The thesis is not just applied to participating development agencies in the Czech Republic or abroad, specific programmes and different ways of selection procedures which are published by the European Commission. Contribution of this thesis is a summary of various recommendations for new tenderers and gives us an unpublished look on statistical data regarding to the success of Czech companies in these procedures between years 2002 and 2008.

The goal of this thesis is to emphasize a significance of the community programme Grundtvig, which support a new European strategy and to point out another option of adults' professional development. This thesis is particularly addressed to a lifelong learning progress in last years and described particular education activities within the frame of Lifelong Learning Programme 2007 - 2013. The main part is focused on the key issues in adult learning. Particularly is focused on current adult education situation in Europe, European Union strategic documents and on success implementation of the lifelong learning concept within particular national politics. At the end are also discussed European structural funds, which represent other possibility of European Union support in terms of adult education. C’est avec le lancement de la Coopération Politique Européenne (CPE) en 1969/70 que les six États membres de la Communaute européenne (CE) ont tourné une page dans l’histoire de l’intégration européenne. À partir de cette date les membres de la CE se sont consultés sur des questions de politique étrangère afin d’harmoniser leurs vues et d’élaborer des positions communes. Dès le début la France avait le plus grand intérêt à mettre le Proche-Orient sur l’agenda des Six. Comme les deux chocs pétroliers de 1973/74 et de 1979 risquaient de peser lourd sur les relations euro-arabes, les autres États membres de la Communauté ont consenti en principe à développer une position commune envers le Proche-Orient. Ainsi une politique proche-orientale des Six, et àpartir de 1973 des Neuf, s’est institutionnalisée au cours des années 1970 qui était basée d’une part sur des déclarations communes sur la situation au Proche-Orient et d’autre part sur une coopération économique interrégionale plus étroite, notamment dans le cadre du dialogue euro-arabe. Sous la présidence de Georges Pompidou tout comme sous la présidence de Valéry Giscard d’Estaing la France a été le moteur dans le développement des relations euro-arabes des années 1970. Même si l’action française qui visait à faire adopter sa propre politique proche-orientale par ses partenaires européens n’était pas toujours couronnée de succès la déclaration commune du 6 novembre 1973 et surtout la déclaration commune de Venise du 13 juin 1980reflètent nettement position pro-palestinienne de la France. / By launching European Political Cooperation (EPC) in 1969/70 the six member states of the European Community (EC) openend a new chapter in the history of European Integration. Henceforward the six member states consulted each other in foreign policy issues in order to develop commun positions where possible. From the beginning France showed the greatest interest in putting the Middle East on the European agenda. As the two oil price shocks of 1973/74 and 1979 put a strain on the euro-arab relations the other member states of the EC supported the French request to develop a commun European Near-Eastern policy. Consequently, the 1970ies were marked by a process of institutionalisation of commun policy towards that region that was, on theone side, based on common European declarations, and, on the other side, on a more intense euro-arab cooperation in the field of economics, and this especially within the framework of the euro-arab dialogue. Both under the presidency of Georges Pompidou and under the presidency of Valéry Giscard d’Estaing France can be described as motor of the development and the extension of euro-arab relations. Even if the French diplomacy that tried to make her Near-Eastern policy a common European policy has not always been crowned with succes the common Brussels declaration of November 1973 and especially the common Venicedeclaration of June 1980 reflect clearly the pro-Palestinian stance of France.

Das nationale Recht wird mehr und mehr durch EG-Recht beeinflussst. In diesem Zusammenhang ergeben sich bei denjenigen EG-Rechtsakten, die anders als EG-Verordnungen nicht unmittelbar in den Mitgliedstaaten gelten, sondern von diesen in nationales Recht umgesetzt werden müssen, vielfältige Probleme. Diese Probleme behandelt der Verfasser aus der Sicht des Anwalts in einer Weise, dass diejenigen, die sich in der Praxis mit derartigen Umsetzungsfragen zu beschäftigen haben, wertvolle Hinweise für eine konkret zu lösende Umsetzungsproblematik erhalten. Komparácia právnych úprav peňažitých nárokov z porušenia práv k duševnému vlastníctvu / The comparison of legal provisions setting down monetary remedies in intellectual property infringement cases

The thesis deals with monetary remedies in intellectual property infringement suits, focusing on industrial property rights. On the background of enacting of the czech Act number 221/2006 Sb. which implements the directive 2004/48/EC of the European parliament and of the Council, the thesis compares these two texts with each other and also with the proposal for the directive KOM(2003) 46 final in their relevant parts. By doing this, it evaluates the directive and the czech act as the directive's implementation. This evaluation represents the secondary aims of the thesis. Comparison, analysis of factual articles and interviews with relevant experts practicising in the area show that by setting the damages as double the "customary" royalties, the czech Act in his § 5 ods. 2 represents a sanction, which confirms the hypothesis of the prevailance of an analogy between the czech provison and the punitive damages in american law. This fact creates scope for the hypothesis of existance of further analogies, the verification of which is the central aim of the thesis. Therefore, the second part of the thesis analyzes american provisions of the United States Code concerning copyright, trademark and patent law, and related caselaw. This is compared both to the directive and the proposal for it, moreover to the czech copyright Act number 121/2000 Sb. and in particular to the czech Act number 221/2006 Sb. The third part supplements the analysis of relevant czech court decisions. The second and third part identify similar and distinct elements of the provisions and reveal analogies in seemingly different institutes. Differences are spotted in the construct used to achieve the punitive function, furthermore between the terms "customary royalty" and "reasonable royalty" and also between the terms "bezdôvodné obohatenie", "infringer's profits" and "unjust enrichment". Conversely, an analogy is identified between the discretionary power of american courts to increase proven damages or determine statutory damages and the czech institute of "primerané zadosťučinenie" (appropriate satisfaction). The prevailance of prohibition of double recovery is another existing analogy between the american and czech law.

