Protection of Persons with Disabilities in Employment Relationships Abstract This thesis analyzes the current state of legal protection of persons with disabilities in the Czech Republic. The aim of the work is not only passively interpret the existing statutes, but also propose some changes "de lege ferenda" that would lead to greater protection of the rights of persons with disabilities. The author does not attempt to provide a full-scale reasoning of the issue, but focuses on selected institutes of labor law and social security law in part, especially in the field of employment of persons with disabilities. The thesis is divided into seven chapters that logically follow each other and gradually reveal the specifics of protection of persons with disabilities in different parts of the legal system. The first chapter is devoted to the concept of "persons with disabilities", its historical development and comparison of the Czech legislation and international regulation. The second chapter concerns the fundamental rights of persons with disabilities in employment relations, protected by international treaties, constitutional and labor law. La liberté de connaître une intimité, une vie sexuelle et amoureuse participe de la construction subjective et de l’édification de relations interpersonnelles. Elle n’est pas également accessible à tous. Les personnes en situation de handicap liée à une déficience motrice, accueillies en établissement médico-social, en font douloureusement l’expérience. Leur dépendance fonctionnelle a comme conséquence un besoin quotidien d’aide et de soins de la part de professionnels qui interviennent dans toutes les dimensions de leur vie. Par conséquent, ceux-ci se trouvent concernés par des aspects de l’intimité, de la sexualité ou de la vie amoureuse des personnes qu’ils accompagnent. Si la visée première de la thèse est de mettre en lumière les expériences, les aspirations des personnes ayant une déficience motrice et vivant en établissement concernant l’intimité, l’amour et la sexualité, elle s’intéresse aussi à ce que les professionnels en disent. Des entretiens conduits avec les unes et les autres font apparaître une divergence, amenant à s’interroger sur la nature de l’écart constaté entre le discours des personnes et celui des professionnels concernant l’intimité, la vie amoureuse et la sexualité et la compréhension qu’on peut en avoir. Partant, trois dispositifs de recherche sont mis en œuvre : la passation d’un questionnaire, l’observation de groupes d’analyse des pratiques professionnelles et l’animation de groupes de paroles. Les données recueillies révèlent que la quête de reconnaissance et de « normalité » des personnes en situation de handicap se heurte à l’influence négative du contexte de vie en établissement, entravant leur liberté, et à la persistance d’une vision essentialiste du handicap chez les professionnels, induisant des pratiques inadéquates. / Freedom of knowing intimacy, sexuality and love participates to subjective construction and to interpersonal relationships’ building. It’s not equally accessible to everyone. Physical disabled people living in special institutions painfully experience it. Their functional dependency leads to a daily need for help and care given by professionals who intervene in each and every aspect of their life. As a consequence, professionals are concerned by some dimensions of intimate, sexual or love life of people they are caring of.If the main designs of the PhD is to highlight experiences and wishes of physical disabled people living in institutions towards intimacy, love and sexuality, we are also interested in what professionals say about this. Interviews conducted with disabled people and professionals reveal a divergence leading to question the the nature of the gap existing between disabled people’s and professional’s speeches and how we can understand it.From then on, three methods are implemented to collect data: administrating a questionnaire, observing supervision groups and animating focus groups. Data collected show that disabled people’s quest for recognition and “normality” faces the negative influence of their living context hindering their freedom and the persistence of professionals’ essentialist view of disability leading to inadequate practices.

This master thesis deals with the design of a new sports center. The capacity of the sports center is 90 visitors and 12 employees. The building is designed as a two-storey, for disabled people and constructed by sandstone brick block with a flat roof. On the first floor is a main and staff entrance, a café, squash, 3 saunas (men, women, mixed), 2 rehabilitation rooms and staff room. On the second floor is a gym, HEAT, spinning, a mirror and gym hall, gallery and staff room. Part of the proposed building is a car park with a capacity of 70 parking spots (4 parking spots for disabled people) and 1 bus stop. Car park for staff has a 16 parking spot.

The main goal of this diploma project is detailed design documentation of the House with hospic care, Litomyšl. The building consists of two upper ground floor levels. First ground floor is partially recessed into the terrain. The layout responds to the main purpose of the building - healthcare and social centre. Hospic is located on the edge of the city, it has the L-shaped form. The area with rooms for patients is distributed along the southern facade. The objective of connecting the interior and garden in the courtyard has been considered while forming the exterior finishing surfaces. The capacity of the hospice centre is 15 beds. The building structure is made of masonry walls with reinforced concrete slabs and combination of single sloped roof with flat roof.

