Sujet à trop d’indéterminations en France, le concept de NCP a nécessité une analyse comparative fondée sur l’expérience italienne afin d’en identifier les contours et, par la suite, d’étudier sa place dans le droit. Il en ressort que les NCP renvoient à une multiplicité de catégories normatives de caractère axiologique et téléologique, servant de stratégie politique et structurant le système juridique. Par ailleurs, l’introduction de la forme programmatique dans les Constitutions modernes mêle l’indétermination de la norme dans son énonciation moderne au droit dans sa déclinaison traditionnelle. Les programmes ont ainsi du mal à trouver leur place dans le droit. Les NCP semblent a priori être privées d’effet juridique ; leur formulation imprécise ne mettrait en place que de simples objectifs. Toutefois, leur développement dans l’espace juridique paraît suffisamment important pour qu’il ne soit pas assimilé à une malfaçon du droit qui entacherait sa pureté. En effet, le concept NCP renvoie à de véritables « normes » constitutionnelles programmatiques dont la normativité reste particulière, signe non pas d’une « crise » du droit mais de son « évolution ». / Still subject to a certain level of vagueness in France, the concept of programmatic constilutional norms (PCN) required acomparative analysis based on the Italian experience in order to identify its trontiers and subsequently study ils place in law. Il appears that the PCN reters ta a multiplicity of normative categories ot axiological and teleological character, serving as political strategy while structuring the legal system. Moreover, the introduction of programmalic form in modern constitutions combines the vagueness of the norm in its modern formulation to the law in ils classical variant. Programs have struggled to find their place in law. The peN seem to be a priori denied of legal effect, their rather vague wordings would only established simple goals. However, their development in the legal space seem important enough 10 avoid PCN to be considered as legal oddities that couk' attend ta the purity of law. Indeed, Ihe concept of PCN connects to real programmatic constitutional norms whose normativity remains peculiar, sign not of a "crisis" of the law, but of its "evolution" .

A topological framework for modeling belief revision

Thesis (PhD (Mathematics))--University of Stellenbosch, 2010. / ENGLISH ABSTRACT: Classical formulations model belief revision as a deterministic process. Under certain circumstances, the process may have more than one outcome, which suggests that belief revision is non-deterministic instead. Representations exist that model belief revision in either format, and for both formats there are axiom schemes that determine whether the representation is in fact a belief revision process. Although the axiom scheme for the non-deterministic case generalises that of the deterministic case, both schemes entail that all of the beliefs held by an agent are affected by new information, which is perhaps unintuitive. Rather, one may consider that belief revision should be local, with beliefs only affected if the new information is pertinent to them. We approach the problem of belief revision from the standpoint that it is local and non-deterministic, and the purpose and contribution of this dissertation is the development of a topological framework with which to model belief revision in this manner. / AFRIKAANSE OPSOMMING: Geloofshersiening word gewoonlik as ’n deterministiese proses voorgestel. Meer as een uitkoms mag bestaan vir verskeie omstandighede, wat aandui dat die proses liewer nie-deterministies van aard is. Beide die gevalle word deur aksiomaskemas gereguleer, en die aksiomas vir die nie-deterministiese geval veralgemeen dié van die deterministiese geval. Albei aksiomaskemas stipuleer, miskien onintuïtief, dat alle gelowe van ’n agent deur die nuwe informasie geaffekteer word. ’n Beter metode is dat net daardie gelowe waarvoor die nuwe informasie toepaslik is geaffekteer word. Ons benader die probleem van geloofshersiening uit die standpunt dat dit lokaal en nie-deterministies is, en die doel en bydrae van hierdie proefskrif is dus die ontwikkeling van ’n topologiese raamwerk waarmee ons geloofshersiening op hierdie manier kan voorstel.

Non-Alcoholic Fatty Liver Disease Alters the Three Stages of Hepatic Drug Management

