Multi-level governance revisited : comparing the strategies of interest representation of legislative regions in EU environmental policy-making

Since the 1980s, regions have taken a strong interest in EU policy-making and increasingly demanded representation in the process. This has given rise to the concept of multi-level governance (MLG) in EU policy-making, which stipulates that subnational and supranational actors will interact and thus to some extent erode the authority of central governments. However, due to the scarcity of case study research looking at concrete instances of policy-making, a number of questions remain about the extent and the effectiveness of the interaction between regional governments and European actors. In addition, the extent and origins of differences in regional activity across regions and member states remain unclear. This thesis aims to contribute to the MLG debate by developing a theoretical framework with a set of hypotheses about regional activism in EU policy-making on the basis of rational choice institutionalist assumptions. It then investigates how seven legislative regions from four member states (the UK, Germany, Belgium and Austria) represent their interests in two concrete instances of EU policy-making and tests the core hypotheses against these fourteen cases. The thesis contributes to the MLG debate in three ways. Firstly, the principal objective of the thesis is to analyse the impact of different types of domestic intergovernmental relations on the strategies of regions at the European level. It is argued that the level and nature of a region's activity on the European level depends on the opportunities for influence in the domestic European policy-making process and the constraints that domestic rules place on European level activity. Secondly, a number of factors that could account for different levels of regional activity both within and between states are analysed. Domestic conflict and the capacity of a region are found to be particularly relevant for regional mobilisation. Finally, the thesis discusses the relative importance of domestic channels compared to European channels of regional interest representation, thus addressing one of the fundamental questions in the MLG literature. It is argued that unmediated interaction between European actors and regional governments is less common than predicted by the MLG literature, but that it can be effective, especially in cases where regions devise a comprehensive strategy of interest representation.

Labour migration management as multidimensional border-drawing : a comparative interpretive policy analysis in the EU

This thesis examines and compares current labour migration management of non-EU workers in Germany, France and the United Kingdom. It aims to explain cross-national similarities and differences from an interpretive policy analysis perspective. The research entails analyses of 33 legal documents and in-depth interviews with 25 high-ranking policy-makers and is anchored in case contexts. In order to gain comparative explanations the analysis maps legal classifications and rights regimes governing incoming migrant workers, explores meanings policy-makers vest in these, and thereby reconstructs the economic, social and political normative references these meanings entail in comparative perspective. By conceptualising migration policy as border-drawing I challenge the main stream migration policy literature, offering an alternative approach which changes the parameters of policy analysis more generally. While most migration policy research concentrates on explaining the control gap between restrictive admission policies and de facto migratory flows, I shift the analytical focus towards states’ power to define legal and illegal positions through policy and allocate rights in a differential way. Empirically, I overcome partial policy accounts by contributing a multidimensional analysis of labour migration policy across its economic, social, and politico-formal dimension, and develop an innovative methodology to explain crossnational variation in the interaction of these aspects. By associating each dimension with a specific borderdrawing site – capitalist coordination system, welfare state regime, and citizenship model – the thesis utilises regime theories to develop benchmarks for the empirical analysis while at the same time testing the explanatory scope of these theories in the field of labour migration. Migrant workers are selected by skill level and labour scarcity in all three cases in line with widely shared economic values surrounding labour migration agendas. Yet, the analysis also pinpoints considerable divergences when selecting migrants by origin, social cohesion concerns or with annual caps. The variable labour geographies into which migrant workers are admitted – mainly relating to post-colonial relationships, distinct uses of EU free movement, and demographic context – are seized by policy actors to selectively contextualise economic border-drawing. It is this distinct socio-political contextualisation of a shared cultural political economy of labour migration which explains similarities and differences in European labour migration management. The thesis hence contributes an empirically detailed understanding of an integrating EU common market which coexists with persistently diverging labour geographies and societies. Findings bear considerable policy implications in terms of European integration and the unequal distribution of labour mobility rights for migrants in Europe.

Policy-making in the European Union : the role of policy networks in EU environmental policy

Research into the European Union (EU) increasingly focuses on the policy-making processes which take place within the EU, as distinct from trying to explain or predict the broad phenomenon of European integration. This thesis adopts a similar focus on EU policy-making. Policy-making in the EU is examined using a policy network approach. The main aim of the thesis is to assess how useful the policy network approach is as a means of explaining EU policy processes and policy outputs. The policy network approach is therefore applied not simply as a mechanism for describing patterns of interest intermediation but, rather, as a tool for explaining a new form of network governance in the EU. The thesis therefore aims to test the claims of the policy network literature that it can better account for policy-making in the EU than can more traditional approaches derived either from international relations (IR) or comparative politics (CP). The thesis applies a policy network approach to the study of EU environmental policy-making. Three case studies - on air quality, landfill and drinking water legislation - are examined, in order to assess whether a policy network approach can help explain the development of EU policy in these areas. Overall the thesis finds a useful role for policy network analysis in helping to explain EU policymaking and policy outputs. At the same time, however, the thesis confirms the limitations of the policy network approach at EU-level. Policy network analysis must therefore be combined with both IR and CP approaches in order to gain a fuller understanding of how EU policy is made.

