Was Feist a catalyst for the structure of database directive? : a legal exploration of the implications of the Feist decision

This thesis studies the influence of US Supreme Court judgement in Feist Publications Inc. v. Rural Telephone Service Co on Directive 96/9/EC. It primarily looks at the implications of Feist decision, and the influence that it had on European legislation. The decision in Feist Publications led the Commission to believe two things: Feist created a new-line of jurisprudence in US in the context of copyright protection of factual databases, and the decision will be detrimental for future production of electronic databases. This thesis shows that the Feist decision was a clarification of existing copyright law. As an example, the thesis observes that the US database market did not react to any apprehended negative impact of Feist. In the US, where there was no specific Database Right, Feist has had negligible practical and doctrinal impact. The Feist decision also left an indelible mark on the overall structure of the Database Directive. While Article 3 represented the positive impact, Article 7 was surrounded by uncertainties and ambiguities. This Article represents the outcome of apprehending negative impact of Feist. This has resulted in an imbalance which must be rectified and only a limited amount of protection should be offered to producers in absence of evidence.

O presente trabalho, cujo objetivo principal é interpretar sociologicamente a atuação de produtores da chamada ciência social uspiana, investiga aspectos da trajetória intelectual de algumas professoras do Curso de Ciências Sociais da Faculdade de Filosofia, Ciências e Letras, da Universidade de São Paulo, examinando disputas simbólicas típicas de grupos intelectuais e voltadas para a conquista da afirmação acadêmica nas Cátedras do Curso. Tais disputas seriam inerentes à busca de afirmação, poder e legitimação, por parte dos cientistas sociais em geral, e corresponderiam a clivagens que são analisadas a partir das origens sociais dessas professoras e das relações de sociabilidade em que elas se enredavam. O autor mostra que tais origens e relações teriam interferido na carreira delas (posições, cargos, títulos conquistados e obras produzidas). Ele usa como referenciais teóricos, principalmente, obras de Pierre Bourdieu e de Norbert Elias, e se vale de textos biográficos, autobiográficos, depoimentos, entrevistas, memoriais e cartas. O trabalho se insere no âmbito dos estudos da sociologia da cultura, mais especificamente na chamada história intelectual ou sociologia da vida intelectual. / This paper, whose principal objective are make a sociological interpretation about the actuation of productors of Social Sciences from USP, research aspects of the intellectual trajectories of female professors from the Socials Science course of Faculdade de Filosofia, Ciências e Letras, of the Universidade de São Paulo, inquire symbolic arguments typical of intellectual groups and with the intention obtaining academic affirmation in the Cathedras of this Course. In addition, such arguments matches would be inherent in the search of affirmations, power and legitimation, by social scientists in general, and they would correspond to cleavages that are analyzed starting from the social origins of these female professors and from the sociability relationship in which they are entangled. The author shows which these origins and relationships would have been interferenced in their careers (positions, achieved titles and produced works). He uses like theoretical references, mainly, works of Pierre Bourdieu and Norbert Elias, and to have recourse of biographical and autobiographical texts, testimonies, interviews, memorials and letters. The paper is inserting in the environment of studies of sociology of culture, more specifically in the called intellectual history or intellectual life sociology.

This thesis looks into the development of Songjiang School in the context of mutual interaction and networking among painters. It focuses on two phenomena. Firstly, it studies the interaction between Songjiang School painters and artists from various Jiangnan art centres. Secondly, it explores the artistic genealogy within the Songjiang School. It investigates the activities of individual Songjian School painters in particular, and the rise and decline of the entire Songjiang School in general. / Under the famous master literati Dong Qichang, Songjiang School painters broke new path in landscape painting, valuing moist ink tones at the expense of brush and ink. But even before Dong, Gu Zhenyi and Mo Shilong were already well known for their efforts in exploring new styles. Supported by brilliant art talent such as Chen Jiru, Zhao Zuo and Shen Shicong, Dong Qichang brought the Songjiang School to its zenith. However, it was also Dong Qichang who dug the grave for the School. As Dong's followers were mostly professional painters, they could not stand as equals to Literati connoisseurs. Some became Dong Qichang's ghost-painters at the expense of their artistic individuality, whereas others were trapped in the lower end of the art market. Consequently, the Songjiang School lost its vigor and prestige in the Qing dynasty. Only Dong Qichang, the leading master of the School, could dominate the literati painting scene. / With its economy revived after the suppression of the wako invasion in late Jiajing period (1522-1566), Songjiang quickly reassumed its dominant position in the art scene. Songjiang School painters became very self-conscious and proud of their own hometown. They succeeded in networking with connoisseurs in Zhejiang and Huizhou, and learning valuable lessons from the works of their Suzhou counterparts. Consequently, although both the Wu (Suzhou) and Songjiang Schools were descendents of the same literati painting tradition, the Songjiang School loomed large throughout the sixteenth and seventeenth centuries. The "third way" : Russia's religious philosophers in the West, 1917-1996