In pharmacotherapeutics, the term "correct dosing" is based on the concept that too high a systemic concentration will lead to drug toxicity, while drug levels that are too low may not produce the intended therapeutic effect. Often, the factors determining the ability of a patient to manage a given dose rely on their capacity to efficiently metabolize and eliminate drugs from the body. The liver plays a crucial role in the processing of many clinically relevant drugs via three stages of hepatic drug management. Drugs must first be taken into hepatocytes by uptake transporters. Drugs are then metabolized by phase I and phase II enzymes to make them more manageable. Finally, metabolites are removed from the hepatocyte by efflux transporters either into the bile for elimination or reintroduction to systemic blood. Alterations in one or more of the hepatic drug management stages increase the potential for adverse drug reactions (ADRs).In the United States, ADRs account for between 3%-12% of admissions to hospitals, and approximately 5% of deaths each year. While less than 20% of these cases are due to genetic polymorphisms, the vast majority of ADRs are due to environmental factors including disease. Non-alcoholic fatty liver disease (NAFLD) comprises a spectrum of conditions progressing from steatosis to non-alcoholic steatohepatitis (NASH) and often leading to cirrhosis. Presently, NASH patients represent the greatest population of candidates for liver transplant, illustrating the severity as well as the incidence of this disease. Patients with NAFLD are typically treated for co-existing conditions of the metabolic syndrome (i.e. hyperlipidemina or type II diabetes) and therefore represent a distinct population at risk for adverse drug reactions.The following studies show that experimental NAFLD affects both the signal transduction pathways regulating hepatic drug management genes as well as the hepatic uptake transporter function. Additionally, patient livers diagnosed with progressive stages of NAFLD, display altered CYP activity and efflux transporter expression similar to those previously reported in experimental NAFLD. Given that changes observed in experimental NAFLD result in functional changes in hepatic drug management, similar changes observed in patients with this disease suggest an increased risk for ADRs.

Nash Alters Drug Metabolizing Enzyme and Transporter Expression Resulting in Significant Consequences for Pharmaceutical Disposition and Toxicity

The body encounters an innumerable amount of foreign substances, termed xenobiotics, which it must remove in order to prevent damage to cells and organs. This system of removal is a collection of processes known as ADME (absorption, distribution, metabolism, and excretion). The dynamics of ADME ultimately determine the fate, or pharmacokinetics, of a xenobiotic in the body whether it be an administered pharmaceutical or a potentially harmful toxicant. The major cellular effectors of ADME are the drug metabolizing enzymes (DMEs) and transporters. DMEs function to transform xenobiotics into a metabolite that is more suitable for excretion, whereas drug transporters serve a two-fold function. They may facilitate the uptake of the xenobiotic into the cell so that it can be acted upon by DMEs, or they may function to actively secrete xenobiotics and metabolites from the cell, encouraging their removal from the body. Any perturbations in the expression or function of these critical cellular effectors can result in the diminished therapeutic effect of a pharmaceutical via accelerated removal from the body, or increased toxicity of a pharmaceutical or toxicant due to retention in the body and increased exposure.Perturbations in the ADME processes may result in adverse drug reactions (ADRs) which are an unintended response to a pharmaceutical when administered at the recommended dose. In the last reporting year, the USFDA documented 471,291 serious ADRs causing hospitalization or permanent disabilities, of which 82,724 resulted in death. ADRs can be categorized as two types: dose-related ADRs, and those that are generally unpredictable and mostly occur in susceptible individuals. The major factors that make a person susceptible to ADRs are genetics and disease; however, genetics account for only a small proportion. This dissertation is focused on the contribution of an environmentally-derived component, particularly liver disease, to the occurrence of ADRs. Nonalcoholic fatty liver disease (NAFLD) is the most common liver disease of industrialized nations. It represents a spectrum of damage progressing to the severe stage of nonalcoholic steatohepatitis (NASH), and is closely related to obesity and type 2 diabetes. The following studies have determined the effect of NAFLD and NASH on DMEs and transporters, and demonstrated the propensity for NASH to result in serious ADRs.

Technology and talk in calls to NHS Direct

This thesis is a conversation analytic investigation of the social organisation of talk in telephone and computer-mediated calls to NHS Direct, a telephone health helpline in England. The data represent fifty-six routinely audio recorded telephone consultations between nurses and callers between June 2003 and June 2004 at one NHS Direct call centre. Data were transcribed using the Jefferson (2004) transcription system. Data analysis follows the broad trajectory of the call. Chapter three illustrates the overall structural organisation of the call as mediated by the Clinical Assessment System (CAS); Chapter four examines how CAS prompted history taking questions are tailoured and delivered by the nurse; Chapter five examines the delivery by the nurse, of the CAS output in the form of the 'disposition' or course of action the caller may take to manage their concern, and Chapter six examines caller's responses to the disposition. The results draw attention to the complexities of telephone and computer-mediated help in which nurses and callers must design their talk to take account of the CAS as a 'third party'. Analysis reveals that nurses typically orient to the CAS output as potentially troublesome. First nurses regularly deviate from and modify CAS prompted questions which works to 'cushion' the system and build rapport between the nurse and the caller. Second nurses regularly simultaneously produce and labour to deny hearably candidate diagnoses. Third callers regularly respond to the CAS produced disposition as dispreferred. In conclusion, this research has revealed how nurses and callers employ a range of interactional practices which work to skilfully tailor and fashion 'embodied help' from an otherwise disembodied CAS technical system. Thus, we can observe nurses and callers artfully displaying through talk the ordinary practical methods for accomplishing telephone and computer-mediated help in this setting.