European energy security policy-making in the context of EU enlargement : the role of newer member states as agenda-setters, 2004-2013

This research analyses the extent to which three newer (European Union) EU member states, Poland, Bulgaria and Latvia have attempted and succeeded in shaping the development of the EU's energy security policy, focusing on natural gas. This explores the argument that EU membership affects the formation of national foreign and energy policy as well as procedures of policy-making, and that newer member states have also been able to shape EU level policy-making through the ‘uploading’ of national preferences. The research engages with relevant conceptual issues to develop and utilise a framework which is a synthesis of literature on EU agenda-setting, policy framing, Europeanisation and the social construction of energy ‘crises’ and (in)security. This conceptual frame is then used to explore and evaluate the influence of newer member states on EU energy policy agenda-setting, policy-making and policy implementation. Evaluating the obstacles and opportunities for influence, an empirically rich data set is analysed to test the extent to which five theoretically derived hypotheses account for member state influence. Five mechanisms are identified as potentially key factors in explaining the degree of influence which member states have. The thesis suggests that one is the impact of supply disruptions and price rises on perceptions and constructions of national and EU energy security. This can contribute towards a context that is conducive to the arguments about policy change and projection being made, a policy window, and is a reflection of the social construction of energy insecurity and energy crises. Diplomatic skill and learning to ‘play the EU game’, being active in Council summits and technocratic level(s), and engaging in consensual policy-making that adheres to EU norms and interests is seen as important. Another key factor is the role of Russia as a major and sometimes monopoly gas supplier, in constraining, enabling, and influencing the strength of national interests - the extent of political will and EU energy policy activism. A fourth factor is considered to be the extent to which institutionalised sub-EU regional and strategic alliances exist and are prioritised as an arena to develop coordinated policies and preferences. The final conceptually derived factor is related to the strength of administrative capacity, in terms of well-coordinated institutions at the national and EU level, and sufficient personnel and resources. The thesis also provides a study of the development of EU energy policy since the 1950s in chapter two, and chapters three to five focus on the three country case studies; Poland, Bulgaria and Latvia. These empirical chapters include in each case a history of their energy policy and relations with both the EU and Russia. The thesis concludes with an analysis of the empirical findings using comparative country case manner approach, along with conceptual (and methodological) observations based on the testing of the hypotheses.

Public policy for long-term societal challenges? : the reframing of policy narratives and the 'Roadmap to a Resource Efficient Europe'

This research examined how public policy addresses long-term societal challenges. The case study focused on policy narratives and frames of resource efficiency in the ‘Roadmap to a Resource Efficient Europe’ of the European Commission (EC). The study followed an interpretive constructionist perspective on public policy and assumed a research strategy based on a single critical case study. The literature review examined perspectives on policy narratives, frames, knowledge and social learning in the interpretive policy analysis and organisation studies literature. Foresight and futures literature also provided insights on the use and nature of knowledge and policy learning in the process of deliberation of future visions. The empirical enquiry was based on a series of in-depth interviews with policy stakeholders, formal EU policy documents and speeches as well as participation in targeted policy events. The thesis makes contributions in three areas. First, the study developed and applied a new conceptual and methodological approach – a policy narrative framework analysis(POLFRAME) – to examine different discursive and narrative layers of policy narratives of the resource efficiency agenda. The framework can lend itself to interrogate any policy narrative, notably ones with explicit or implicit future scenarios and vision. Second, the policy case study contributed to knowledge on the evolving EU policy area of resource efficiency, addressing challenges of the sustainable use of natural resources. The research provided insights into how a complex societal, economic and environmental challenge of resource efficiency was understood by different stakeholders and intentionally framed in the official policy narrative. The emerging EU agenda on resource efficiency was intentionally reframed to advance a broader approach to environmental policy that moves beyond a traditional goal of environmental protection towards a systemic transition of economic system to achieve decoupling of economic growth from environmental impacts. While the study found evidence of a significant shift in scoping the challenge, their framing has not led to radical changes in underlying normative assumptions on the relation between nature and society or on the central role of economic growth in transition. Third, the research discussed theoretical implications of introducing a long-term challenge-driven perspective to public policy narratives. Introducing a future vision to policy narrative added a stronger normative orientation to policy argumentation. The case study demonstrated that an inclusion of a long-term societal challenge to the resource efficiency agenda influenced the selection, interpretation and use of evidence in policy narratives. The design of challenge-driven long-term policies bears a family resemblance to the perspective of post-normal science. Finally, the thesis puts forward messages and recommendations for policy makers and practitioners interested in the process of radical policy reframing. It also suggests further research encompassing a comparative dimension and longer periods of enquiry of policy frames, which would allow for better understanding the effects of the reframing of policy on various phases of policy cycles.