In 1922, the Bolshevik government expelled some 160 prominent intellectuals from Russia. Numbered among these were many of the leaders of the Religious Renaissance which had flourished since the turn of the century. They advocated a "third way": neither for the Tsarist regime nor the Bolsheviks; neither for Capitalism nor Communism; neither for Materialism nor Idealism; rather, they promoted personalist, spiritual development (Godmanhood ), Christian economic ethics (Sobornost'), and a path to knowledge informed by reason, but guided by faith (Religious-Philosophy ). Forced to join the Russian diaspora, these religious philosophers continued to advance their movement with the help of the Young Men's Christian Association. Largely at the initiative of Nikolai Berdyaev (1874--1948), they also began to interact with the French intellectual milieu in Paris in order to develop inter-confessional and cultural understandings. Although Russian religious-philosophy suffered a certain decline following World War Two, many of their writings had returned to the USSR. As Soviet intellectuals discovered these works, they gradually began to revolt against dialectical materialism, and aspire to recover the religious-philosophical tradition. In 1988, this Return was at last made possible, and religious-philosophy has been enjoying a second renaissance which continues unabated today.

Para tal, foram aplicados questionários aos recepcionistas e entrevistas aos gerentes do setor. Inicialmente são apresentadas as inter-relações do capital intelectual, humano, estrutural e do cliente. Através da análise dos dados levantados e apresentados nas tabelas pode-se concluir que na unidade estudada a gestão do capital intelectual ainda não é devidamente explorada. Este fato deve-se ao crescimento deste setor no momento atual da cidade do Rio de Janeiro. / The globalization process and the increasing access to information have created a highly competitive environment. Facing this new scenario, organizations were driven to seek new advantages for their products, services and business models. In this context, this paper aims to demonstrate the current status on the implementation of the intellectual capital management concept at the reception of a chain hotel unit in the Rio de Janeiro city. To this task, application forms have been applied to the receptionists and managers interviewed. Initially the interrelationships between intellectual, human, structural and customer capital are presented. By analyzing the collected data presented in tables, one can concluded that the intellectual capital management is not properly explored yet in the studied hotel unit. This fact is due to the growth of this sector at the present time the city.

Strategic management of intellectual property in the field of vehicle autonomy and connectivity : A case study in the truck manufacturing field

The truck manufacturing field is expected to go through a disruptive change in the coming decade(s) due to a predicted implementation of autonomous (self-driving) heavy-duty vehicles. Here, companies face a challenge in that autonomous vehicles (AV) will include technologies and competences from multiple industries. This will most likely have an impact on how companies manage their intellectual property (IP) to protect their inventions if they wish to keep up with the changing market. To do this in the most optimal way, it is argued that a company’s IP-strategy needs to be incorporated into their business strategy. At the same time, studies show that companies are experiencing difficulties in extracting the full potential of their IP-management. Hence, this master thesis aims at investigating how a truck manufacturing company can adapt their IP-management policy in line with future developments within these emerging technologies and how their IP-strategy can become intertwined with their business strategy. Next to a literature review of these fields, the thesis conducts a qualitative case study of a truck manufacturer that intends to be part of this change based on 11 semi-structured interviews. From the empirical results, the company’s decision-making process regarding IP is identified, whereby this thesis suggests four points of improvement that could make their IP-management policy more effective. Further, this study presents three actions that can be taken in a company to incorporate their IP-strategy with their overall business strategy. The study ends with giving suggestions for future research and presenting six managerial implications that would come by implementing the suggestions made in this thesis.

Towards an explanatory model for challenging behaviour in person with intellectual disabilities in the Capricorn District, Limpopo Province

Thesis (Ph.D. (Psychology)) -- University of Limpopo, 2021 / Persons living with intellectual disabilities (ID) at times display behaviours that are a challenge for healthcare professionals, parents and teachers. These challenging behaviours are often presented in health-care, educational, or social care services by individuals with intellectual disabilities. However, what could be explained as challenging may be understood differently through cultures, beliefs or surroundings. The aim of the study was to conceptualise and develop an explanatory model for challenging behaviour in persons with intellectual disabilities. The study comprised twenty (23) participants who were parents and teachers of persons with intellectual disability. The target population of the study live in Ga-Dikgale and Ga-Molepo villages that are located in the Capricorn District, Limpopo Province. These villages were chosen because they have special schools for children with ID. A semi-structured, in-depth, one-on-one interview was used to collect data. The data was analysed using thematic content analysis (TCA). Three superordinate themes emerged that covered the understanding of challenging behaviour from the participants. These themes were: (a) knowledge about challenging behaviour; (b) beliefs about causal explanations of challenging behaviour; and, (c) coping with challenging behaviour. The results revealed that participants held varied beliefs regarding causal explanations of challenging behaviour. Cultural background of the participant seemed to play a critical role in shaping these beliefs. Additionally, three modes of coping were used by the participants in the study to cope with challenging behaviour. These are: cultural/traditional coping; religious coping; and, family and professional support methods. A Bio-Psycho-Socio-Cultural Model (BPS-C) was subsequently developed to explain challenging behaviour of persons with intellectual disability. This model integrates components of the Bio-Psycho-Social model (biological characteristics, behavioural factors, and social condition such as social support and family relationships) and cultural aspects to conceptualise challenging behaviour as understood and explained by parents and teachers of persons with intellectual disability. / NIHSS and SAHUDA