Consequently human resource managers are keen to find the strategies to keep their workforce fully motivated and dedicated to their jobs. In this study dissimilar from prior studies researcher has applied work attributes (Herzberg, 1968; Adams, 1963) and personality aspects (Judge etal, 2001) to examine the relationship of work attributes and personality disposition with job satisfaction. In current era of Information technology revolution organisations across the globe confronting several challenges on different counts including to keep workforce motivated and effective to gain maximum from their skills. Keeping workforce motivated to reduce tardiness, absenteeism, misuse of resources, and turnover are major issues of concern in the domain of employee job satisfaction and human resources management. Therefore, human resources management practitioners, managers, and policy makers are enthusiastically concerned to know about the factors that may help to make workforce effective, motivated and contend with work. The aim of this Doctoral thesis was to study the determinants of employee job satisfaction. The objectives were to explore the organisational work attribute factors and employee personality aspects in Public healthcare sector of Pakistan Where various reforms introduced after implementation of new health policy called Health for All(HFA) lately. This study was categorised in seven parts staring with introduction stating the setting of the study which covers background of this empirical study and supplies the transparent context information. In second phase systemic carefully carried literature review led to theoretical frame work and hypotheses development in third phase. Onwards Survey Questionnaires were administrated to General physicians working in public hospitals for data collection purpose. Descriptive statistics, multi analysis of variance, and exploratory factor analysis with the help of Statistical package for social science (SPSS) was applied to analyse the data, hypotheses testing and confirmatory factor analysis were done with the help of structural equation modelling(SEM). Outcome generated discovered that perception of procedural justice, on job training, working conditions, esprit de corps (team work) and personality aspects self esteem, and self efficacy belief, were significantly and affirmatively correlated and neuroticism personality aspect negatively correlated with employee job satisfaction. However, employee job clarity, task significance perception and personality aspect of locus of control orientation were not found to be related with job satisfaction. Implications and recommendation of research for employee job satisfaction are also discussed.

The Fate of Benzo(a)pyrene in Tissues of Mice Exposed to Diesel Exhaust

Mice were exposed to diesel exhaust for 9 months prior to evaluation for benzo(a)pyrene disposition. On the last day of exposure the mice were instilled intratracheally with tritiated-benzo(a)pyrene ([3H]BP). The mice were sacrificed at intervals of 2, 24, and 168 hours. Disappearance of radioactivity from lungs and liver was rapid and essentially linear with time. In lungs, liver, and testes; [3H]BP metabolites were found mainly as conjugates, a form readily excretable. Clearance of the hydrocarbon from liver and testes in exposed mice was not markedly different from that in nonexposed mice. However, mice exposed to diesel exhaust had delayed [3H]BP clearance from lungs, possibly due to [3H]BP adsorption to diesel smoke particles.

