Adolescentes em conflito com a lei e a vulnerabilidade social das suas famílias têm sido amplamente discutidos no cenário acadêmico, político e social. Também, tem se tornado comum, em debates, o exacerbado envolvimento de adolescentes com práticas infracionais, a visão estigmatizada da sociedade sobre os adolescentes e o aumento vertiginoso do número de reincidências. Diante dessa realidade, este estudo se propõe trabalhar as questões pertinentes à ressocialização do adolescente em conflito com a lei, e teve por objetivo: compreender a contribuição da dinâmica familiar no processo de ressocialização e na manutenção desse processo em adolescentes que cometeram atos infracionais. Os participantes da pesquisa foram constituídos por dois grupos. Dez profissionais, entre eles psicólogos, orientadores sociais, assistente social e pedagogo, que trabalham na medida de Liberdade Assistida. E dez famílias de adolescentes que haviam recebido progressão de medida para a Liberdade Assistida. Os instrumentos para a coleta de dados foram compostos de uma entrevista semidirigida e de um questionário criado pela pesquisadora a partir dos objetivos da pesquisa. A metodologia é de natureza qualitativa, tendo em vista que esta permite a descrição de fenômenos em um contexto. As análises dos dados mostraram que as várias facetas da ressocialização de adolescentes em conflito com a lei são vivenciadas numa realidade permeada pela precariedade, não só econômica, mas também de vínculos, calcados na violência, na provisoriedade e na instabilidade, perpassados por aspectos psicossociais como estigmatização e culpabilização. Diante desses aspectos, parece que a revolta da família constitui expressão de demonstrar inconformidade diante das condições de existência e de tratamentos recebidos. A coexistência desses fatores, dentre outros, acrescidos da dificuldade dos familiares em lidar com seus filhos, o uso de substâncias psicoativas e o envolvimento com amigos que exercem influência perniciosa, parecem favorecer a permanência do adolescente no mundo delituoso. Porém, quando os familiares apóiam efetivamente os seus filhos em condutas socialmente aceitas educando-os, estes expressam o desejo de mudança, retomando aos estudos e afastando-se de amigos que possam contribuir para o retorno à prática infracional, investindo inclusive, em curso profissionalizante. / Teenagers in conflict with, before law, and their families social vulnerability have been largelly discussion matter in academic, political and social scenery. 兩岸假釋制度之比較研究 / Comparative study of parole systems across the Taiwan Strait

