El derecho a la libertad de expresión artística en el Estado ConstitucionalLoyola Ríos, Néstor Daniel 25 July 2019 (has links)
Este trabajo de investigación aborda en forma dogmática y jurisprudencial el derecho a la
libertad de expresión que se ejercita a través de las modalidades artísticas, como son las
caricaturas, las parodias, la pintura, el cine, la música, los poemas, entre otras. De esta
manera, rompe con la concepción clásica de dicha libertad que la identifica como una
garantía que permite la libre difusión de ideas y opiniones efectuadas en forma oral o
escrita, ya que se inserta en un nuevo escenario que implica concebirla como una auténtica
manifestación de cultura en nuestro Estado Constitucional.
Así, la persona, en tanto actor eminentemente crítico y reflexivo de su realidad, exterioriza
sus pensamientos y sentimientos mediante el uso de un lenguaje o comportamiento
expresivo abstracto, satírico y heterodoxo, con el fin de contribuir en la culturización y
educación de la sociedad mediante las artes.
Por eso, el presente estudio tiene como propósito construir el contenido del derecho, del
cual se desprende a su vez la existencia de un derecho a la irreverencia atendiendo a la
razón de ser del arte. También pretende establecer determinados criterios interpretativos
para orientar a una adecuada solución de aquellos conflictos constitucionales que se
produzcan entre la libertad de expresión artística y otros bienes y derechos fundamentales,
a partir de la experiencia judicial comparada (Colombia, Estados Unidos, Alemania y el
Tribunal Europeo de Derechos Humanos).
Finalmente, se resaltan diversos casos del acontecer nacional que ponen en evidencia la
necesidad de aprehender cómo funciona esta libertad fundamental, hasta dónde alcanza su
ámbito de aplicación y, por supuesto, cuáles son los límites que se anteponen para cautelar
su debido ejercicio.

El trabajo pretende ofrecer el contenido, sistematización, y aplicación operativa de
la pena de inhabilitación en el Derecho Penal peruano. Se toma como punto de
partida el estudio histórico, que permite observar su transición en el sistema de
penas hasta la actualidad, por lo que, se cuestiona su denominación en el
catálogo de penas limitativas de derechos; toda vez que, no guarda relaciónfunción
con las demás penas que son contenidas en dicho catálogo. Frente a los
desafíos que presenta la Administración de Justicia, es necesario incidir en la
reconducción de la pena de inhabilitación a un nivel anterior a la decisión judicial;
es decir, el persecutor del delito debe determinarlo bajo los cánones del principio
de legalidad, culpabilidad, razonabilidad y proporcionalidad. Con lo cual viabilizará
su eficiencia en el proceso de la determinación judicial de la pena a imponer. Se
aborda finalmente, su incursión en las faltas, en las medidas alternativas a la pena
privativa de libertad, otorgando a la citada pena un cariz innovativo que se ajusta a
los parámetros de un Derecho Penal Constitucional, que lo que pretende es la
máxima eficiencia de las garantías y no la cosificación de la persona. / The research aims to provide the content, systematization and operational
implementation of the penalthy of disqualification from them peruvian criminal law.
It takes as a start point the historical study, that allows to observe their transition in
the systmes of penalties until the present, it doesn`t save an unrelated – function
with the other penalties that are contained in this catalog. Facing the challenges of
the Administration of Justice, it is necessary to influence the renewal of the penalty
of disqualification to a previous level to the judicial decision, that is to say, the
persecutor of the crime should be determined under the guns of the principle of
legality, guilt, reasonableness and proportionality. Thus, make it viable the
efficiency in the process of the judicial determination of the death penalty to be
imposed. Finally, discusses the foray into the faults, in alternative measures to
imprisonment, giving the aforementioned worth a look that fits the parameters of a
constitutional criminal law that it is the maximum efficiency of the guarantees and
not the objectification of the person.