This dissertation thesis focuses on the philosophical aspects of the relationship of Man toward the city. The main methods of the work are interpretation of texts connected with the city and a philosophically inspired analysis of the bond of Man with the city as a space and time constructed, inhabited and shared by humans, and with its experienced phenomena. First of all it presents the method by which the theme of the city has been dealt with by scholars from the field of philosophy and other social sciences. We find the theme of the city in the works of a whole range of philosophers: For example, it served J. A. Comenius as a symbol of human situation in life, Michel Foucault as a point of departure for his political-philosophical analysis of power, and Emmanuel Lévinas for his discourse on culpability, punishment and responsibility. In order to understand the phenomenon of the city, observations from sociologists, architects, town planners and historians of architecture are also important. The thesis deals primarily with the description, analysis and framing of public policy issues with regard to handicapped athletes. The main aspect of this work is to identify the most problematic areas with which disabled athletes normally meet in reality. The thesis also includes the state of the current sports environment in the Czech Republic. This condition is presented primarily with regard to disabled athletes. It is clear from other research that the position of disabled athletes is currently largely neglected. In the next part of the thesis it is important to find out how disabled athletes are designed in the Czech media. This is followed in the analytical part of the thesis is the analysis of the media situation with access to disabled athletes. The work brings an analysis of newspaper articles between the Olympic Games in 2012 and 2016. By analyzing newspaper articles creates the concept of the most burning problems with which work is finally being done. The key task of the thesis is to provide a holistic view of the overall picture of handicapped athletes in the Czech Republic. Due to declining employment in the last few years, employee motivation has become a very real issue in social services. The subject of the diploma's thesis is the analysis of the motivation of workers in social services (personal support workers) in three organizations providing community living for disabled people in the Karlovy Vary region. The theoretical portion of the thesis contains information about motivation, some theories of work motivation and selected theories of human resource management regarding work motivation, plus a section on social services about community living for disabled people and the role of the manager in social services. Within the empirical part of the thesis two goals are met through the methods of mixed research. One goal is to analyze the motivation of workers in social services, which resolved using a questionnaire survey. That research identified factors causing employee satisfaction and factors that motivate employees. The second goal of the thesis is met in form of structured interview to determine how managers in the researched organisations motivated employees. Personer med funktionsnedsättning är en utsatt grupp som lider av sämre hälsa än övriga befolkningen, vilket ser lika ut i hela världen. I Sverige är ohälsa hos personer med funktionsnedsättning vanligt förekommande och relaterad till ohälsosamma levnadsvanor, vilka till stor del skulle kunna förebyggas. Distriktssköterskan har ett ansvar att arbeta hälsofrämjande och är den profession som vanligen ansvarar för hälso- och sjukvården hos personer med funktionsnedsättning som bor på en LSS-bostad. Syftet med studien var att beskriva distriktssköterskans upplevelse av hälsofrämjande arbete hos personer som bor på LSS-bostäder. En kvalitativ studiedesign användes och data insamlades vid tio semistrukturerade intervjuer, vilka analyserades med kvalitativ innehållsanalys utifrån en induktiv ansats. Resultatet visar på att distriktssköterskor upplevde det hälsofrämjande arbetet som komplext med flera faktorer som påverkar. Många distriktssköterskor upplevde en frustration utifrån brist på resurser i form av tid och organisatoriskt stöd. Personalen som arbetar på LSS-bostäder var en viktig komponent i det hälsofrämjande arbetet och utgjorde en positiv faktor när kompetens och engagemang fanns, likväl som ett hinder när dessa delar saknades. Resultatet visade att bristande kommunikativa förmåga och insikt i hälsosamma levnadsvanor hos personer med funktionsnedsättning kunde utgöra ett hinder i det hälsofrämjande arbetet. Slutligen visar resultatet på brister i distriktssköterskans hälsofrämjande arbete hos personer som bor på LSS-bostäder. Det behövs fortsatt forskning i hur distriktssköterskan bör arbeta hälsofrämjande och hur distriktssköterskans förutsättningar för det arbetet kan förbättras. / People with disabilities are an exposed group who are less healthy and more likely to suffer from illness than the rest of the population. In Sweden, there is a clear connection between people with disabilities and an unhealthy lifestyle. This health issue can be prevented though. Community health nurses are responsible to promote health for people with disabilities living in residence with special services in group housing. The intention with this study is to learn about the experiences community health nurses have while promoting health in group housing. 10 semi-structured interviews have been conducted with community health nurses working with disabled persons living in group housing. Qualitative content analysis was used to analyze the interviews. The result showed that all nurses experienced their health promoting work as complexed and challenging. They were frustrated with the inadequacy of support from their employer and lack of time to set aside for these tasks. The nurses described the staff working in group housing as essential for health promoting. The staff was described as a positive influence when they were engaged and competent in their field but could also work as an obstacle when they lacked those capacities. The result showed that the nurses experienced the lack of communication abilities and understanding in a healthy lifestyle of the persons with disabilities as the biggest obstacle in their work. Lastly, the results show deficiency in the health promoting work at the residences with special services in group housing led by the nurses. Further research is needed, both regarding the way health promoting work can be conducted by the community health nurse and how the work conditions best could be adapted. / <p>Godkännandedatum: 2020-11-04</p>

