Patents, pills, poverty and pandemic: the ethical issues

This thesis argues that corporations qua corporations are moral agents sui generis and hence capable of being held morally responsible. I argue that corporations qua corporations are responsible for the actual and foreseen consequences of their actions. I analyse normative theories and the different proscriptive responsibilities they place on moral agents and hence corporations. I examine Kantianism, utilitarianism and virtue ethics. I argue for a unique normative ethical theory that incorporates reasoning from all three of the normative theories. I argue for a broad range of reasons to factor into deciding whether an act is ethical or not. One of the claims of this thesis is that ethical theories must incorporate an agent’s motivation, intention and character traits as relevant to deciding on whether an action is ethical or not. My thesis argues for an indispensable role for the virtues while at the same time incorporating impartial beneficence and universal rationality from utilitarianism and Kantianism. This position I, following the literature, refer to as moderate virtue theory. Having established corporate qua corporate responsibility I question the pharmaceutical corporation’s practice of patenting life saving medication during a state of pandemic in poor countries. The moderate virtue theory position prioritises contexts and the actual human condition and criticises normative theories that attempt to give universal, abstracted answers to ethical problems. It is for this reason and the current (2003) HIV/AIDS pandemic that I focus on a particular context. I examine the practice of patenting life saving medication within South Africa and argue, applying moderate virtue theory, that this act cannot be justified. I argue that a pharmaceutical corporation that patents life saving medication in South Africa cannot justify that action and thus is morally responsible for that action. I also argue that corporations patenting HIV/AIDS medication in South Africa have unethical motivations and intentions.

O juízo como subordinação intensional e a Analítica Transcendental da Crítica da Razão Pura

Interpretações com diferentes nuances têm sido oferecidas para a concepção de juízo enunciada na Crítica da Razão Pura, mas, grosso modo, pode-se classificálas sob duas linhas gerais, a interpretação analítica e a interpretação a partir de Port-Royal. Ambas as linhas interpretativas, entretanto, se identificam na tese de que no juízo são também subordinadas representações singulares. Esta concepção, designada de interpretação extensional do juízo, leva de modo geral a uma leitura pouco caridosa da obra. A finalidade deste texto é propor e esboçar a defesa de outro modo de conceber o juízo pautado pelas seguintes teses: i) intuições e conceitos não se relacionam no ou pelo juízo; ii) a relação extensional não é suficiente para a determinação de qual conceito é superior ou inferior (gênero ou espécie) e iii) a relação que estabelece a série intensional do conceito determina a hierarquia superior/inferior e por isto é a relação de maior relevância cognitiva. Fazendo frente à concepção extensional, a proposta aqui defendida é designada de interpretação intensional e demanda que a distinção entre intuições e conceitos seja levada às últimas consequências. A potência elucidativa e a conformidade com o texto desta abordagem do juízo mostram-se pela possibilidade de compatibilização das diferentes partes da Analítica transcendental, mesmo aquelas que a literatura secundária tende a descartar ou atribuir pouco significado. Na esteira da elaboração desta compatibilização, após a apresentação e defesa da concepção intensional do juízo, o texto trata em sequência da Dedução metafísica, da Dedução transcendental, do Esquematismo e dos Princípios, procurando ressaltar a interconexão e articulação destas partes, que é calcada na mediação da relação entre os produtos do entendimento e da sensibilidade pela imaginação. Assim, apesar de partir da concepção de juízo, o objetivo do texto é buscar uma leitura da obra magna de Kant que prioriza a consistência. A compatibilização da concepção de juízo com as partes mais relevantes da Analítica – principalmente para o que pesa para o problema da possibilidade de juízos sintéticos a priori – é uma conquista considerável, mas este estudo representa passos, que embora sejam fundamentais, são apenas iniciais na compreensão do idealismo transcendental. / Interpretations with different nuances have been offered for the conception of judgment set out in the Critique of Pure Reason, but, roughly speaking, one can classify them under two broad lines, named, analytic interpretation and interpretation from Port-Royal. However, both lines identify itself under the thesis that in judgments are also subordinate singular representations. This conception, designated here extensional interpretation of judgment, commonly leads to an uncharitable reading of the work. The objective of this text is to propose and outline the defense of another conception of judgment, guided by the following theses: i) intuitions and concepts do not relate in or by means of judgment, ii) the extensional relation is not sufficient to determine which concept is higher or lower (genus or species) and iii) the relation which establishes the intensional series of concept is that one which determines the higher/lower hierarchy and that is the relationship of more cognitive relevance. Contrasting to extensional conception, the proposal advocated here is named of intensional interpretation and demands to take the distinction between intuitions and concepts until its ultimate consequences. The explanatory power and accordance with text of this approach of judgment shows itself by reconciling different parts of the Transcendental Analytic, even those that secondary literature tends to dismiss or assign little significance. In the development of this compatibility, after the presentation and defense of intensional conception of judgment, the text addresses sequentially the Metaphysical Deduction, the Transcendental Deduction, the Schematism and the Principles, seeking to emphasize the linkage and interconnection of these parts, which is modeled on mediation of imagination in the relationship between the products of understanding and sensibility. Therefore, although starting from the conception of judgment, the purpose of the text is to seek a reading of Kant's greatest work that prioritizes consistency. Presenting the compatibility of conception of judgment with the most relevant parts of Analytic – mainly for the concern of the possibility of synthetic a priori judgments – is a considerable achievement, but this study represents steps that, although fundamentals, are just initials to the understanding of transcendental idealism.