Les dispositifs de formation ouverte en langue étrangère ont la double finalité de permettre aux apprenants d'acquérir une autonomie langagière et une autonomie d'apprentissage. Ces dispositifs articulent plusieurs modalités d'accompagnement afin de se centrer sur l'apprenant et de prendre en compte ses dispositions (représentations, motivations). En tant que chercheuse et enseignante/conseillère dans un dispositif de formation ouverte en présentiel (le Département de Français Langue Etrangère de l'Université de Lorraine - DéFLE), nous avons été interpellée par le fait que des apprenants semblent rencontrer des difficultés dans le développement de leur autonomie langagière et d'apprentissage. La présente recherche-action a pour but d'évaluer les expériences d'apprentissage vécues par les apprenants dans le dispositif et d'identifier les causes éventuelles de réussite ou d'échec de leur processus d'autonomisation. Plusieurs questions guident notre recherche : dans quelle mesure le dispositif permet-il aux apprenants d'acquérir des compétences langagières et d'apprentissage ? Quelles sont les modalités d'accompagnement qui favorisent le mieux l'autonomisation ? Quels changements pourraient être apportés à nos pratiques pédagogiques dans l'optique d'une meilleure prise en compte de la singularité des apprenants au niveau psycho-socio-cognitif ? Pour répondre à ces questions, nous avons procédé à une évaluation auprès d'étudiants étrangers du DéFLE en début et en fin de formation. Notre protocole comprend six outils qui nous permettent d'évaluer les effets du dispositif sur l'autonomisation des apprenants. Il repose sur la collecte de données quantitatives et qualitatives par le biais d'entretiens semi-directifs, de questionnaires et de tests. Les résultats de notre enquête montrent des résonances et des dissonances entre la visée autonomisante du dispositif, les attentes et les perceptions des apprenants. Il s'agit à terme de proposer les changements nécessaires pour optimiser le fonctionnement du dispositif et valider ou non par la même occasion un ensemble d'instruments de mesure et d'évaluation transposables à d'autres dispositifs de formation. / Open trainings in foreign language have the dual purpose of enabling learners to acquire learning autonomy and language autonomy. These trainings combine several kinds of pedagogical support in order to focus on the learner and to consider its dispositions (representations, motivations). As a researcher and a teacher/counselor in an on-site training (the Department of French as a Foreign Language at the University of Lorraine - DEFLE), we have noticed that some learners seem to have difficulty in developing their language and learning autonomy. This action research aims to assess the learning experiences of the learners within the framework of the training and identify the possible causes of success or failure of their autonomisation process. Several questions guide our research: to what extent does the training allow learners to acquire learning and language skills ? What are the pedagogical support that best promote autonomisation ? What changes could be made to our teaching practices in order to better take into account the uniqueness of learners at a psycho-socio-cognitive level ? To answer these questions, we carried out an evaluation on foreign students of the DEFLE at the beginning and the end of their training session. Our protocol includes six tools that allow us to evaluate the effects of the training on the learners' autonomisation. It is based on the collection of quantitative and qualitative data through interviews, questionnaires and tests. The results of our evaluation show resonances and dissonances between the aim of autonomisation of the training, the expectations and perceptions of the learners. This is to eventually propose the changes necessary to optimize the operation of the training and validate at the same time a set of instruments for measuring and assessing, transferable to other trainings.

Degree thesis deals with behavioral finance with a focus on behavior and psychology of an individual investor. The first part is devoted to the prospect theory that is a descriptive model of behavior of economic agents under the conditions of uncertainty and stands in a stark contrast with the traditional normative expected utility theory. The second part is devoted to the group of behavioral biases that are distortions of human thinking and judgment documented by cognitive psychology. These biases are difficult to eliminate and lead to a biased perception, inaccurate judgments and illogical interpretations. The third and final part is devoted to a questionnaire survey whose goal was to find out whether financial market participants behave according to the axioms of the expected utility theory or whether they systemically deviate from the axioms of this normative theory. The second goal of the survey was to confirm or disprove inferences of academic studies about existence of behavioral biases.

How do managers handle their time? A descriptive study about the Temporal Dispositions of middle- and low-level managers : Exploring the correlation between Time urgency and Pacing styles

In modern business environment, time becomes more and more valuable resource fororganizations. The way managers will organize their time for completing managerialtasks, will influence not only job performance but inner feelings and job satisfaction,and, eventually, organizational performance. Research uses the term t emporaldispositions for analyzing how people are seeing the time. Temporal disposition hasdifferent elements and each of them are considering a different viewpoint of howpeople perceive the time. We found out that the connection between two basicelements of temporal disposition, time urgency and pacing styles, are not researchedproperly which leads into a misunderstanding about these concepts.  The purpose of this study is to d iscover the correlation between two different elementsof temporal dispositions (time urgency and pacing styles) through measuring the timeurgency and pacing styles of middle- and low-level managers. Further, this studyaims to enhance our understanding about Swedish managers’ time urgency andpacing styles. Finally, the thesis attempts to expand the academic field of temporaldisposition through e xplaining how the way managers are feeling about time (timeurgency) affects how they are distributing their time for completing managerial tasks(pacing styles). The quantitative research has been used in this study. A questionnaire with 10 itemshas been developed for this study, and 122 managers have been participated in thesurvey. The following correlation between time urgency and pacing styles has been found:time urgency is positively correlated with U-shaped pacing style and negativelycorrelated with steady-action style. We have not found any significant correlationbetween time urgency and deadline-action pacing style. Further, this study foundthat time patience (the opposite of time urgency) is positively correlated withsteady-action pacing style and negatively correlated with deadline-action pacingstyle. Similarly, results have shown that U-shaped pacing style is used both by timeurgent and time patient managers. Finally, we found that middle-level managers aremostly time urgent and using U-shaped pacing style when completing managerialtasks while low-level managers are mostly time patient and using steady-actionpacing style.
