A critical analysis of the factors that influence the sustainability of attorney's client protection funds : a Namibian perspective

Thesis (MBA)--Stellenbosch University, 2005. / ENGLISH ABSTRACT: The cornerstone of the legal profession is the trust harboured by clients when depositing monies with legal firms. A few regulations usually exist to protect trust monies. In the absence of a client protection fund, a client has no insurance against theft of trust monies. Most countries have come to realise the importance of employing a client protection fund to reimburse victims of theft in order to protect the integrity of the legal profession. Client protection funds are operated on different business models and a broad overview of the funds of New York, British Columbia, New Zealand and Botswana indicated that such funds are not able to compensate all proven claims without enforcing limitations. There is currently no benchmark whereby client protection funds can assess their effectiveness and sustainability. A standard for evaluating these funds is created based on the following criteria common to all funds: the purpose of a fund, the status of a fund, proper management of the fund, the methods which a fund employs to limit liability, the financial strength and sustainability of a fund, the rights of a fund where claims are awarded and the preventative measures employed by a fund. After evaluation of these funds it became clear that all of them are financially unsustainable if they were to pay proven claims without imposing limitations on their liability. The Namibian fund appears to be the most sustainable fund and was also used as the benchmark in one of the criterion of the evaluation model. A more critical study of the Namibian fund indicated that it would in future become less sustainable as the growth rate in trust deposits exceeds the growth rate of the fund's reserves. After a SWOT analysis it is suggested that the Namibian fund continues its current preventative measures, as same is likely the reason why an insignificant amount of thefts occurred over the past 15 years, and should focus on increasing income by negotiating better agreements with banks and employ a dedicated inspectorate, not only to ensure compliance with such agreements, but provide the fund with annual reports on each firm's level of compliance with statutory regulations on trust accounting. / AFRIKAANSE OPSOMMING: Die hoeksteen van die regsprofessie is die vertroue wat kliënte in prokureurs plaas om trustgeld te bewaar. 'n Basiese stel boekhou regulasies is al wat normaalweg dien as beskerming van trustgeld. In die afwesigheid van 'n getrouheidsfonds het 'n klient geen versekering teen diefstal van trustgelde nie. Meeste lande het reeds die waarde van 'n getrouheidsfonds besef as beskermingsmeganisme van die integriteit van die professie. Getrouheidsfondse is baseer op verskillende besigheidsmodelle en 'n breë oorsig van die fondse van New York, British Columbia, New Zealand en Botswana dui daarop dat sulke fondse nie in staat is om alle eise te vergoed sonder om daadwerklike beperkinge op hul verpligtinge te plaas nie. Daar bestaan huidiglik geen universele maatstaf waaraan fondse hul effektiwiteit en volhoubaarheid kan meet nie. 'n Eenvormige evaluasie model is ontwerp wat gebruik maak van die volgende ooreenstemmende kenmerke van alle fondse: die doel van die fonds, die status van die fonds, die behoorlike bestuur van die fonds, die metodes wat die fonds aanwend om verpligtinge te beperk, die finansiële vermoë en volhoubaarheid van die fonds, die regte van die fonds na betaling van eise en die voorkomende maatreëls wat die fonds aanwend. Na evaluasie van die bogenoemde fondse is dit duidelik dat sulke fondse nie finansieel volhoubaar sal wees as hulle alle goedgekeurde eise ten volle sou uitbetaal sonder die afdwing van beperkende maatreëls nie. Die Namibiese fonds blyk die mees volhoubare fonds te wees en word ook as maatstaf gebruik in een van die kriterium van die evaluasie model. By nadere ondersoek van die Namibiese fonds is vasgestel dat die fonds in die toekoms minder volhoubaar sal raak omdat die groeikoers in trust deposito's hoër is as die groeikoers van die reserwes van die fonds. Na 'n SWOT-analise word voorgestel dat die Namibiese fonds moet volhart in die uitvoering van voorkomende maatreëls en ook inkomste moet verhoog deur beter ooreenkomste met banke aan te gaan. 'n Toegewyde ondersoek afdeling sal verseker dat firmas sulke ooreenkomste nakom, asook aan die fonds raporteer oor firmas se nakoming van statutêre reëls.