No primeiro capítulo, procuro mostrar o desenvolvimento do Iluminismo na sua relação com o teatro nacional alemão. Lessing é, sem sombra de dúvida, o autor decisivo neste sentido, pois reunia em si não só o artista criativo, mas também o teórico. Para explorar essa potente combinação, é necessário que se estude sua produção artística associada à sua teorização estética, política e educacional. Um aspecto particularmente interessante a ser notado é a complexa coexistência de aspectos nacionalistas e cosmopolitas nos personagens e ideais por ele propostos. Os textos discutidos, embora não esgotem sua obra, são indispensáveis para uma compreensão do Iluminismo lessinguiano: a peça juvenil Os judeus, o diálogo Ernesto e Falco, as teses sobre A educação da humanidade, e sua obra-prima Natan, o sábio, que se inspira na figura de Moses Mendelssohn. No segundo capítulo, passo a examinar, entre outros escritos, o ensaio Jerusalém de Moses Mendelssohn, no qual ele ataca a autoridade eclesiástica e estatal, além de advogar a missão monoteísta do Judaísmo e defender a obtenção de direitos para os judeus. Tendo previamente examinado a peça por ele inspirada, não deixa de ser instigante ver o próprio Mendelssohn ou ¿Natan¿ falar em suas próprias palavras, dando-nos, assim, um certo senso de realidade. No terceiro capítulo, procuro mostrar o interesse filosófico de A flauta mágica de Wolfgang Amadeus Mozart, com um enfoque sobre os personagens como Papageno, Tamino, Pamina, Papagena e Sarastro. Por algum motivo, este Singspiel parece levantar questões candentes da modernidade como machismo, racismo, e homossexualidade, apesar de sua aparente falta de coerência narrativa. Admitindo o caráter esotérico da narrativa, acompanho, no decorrer da peça, a expressão literal desses conflitos permeando a interação dos personagens. No quarto capítulo, procuro delinear a figura kantiana do ser humano (Mensch) iluminado partindo das diferenças antropológicas concretas, mas posteriormente explicitando os conceitos envolvidos na teorização sobre seu suposto esclarecimento. Ao contrário dos autores anteriores, nos quais se pode falar de uma construção estética de personagens, em Kant essa construção dos tipos antropológicos passa a ser teórica, mesmo se baseada em fatos provindos da literatura de viagem. A prova disso está na sua tentativa, explícita, de construir um conceito de raça humana a partir do critério da cor da pele / Abstract: The main purpose of this dissertation is to show how ideal characters were constructed by major German philosophers and writers during the second half of the eighteenth century. Chapter One (¿Lessing¿) is concerned with establishing and clarifying the relation between Enlightenment philosophy and literature in the German-speaking world. G. E. Lessing is certainly the most critical author in this respect, as he was both a major creative artist and a theoretician to boot. To fully appreciate this powerful combination, it is necessary to study his plays in light of his aesthetic, political and educational ideas and vice versa. It is especially interesting to see the tense coexistence between concerns for national German political and linguistic unity on the one hand, and, on the other hand, a yearning for cosmopolitan, abstract, humanity (the so-called Mensch). Although not exhaustive, my examination covers several texts which are crucial to an adequate understanding of Lessing¿s Enlightenment project: the play, written in his youth, The Jews, the Masonic dialogue Ernest and Falk, the philosophical and theological theses in The education of humanity, and his masterpiece Nathan, the wise, whose title character was inspired by Moses Mendelssohn. Chapter Two (¿Moses Mendelssohn as Nathan¿) reviews, among other writings, the essay Jerusalem, in which Moses Mendelssohn attacks church and state authority, claims a monotheist mission for Judaism and argues for Jewish rights. It is particularly enlightening to compare Lessing¿s fictional Nathan to Mendelssohn himself. Chapter Three (¿Mozart and The magic flute¿) is an attempt to show the philosophical relevance of W. A. Mozart¿s The magic flute, while focussing on characters such as Papageno, Tamino, Pamina, Papagena, Monostatos and Sarastro. For some reason, this Singspiel raises several controversial issues of modernity such as male chauvinism, racism and homosexuality, despite its apparent lack of narrative coherence. I acknowledge the esoteric character of the narrative but follow the literal expression of these conflicts as the characters interact throughout the play. Chapter Four (¿Kant and the Mensch¿) deals with I. Kant¿s pre-critical anthropology and relates it to his concept of the enlightened Mensch. Contrary to the previous authors, however, who were concerned with an aesthetic construction of characters, in Kant¿s case, the construction of anthropological types is, properly understood, theoretical, even if it relies on data gleaned from the then popular travel book literature. L'articulation des perspectives objective et subjective en éthique chez Bernard Williams et Thomas Nagel

