The objective of this study is to demonstrate that education of prisoners make them less likely to re-offend because it facilitates their re-integration to their community at the end of their prison sentences. As a consequence, the whole society can benefit from the implementation of the right of education of prisoners. The method of study employed involved the analysis of other research and references addressing the problem of education of prisoners in Brazil, the analysis of the constitutional rules and of criminal proceedings in the past and present time, giving a historical view of the evolution of criminal procedural laws in Brazil. Moreover, this research investigates some models of public administration which put into practice education polices and techniques as a means to integrate prisoners in society. Finally, it highlights the need to support the agents who will be directly dealing with the education of prisoners and offers alternatives / O presente trabalho acadêmico busca estudar a importância do direito à educação dos presos e as conseqüentes perspectivas das normas processuais penais e de execução penal em relação a esse direito constitucionalmente previsto pela Constituição brasileira. Afirma a importância, no atual Estado Democrático de Direito, de obedecer aos ditames da Constituição Federal de fornecer indistintamente a qualquer pessoa o direito à educação fundamental. Desenvolve, por meio de pesquisas bibliográficas, estudos acerca da educação na norma constitucional brasileira atual e suas raízes históricas, bem como sua interligação com o direito processual penal e de execução penal, além de discorrer sobre a própria evolução dos princípios do direito processual penal na Constituição brasileira vigente. Busca apontar os fins do processo penal e a necessidade da plena observância do princípio da dignidade da pessoa humana em relação à educação, demonstrando, ainda, como é importante educar os prisioneiros que estão atualmente descontando pena privativa de liberdade em regime fechado, para com isto facilitar a sua ressocialização. Estuda as decisões jurisprudenciais e seus embasamentos teóricos em relação ao instituto da remição pelo estudo e sua aplicabilidade em face do ordenamento jurídico. Aponta a necessidade de fornecer integral apoio às condições de acesso à educação do preso como finalidade de agir das políticas públicas na melhoria da sociedade, pautada pelos princípios da igualdade e da legalidade que constituem verdadeiros requisitos para a existência do Estado Democrático de Direito. Indica, ainda, o presente trabalho acadêmico a real importância da educação do preso como forma de prevenção criminal, inclusive com a diminuição da reincidência no crime

Essa abordagem surge do fato de buscar nos princípios a fonte originaria da busca do direito, sendo assim, ampliam-se as perspectivas que garantem esse direito na Constituição Federal de 1988, além dos artigos referentes à temática da educação existentes na Carta Magna e que, também, é possível ampliar essa tutela através dos princípios constitucionais. Dessa maneira, em cinco capítulos, procura-se destacar que a educação é um importante instrumento para a formação da pessoa com deficiência e que bem aplicada produz uma melhor qualidade de vida de quem tenha qualquer tipo de deficiência, proporcionando formação intelectual, independência, autonomia, qualificação profissional, bem como criando uma pessoa capaz de ser um agente multiplicador dessa adequada educação. 9 Para essa finalidade destaca-se a contribuição da família que é quem recebe a pessoa com deficiência e que será inicialmente responsável para não inibir essa preparação, que será continuada pelas escolas especiais ou não, dependendo do tipo de deficiência e que ajudará na preparação e formação profissional da pessoa humana

Analyzing the Principle of Equality and Discrimination in all Brazilian Constitution, from the Empire until the actual valid Federative; accepting the starting point of doctrines and the home land legislations, always, the equality in the presence of the law. Inside the Fundamental Right of Education, an historical analyzes of past Constitutions. We present the pros and cons of the program that inserts the system of quotas on the, public and private universities, further analyzing the temporary measures, the actual laws and the jurisprudences. We defend the acceptance on an university thru a meritocratic system, thru the governmental politics of elementary and middle schools of public education, that would prepare an individual since childhood, so one have the intellectual condition to dispute a place in a public or private university, in equality and condition of the candidate that had attended a private elementary and middle schools. At last, we have to improve our public elementary and middle schools, so that the students will get to a superior education, thru their own merits, without depending on palliatives or discriminatory measures / O presente trabalho visa averiguar conceitos, correntes e doutrinas acerca do princípio da igualdade e a discriminação; tendo o direito fundamental à educação como aporte principal voltado para o ensino superior e ao sistema de cotas. Analisamos o princípio da igualdade e a discriminação em todas as Constituições brasileiras, do Império até a Federativa vigente; partindo do ponto aceito pela doutrina e legislação pátria, desde sempre, que é o da igualdade perante a lei. Adentramos ao Direito Fundamental à Educação fazendo uma análise histórica das Constituições passadas. Apresentamos os prós e os contras do programa que insere o sistema de cotas nas universidades públicas e privadas, além de analisarmos as medidas provisórias, as leis vigentes e as jurisprudências. Impact des allocations en ressources sur l'efficacité des écoles primaires en Côte d'Ivoire / Impact of resource allocations on the effectiveness primary schools in Côte d'Ivoire

