An Investigation On The Application Of Standard Contracts In The Turkish Construction Industry

Construction contracts are one of the most important tools in the construction sector. They define the various aspects, obligations and relations between each party that are necessary to reach a common expected goal. They contribute to successful completion of projects. Turkish construction companies have successfully completed many projects in domestic and international venues and gained important experience in this respect / however, they still encounter problems in application. The aim of this study was: - to analyze Yapim &amp / #272 / slerine Ait Tip S&ouml / zlesme (Standard Contract for Construction Works, YIATS) of Kamu &amp / #272 / hale Kurumu (Public Procurement Authority KIK) and F&eacute / d&eacute / ration Internationale des Ing&eacute / nieurs-Conseils (International Federation of Consulting Engineers, FIDIC) standard contract for construction / - to identify problem areas and their causes in application of contracts / - to compare YIATS and FIDIC contracts with respect to problem areas / - to analyze views, experiences and recommendations of companies about YIATS and FIDIC contracts. In this study, based on survey conducted on contract literature, questionnaire was applied to member companies of T&uuml / rk M&uuml / teahhitler Birligi (the Turkish Contractors&rsquo / Association, TMB). Applied standard contracts, Court of Cessation decisions and International Chamber of Commerce (ICC) arbitration awards were analyzed to determine problem areas. Telephonic and face-to-face interviews were performed with staff of companies for further information on their answers, their opinions and recommendations on problem areas. Additionally, hypotheses were tested: to determine the effect of existence of clauses on exposure of contractors to consequences of problems emerged in execution phase of contract / to analyze relationship between problems encountered in FIDIC or YIATS and financial, temporal and non-compliance problem areas / to analyze effect of cost determination method on emergence of problems related to these areas. These studies revealed main problem areas as: financial, temporal and non-compliance issues.

Processos licitatórios: legislação e formalização

Este projeto de mestrado objetiva trazer aos responsáveis pelas áreas de aquisição das Instituições Federais de Ensino Superior (IFES), principalmente às da Universidade Tecnológica Federal do Paraná (UTFPR), esclarecimento a respeito da atual legislação aplicada ás licitações, bem como a proposição aos seus Administradores de modelos para os processos de licitação, a fim de padronizá-los, trazendo melhorias em seu desenvolvimento, reduzindo custos e eliminando retrabalho. O método adotado nesta pesquisa foi o estudo de caso, que envolve estudo profundo e exaustivo de um determinado tema, de modo a permitir conhecê-lo de forma ampla. O estudo também foi fundamentado na pesquisa documental dos processos licitatórios elaborados pela Reitoria da UTFPR, de 2010 a abril de 2012, nas notas técnicas emitidas pela Procuradoria Jurídica da UTFPR (PROJU) e nas constatações colhidas no portal da Controladoria Geral da União (CGU). De posse das informações, optou-se, como instrumento de coleta de dados, a elaboração de um questionário, que foi respondido por servidores da UTFPR atuantes nas áreas de licitação, da Auditoria Interna e da Procuradoria Jurídica. Como resultado da pesquisa foi apresentado a legislação e os procedimentos para a realização de uma licitação, bem como os modelos, com os requisitos e fases da licitação, para as modalidades de Concorrência Pública, Tomada de Preços, Convite, Cotação Eletrônica, Inexigibilidade, Dispensa, Pregão Eletrônico e Ata de Registro de Preços. / This master's project aims to bring those responsible for the areas of acquisition of Federal Institutions of Higher Education (IFES), especially at the Federal Technological University of Paraná (UTFPR) clarification regarding the current legislation witch ace bids, as well as the proposition their administrators bidding process models in order to standardize them, bringing improvements in their development, reducing costs and eliminating rework. The method adopted in this scientific research was the case study, which involves deep and thorough study of a particular topic, to enable it to meet broadly. The study was also based on desk research of bidding process developed by the Rectory of UTFPR the years 2010 to April 2012, in the technical notes issued by the Legal Department of UTFPR (PROJU), and the findings taken from the portal of the Comptroller General's Office (CGU). As a result of the research were presented legislation and procedures for conducting a bidding, and models, with the requirements and stages of bidding for the modalities of Competitive Bidding, Socket Pricing, Announcement, Electronic Quotation, Unenforceability, Utility , Electronic Trading and Price Registry Act.

Les ruptures d'un commun accord du contrat de travail / Modes of termination of the employment contract throught mutual agreement