Ce mémoire s'interroge sur la façon appropriée d'articuler les perspectives objective et subjective en éthique. Il évalue et compare les réponses respectives de Bernard Williams et de Thomas Nagel. Williams refuse de considérer la perspective subjective comme la seule acceptable en morale à cause du danger que cela représente pour l'identité personnelle et le savoir éthique forgé dans une communauté. Il propose plutôt que la morale soit basée sur des règles substantielles reflétant l'anthropologie propre à un groupe d'appartenance. Nagel met l'emphase sur une tension irréductible entre les perspectives, autant au niveau des choix individuels que politiques. Aussi, même s'il favorise la prédominance des exigences morales objectives, il ne néglige pas les préoccupations subjectives et propose des moyens de diminuer la tension perspectuelle. J'esquisse finalement un moyen de dépasser Williams et Nagel dans la réconciliation des perspectives et l'accroissement de la motivation morale, en ayant recours au dialogue intersubjectif.

El mal radical según Hannah Arendt y el psicoanálisis freudiano

Buscamos establecer un paralelo entre algunos conceptos del psicoanálisis freudiano y el concepto kantiano del «mal radical», el cual fue adoptado por Hannah Arendt para referirse a las atrocidades cometidas por el régimen totalitario nazi contra los judíos en la Shoah. Arendt considera el nazismo como un régimen totalitario basado en una ideología racial que proporcionó la «ficción creíble» que argumenta que gracias a las Leyes de la Naturaleza surgió la raza aria - «superior y pura» - para la cual su objetivo principal fue destruir a su contraparte, el pueblo judío «infrahumano». Los nazis utilizaron campos de concentración y exterminio para eliminar a millones de personas consideradas «superfluas» y «prescindibles». En este artículo analizamos la obsesión de los nazis de exterminar a los «infrahumanos», utilizando, entre otros, el concepto psicoanalítico freudiano de la «pulsión de muerte» y sus subrogados, fenómenos de la psicología individual que se aplican a las masas colaboradoras de los nazis. Entendemos el «mal radical» utilizado por Arendt como un constructo que abarca aspectos socio-económicos, políticos, filosóficos e históricos; simbólicamente, el mundo externo, mientras que los conceptos freudianos dan cuenta de la dinámica intrapsíquica inconsciente como sustrato del comportamiento destructivo, que representan el mundo interno. Argumentamos que ambos mundos: interno y externo se encuentran en permanente dinámica e interacción. Encontramos semejanzas y aspectos complementarios en los aportes de ambos Arendt y Freud. Creemos que, en el sustrato inconsciente de los perpetradores nazis, ocurrieron los fenómenos psicológicos antes señalados, y además, que las acciones nazis fueron el producto del proceso secundario, del pensamiento consciente, con pleno uso de libertad de elección y de una voluntad pervertida. Reiteramos que la implementación del «mal radical» por los nazis es imputable. / In this work, we aim to establish a parallel between some elements in Freudian Psychoanalysis and the Kantian concept of «radical evil» adopted by Hannah Arendt to give an account of the atrocities committed by the Nazis against the Jews during the Holocaust. Arendt considers Nazism to be a totalitarian regime based on a racist ideology which provided the so-called «credible fiction» which argues that thanks to the Laws of Nature, the «superior and pure» Arian Race emerged, for which its main objective was the destruction of its counterpart: the «subhuman» Jewish People. The Nazis used concentration and extermination camps for the elimination of millions of people considered superfluous and disposable. We also analyze the Nazi obsession with the extermination of the «subhuman» using, among others, the psychoanalytic Freudian concept of the «death