Conscience et création en droit d'auteur / Consciousness and creation in copyright law

Le droit et la conscience entretiennent une relation évidente, mais ambigüe. Plusieurs auteurs ont déjà été séduits par ces rapports, mais aucun ne s’est encore intéressé aux relations qui existent entre la conscience et le domaine spécifique de la science juridique qu’est le droit d'auteur. Pourtant, le droit d'auteur n'est pas indifférent à la notion de conscience. La conscience s’entend de deux acceptions : la conscience morale, qui renvoie à la distinction du bien et du mal, et la conscience psychologique, qui désigne l’appréhension que l’homme a de lui-même et du monde qui l’entoure. Chacun de ces deux aspects de la conscience se retrouve en doit d’auteur. La conscience morale est en principe indifférente en droit d’auteur : ses liens avec la liberté artistique en font un domaine amoral. Mais la liberté artistique n’est pas sans limite. Or ces limites posées à la liberté artistique se répercutent sur l’exercice, et parfois même sur l’existence du droit d’auteur. L’indifférence affichée du droit d’auteur pour la conscience morale s’effrite alors, laissant apparaître des hypothèses de prise en compte de la moralité, ou plutôt de l’immoralité de l’œuvre. La conscience psychologique, au contraire, semble jouer un rôle nettement plus fondamental en droit d’auteur. Malgré le silence du législateur, la majorité des membres de la doctrine conditionnent la reconnaissance de la protection par le droit d’auteur à la conscience de la création. Il faut alors distinguer les différents éléments de la conscience psychologique de l’auteur : son discernement, sa volonté de créer et sa maîtrise du processus de création sont les trois conditions doctrinales rattachées à la conscience de la création. Or aucune de ces trois conditions n’est appliquée systématiquement et il apparaît qu’elles ne sont pas justifiées, ni même nécessaires. Une relecture de la conscience de la création s’impose alors. Dans un jeu de miroir, la conscience morale et la conscience psychologique jouent un rôle en droit d’auteur qui n’est pas celui que l’on attend d’elles : la conscience morale entre inévitablement en compte alors qu’elle est affichée comme indifférente, la conscience psychologique joue selon la doctrine un rôle discriminant qui n’est pas celui qui lui revient. / Connections between law and consciousness are obvious but ambiguous, and this statement is undeniable in the specific field of legal science that is copyright law. Consciousness can have two sides: a moral one, which refers to the distinction of right from wrong, and a psychological one, which mainly refers to a man’s awareness. Each of these two aspects of consciousness can be found in copyright law. In theory, moral conscience is irrelevant in copyright law: its links with artistic freedom make it an amoral field. But artistic freedom has its limits, which often impact on the exercise, and even sometime on the very existence of copyright. Then the indifference displayed by copyright law towards moral conscience crumbles. At the opposite, the awareness seems to play a key role regarding copyright law. In spite of the legislator’s silence, most of the doctrine’s members grant copyright protection based on the artist’s awareness of his creation. His judgment, his will to create, and his control of the creating process are the three doctrinal conditions resulting from the requirement of awareness. However, none of these three conditions is systematically applied, and it seems like they are not grounded, or even necessary. The requirement of awareness creation then must be rethought. Through a game of mirrors, moral conscience and awareness play unexpected parts in copyright law. While being displayed as irrelevant, moral conscience is inevitably taken into account, whereas awareness is interpreted as a discriminatory exigency, role it should not play.

The Communication Decency Act became law in 1996 and was immediately challenged on Constitutional grounds. It was subsequently declared unconstitutional based on the First Amendment guarantee of free speech. Using Fantasy Theme Analysis, an analysis of the dramatic elements of the key players was accomplished. The dramatic elements of Overall Theme, Abstract Concept, Hero/Villain interaction and Emotion were the focus of this analysis. The key players have been named the Antiobscenity Crusaders, the Defenders of Liberty and the Homesteaders after the roles they play. The focus of the analysis was an examination of how these groups rhetorically construct the internet as they attempt to persuade the Supreme Court about the Constitutionality of the Communication Decency Act. / Graduation date: 2000

PhDr. Jan Sokol, CSc., Ph.D. 2020 ANNOTATION The increase in private wealth in our cultural circuits has been unprecedented which fosters growth in private philanthropy. Charitable giving has been on a rise throughout the western world, including the Czech Republic, where we can document long-term and steady growth in both the number of charitable gifts as well as in the amount donated. In parallel, on the beneficiary side, there is a stabilized sector of well-established civic organizations covering the standard array of charitable topics. We may state that following 1989, the Czech civic sector has been revived, showing - despite all challenges - most signs of healthy maturing. In this paper, we attempted to capture the cultural and social context of philanthropy from the point of view of practical philosophy. We examined the rich roots of philanthropy and described the processes of its institutionalization until now. As a result of this work, it was revealed that there is a connection between openness to experience and trust among employees of a company or enterprise. As a result of correlation analysis, it was found that openness to experience is interconnected with trust in an organization with positive reliable relationships. The result of the comparative analysis conducted in the research groups showed that the level of employee confidence directly depends on their level of openness to new experience and innovations. / В результате проведенной работы было выявлено, что существует связь между открытостью к опыту и доверием среди сотрудников компании или предприятия. В результате корреляционного анализа было обнаружено, что открытость опыту взаимосвязана с доверием к организации с положительными надежными отношениями. Результат данных сравнительного анализа, проведенного в исследовательских группах, показал, что уровень доверия сотрудников напрямую зависит от уровня их открытости к новому опыту и инновациям.

'The Fabric of Life: Linen and Life Cycle in England, 1678-1810' is structured around the human life cycle to draw out the social and cultural importance of linen for all ranks of society. Human and object life cycles are juxtaposed in the thesis to analyse co-dependent activities and processes rather than focusing on one facet of daily life. For thousands of years flax was a staple fibre, used for textile production in many parts of the globe. Cotton only overtook linen as the most popular textile in England at home and on the body during the nineteenth century. This thesis examines the preceding century to reveal why linen remained a daily necessity in England between 1678 and 1810, a period which encompassed a series of significant changes in the production, trade and use of linen. Linen was ubiquitous as underwear, sheets, table linens and for logistical purposes therefore it provides a unique insight into the early-modern world; a means of understanding the multifaceted experiences of daily life, of integrating understandings of the body, domestic, social, cultural and commercial activities. This thesis is social history through the lens of linen, reading a society through its interactions with a textile.

In the present thesis, I focus on the comprehensive legal framework for the legal instrument of compensation for non-pecuniary harm that was sustained by secondary victim(s), i.e., a person or persons not affected directly who are close relatives to primary victims, differing from primary victims whose interest is secured by article 2958 of the Civil Code (designated as smart money and compensation for aggravation of social position). It is these secondary (indirect) victims who sustain non-material harm through mental suffering that is a natural reaction to the death or grave injury of the primary victim who is their close relative. They are also provided for by law by means of the special provision of article 2959 of the Civil Code, which allows them to seek adequate pecuniary settlement from the offender, aimed at mitigating the pain upon either the loss of a close relative or their permanent and irreversible grave impairment that requires permanent care. ! !