The analysis made located the historical movement of the conquest of this right in the cultural, political and social Brazilian dynamic that displaces the poor from their citizenship condition, struggled to approve the BPC in the Constitutional Convention, from which the 1988 Federal Constitution was originated, as well as discussed thoroughly the ambiguities that pass throughout the very own history of the social work in the Brazilian society. In the perspective to discuss thoroughly and contribute to the BPC consolidation, this study analyzed the support and resistance power in the process of the BPC constitution, discussed the nature of this benefit in the bounds of social work and identified the attempts of dismemberment and retrocession that surrounded its definition and implementation. It was also possible to think about BPC in its articulation with Unified System for Social Assistance - SUAS, its challenges and possibilities to include its beneficiaries in programs, projects and social work services. It's assumed that the social work is bound to social protection fields as one of the social politics that constitutes the Brazilian Social Security. Being so, to assume that the social protection as a right to all citizens expresses a rupture of a culture that forwards social rights to waged work, defining a new relation between the state and the society based on the conception of universal citizenship. From Campinas, SP, focusing on the BPC beneficiaries - elderly and disabled people and their interlocutors; this study tried to demonstrate the BPC perception as a social assistance right, highlighting the conditions of access and maintenance of this benefit, an identification of its expenses by the beneficiaries, its articulation with CRAS (Social Reference of Social Assistance Center), the social control and its interfaces with INSS (Social Security) related to its operationalization. As well as methodological procedures, documental and bibliographic research, this essay was based on empiric research with a qualitative approach and semi-structured interviews with BPC beneficiaries, social workers who work for CRAS (Social Assistance Reference Center), social workers responsible for the revision of this benefit in Campinas city, INSS (Social Security) solicitor and members of the City Council for the elderly and the disabled. The produce of this work is displayed in four chapters and the results show a fragile vision about BPC as a social assistance right with constitutional base, a consequence of a political culture with low inscription in the fields of human rights / Esta pesquisa procurou ressaltar o caráter inaugural do Benefício de Prestação Continuada BPC como um direito social não-contributivo, num país que historicamente teve como marca a cidadania regulada e que, portanto, nunca universalizou o trabalho assalariado e a proteção social para toda a população. A análise empreendida situou o movimento histórico de conquista deste direito na dinâmica cultural, política e social brasileira, que destitui o pobre da condição de cidadania, retomando os embates para a aprovação do BPC na Assembléia Constituinte que deu origem à Constituição Federal de 1988, bem como discutiu as ambigüidades que perpassam a própria historicidade da assistência social na sociedade brasileira. Na perspectiva de problematizar e contribuir para a consolidação do BPC, este estudo analisou as forças de apoio e resistência no processo de sua constituição, discutiu sua natureza no âmbito da assistência social e identificou as tentativas de desconstrução e retrocesso que cercaram a sua definição e implementação. Também foi possível refletir sobre o BPC em sua articulação com o Sistema Único de Assistência Social SUAS, os desafios e possibilidades para inclusão dos seus beneficiários em programas, projetos e serviços socioassistenciais. Partiu-se do pressuposto de que a assistência social se vincula ao campo da proteção social como uma das políticas sociais que compõem a seguridade social brasileira e que, desse modo, assumir a proteção social como direito de todos os cidadãos expressa a ruptura com uma cultura que remete direitos sociais ao trabalho assalariado, demarcando uma nova relação entre o Estado e a sociedade fundada na concepção da cidadania universal. A partir de dados coletados no município de Campinas (SP), focalizando-se os beneficiários do BPC idosos e pessoas com deficiência e seus interlocutores, buscou-se demonstrar a percepção do BPC enquanto direito socioassistencial, enfatizando as condições de acesso e manutenção deste benefício, a identificação do seu gasto pelos beneficiários, sua articulação com os Centros de Referência de Assistência Social CRASs o controle social e as interfaces com o INSS, no que diz respeito a sua operacionalização. Como procedimentos metodológicos, além da pesquisa documental e bibliográfica, a dissertação apoiou-se em pesquisa empírica com uma abordagem qualitativa, realizando-se entrevistas semi-estruturadas com beneficiários do BPC, assistentes sociais que trabalham nos CRASs, assistentes sociais responsáveis pela revisão do benefício na cidade Campinas, procuradores do INSS e membros dos conselhos municipais do idoso e da pessoa com deficiência. Theoretically speaking, this investigation is structured in a way that concepts of information, information society, disability and accessibility are carefully explored. The main goal is to look into the level of accessibility of Brazilian Government research web sites when it comes to disabled people, but also find out whether there is any indication that the discourse of digital inclusion, advocated by information society, is making a real difference for them. This investigation reveals that the access to contents of digital pages in the Brazilian Government web sites is still ineffective, presenting large amount of errors which means a high degree of difficulty for disabled people in general.