The quality of service delivery by the estate agency industry in Bloemfontein

Published Article / 'n Groot hoeveelheid eiendomsagente het tot die eiendomsagentskapsbedryf toegetree in die laaste paar jaar. Tersel fdertyd het die kliënte se beoordeling van die kwaliteit van dienslewering deur eiendomsagente in die bedryf 'n afwaartse neiging getoon. Hierdie persepsie van swak kwaliteit lei tot 'n negatiewe impak op die bedryf. Navorsing gedurende 2004 het uitgewys dat kliënte in die Bloemfontein streek oor die algemeen nie tevrede is met die gehalte van dienslewering deur eiendomsagente in die bedryf nie. Respondente het sekere areas waar verbeterde hoë vlak dienslewering kan plaasvind, uitgewys. Hierdie navorsing en aanbevelings het dit moontlik gemaak om 'n model te ontwikkel vir die verkryging van maksimale tevredenheid van beide kopers en verkopers. A large number of estate agents entered the real estate industry in the last few years. At the same time the client rating of the quality of services offered by estate agents in the industry followed a downward trend. This perception of poor quality is causing a negative impact on the industry. Research done in 2004 has identified that clients within the Bloemfontein region are generally not satisfied with the level of service delivery by estate agents within the industry. Respondents did identify certain areas that could be improved in order for estate agents to deliver a superior level of service. On the basis of this research and recommendations, it was possible to develop a model of the service delivery that will maximise the satisfaction of both buyers and sellers.

Qu'est-ce qu'une consultation efficace? Cette question est pertinente pour les praticiens qui tentent de porter un regard critique sur leurs interventions puisque peu d'études portant sur l'efficacité sont disponibles. La plupart des recherches présentent le point de vue des consultants. Cependant, malgré l'importance accordée à la satisfaction du client, peu d'études empiriques portent sur la perception du demandeur de service de l'efficacité de la consultation. Les résultats qui ressortent de l'étude apportent un éclairage complémentaire à la documentation actuelle sur l'efficacité de la consultation en proposant une série de facteurs et de critères définis venant du point de vue des clients que peuvent utiliser les consultants pour évaluer leur valeur ajoutée. Les consultants étant davantage informés des attentes de leur client, ils peuvent mieux s'adapter et ainsi augmenter leur chance de succès. Ces résultats ont aussi été mis en parallèle avec les résultats de recherche obtenus sur le même thème, mais à partir de la vision des consultants. L'étude révèle que de façon générale les consultants ainsi que les clients expliquent et évaluent l'efficacité de la consultation de façon similaire, mais parfois avec des vocables et des définitions qui diffèrent.

Genetic counselling and adult polycystic kidney disease : patients' knowledge, perceptions and understanding

Adult Polycystic Kidney Disease (APKD) is a genetic disease transmitted in an autosomal dominant fashion. There is no cure. Treatment is of the symptoms as they appear usually in adulthood. Patients affected by APKD may receive genetic counselling from renal physicians. The aims of genetic counselling can be described through paradigms which reflect the current understanding of genetics and knowledge of the illnesses. The availability of new diagnostic techniques creates a new paradigm concerned with the ethical issues of genetic testing and counselling. An investigation into patients' knowledge, perceptions and understanding of genetic counselling was undertaken at the Renal Unit of Glasgow Royal Infirmary, prior to the establishment of a screening and counselling service for those at risk for APKD. The main findings of the study were: the majority of patients had received some genetic counselling from renal physicians; the majority of patients had relatively good knowledge of the symptoms of and treatments for APKD; nevertheless patients believed that the two most important items to be included in genetic counselling were information about the symptoms and the treatment of APKD; patients did not fully understand the genetic inheritance of APKD; they described the risk of transmission of APKD (50-50) as a medium risk; almost all patients recommended that their at risk relatives and their children be tested for APKD; prior to the availability of prenatal diagnosis, patients thought that their children should be tested between the ages of 16 and 20. A secondary study, including spouses of those with APKD and also haemophiliacs and their spouses, found that respondents favoured prenatal testing without termination of pregnancy and that both diseases were rated as being of medium severity. These findings raise ethical issues for those giving genetic counselling, and have implications for the content of genetic counselling.

