大学における知的財産の事業化に関して、バイドール法の施行に伴う日本と米国の影響は異なる結果となった。バイドール法は、日本の大学における研究活動活性化に対して、重要な影響を与えていなかったのに対し、米国では大学における研究活動を活性化させるのに寄与したと判断できる。また、発明を商業化するための特許取得に関する行動でも、影響の小さかった日本に対し、米国では発明からの収益を最大化させるような行動を高めたことが示された。 / Liberalizations of Japan's and America's policies on academics' intellectual property commercialization resulted in different outcomes. Japan's results show no significant change resulting from liberalization, while US results showed both significant improvement in academics' retention of research work after the system changed and that improvement aligned US academics with the level of participation present in Japan both before and after its policy change. Equity Considerations in the Assessment of The Bayh-Dole Act

abstract: Extant evaluation studies of the Bayh-Dole Act of 1980 have focused primarily on its effects on the pace of innovation and on the norms and practices of academic research but neglected other public values. Seeking to redress this shortcoming, I begin by examining Bayh-Dole with respect to other relevant public values following the Public Value Failure approach. From that analysis, equity emerges as a pressing issue. I define equity issues, in a loosely Rawlsian sense, as situations of unfair distribution of political power and economic resources. My analysis identifies a business model of offices of technology transfer--that I call "nurturing start-ups"--that is likely to become a standard of practice. This model can foster either firm competition or concentration in emerging industries and will therefore have an impact on the distribution of economic benefits from innovation. In addition, political influence to reform Bayh-Dole is allocated disproportionately in favor of those who stand to gain from this policy. For instance, elite universities hold a larger share of the resources and voice of the university system. Consequently, adjusting the nurturing start-ups model to foster competition and increasing cooperation among universities should lead to a more equitable distribution of economic benefits and political voice in technology transfer. Conventional policy evaluation is also responsible for the neglect of equity considerations in Bayh-Dole studies. Currently, "what is the policy impact?" can be answered far more systematically than "why the impact matters?" or "is this policy designed and implemented legitimately?" The problem lies with the consequentialist theory of value that undergirds evaluation. The impact of the Intellectual Property Rights Act for publicly funded research and development on technology transfer offices at South African universities

The impact of the Intellectual Property Rights Act for publicly funded research and development on technology transfer offices was studied, using a questionnaire survey and guided interviews of six technology transfer officers. The survey requested technology transfer officers to express the impact level of each of the eleven impact elements on the four stages of intellectual property development – these being intellectual property creation, disclosure, protection and commercialisation. The set of data was weighted for each element, by intellectual property development stage, and analysed using frequency tables. The impact elements of „structural and resource requirements to commercialise and manage intellectual property‟, „intellectual property detection process by the technology transfer officers‟, and‟ disclosure process‟ were ranked as the top three impact elements, in that respective order. Narrative inquiry and theme extraction allowed further elaboration of the impact elements. Comparison with Staphorst‟s (2010) results showed that the impact elements were different for science councils, pointing to unique requirements by universities in their intellectual property management systems. The results of this analysis clearly indicate that the Intellectual Property Rights Act enforcement and execution will demand a high degree of structural and resource requirements, particularly, and most importantly, at the intellectual property disclosure stage of intellectual property development. Intellectual Property and Policy Issues in Biotechnology

Intellectual property, particularly patents, plays a major role in innovation and discovery in biotechnology. Likewise, since the passage of the Bayh-Dole Act in 1981, patents have become an increasingly important factor in U.S. university-driven basic research, especially in the life sciences where patented technologies have transformed agriculture. Specifically, this paper looks at the potential impacts of these trends on university driven research, the university researcher, the pharmaceutical industry, and the farm sector with an emphasis on recent and pending court cases and legislation. This paper examines policy and adoptions issues in biotechnology and biomedicine in depth and touches on important developments in the tech sectors as a back drop for pending legislation and recent court rulings. How policy is adopted, implemented and interpreted have profound impacts on food production, medical ethics, ecology, U.S. and international farm and innovation sectors and the competiveness of the U.S. in the global economy

The impact of intellectual property rights from publicly financed research and development on governance mode decisions for research alliances

This study consisted of two distinct research phases, performed within the context of the South African Council for Science and Industrial Research (and its current and potential research alliances). The purpose of the study was to develop a decision making model that would enable strategists at publicly financed research and development organisations to analyse and predict governance mode decisions, as well as select optimal governance mode structures (ranging from quasi-market structures, such as once-off contracts, to quasi-hierarchy structures, such as research joint ventures) for research alliances. During the qualitative first phase, the study aimed to identify impact domains within South Africa’s new Bayh-Dole-like Intellectual Property Rights legislative framework that consists of the Intellectual Property Rights from Publicly Financed Research and Development Act, as well as the Technology Innovation Agency Act, which could potentially influence research alliances (based on the Transactional Cost Economics, Resource-based View and Real Options Approach perspectives) with publicly financed research and development organisations. This was followed by the quantitative second phase, which attempted to verify the validity of a value-mediated governance mode model that included the highest ranked impact domains identified during the first phase as formative indicators for the perceived Intellectual Property Rights regime strength uncertainty factor. A qualitative online survey amongst senior managers at the Council for Science and Industrial Research, followed by Theme Extraction combined with Constant Comparative Method analysis, as well as a weighted frequency analysis, constituted the research methodology employed during the first phase’s identification and ranking of impact domains within the South African legislative framework. This phase demonstrated that the highest ranked impact domains (primarily driven by the Transactional Cost Economics perspective) included the choice of Intellectual Property Rights ownership, state walk-in rights on undeclared Intellectual Property, and benefit-sharing policies for the creators of Intellectual Property. The second phase consisted of a quantitative online survey, distributed amongst current and potential research alliance partners of the Council for Science and Industrial Research, followed by Structural Equation Modelling of a value-mediated governance model that included, amongst others, the perceived Intellectual Property Rights regime strength as an uncertainty factor. This phase revealed not only that the impact domains identified during the first phase could be used as formative indicators of the perceived Intellectual Property Rights regime strength, but also that stronger perceived regimes are positively related to the preference for quasi-hierarchy research alliance governance modes. Furthermore, it established that the expected value of a research alliance, which was shown to be positively influenced by the strength of the perceived Intellectual Property Rights regime, acted as a mediating factor on the relationship between the perceived Intellectual Property Rights regime strength and the preferred research alliance governance mode. The influence of entrepreneurial activities on teaching at Universities in the United States

This study is to investigate the influence of entrepreneurial activities on teaching at universities. Specifically, the study focuses on entrepreneurial activities' effect on professors' time allocation. The dataset analyzed was constructed from the survey conducted by University of Illinois at Chicago in 1998. The sample was drawn from American academic professional associations' members of the four fields: experimental biology, physics, mathematics, and sociology. Based on the data of 133 professors, the study shows that professors with paid consulting work tend to spend less time in teaching when research activities are controlled. Insignificant are the other variables about entrepreneurial activities: patent application, industry funding, and research collaboration with industry. Also, more research time is likely to result in less teaching time. Insignificant are the other research-related variables: research funding at large and collaborative research in general. In terms of personal and institutional conditions, assistant professors tend to invest more time in teaching than senior professors, but they are likely to reduce more time on teaching than their senior counterparts for increasing research time. Finally, biology and sociology professors tend to allocate less time to teaching than physics and mathematics professors. In a word, entrepreneurial activities and research tend to conflict with teaching at the level of individual professors' time allocation.
