Examining Orders of Protection: An Analysis of the Court System in a Rural Tennessee County.

To provide safety to domestic violence victims, law reform efforts provided victims with a civil remedy in which a judge orders the abuser to stay away from the victim. The research uses 1 rural county judicial system data to evaluate protective orders. Findings indicate that 42% of petitions are dismissed by petitioner's request or failure to prosecute. Moreover, court fees are not recouped in 79% of the cases. Logistic regression analysis indicate that an intimate relationship between the parties and payment of court costs by petitioner increased the probability of dismissal of petition upon petitioner's request; use of a gun and request to protect children increases the probability of applying the Brady Act; stalking and the issuance of the order of protection without social contact increased the probability of violations.

Denna uppsats skall genom granskningar av domstolsprotokoll, och dess beslutsgrundande motiveringar, undersöka hur tvångsingripande åtgärder vid missbruk enligt LVM-lagstiftningen tillämpas. Intentionen är försöka finna de underliggande och uppbyggda formuleringar som rättfärdigar den svenska staten, att via socialtjänst och förvaltningsrätter frihetsberöva och tvångsvårda medborgare mot den enskildes vilja. Är det inte den fria medborgarens rättighet att leva sitt liv som den önskar även om det anses som ett destruktivt leverne? Empirin är av mig uppbyggd utifrån de diskurser som blottläggs vid undersökningen. Syftet med sammanställningen av de olika diskurserna och begreppen som förekommer i dessa domstolsbeslut är att ge insyn i en verksamhet som med stor säkerhet går allmänheten förbi. Detta kan förklaras med att detta rör en sådan i periferin existerande grupp av människor. Jag vill vidare påvisa ett kritiskt tänkande kring fenomenet och slutligen ge förslag till en förändring av företeelsen. / This investigation will examine, through audits of court protocols, and its motivational reasons, how enforcement measures are applied in the event of abuse under the LVM legislation. To try to find the underlying and also the case-formulated formulations that justify the Swedish state, through its municipalities' social services and administrative rights, to the detention of the individual's detention and coercion for citizens. Is not it the free citizen's right to live his life as it wishes even if it is  considered a destructive delivery? The empirin is built on the basis of the discourses exposed to the investigation. The intention of compiling the different discourses and concepts contained in these court decisions is to provide insight into an activity that surely passes the public when it comes to such a peripheral group of people as well as to demonstrate critical thinking about the phenomenon and finally suggest a change of the phenomenon

Florida Nonpartisan Trial Court Elections: An Analysis of Voter Turnout and Ballot Roll-Off

This research explains the variance in voter turnout and ballot roll-off in county and circuit nonpartisan judicial elections in Florida from 2014 and 2016. Based on theory, a collection of constituent (demographic and socioeconomic), candidate, competition, and contextual variables is gathered to construct four regression models. Two full regression models were constructed for turnout and roll-off and analyzed using SPSS software, in addition to two best regression models analyzing five statistically significant variables found within each full model. Presidential year elections and higher populations age 65 and up had positive impacts on voter turnout, while primary elections, campaign expenditures, and populations of minor (other) party registered voters had statistically significant negative effects on turnout. Increases in ballot roll-off were associated with presidential year elections, and populations with more college degrees, higher median household income, and higher percentages of voters registered with no party affiliation or minor political parties. Roll-off decreased in primary elections. While various contextual, competition, and constituent variables had significant impact on both turnout and roll-off in Florida judicial elections, candidate characteristic variables had no significant impact on differences in voter turnout and ballot roll-off.
