In Peru, the amparo process is the most widely used constitutional process, and   one of the most important ones. For that reason, there is a strong need to analyze in detail this emblematic legal form, as the next questions should be answered: has the amparo process always hadthe same regulation in Peru? What is the importance of the Constitutional ProcedureCode and the Constitutional Court regarding this process?In this article, the author conducts the mentioned analysis in a remarkable way, providing answers to those and other questions from a historic and legal point of view. / En el Perú, el amparo es el proceso constitucionalmás utilizado y uno de los más importantes. Perceptions of women's freedom of movement in the Avenues suburb in Zimbabwe

This study explores perceptions of women’s freedom of movement since the 27 May 2015 Constitutional Court ruling CCZ 15/15, outlawing arbitrary arrests of women after dusk on grounds of loitering with intent to solicit for prostitution, focusing on Zimbabwe’s Avenues community. It traces issues surrounding women’s mobility under patriarchy since colonialism which through the 1960 Vagrancy Act marked the inception of its legal regulation premising stereotypic arrests by state agents. Guided by Pragmatic and Feminist philosophy the researcher adopts a Mixed Method Strategy to gather new knowledge on the complex issue. Employing Radical Feminist Theory under Feminism it critiques government efforts and their efficacy towards ensuring gender equality in mobility. The study argues that while useful legal mechanisms and laws have been adopted to enable women’s right to mobility, ideological and physical challenges continue to hamper this realisation. Empowering the Gender Commission with binding powers, ensuring sufficient security in public areas and educating women about their rights are some recommendations proffered to address challenges faced by women in the exercise of their right to movement. / Development Studies / M.A. (Development Studies)

The impact of the political question doctrine on decision-making of judges of the Constitutional Court of the Czech Republic Abstract The thesis deals with the influence of the political question doctrine on decisions of the Constitutional Court of the Czech Republic. It explains the meaning of the political question in the United States, describes what the possible Czech political questions could be and outlines reasons for judicial restraint in the cases lying on the boundary of law and politics. The first part of the thesis briefly presents relations between constitutional law and the part of politics which is closely connected to the constitutional judiciary. This relationship is explained by a phenomenon called the judicialization of politics which describes the growing role of constitutional courts in solving political controversies and policy questions. Moreover, to better understand the impact of the political question doctrine on decision-making of Czech constitutional judges, the second part of the thesis deals with the origin and an establishment of this doctrine in the Supreme Court of the United States, and indicates its future development. The diploma thesis deals mainly with four topics - the rule of law, democracy, the democratic state governed by the rule of law and its real form in the Czech Republic during the global pandemic of COVID-19. The development of the rule of law, democracy and the democratic state governed by the rule of law continues and is influenced by the challenges that arise over time. The original formal conception of the rule of law was focused primarily on the observance of the rule of law, while the material conception already takes into account certain value aspects and fundamental human rights. Today's form of democracy differs significantly from its original ancient Greek definition. It was originally intended to be applied to small homogeneous units in which individuals would participate in voting on all important matters. Over time, however, it began to apply to large nation states, which required the adoption of the institute of council. A democratic state governed by the rule of law is a concept based on the dynamic balancing of the components between which a certain tension may arise. Its ideal is fulfilled by a situation where its individual aspects are continually improved in the most balanced way possible. Legal and Extralegal Factors in Argumentation and Decision-making of the Constitutional Court of the Czech Republic Abstract The thesis deals with the influence of legal and extralegal factors on the decision-making of the Constitutional Court of the Czech Republic. Particularly, it focuses on the questions of which preconditions for decision-making of the Constitutional Court are created by the external political and social environment, how this decision-making reflects the