, Munshiganj and Satkhira – often migrate for better livelihoods. However, they usually do not associate their movement to the hazards. At the same time, the quantitative analysis shows that experiences of drought and cyclone positively influence migration outside the district. Though riverbank erosion and flood negatively influence longdistance migration, people affected by erosion tend to move locally. Logit models suggest that though migration is largely driven by poverty and income needs, the poorest, especially those without any assets, are often unable to migrate outside the district. Meanwhile social networks and education contribute to migration. Whether people state it or not, migration can be a strategy that helps them offset losses and prepare better for future stresses and shocks. However, whether such migration leads to adaptation to climate change depends on the policy environment in the country. A textual analysis of policy documents, however, shows that though urban migration is inevitable for Bangladesh's economic growth, its role as a climate change adaptation strategy is often not acknowledged. The thesis argues that policies need to be more proactive so that migration does not become maladaptive or people unable to move out are trapped in places exposed to climate- and environment-related hazards.
