6. SUMMARY The purpose of my thesis is to describe the administrative organization in the People's Republic of China. The reason for my research is the growing interest resulting need for its introduction to the public. The thesis is composed of five chapters, each of them dealing with different aspects of Chinese administration. Chapter One is introductory and in its first subdivision it depicts the methodology used in the process of my research and also defines basic rules for translations of terminology used in the thesis. The second subdivision addresses the issue of literature and sources used in this thesis. Chapter Two introduces the geography, population and territorial divisions of China. The next chapter is subdivided into six parts. Part One specifies the Chinese legal culture, while the second part provides an overview of the legal development in the 20th century. Part Three investigates the legal and political system of nowadays China. Part Four depicts and explains the bodies of state power, while the next part introduces the Chinese Communist Party, which in fact is the main authority when discussing the state power in China and the most important decision-making body. Firmicus Maternus' Mathesis and the intellectual culture of the fourth century AD

The focus of this thesis is Firmicus Maternus, his text the Mathesis, and their place in the intellectual culture of the fourth century AD. There are two sections to this thesis. The first part considers the two questions which have dominated the scholarship on the Mathesis and relate to the context of the work: the date of composition and Firmicus' faith at the time. Chapter 1 separates these questions and reconsiders them individually through an analysis of the three characters which appear throughout the text: Firmicus, the emperor, and the addressee Mavortius. The second part of the thesis considers the Mathesis within the intellectual culture of the fourth century. It examines how Firmicus establishes his authority as a didactic astrologer, with an emphasis on Firmicus' use of his sources. Chapter 2 examines which sources are credited. It considers the argument that Manilius is an uncredited source through an analysis of the astrological theory of the Mathesis and the Astronomica. In addition, the astrological theory of Ptolemy's Tetrabiblos is compared to the Mathesis to assess Firmicus' use of his named sources. The methods that Firmicus uses to assert his authority, including his use of sources, are compared to other didactic authors, both astrological or Late Antique in Chapter 3. This chapter examines whether Firmicus' suppression and falsifying of sources is found in other didactic literature. Chapter 4 considers possible reasons for the omission of Manilius' name and also the effect that this has had on intellectual culture and the place of the Mathesis within it.

Em seu Law and Disagreement, Jeremy Waldron apresenta o que denomina de uma teoria democrática do direito, uma teoria normativa sobre a autoridade do direito baseada em sua legitimidade democrática. Para Waldron é a legitimidade do direito enquanto fruto de um processo de deliberação e votação majoritária que sustenta sua autoridade. Esse trabalho busca explicar a teoria democrática do direito de Waldron apresentando-a no contexto do liberalismo e do positivismo normativo. Dada a importância da legitimidade para a autoridade do direito em Waldron, esse trabalho discute também o que Waldron entende por legitimidade e sua distinção em relação à justificação, e defende a teoria de Waldron acerca da legitimidade como superior a outra teoria semelhante, defendida por John Simmons. Esse trabalho apresenta a teoria democrática do direito de Waldron no contexto das denominadas circunstâncias da política – a necessidade sentida de uma decisão comum e o desacordo sobre qual deve ser essa decisão. Essa tese defende que Waldron apresenta dois argumentos distintos em defesa de sua teoria: a) um argumento epistêmico, baseado na tese da justificação normal da autoridade, de Joseph Raz, adaptada ao contexto das decisões majoritárias, e que está suscetível a certos tipos de crítica, e b) um argumento de equidade, que recorre à igual consideração e respeito nas circunstâncias da política, o qual está suscetível a outros tipos de crítica. in English The thesis deals with the liability of the members of statutory authority of a joint-stock company in antecedent legislation and in present legislation. These legislation are compared and their differences are described. Duties of a member of statutory authority (foremost duty of care), whose violation led to commencement of obligation to compensation for damage, are characterized. Specifically the thesis deals with their obligation to pay damages and their liability for damage. These relations are analyzed not only to company itself, but also in relationship to the shareholders and third persons. Thesis contains also research of claiming damages and business judgment rule.