La problemática de las mujeres filicidas: Las reescrituras de <i>Medea</i> de Eurípides en dos Medeas argentinas y el diálogo intertextual con <i>Médée Kali</i> de Laurent GaudéDelbueno de Prat, María Silvina January 2014 (has links)
Desde su génesis mítica griega Medea ha sido caracterizada como la mujer bárbara, la transterrada, la desesperada, la hechicera y la filicida. Calificativos éstos que, en mayor o menor medida, han sostenido los numerosos autores que la han reescrito desde el siglo V hasta nuestra era, dado el carácter polisémico que este personaje adquiere. Ella encarna la marginalidad que significa ser mujer y extranjera en la Atenas del siglo V a.C, una suerte de alteridad que carga con una serie de impulsos y de reacciones, en particular la cólera desmedida, el furor pasional que le ha permitido trascender la exclusividad del ámbito literario e incorporarse definitivamente en la pluralidad de las artes: la literatura, el cine, la pintura y la música; y en la pluralidad de los tiempos.
Ya Eurípides en el 431 a.C resemantizó el relato tradicional al implementar el rito iniciático de la muerte de los hijos. A posteriori, la literatura de Occidente vuelve sobre esta imagen en la que se siguen indagando los aspectos psicológicos de la mujer y de la madre con los aportes decisivos que cada autor ha gestado en ella.
En este trabajo analizamos la concepción trágica de la mujer desde la tragedia griega, <i>Medea</i> de Eurípides, hacia las distintas performances que brinda la literatura de Occidente, en el marco de los estudios comparados. Los personajes femeninos de Eurípides representarían un tipo de diseño que los haría más cercanos a las mujeres reales pues su trágica humanidad, les ha permitido perpetuarse en los trazos de otras mujeres, otras Medeas, en la particularidad de la literatura argentina y de la literatura francesa, en los albores del siglo XXl.
Sin circunscribirnos a una lectura unívoca, creemos que las mujeres de las obras analizadas, transgreden los límites previsibles, quiebran un orden, el del κόσμος, en la vertebración de tres ejes: la extranjería, el destierro y finalmente el filicidio. Cada una de ellas: Bárbara en <i>La frontera</i> de David Cureses, Medea en <i>Jasón de Alemania</i> de Javier González, y Médée en <i>Médée Kali</i> de Laurent Gaudé, se erigen en representantes de la extralimitación, de la desproporción en sus sentimientos de amor y de odio y en sus consecuencias más terribles. Por ello son mujeres trágicas, en un momento dado, en el momento en que la tragedia es el verdadero espejo de la vida humana en sus crisis decisivas, en la descripción del sufrimiento humano.

El propósito de este estudio es abordar el concepto de espacio y, en particular, su desocupación, a través de tres obras: Caja Vacía/Metafísica de Jorge Oteiza, Who´s afraid of red, yellow and blue de Barnett Newman y el Pabellón de Alemania de Ludwig Mies van der Rohe. El discurso se construye a través de un transitar sobre la banda de Moebius y en su vaivén y en su doblez aparecen y desparecen imágenes, ideas y textos sobre los que fluye la voluntad de construir una interpretación nueva sobre el objeto descrito. Martin Heidegger, Gilles Deleuze y Gaston Bachelard son los tres sostenes teóricos de esta estructura. Y más cerca y más lejos de este texto siempre se mantiene la difícil tarea de entender cuál es la forma de habitar y de ser (Ich bin) del hombre en la tierra. / The purpose of this study is to address the concept of space and, in particular, its disoccupation through three different pieces of work: Empty/Metaphysical Box by Jorge Oteiza, Who´s afraid of red, yellow and blue by Barnett Newman and German Pavilion by Ludwig Mies van der Rohe. The discourse is constructed through a move on the Moebius band, its swing and double apparition and disappearance of images, ideas and texts which build a new interpretation of the subject matter. Martin Heidegger, Gilles Deleuze and Gaston Bachelard are the three theorists of this structure. The difficult task of understanding what is the way of living and being of man (Ich bin) on earth always remains what is closer and further away from this text.
