Prorogační a rozhodčí doložky v mezinárodním obchodě / Prorogation and arbitration clauses in international trade

The thesis is dealing with prorogation and arbitration clauses in international trade, focusing on Regulation (EU) No 1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (Brussels I bis) and on the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. In particular, the thesis aims to describe the procedure of valid negotiation and the formation of clauses, including the analysis of possible interpretation issues. The common objective of the prorogation clauses as a choice of court agreements and arbitration clauses, is to determine who and where should have the jurisdiction to resolve any dispute arising between the parties and to reinforce their legal certainty. The outcome of the work is therefore to verify the hypothesis that the conclusion of such clauses really strengthens the legal certainty of the parties. Even though the crisis appears to be over, the new official authorities of Ukraine and the self- proclaimedDonetsk and Lugansk people's republics are still conflicting.It has commonly been assumed that the armed conflict in Donbas was the result of a latent Russian military aggression against Ukraine and that forces opposing the Ukrainian government do not represent the local populationrather being sponsored by the Russian authority.However, external incentives arguably could not lead to the emergence of a viable and widespread rebel movement unless there were internal predispositions to the emergence of armed separatism. It is vital to address problems within the country to identify domestic preconditions for invasion and conflict incitement. This thesis focuses on errors and difficulties that students face when solving problems with algebraic expressions in mathematics at secondary school. Its aim was to describe the factors that affect pupils' achievement while dealing with algebraic expressions, classify them on the basis of a classification of pupils' errors used in mathematics and identify the biggest pupils' difficulties. The thesis consists of theoretical and experimental parts. The theoretical part focuses on the factors that influence the success of pupils in their learning process. I present their summary based on information gained from literature and I complete them with my own teaching experience of mathematics at secondary school. Next I deal with the concept of error, error classification and one of the most important phases of learning process, which is a description of teacher's work with pupil's error (again on the basis of information gained from the literature). The theoretical part ends with definitions of basic concepts from specialized literature on algebraic expressions at the end of the theoretical part. The theme of this thesis is the assessment of the prerequisites for the pluralism of law and non-state justice systems to improve the possibilities of solving disputes in society. The main research question is whether non-state justice systems fulfil a social role in providing justice. The thesis should offer a descriptive analysis of the concept of legal pluralism and methodological procedures for the inclusion of non-state justice systems in the state. The outcome of the work should be an overview of the possibilities of interaction between different legal systems, whether formal or customary, of the different ways of resolving disputes in this environment, and of the contribution of such proposals to the reform of the legal environment that count on the real situation in society. The thesis of procedural pluralism and participatory methods of solving disputes that have a user, a citizen in the center of these systems is offered as a starting point for new designs. The final part of the work will therefore explore current approaches to improving legal systems that aim to increase participation of user based on their needs, and will include some cases for comparing individual programs to improve legal systems.

Master thesis deals with a computing simulation of two props turbines lines. The thesis output is gaining maximum possible load, at which a commencement of deformation stability critical state for various geometrical imperfections has not arisen yet. The calculation has been done by FEM in two different ways: linear solution (using a calculation conversion into eigenbuckling) and nonlinear solution (using a FEM deformation option). Result analysis compares both methods outcomes. Safety factor for the props operation has been proposed taking into consideration known influences on operating state.

To create this work was done study of theoretical perspectives on alternative dispute resolution of consumer disputes and consumer protection. It was implemented the managed-depth interviews, the analysis of secondary data and the case study. The conclusion was to evaluate all of the data and defined a proposal to improve cross-court resolution of consumer disputes.

Prostoročasy se zrychlenými zdroji / Spacetimes with accelerating sources

The core of this thesis is the analysis of accelerating black hole solution with the NUT parameter, which was found by Chng, Mann and Stelea in 2006, and related spacetimes. The original work consists of three interconnected parts. In the first chapter we study the Taub-NUT solution, in particular the nature of its pathological axes, and we include a number of visualizations. In the second chapter we investigate the accelerating Taub-NUT solution, we present it in a new form, and we discuss its "deviation" from the Pleba'nski-Demia'nski class of solutions. To see the differences more clearly, in the final chapter we put also the Pleba'nski-Demia'nski metric into a completely new factorized form. The work is concluded by discussion of special subcases, from which it is clearly seen that the Pleba'nski-Demia'nski class does not contain the accelerating Taub-NUT solution.

The purpose of the thesis was project a field road to reconstruct and modernize the current traffic connections between selected villages Sviny and Borkovice, using technology for application of Glorit. It was created reinforced major field road with turnouts the design category of P 4,5/30. Studies of the field communication were prepared in two different variants. The beginning of routes is in the village Sviny and end is in the village Borkovice. Both variants are connected to the current road. After the consultation with the executive of the thesis, one of the variants was evolved for building licence documentation. The documentation consists of plans and manual. Emphasis was placed mainly on routes to achieve fluency with regard to appropriate and sensitive integration of the field road to the countryside. There was also an effort to minimize earthwork and associated financial intensity of construction. The project of the field route was prepared in conformity with applicable national standards (DIN) and technical regulations that relate to the issue.

This master´s thesis deals with the issue of the building from a clay. It is focused on defects and rehabilitations of these constructions. The introductory parts concerns with probable defects especially of clay buildings, furthermore with causes of the creation of defects, its depictions and the relevance. In the following part the methods of rehabilitation not only of clay buildings are presented. In this part the rehabilitative methods of foundation, vertical and wood constructions, which create mainly the structural support of the buildings, are described. In the second part, the structural and technical research of the current structure with farm part – barn is executed. The part of research is creation of the drawing documentation, description of disposition and structural and constructional solution of building, structural calculation of a part of construction, assessment of actual state of structure and prospective plan of proceeding and rehabilitation.

It is based on engineering survey according to which three possible models are designed. Capacity assesment is made on each of these models. Throug the evaluation is selected the most suitable design of turbo roundabout type "knee", which is technically processed and substantiated by text and drawing documentation.
