[pt] Esta dissertação tem como objeto a análise da pragmática da conversação
aplicada ao Direito, especialmente a decorrente da teoria griceana. Segundo Paul
Grice, a compreensão num discurso comum decorre do princípio cooperativo,
segundo o qual falante e ouvinte buscam eficiência na comunicação e, por isso,
atendem a certas regras de conduta, denominadas máximas conversacionais.
Vendo a atividade jurídica como um diálogo num contexto específico, que é o
contexto legal, e considerando o legislador como falante e o Judiciário e a
sociedade como ouvintes entende-se que a aplicação da Teoria da Conversação
Griceana, com as ressalvas decorrentes das diferenças entre o discurso normal e o
discurso jurídico, é instrumento eficiente na busca de racionalidade na
interpretação, através de métodos pragmáticos, especialmente, na medida em que
se reconhece a insuficiência dos métodos de interpretação legal. Num debate entre
correntes denominadas textualista e intencionalista evidenciam-se a
dificuldade de mensurar o papel do texto, da intenção do legislador e da
compreensão do aplicador da norma para, diante da obrigatoriedade da atividade
interpretativa, explicitar métodos objetivos que evitem abusos e imprimam
racionalidade e controlabilidade à interpretação. De tudo, tem-se que com a
interpretação pragmática e a correta utilização do significado do falante para fins
de compreensão do melhor sentido da norma, cada geração poderá dar sua própria
resposta ao problema fundamental da interpretação jurídica de acordo com suas
necessidades e valores, sem, no entanto, se afastar de um padrão de racionalidade
que garanta ao sistema normativo estabilidade pautada em segurança jurídica e
inovação pautada em objetividade. / [en] This dissertation aims to analyze the pragmatic of law-applied
conversation, especially the one derived from the Gricean theory. Paul Grice has
stated that comprehension in ordinary discourse results from the cooperative
principle, according to which speaker and listener seek communication efficiency,
and, therefore, follow certain behavior rules called conversational maxims. If
the juridical activity is seen as a context-specific dialogue happening within the
legal context, and if the legislator is the speaker and the judiciary and society are
the listeners, then the application of the Gricean Conversation Theory, with the
proviso due to the differences between ordinary and juridical discourses, is an
efficient tool to seek the rationality of interpretation, through pragmatic methods,
especially when the insufficiency of the methods of legal interpretation is taken
into account. In a debate between the textualist and intentionalist currents, it
is made clear the difficulty to measure the role of the text, the legislator`s
intention, and the comprehension of the norm enforcer to, faced with the
compulsoriness of the interpretative activity, explicate objective methods that
avoid abuse and provide rationality and controllability to interpretation. With
pragmatic interpretation and correct use of the speaker`s meaning to comprehend
the best sense of the norm, each generation will be able to respond to the
fundamental issue of juridical interpretation according to its own needs and
values, although not ignoring a rationality pattern that provides the normative
system with stability, grounded on juridical safety, and innovation, grounded on
objectivity.

[pt] O presente trabalho tem por objetivo apresentar uma discussão sobre a
indeterminação do Direito. Para tanto, serão analisados os preceitos do realismo
jurídico e os pensamentos de Herbert L. A. Hart. O pensamento de Holmes e a
sociologia jurídica de Pound abriram caminho para o realismo jurídico norteamericano
e serviram de fundamento para autores considerados realistas, como
Jerome Frank e Llewellyn, entre outros. Um dos fortes argumentos do realismo
jurídico se encontra no fato de os juízes primeiro decidirem e posteriormente
buscarem, na norma, o fundamento de suas decisões, chegando ao extremo, como
defendido por Jerome Frank, de colocar um alto grau de pessoalidade nas
decisões, expressa pela famosa frase, que o julgamento depende daquilo que os
juízes comerem no café da manhã. Hart, da mesma forma que o realismo, também
defende a indeterminação do direito, no entanto, a defende com base na textura
aberta da linguagem. Esta discussão busca apresentar dois posicionamentos
coincidentes no que se refere à indeterminação, mas divergentes quanto às causas
originárias. / [en] This thesis aims to discuss the indeterminacy of law through the lenses of
the legal realism movement and the thoughts of H. L. A. Hart. The insights and
works of Holmes and Pound opened the way for American legal realism and were
used as building blocks for the work of legal realists such as Jerome Frank and
Karl Llwellyn, among others. One of the best known points of legal realism is that
judges first arrive at their decision through non-legal means and then seek, in the
legal material, the basis for justifying their decisions. According to the legal
realists the legal material can justify just about any decision arrived at through
non-legal means. Jerome Frank placed a high degree of subjectivism in the legal
decisions, going as far as explaining how judges decide based on what they had
for breakfast. Hart, as the legal realists, also defends the indeterminacy of law.
