Networks of Power. Water, Infrastructure and Territory in the West Bank, Occupied Palestinian Territories

This thesis investigates the relationship between water resources, networks and territory under changing relations of rule in the West Bank, Occupied Palestinian Territories. It focuses on the creation of uneven patterns of water infrastructure development since Israeli occupation of the territory in 1967, and on their perpetration following the establishment of the Palestinian National Authority in 1995. This is produced by the interplay of three different imperatives of water resource development: a military-strategic and territorial one, represented by the Israeli Civil Administration, one based on national sovereignty over resources and universal water rights, represented by the Palestinian National Authority, and one based on technical efficiency of the sector, promoted by some international development institutions. The relative strength of these three actors in relation to each other, which in turn is influenced by the political history of the region, determines the physical outcome of water resource development.

Shi‘ite Higher Learning and the Role of the Madrasa-yi Sulṭānī in Late Safavid Iran

This dissertation explores the ways in which religious knowledge was produced and transmitted in Safavid madrasas, particularly in Isfahan, during the later Safavid period—from the reign of Shāh Abbās II (1642–66) to the end of Shāh Sulṭān Ḥusayn’s reign (1694–1722). It argues that Safavid madrasas functioned as multifaceted cultural centres that disseminated religious knowledge, preserved the Shi‘ite intellectual heritage, and played an important role in reconstructing, re-articulating, and contextualizing or contemporizing the past. Safavid madrasas, which were established thanks largely to the largesse and piety of the Safavid shahs, very often acted on behalf of the established political power. However, due to the flexible, inclusive, and personal character of Islamic pedagogy, Shi‘ite learning, like that of the wider Muslim community, could occur in a wide variety of places, from the houses of scholars to any mosque or shrine. After surveying Shi‘ite scholarship and its institutions from the early decades of Islamic history until the mid-seventeenth century, this study contextualizes the Madrasa-yi Sulṭānī, or Royal Madrasa, of late Safavid Isfahan within its political, social, and religious setting. This particular madrasa exemplifies the ways in which religious knowledge was transmitted in early modern Iran. By analyzing the deeds of endowment (waqfiyyas) of the Madrasa-yi Sulṭānī and other madrasa-mosque institutions built by Shāh Sulṭān Ḥusayn and members of the Safavid elite, this study sheds light on the organizing mechanisms and structures for such educational and charitable foundations. Based on the large number of extant ijāzas that were issued by Safavid scholars, and other primary sources, including waqfiyyas and autobiographies, this study reconstructs the curriculum of the Safavid madrasa and describes the pedagogical methods that Safavid scholars employed to transmit religious knowledge to their students. It also discusses the major problems facing Shi‘ite higher learning by examining the critiques of such scholars as Mullā Ṣadrā (d. 1635 or 1640), the Safavid philosopher, Muḥsin-i Fayḍ Kāshānī (d. 1679), a renowned traditionalist, and Muḥammad Bāqir Khurāsānī, known as Muḥaqqiq-i Sabzawārī (d. 1679), the Shaykh al-Islam of Isfahan and a prominent mujtahid. Finally it examines the life and career of Sayyid Mīr Muḥammad Bāqir Khātūnābādī (d. 1715), the first Safavid mullā-bāshī (head of religious scholars) and the first rector and professor of the Madrasa-yi Sulṭānī.

Criminal Law and the Development of the Assizes of the Crusader Kingdom of Jerusalem in the Twelfth Century

The legal treatises of the Kingdom of Jerusalem were written in the thirteenth century, when most of the kingdom had been re-conquered by the Muslims. There are no treatises from the twelfth century, when the kingdom was at its height. The thirteenth-century jurists claimed that the kingdom had always had written laws, but they may have been making this up for political purposes. The treatises also discuss issues important to the noble class of which the jurists were a part: property rights and the feudal services owed to the king, as well as the proper way to plead their cases in court. But what do they say about criminal law, and laws for the lower classes? How were crimes tried and punished in the twelfth century, and did this differ from the laws recorded in the thirteenth century? Chapter one deals with the different treatises, and their claim that there was a set of laws called “Letres dou Sepulcre” in the twelfth century. The most important of the treatises for criminal law, the assizes of the burgess court, is examined in detail. Chapter two looks at the small number of laws that survive from the twelfth century, in charters, the canons of the Council of Nablus, and the chronicle of William of Tyre. Chapter three is a study of other descriptions of crusader law in the twelfth century, including those by Christian and Muslim pilgrims, and especially the observations of Usama ibn Munqidh. These accounts are tied together by the common theme of theft and the ways that thieves could be punished. Chapter four deals with cases mentioned by thirteenth-century sources, including theft, assault, and prostitution, but especially cases that led to trials by battle. The usefulness of such trials for dating some of the laws is also examined. The conclusion demonstrates that certain parts of the assizes relating to criminal law must have already existed in the twelfth century, and offers some tentative ideas about the specific origin of the laws. Avenues for future research are also introduced.