Longtemps délaissé, l’accord est aujourd’hui au coeur du processus de rupture du contrat de travail. A la suspicion qui entourait l’expression commune des volontés est substituée la confiance. La légalisation de la rupture d’un commun accord du contrat de travail par la loi du25 juin 2008 sous le nom de rupture conventionnelle en témoigne. Cette réforme a bouleversé le droit de la rupture du contrat de travail. Même s’il est acquis depuis longtemps que les parties peuvent mettre un terme d’un commun accord au contrat qui les unit sur le fondement de l’article 1134 du Code civil, cette modalité de rupture n’a longtemps été utilisée que de manière très ponctuelle. L’absence d’encadrement de cette technique et les restrictions apportées à son champ d’application l’expliquent en partie. La reconnaissance du commun accord comme mode de rupture spécifique du contrat de travail, auquel est attaché un régime précis et autonome, pourrait signifier la fin de l’utilisation de la rupture d’un commun accord de droit commun, considérée comme peu adaptée aux relations de travail. Un tel régime pourrait également mettre un terme au monopole détenu par les ruptures unilatérales, en particulier le licenciement. Une large prise en compte du dispositif de rupture conventionnelle est de nature à contribuer à l’apaisement et à l’équilibre des relations de travail. / Initially relinquished, mutual agreement is now at the heart of the process of terminating the employment contract. There has been an evolution tending to the shift from suspicion towards mutual agreement as a termination device to the trust in such means. This acquired trust is best illustrated by the recognition of employment termination via mutual agreement by the Act dated June, 25th 2008. The reform introduced by this Act transformed the legal regime applicable to the termination of employment contracts. Despite the fact that Article 1134 of the French Civil Code has long granted parties the possibility to terminate the contract binding them by mutually agreeing to do so, such mode of termination has only been resorted to on a fairly limited basis. This phenomenon can notably be explained by both the lack of clear legal framework applicable to this device, and the restrictions imposed on its ambit. The recognition of termination of the employment contract via mutual agreement as a device specifically applied in the field of labor law, as well as the definition of a specific and independent regime would be likely to give rise to ending the resort to Article 1134, whose scope is only general and not specifically tailored to labor relations. The implementation of this specific regime could put an end to the monopoly held by unilateral terminations of the employment contract, particularly the method of dismissal. A broad consideration of termination of the employment contract via mutual agreement can also contribute to the appeasement and balance in labor relations.

Current issues concerning the duty of mutual trust and confidence in South African Labour Law

(Labour Law)) -- University of Limpopo, 2012 / In Joseph v University of Limpopo & Others (JA14/09) [2011] ZALC 8 (13 May 2011) the Labour Appeal Court affirmed that there was unfairness in the process adopted by the employer in failing to renew the employee’s fixed term contract. This research paper examines the Labour Appeal Court’s reasoning in this case, with particular focus on the development of an implied term that each party to an employment contract owes the other a mutual duty of trust and confidence, and general reasonable behaviour. This paper further argues that mutual trust and confidence in the employment context protects the legitimate expectations of employees by serving as a bulwark against illegitimate conduct or acts of on the part of the employer designed or likely calculated to destroy the employer-employee relationship, thereby ensuring fuller protection of an employee’s constitutional rights. Joseph v University of Limpopo & others is of great significance. It indicates that the employer’s ability to rely successfully upon its prerogative not to renew fixed term contract where an employee has legitimate expectation of renewal may be contingent on its having acted in a manner consonant with mutual trust and confidence.

Compras públicas sustentáveis na UTFPR: estudo de caso do campus Curitiba – sede reitoria

CAPES / A presente pesquisa tem como tema central a análise das compras públicas realizadas na Universidade Tecnológica Federal do Paraná (UTFPR) sob o prisma da Sociedade Sustentável, da Educação Tecnológica e da Ciência do Direito. O objetivo principal foi verificar se as compras da UTFPR podem ser consideradas Compras Públicas Sustentáveis, a partir das contribuições dos aspectos teóricos de direcionamento da pesquisa nomeados de Unidades de Análise. O método empregado foi o Estudo de Caso, que se baseia em pesquisa exploratória e descritiva do tipo mista (quantitativa e qualitativa). Da análise dos 507 arquivos de pregões eletrônicos realizados pela UTFPR no período escolhido, constatou-se que, dos 14.758 itens comprados, poucos traziam previsões específicas sobre a sustentabilidade. Em função destes resultados, foram propostas linhas de referência traçadas especificamente para o caso das Compras Públicas da UTFPR. A intenção foi colaborar para que esta Instituição Tecnológica de Ensino Superior possa demonstrar um comprometimento com as normas e princípios vigentes no Direito Ambiental e com a Sociedade Sustentável, o que lhe permitirá tornar-se uma referência para outras Instituições que realizem compras públicas. / This research focuses on the analysis of public procurements made by the Federal Technology University of Paraná (Universidade Tecnológica Federal do Paraná - UTFPR) from the perspective of the Sustainable Society, the Technological Education and the Science of Law. The main objective was to verify by applying these guiding theoretical aspects – named herein as Analysis Units – whether UTFPR purchases can be considered as Sustainable Public Procurements. The methodology employed for it has been a case study based on a mixed type (quantitative and qualitative) exploratory and descriptive research. Based on the analysis of 507 records of electronic auctions conducted by UTFPR in the chosen period, it was found that, out of the 14,758 items purchased, very few of them contained specific references to sustainability. According to these results, reference guidelines were specifically drawn for the case of the UTFPR Public Procurements. The purpose has been to contribute to this higher education technological institution o that it can demonstrate a clear commitment with the current rules and principles of Environmental Law and the Sustainable Society, becoming a model for other institutions performing public procurement.