A multivariate analysis of client expectation, client satisfaction, and client personality characteristics at the Ball State University Counseling Practicum Clinic

This study was an investigation of the Ball State University Counseling Practicum Clinic in terms of client expectation, client satisfaction, and the relationship between client personality characteristics and client satisfaction. Specifically, this study attempted to (1) identify and compare the expectations in the cognitive and affective domains that clients have when they come for counseling within the three clinic counselor assignment groups, (2) determine the extent of satisfaction in the cognitive and affective domains within the three clinic counselor assignment groups as a result of counseling, (3) investigate whether or not there is a significant relationship between client personality characteristics and client satisfaction in the cognitive and affective domains within each of the three clinic counselor assignment groups, (4) analyze the responses of the Client Satisfaction Questionnaire, and (5) describe client demographic characteristics within the three clinic counselor assignment groups in the cognitive and affective domains.Subjects in this study were volunteer clients seeking psychological counseling at the Ball State University Counseling Practicum Clinic during the Winter Quarter, 1975-1976, and the first five weeks of Spring Quarter, 1976.The data collected for each subject came from the following sources: (1) the Client Expectancy Inventory (CEI), (2) the Inventory of Fulfillment of Client's Expectancy (IFCE), (3) the California Psychological Inventory (CPI), and (4) the Client Satisfaction Questionnaire (CSQ).The data were treated by one-way multivariate analysis of variance, multiple regression analysis, and descriptive techniques. No differences were detected in either client expectations or client satisfactions within the three clinic counselor assignment groups in the cognitive and affective domains. Also, no significant association between cognitive and affective domain satisfaction scores and group membership was detected nor did any of the CPI scale scores provide a significant amount of additional explained variation in the client satisfaction scores. The clients within the three clinic counselor assignment groups indicated that their counseling experience had been moderately to slightly satisfactory. And, client demographic characteristics did not offer any significant information in predicting client satisfaction.Under the constraints of the study, the following conclusions were drawn.1. There was no significant difference in expectations among the clients in the cognitive and affective domains who were assigned to counselors with various levels of supervised training. 2. No association was found between entering expectations of clients and the extent of client reported satisfaction in the three clinic counselor assignment groups in the cognitive and affective domains.3. Clients of the advanced and post-advanced counselor groups reported the same level of satisfaction in the cognitive and affective domains as did the less severe clients who werecounseled by counselors with less supervised training.4. No association was found between a subset of premeasured personality characteristics and client reported satisfaction in the cognitive and affective domains.5. No association was found between group membership and client reported satisfaction in the cognitive and affective domains.6. Clients reported that their counseling experiences had been from moderately successful to successful. Also clients reported that they were either somewhat satisfied or satisfied with their counseling experience at the Ball State University Counseling Practicum Clinic. The above conclusions hold true irregardless of the (1) sublevel of the demographic characteristic investigated, (2) clinic counselor assignment group, or (3) cognitive or affective domain to which clients were classified.5

In recent years, with the arrival of information era and the rapid development of the medical health system, there has been a trend for hospitals and medical care centers to record the patients’ medical record electronically rather than by means of old-fashioned paper-based method. It has indeed reduced the workload of medical workers and it simplifies the procedure within the medical system. It is worth mentioning that the growth of mobile medical care is beginning to catch up as a consequence of the incredible popularization of mobile networks and the broad use of mobile devices. A significant possibility is that in the coming years, mobile medical care applications will play a large part of the whole electronic medical care system. This project will mainly focus on presenting the process of developing an Android application of doctor’s end in the electronic healthcare system which makes it possible for doctors to retrieve data from their patients and diagnose them as well as setting up appointments using mobile devices. The development for the doctor’s end application will follow the waterfall development methodology. In this report the functions of the doctor’s end application will be introduced, and how these functions are realized will also be displayed in detail. After the implementation, the app will be tested on an Android device emulator and on real Android mobile devices in order to evaluate their performance. In addition, it will be tested by mobile phone specialists in relation to gathering feedback. Finally, a reasonable conclusion will be drawn with regards to this project including ethical issues.