Fallahin on Trial in Colonial Egypt: Apprehending the Peasantry through Orality, Writing, and Performance

This dissertation explores the experiences of Egyptian peasants from the Delta province of Minufiyya who were tried for murder by newly created "native" or "national" courts between 1884 and 1914. Through the study of 2,000 pages of criminal files, I deconstruct how the colonial state used the modern techniques of judicial orality, writing, and performance, both to justify a series of reforms that turned the entire legal process into a parody of justice, and to develop a grand narrative that essentialized peasants as revengeful, greedy, and passionate and ultimately linked their alleged immorality to their illiteracy. Furthermore, my work sheds light on how peasants reacted to this process of moralization of the law by promoting the "honor of the brigand" through violence and poetry. Finally, by focusing on the many petitions contained in the judicial files, my dissertation provides new insight into the development of a "vernacular" culture of the law that betrays the peasants' awareness of the highly political nature of the legal process. By presenting and analyzing an untapped wealth of Egyptian archives produced by the native courts, this research not only sheds invaluable light on the workings and hence the very nature of British colonial justice in Egypt, but also represents a significant advance in the knowledge of the origins of Egypt's current legal system. On a more theoretical level, this study also constitutes an important contribution to the reflection on the subaltern subject initiated by Rosalind O'Hanlon and Talal Asad, by showing how the peasants' agency paradoxically lies in their "disempowerment."

Iraq and the Assyrian Unimagining: Illuminating Scaled Suffering and a Hierarchy of Genocide from Simele to Anfal

The 1933 genocidal attacks on Assyrians in the Simele region defined the birth of the nascent Iraqi nation and identity. Iraq has ever been in the spotlight of ethnic and cultural strife, especially concerning Sunni-Shia animosity, and more recently in dealing with the Kurdish people and Iraqi Kurdistan. In most cases, however, the Assyrians are completely neglected from scholarship concerning Iraq and its peoples. This work reinserts the Assyrian people into the fabric of Iraq and discusses the violent and non-violent suppression of Assyrian identity and culture through genocide, cultural genocide, and ethnic cleansing. Three fundamental factors emerge from this reinsertion with respect to Iraq and genocide. First, this approach introduces an often-neglected element in Iraqi studies: the inclusion of minorities, or micro-minorities, within the existing discourse on Iraqi studies. Second, it contributes to genocide studies by examining the impact of the non-physical, or cultural, aspect of genocide. Further, it discusses the importance of the Assyrian case in Iraq for understanding Iraqi history, and serves as a case in point of scaling suffering and for understanding how and why a hierarchy of genocide exists.

British Intelligence and Turkish Arabia: Strategy, Diplomacy, and Empire, 1898-1918

This dissertation addresses early British intelligence activities and Anglo-Ottoman relations by viewing the activities of army officers and private individuals as a collective pursuit to safeguard British imperial interests. It offers a new understanding of the relationships between intelligence, grand strategy, and diplomacy before the Great War. It also examines the role that pre-1914 intelligence played in that conflict. The Boer War had shown that the geographic expanse of the British Empire was a source of strategic danger as well as a foundation of global power. The revelation of weakness propelled Britain to begin collecting intelligence on possible sources of conflict in preparation for the next war. A 1906 border incident between Egypt and Turkey marked turning points in Anglo-Ottoman relations and British intelligence efforts. Intelligence began to focus on railways that threatened Britain’s commercial position, on the disposition of Arab tribes who might revolt against Turkish authority, on the state of the Turkish army, and on the extent of European activity in Turkey. In 1914, British policy in the Middle East was unco-ordinated. Needing an effective means of combatting the Turco-German Jihad proclaimed in 1915, London created the Arab Bureau as an advisory organ based in Cairo. It became the central repository for much of the intelligence gathered before 1914. Officials in Cairo and London created new maps, compiled route reports, and assembled intelligence handbooks for distribution. Once the Arab Revolt began in 1916, intelligence helped marshal Britain’s resources effectively in pursuit of victory. Placing pre-1914 intelligence in the context of British imperial concerns extends our understanding of Anglo-Ottoman relations by considering strategic and diplomatic issues within a single frame. It demonstrates the influence of the Boer War in initiating intelligence-gathering missions in the Ottoman Empire, showing that even those undertaken before the establishment of a professional intelligence service in 1909, although lacking organization, were surprisingly modern, and ultimately successful. Analysis of under-utilized sources, such as the handbooks created by the Arab Bureau and the Royal Geographical Society, demonstrates the value of pre-war intelligence in detailed ways. It deepens understanding of the role British intelligence played in the defeat of the Ottoman Empire and shows how one nation’s intelligence, military, and diplomatic bodies operated separately and collectively in an era that presented them with unprecedented challenges and opportunities.