different attitudes and approaches of individual judges and how it is influenced by the composition of the judicial panels. The author first summarizes a wide range of factors whose influence on court decisions has been observed. These include not only the content of legislation, but also judicial philosophy, including activism and self-restraint, and various extralegal factors observed by the attitudinal and strategic model of judicial decision-making, but also by psychological and economic studies. Subsequently, the thesis focuses on the Constitutional Court of the Czech Republic. Thesis (LLM)--Stellenbosch University, 2002. / Some digitised pages may appear illegible due to the condition of the original hard copy / ENGLISH ABSTRACT: This thesis is a response to the judgment of the Constitutional Court in South African Personal Injury Lawyers v Heath, in which certain provisions of the Special Investigating Units and Special Tribunals Act were subjected to constitutional review. The outcome of the case was the striking down of certain provisions of the Act as unconstitutional, and the removal of Judge Willem Heath from his position as head of the Unit. The provisions were said to infringe upon the principle of separation of powers, an implicit term of the Constitution of South Africa. This principle affects the extent of the judicial power because of its influence on determining the acceptability of extra-judicial functions. The doctrine of separation of powers is therefore considered in its historical and theoretical context, with particular reference to the way in which it tends to limit or define the role of judges. Following this analysis, the status of institutions supporting constitutional democracy is examined, and the legislation governing Special Investigating Units is compared with that which regulates the office of the Public Protector. As a result, some alternative legislative means of achieving the ends of the Units, namely the combating of state corruption and maladministration, are suggested. / AFRIKAANSE OPSOMMING: Hierdie tesis volg op die uitspraak van die Grondwetlike Hof in South African Personal Injury Lawyers v Heath, waarin sekere bepalings van die Wet op Spesiale Ondersoekeenhede en Spesiale Tribunale aan grondwetlike hersiening onderwerp is. Die uitkoms van die saak was dat sekere ongrondwetlike bepalings van die Wet ongeldig verklaar is, en dat Regter Willem Heath van sy posisie as hoof van die Eenheid onthef is. Dit is bevind dat die bepalings die beginsel van skeiding van magte, 'n implisiete term van die Suid-Afrikaanse Grondwet, geskend het. As gevolg van sy invloed op die bepaling van aanvaarbaarheid van buite-juridiese funksies, beïnvloed dié beginsel die omvang van die juridiese mag. Die skeiding van magte leerstuk word dus in sy historiese en teoretiese konteks oorweeg, met spesifieke verwysing na die manier waarop dit neig om die rol van regters te beperk of te omskryf. Na hierdie analise word die status ondersoek van instellings wat grondwetlike demokrasie ondersteun, en die wetgewing wat die Spesiale Ondersoekeenhede beheer, vergelyk met dié wat die Openbare Beskermer reguleer. Šis magistrinis darbas tema „Lietuvos Respublikos Konstitucinio Teismas ir įstatymų leidyba“ yra skirtas išanalizuoti Konstitucinio Teismo įtaką įstatymų leidybai. Lietuvoje, kaip ir visose kitose demokratijos tradicijas turinčiose šalyse, svarbu užtikrinti tinkamą konstitucinę kontrolę, kad būtų garantuotos pagrindinės žmonių teisės ir laisvės, svarbiausių visuomeninių santykių konstitucinis reglamentavimas. Lietuvos Respublikoje konstitucinės kontrolę atlieka Konstitucinis Teismas. Lietuvoje institucinė valstybinės valdžios sąranga grindžiama valdžių padalijimo principu. Vadinasi kiekviena valdžios sistemos grandis atlieka tik jai patikėtas funkcijas. Šiuolaikinėse demokratinėse valstybėse teisminė valdžia veikia kaip savarankiška valstybės valdžia, nepriklausomai nuo įstatymų leidžiamosios ir vykdomosios valdžios. In the Republic of Lithuania the constitutional control is perforemd by the Constitutional Court. In Lithuania the system of the institutional authority is based on the partition of powers. This thesis aims to analyze legislation of the Czech legal order concerning religious freedom. The work is divided in two parts. The first part of the thesis deals with the definition of religious freedom in the first place. Afterwards the thesis describes the Constitutional law relating to the religious freedom (especially the Article No. 15 and No. 16 of the Charter of the Fundamental Rights and Freedoms of the Czech Republic), international conventions relating to the theme (e.g. The Universal Declaration of Human Rights, The International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights etc.) and further statutory provisions and legislative rules guaranteeing religious freedom in the Czech Republic.