La qualité de l’enseignement primaire en Côte d’Ivoire s’est fortement dégradée au cours de ces trois dernières décennies. Cette situation est la résultante d’une gestion approximative du système éducatif, qui se caractérise par une insuffisance de support pédagogique, une mauvaise allocation des ressources, un encombrement des salles de classe (42 élèves par enseignants au primaire) et un déficit d’enseignants qualifiés et bien formés. En outre, le conflit militaro-politique de septembre 2002 n’a guère amélioré cet état de choses, bien au contraire, il n’a fait que détériorer davantage la situation. Ainsi, la présente thèse s’est fixée comme objectifs d’analyser, d’une part l’influence des dotations en ressources sur l’efficacité des écoles primaires en Côte d’Ivoire sur la base d’une enquête sur les compétences réalisée par le Ministère de l’Education Nationale et d’autre part, d’examiner l’impact du conflit militaro-politique de septembre 2002 sur la demande d’éducation en s’appuyant sur les données des enquêtes MICS-2000 et 2006 réalisées auprès des ménages. Pour ce faire, une classification des écoles selon leur dotation en ressources s’est faite, ensuite, au moyen de la méthode de l’enveloppe des données (DEA, méthode non paramétrique), une frontière d’efficience est construite pour mettre en exergue les spécificités des écoles et enfin une estimation économétrique (modèle Tobit sur les données censurées) est mise en œuvre pour déceler les facteurs influençant la formation des scores d’efficacité. Il ressort des analyses qu’une augmentation de la quantité des ressources allouées à une école n’est pas gage de sa performance car les facteurs d’efficacités ne résident pas dans les dotations en quantité, mais plutôt dans les dotations en qualité c'est-à-dire les valeurs et caractéristiques intrinsèques aux personnes et matériaux mises à la disposition des écoles, ceci fait dans un souci d’adéquation aux besoins spécifiques des écoles et d’équité. Par ailleurs, à partir d’une méthodologie combinant à la fois l’estimation par les doubles différences, l’estimation par les triples différences et la correction par les contrôles de robustesse, elle aboutit aux résultats selon lesquels, les taux d’accès et d’achèvement aux grades un à six du primaire ont baissé du fait de la crise. En effet, les proportions d’enfants qui achèvent les grades 1 et 2 ont baissé de 25 % et celles des enfants qui achèvent les grades 3, 4 et 5 ont diminué respectivement de 22 %, 16 % et 4 %. / The quality of primary education in Côte d'Ivoire has deteriorated sharply over the past three decades. This situation is the result of an approximate management of the education system, which is characterized by a lack of educational support, a misallocation of resources, a congestion of classrooms (42 students for a teacher in primary school) and a lack of skilled and well trained teachers. In addition, the military-political conflict in September 2002 did not allow to improve this situation; on the contrary, it has further deteriorated the situation. Thus, the aim of this thesis is first to analyze the influence of resource endowments on the effectiveness of primary schools in Cote d'Ivoire on the basis of a survey on the competence conducted by the Ministry of Education. Secondly, it examines the impact of military-political conflict in September 2002 on the demand for education based on data from the MICS-2000 and 2006 household surveys. To do this, a classification of schools according to their resource endowment was made, then, using the method of data envelopment analysis (DEA nonparametric method), an efficiency frontier is constructed to highlight the specificities of schools and finally an econometric estimation (Tobit model censored data) is implemented to identify factors influencing the formation of effectiveness scores. The analysis shows that increasing the amount of resources allocated to a school does not guarantee its performance as the efficiency factors are not resident in endowment quantity, but rather in the endowment quality, that is the values and characteristics intrinsic to people and materials available to schools, this fact in order to fit the specific needs of schools and fairness. Furthermore, using a methodology combining both double differences estimation, the triple differences estimation and correction by the robustness checks, we find that the rate of access and completed grades of primary school s one to six of primary school declined because of the crisis. Indeed, the proportions of children completing levels 1 and 2 have fallen by 25% and those of children completing levels 3, 4 and 5 have decreased by 22%, 16% and 4% respectively.

Education plays an increasingly important role in achieving success in life and the social ladder, because every individual should have the same opportunity to study regardless of their origin, social characteristics, educational family history or other ascriptive factors. This thesis deals with an access to higher education for those who come from low-income families or families where a higher education has no family history. It describes and analyzes the current access to tertiary education in the Czech Republic in the context of the equalization of opportunities of students from families with no tradition of higher education or lower socio- economic status. The theoretical part presents information about the issue of access to higher education. It explains the concepts which are often mentioned in this thesis, describes the historical development of the right to education and the path to the right of equal access to tertiary education in a modern society. The following describes the sociological theories on educational inequality and they are applied to the specific factors influencing equity of access to tertiary education. It addresses the heavy reliance on formal education, which has left many students and graduates without the necessary skills to combat high youth unemployment. Informal channels play a significant role but suffer from limited access to resources and quality education, leading to a skill gap among young adults.