However, according to him law’s indeterminacy is due to the open texture of
language. The present work will investigate the position of the realists and H.L.
A. Hart about the indeterminacy of law. Even though they converge on the
indeterminacy thesis, they disagree about its root causes.

[pt] A presente dissertação busca observar o discurso da
Magistratura
Fluminense nos conflitos agrários envolvendo o Movimento
dos Trabalhadores
Rurais Sem Terra - MST. A análise do discurso foi feita a
partir de fragmentos de
decisões judiciais em processos de reintegração de posse
em face do MST, no
período de reestruturação do movimento no Estado, que data
da segunda metade
da década de 1990. É nossa hipótese que o discurso
jurídico hegemônico
caracteriza-se como conservador, assegurando o direito de
propriedade e
criminalizando as ocupações de terra realizadas pelo MST.
Em nosso estudo
empregaremos as noções das teorias descritivas sobre a
interpretação judicial que
destacaram o conteúdo político, valorativo e ideológico da
atividade jurisdicional.
Neste sentido, serão analisadas as tese desenvolvidas por
Hans Kelsen, Herbert
Hart e Alf Ross, que observam a indeterminação do texto
normativo e o papel
criativo desempenhado pelos juízes. Casando-se as noções
dos marxistas Antonio
Gramisci, Nicos Poulantzas e, do filósofo Pierre Bourdieu
sobre a formação
ideológica e a disputa de hegemonia presente na sociedade,
responsáveis pela
postura assumida pelos magistrados em suas decisões. Desta
forma, pretendemos
verificar o discurso adotado hegemonicamente pela
magistratura fluminense sobre
os conflitos agrários e suas possíveis rupturas.
Buscaremos, assim, contribuir com
as reflexões sobre o Campo Jurídico e seu papel na luta
pela democratização do
acesso à terra no Brasil. / [en] The present dissertation observe the discourse of the
fluminense
magistracy in the conflicts of the agriculture areas,
involving the Rural Workers
Without Land Movement - Movimento dos Trabalhadores
Rurais Sem Terra
[MST]. The analysis of the discourse was realized using
the fragments of the
judicial decisions against MST, in the period of the
movement restriction in the
state - second half of the 1990 decade. The hypothesis of
the work is that the
hegemonic juridical discourse is characterized as
conservative. This guarantees
the property right and criminalize the land occupations
made by MST. In our
work, we used the descriptive theories about the judicial
interpretation that detach
the politic and valuable contents - therefore ideological -
from the jurisdictional
activities. In this direction, we will analyze the thesis
developed by: Hans Kelsen,
Herbert Hart and Alf Ross. They point out the
indetermination of the normative
text and the creative role played by the judges,
connecting the Marxist ideas of
Antonio Gramsci, Nicos Poulantzas with the notions of
ideological formation and
dispute for hegemony - as we can see in our society - from
the philosopher Pierre
Bourdieu. And so, we searched the hegemonic discourse
adopted by the
fluminense magistracy about the rural conflicts and the
possibilities of ruptures.
Thus, we contributed toward the discussions about the
juridical thought and his
role in the struggle for the democratization of the land
access at Brazil.