歐美葡萄酒貿易協定於2006年3月10日經歐美雙方簽署後,對於延宕多年之數項關於雙方葡萄酒貿易上之爭議,達成了一定程度之妥協。然雙方所妥協之內容均與WTO協定之規範有衝突之處;然從另一方面觀之,該協定卻有助於美國在其葡萄酒產品使用歐盟地理標示之爭議上,朝向與TRIPS協定較為合致之方向去修正。 歐美葡萄酒貿易協定最主要之爭議可分為兩大部分,一為歐盟關於葡萄酒釀造製程上之規範;另一是美國葡萄酒產品使用歐盟地理標示,本文主要將針對此二議題與WTO協定間之合致性進行探討,以了解該協定所妥協之部分與WTO協定間之合致性。由於歐盟與美國係為WTO內最具影響力之兩大會員,本文最後將探討該協定對於WTO多邊架構以及爭端解決機制上之所衝擊與影響。 / The EU-US agreement on trade in wine was signed on March 10, 2006, marking the end of a first phase in wine trading discussions began in 1983. The Agreement addresses several key issues, such as oenological practices, import certification, the use of European geographical indication on the wine label which produced in US and other labeling issues. This thesis is to analyze the most controversial parts of this agreement. This agreement compromises 17 provisions, there are two parts most controversial: one is the mutual acceptance of the EU-US oenological practice regulations, which would facilitate the trading of wine between the two parties. And the other is that finally U.S. agreed to prohibit new brands from using these names on non-European wine and grandfather those existing uses. The oenological regulation of EU is more strictly and conservative compare to the related international standard. Moreover, EU ban the import of wine which is not conform with its oenological regulation unless the exporting country meet the Derogation requirement to allow the wine to be imported and circulated in the territory of EU. This article is to analyses the consistency of the EU oenological regulation with the TBT agreement, and the MFN treatment with this derogation. And the U.S. had allowed the use of specific EU geographical indications, which is called semi-generic names in U.S. regulation, on the wine label for the wine producing in the U.S in its labeling regulation. According to the TRIPS Agreement, the use of EU’s GI is in a continuous matter before 1994 can be excepted from the regulation of additional for GI. This thesis would like to clarify which part of the use of those semi-generic names may or may not except from the context of TRIPS agreement about GI. Since the wine agreement settle down several issues which violate the WTO agreement, this thesis would like to discuss the impact of the wine agreement to the WTO multilateral system.

Le prolongement du processus de communautarisation va certes avoir des conséquences sur le plan extérieur de l'Union européenne. La reconnaissance des décisions tierces par le juge français sera désormais influencée par l’application des principes et valeurs européens. La présente étude mettra l'accent sur le sort des conditions exigées, en France, pour les décisions tierces. Le rôle du juge d'exéquatur sera déterminant pour illustrer la transition de la pratique juridictionnelle. En effet, c'est le pouvoir de celui-ci qui va déterminer le sort de cette pratique envers les décisions émanant des États tiers. Outre les conventions élaborées dans le cadre européen, la convention de Bruxelles du 27 septembre de 1968 et le règlement européen n° 44/2001, ainsi que le règlement Bruxelles II, Bruxelles II bis et les accords de partenariat, ne seront pas à l'abri de notre recherche. Autrement dit, nous voulons mesurer le développement du droit international privé européen, notamment en termes d'entraide judiciaire, sur le plan extérieur. Le but est de donner au droit européen une dimension universelle. / The extension process of communitarisation will certainly have implications outside the European Union. Recognition of third decisions by the French judge will now be influenced by the application of European principles and values. This study will focus on the fate of the conditions required in France for the third decisions. The role of the judge will determine exequatur to illustrate the transition from legal practice. Indeed, it is the power of it will determine the fate of this practice to decisions from other States. In addition to the conventions developed in the European context, the Brussels Convention of 27 September 1968 and this Regulation No. 44/2001 (also Brussels II and Brussels II bis) and the partnership agreements, will not be immune to our research. In other words, we want to measure the development of European private international law, particularly in terms of mutual legal assistance on the outside. The goal is to give the European international private law a universal dimension.

The aim of this work is to analyze the success of European monetary integration and it's contribution to countries, who's economics are, no matter if for the long lasting difficulties or recent transformation, likely to be called hazardous. In the first part, the work concerns itself with the very conception of the idea of European monetary integration and it's development, over the final form of the project, it's accomplishment up till current problem and challenges. The second part is an analysis of chosen countries who belong in the category named above. With this countries I will try to analyze the effect that joining the monetary union had on their economy. In the end I'll summarize the acquired knowledge to evaluate the effect of the common currency on the chosen group of countries.