drive» and its subrogates, concepts that describe a phenomenon of individual psychology applied to the masses which collaborated with the Nazis. We understand the concept of «radical evil» used by Arendt as a construct that encompasses socio-economic, political, philosophical and historical aspects, symbolizing the external world, while the Freudian concepts give rise to an intra-psychological dynamic unaware of its role as the substrate of destructive behavior, representing the internal world. We argue that both worlds: the external and the internal, exist in perpetual interactive dynamics. We thus find similarities and complementary aspects in the contributions of Freud and Arendt. We believe that in the unconscious substrate of the Nazi perpetrators of evil the above mentioned psychological phenomena took place. Moreover, the explicit actions undertaken by the Nazis were the product of a secondary process, of conscious thought, with full use of freedom of choice and an evil will. Therefore, we reiterate that the implementation of the «radical evil» by the Nazis is imputable.

Contribution à la définition de l'éducation de la philosophie des Lumières : une perspective selon Diderot, Kant et Rousseau

Et ces finalités, à travers les époques, témoignent immanquablement d'idéaux axiologiques propres à une aire géopolitique et culturelle donnée. L'histoire de l'éducation occidentale a été caractérisée par plusieurs éléments de continuité, mais aussi, à d'autres moments par quelques moments de rupture. Ce fut notamment le cas dans l'Europe du XVIIIᵉ siècle, où la pensée philosophique des Lumières, marquée, entre autres, par des idéaux d'égalité, d'émancipation et de raison, et par la volonté claire d'abolir l'Ancien régime, influencera grandement la pensée éducative contemporaine. Afin de mieux comprendre comment la conception éducative des penseurs des Lumières est teintée par des considérations sociopolitiques sous-jacentes, nous avons tenté de répondre à la question suivante : Quel type d'individu l'éducation doit-elle tendre à former ? Pour y répondre, nous avons analysé la pensée éducative de Diderot, de Kant et de Rousseau, telle qu'elle peut respectivement être circonscrite dans l'*Encyclopédie, Réflexions sur l'éducation* et l'*Émile*. Si leur conception éducative est teintée d'idéaux qui leur sont propres et que, par voie de conséquence, chacun envisage l'éducation selon des finalités spécifiques, ils s'entendent tous sur le fait que l'éducation devrait préparer le terrain pour la mise en place d'un nouveau contrat social, dans lequel chaque citoyen contribue à l'établissement d'une meilleure société. / Behind the school lies the question of the purposes of education. And, through the ages, these purposes automatically attest to axiological ideals of a given geopolitical and cultural area. The history of Western education has been characterized by several elements of continuity, but also by moments of disruption. This was particularly the case in 18th-century Europe, where the philosophical thought of the Enlightenment--known for its ideals of equality, emancipation and reason, as well as the clear desire to abolish the Old Regime--would greatly influence contemporary educational thought. In order to better understand how the educational design of the Enlightenment thinkers was coloured by the underlying sociopolitical considerations, we have attempted to answer the following question: What type of individual benefits from education? In response, we have analyzed the educational concepts of Diderot, Kant and Rousseau as described in l'Encyclopédie, *Lectures on pedagogy* and *Emile*, respectively. Even if their views differ due to ideals which are specific to each, they nevertheless agree on the fact that education should lead to the establishment of a new social contract, where every citizen contributes to a better society.