受刑人假釋出獄,係從機構內(監獄)矯正移轉至機構外(社區)矯正,其關係著矯政體系「危險的轉移」,更關係著社會「治安的良窳」。雖然人道主義、行刑社會化與受刑人基本人權之保障是現代法治國家所共識,亦為執行刑罰的指導原則。但是,和諧社會的穩定,必須兼顧犯罪人、被害人及社會三方面利益的維護。當社區矯正制度之法制與社會客觀環境無法完全契合,勢必衝擊社會和諧。因此,面對急遽變化的社會環境,社區矯正工作應講求其務實可行,而不是倡導犯罪人人道主義或完整復健的高調。社區矯正制度為維護社會穩定的重要關鍵,面對急遽變化的社會,兩岸皆應檢討現行社區矯正相關法規制度,以建構本土化的社區矯正制度。 臺灣地區假釋中付保護管束之社區矯正制度已行之有年,法律制度雖具基礎,但因在法律適用之爭議中,人權論者間有力主保障犯罪人人權,而輕忽社會安全。而政府有關部門或有忙於政治盤算、各自為政,而因應無力,加以少數基層執法人員怠於執行(處分)公務之態度,社會公安怎能令人滿意。因而培養執法人員之專業知識、敬業精神及樂業態度,強化對假釋受刑人之風險管理與危機管理,修法簡化假釋程序並完善法律,以建構完整之司法權與假釋制度,係維護社會治安之重要關鍵。 大陸地區,深知和諧的社會,有賴法律制度的支撐與執政者的態度,假釋之社區矯正制度即為社會和諧穩定的基礎。大陸地區目前猶無社區矯正專法,社區矯正制度起步較晚,有關社區矯正工作,主要依據為最高人民法院、最高人民檢察院、公安部、司法部聯合發布之「關於開展社區矯正試點工作的通知」,其通知係屬規章性質,雖為權宜措施與政策之宣示,但其為求事權統一,中央令示統合相關部門,全力推動社區矯正工作。目前各試點地區仍在摸索中前進,且限於經濟發展與教育文化較高之東部、中部及西部等地區,而城市及農村之客觀環境、條件不同,對大陸地區整體而言,在深化試點、總結經驗的同時,社區矯正制度的落實,除制定「社區矯正法」,以作為執行社區矯正工作之依據外,仍有待執政當局持續努力與時間的檢驗。 關鍵詞:假釋、保護管束、保安處分、社區矯正、施行區域 / How well the parole returns to his/her community relates to both the danger transiting from prison to community and the public security. The humanitarianism, socializing penalty and guarantee of the inmates’ basic human rights are recognized by the modern society, and also guiding principle for executing penalty. However, a stable and harmonious society, must take care of maintaining benefits of the criminals, the victims and the society at the same time. A community correctional system unable to match the social environment will definitely affect the social harmony. Therefore, facing rapid changing social environment, the community correctional system has to be as practical as it is focusing on criminal humanity and the complete recovery. The community correctional system is the key issue for social stability, facing the rapid changing society, both China and Taiwan should review their regulations carefully in order to establish a localizing community correctional system. In Taiwan, community-based correctional system for adult probation has been implemented for decades, with legal system. However, discussion still arises on how human rights of prisoners are guaranteed without ignoring social security. People are not so satisfied with the public security partly caused by the government’s hesitation to respond or ineffective bureaucracy or some basic personnel performing their jobs with a unprofessional manner. Thus, the key to maintain public security is assisting the personnel to enhance specialized knowledge, respect for and willing to work, strengthening risk management and crisis management regarding the parolee, and simplifying procedures and constructing a integrated parole system. China fully realizes the harmonious society depending on the legal system and Authorities’ manners. Community-based correctional system for adult probation is the cornerstone for a harmonious and stable society. Unlike Taiwan, China still has no special regulations on community correctional system. The main basis is "A notice for developing the experimental site regarding community correction ", jointly issued by the Supreme People's Court, the Supreme People's Procuratorate, Ministry of Public Security and Ministry of Justice. This notice serves as an expedient strategy, but also as a national order for unification and cooperation from the relevant departments. At present these experimental sites, mostly restricted in the economically, educationally and culturally developed areas, are still moving forward. Even though differences exist between city and the suburb, speaking of China as a whole, the authorities have to compile and utilize the experiences of the experimental sites, so that “the law for community–based correctional system for adult probation” will be established and carried out with continual examination. Esta dissertação dedica-se ao estudo das consequências da aplicabilidade da pena privativa de liberdade e das condições de possibilidade de legitimá-la, através de propósitos ressocializadores. Parte-se do princípio de que a pena carcerária é um mal que ainda se apresenta necessário, e para tanto não merece total extinção, mas sim significativas reformas. Toma-se como base dessa hipótese a desvinculação dos crimes que atingem bens jurídicos de maior relevância e propostas alternativas de encarceramento. Como fundamento, analisa-se os reflexos do encarceramento e suas diferentes propostas, enquanto medida indutora à reincidência, pretendendo sugerir propostas de modificação dos caminhos que provocam o sempre crescente índice de reincidência, embasando-se na participação da sociedade nos processos de reconstrução da dignidade profissional do apenado e do egresso. Nesse contexto, sugere-se que as parcerias entre o poder público e a iniciativa privada haveriam por emprestar ferramentas hábeis a esse desiderato, sugerindo o estudo e a implementação de estratégias que minimizem os efeitos perniciosos da pena convencional. O propósito último é estabelecer processos interativos que liguem a sociedade ao infrator com vista à inclusão desse último à vida social / The broad aim of this dissertation is critically develop a social and legal analysis of the actual, situation of the political system of imprisonment in the penitentiaries of Brazil. Specifically, the focus of the research is directed toward those people who were condemned to imprisonment through long length sentences, due to have been accused and convicted of serious crimes against individuals, the social order and its security. The hypothesis raised here based upon careful empirical observations is that the State, alone, is weak and unprepared to cope with programs of re-socialization of these people; there is no serious academic and educational strategies directed to help them to reach dignity and professional and social respectability; nor have been introduced effective policies toward a professional training, or re-training, in order to integrate them in industrial or commercial activities. By contrast, what has happened is that prisons have frequently be transformed in a web of delinquence, tying, inside and outside the prisons, criminal leaders and their gangs. So, once they leave prison, (when and if they do) they are again engaged in different types of criminal actions. Objectively, this research tries to conceive a new and revolutionary project, on the basis of establishing agreements between state partners and private ones, concentrating both money, social services, and technologies, able to provide educational and professional means and efforts, not only in order to low the level of criminality, but mainly to create new and more effective alternatives to the prisoners to reach moral, social and professional reintegration within the community, as well as regain their citizenship

A study of the participation of Vhembe District Community Corrections Forum (CCF) members in the re-integration of ex-offenders into the community

Thesis (Ph.D. (Criminology)) -- University of Limpopo, 2016 / Community involvement in ex-offenders’ re-integration is an important issue in efforts to reduce recidivism and to control overcrowding in our correctional facilities. Crime is a social problem which requires society to come together to fight against. The Department of Correctional Services (DCS) introduced Community Corrections Forums (CCFs) with the aim of controlling re-offending by ex-offenders. CCFs were established in each region to bring the community, business and stakeholders together to facilitate rehabilitation and re-integration. This study was conducted in the Limpopo Province, in Vhembe District Municipality within four local municipalities, namely Musina, Makhado, Mutale and Thulamela. A total number of 30 participants were interviewed and all were members of Community Corrections Forums. This was necessitated by the fact that Musina is a very small area which compelled the Department of Correctional Services to combine the two (Musina and Makhado) into one social re-integration entity. This is a qualitative research study where participants were selected through the use of purposive sampling. Participants were selected based on the value they would add to this study in order to achieve objectives. The data collection method of this study was the focus group which comprised by 3 groups of 10 participants each. Thulamela and Mutale local municipalities formed a group with (10) participants each whereas Musina (2) and Makhado (8) formed another. Results indicate that the current situation is not conducive for re-integration to be successful. CCF members raised many factors that need serious redress, namely offenders’ discrimination, lack of forgiveness by members of the community which is fuelled by lack of community awareness due to lack of education of communities by the Department of Correctional Services on reduce space of ex-offenders’ re-integration. The relationship between CCF and DCS raises many questions based on the results. Without a good working relationship between these two offices, the study observed that there would be no successful re-integration policy. Theoretical implications of the investigation based on labelling theory are discussed, together with practical applications for ex-offenders. The latter face daunting barriers to successful re-integration. Successful re-entry requires strong community support networks and comprehensive services by DCS, both of which are lacking in Vhembe District.