Parliamentary Standing Committees in the EU policy-making process. : A comparative case study of two committees from the Bundestag

The EU integration process has led to severe changes in policy-making. On the one hand, authority shifted from the national level to the EU. On the other hand, national level executives have gained power relative to the national legislatures. However, since the Treaty of Lisbon entered into force, scholars argue for a comeback of national legislatures. In Germany, parliamentary standing committees have gained considerable power throughout these developments. Nonetheless, their traditional role as policy shaper is contested among scholars. Thus, clarification of their role is needed. While, previous analysis has mainly focused on the Bundestag as a unitary actor. This thesis investigates the role of two standing committees of the Bundestag – Ausschuss für Landwirtschaft und Ernährung and Ausschuss für Gesundheit – in the EU policy-making process across two different competence areas emerging due to the Lisbon Treaty. To answer the research questions, semi-structured interviews with committee members have been conducted. The results of the study show a diverging picture. The members of the Ausschuss für Landwirtschaft und Ernährung are considerably constrained in their ability to act as a policy shaper. The members of the Ausschuss für Gesundheit can secure their policy-shaping powers to a great extent. The former committee lacks these qualities concerning the shift of an increasing amount of policy authority in agriculture to the EU, the restricted use and abilities of the Early Warning Mechanism and the constrained ability to influence the minister’s position in the Council. The members of the latter are more successful in securing policy authority in public health at the national level by making use of the EWM. Nonetheless, the restricted ability to influence the minister’s position in the Council is present, too. We can conclude that the Ausschuss für Landwirtschaft und Ernährung has inherited the role of a scrutiniser and executer meanwhile the Ausschuss für Gesundheit can be described as policy shaper.

Ambitions v. Implementation : A case study on how the European Commission has affected the gender equality policies of Poland

Considering the persisting issue of gender inequalities, this thesis aims to examine the European Commission’s role in the development of gender equality policies in member states. Illustrating the Commission’s role by conducting a case study on the development of equality policies in Poland during the years 2004 – 2020. The Commission’s influence was analysed using the three integration mechanisms: positive, negative, and framing integration through the application of the top-down Europeanization approach. The influence was thereafter measured by examining the extent of compliance to and implementing the Polish government's EU policy. The analysis indicated the Commission’s role as the supervisor of the implementation process as an important factor in transposing a number of EU directives on gender equality in Poland. Moreover, the pressure from the Commission in the form of Reasoned Opinions contributed to the advancement of gender equality policy from 2004 through 2015. The institution’s strategies on gender equality also resulted in compliance with EU objectives and necessary institutional changes. Resulting in instances of positive integration. The strategies also resulted in some framing integration, where some of the political and social debate on gender equality policy came to comply with the discourse of the Commission. Yet, the analysis also demonstrated that the transposing varied in level of compliance with the measures stated in the directives. The implementation of the policies also varied greatly. When the Law and Justice party formed a majority government in 2015 there was a significant regression of certain areas of gender equality policy and the former institutional changes of the national equality body. This development in Poland resulted in an infringement procedure and the first instance of negative integration. Demonstrating the Commission’s capability to directly affect national legislation that contradicts EU law. The main conclusion of this thesis is therefore that the Commission has had an important role in the development of gender equality policy in Poland, but the advancements in this policy area vary in levels of compliance and implementation.

The Subnational Level's Attempts to Influence EU Policy

Micro-regions have gained an increasing awareness of their potential in global politics, an illogical development that have yet to be explained. In this study, we hypothesize that there is a trend where regions attempt to lobby EU-policy, and explore the role of regions, and their channels to Brussels: how they look today, and how they have changed over time. In this exploration, we conducted a comparative case study where the Swedish regions’ channels to Brussels were compared over time by a theoretical framework built on new regionalism ideas. To collect data, we interviewed representation office officials, and supported this data with a content analysis. We then compared our results to a similar study from 2007.We found that the representation offices today lobby as a daily activity, and that monitoring is often emphasized to be pro-active in policy influencing. Money is still experienced as the prime logic for regional representation in Brussels, but possibilities for financial gain may incentive regional interest to contribute to the EU policy framework. The representation offices favor the European Commission as a channel, but this depends on where in the process the office enters, while informal networks are given an increased value for several reasons.

Bioeconomy Strategy effects in Rural Areas : A comparative study of the Alpine region and Inner Scandinavia

The European Commission Bioeconomy Strategy aims to stimulate an ecologically sustainable economy to mitigate climate change, declining biodiversity, and as an economic and social strategy meant to provide jobs and stimulate growth. The aim of this research project is to understand how the European Commission Bioeconomy Strategy is being interpreted and implemented in two different rural European regions, Inner Scandinavia, and the Alpine region, and based on those findings discuss how a sustainable bioeconomy strategy can be understood primarily in relation to the ecological sustainability goals of decarbonizing the economy and protecting biodiversity. This project has through literature studies and a case study with interviews, field observations and a spatial analysis of the territory using Corine Land Cover data highlighted the importance of links between governance and policy as enablers of ecologically, socially, and economically sustainable bioeconomy strategies. The results indicate three models comprised of distinct landscape types associated with specific bioeconomy strategies that are discussed in relation to the key concepts, bioeconomy, and sustainability. The analysis demonstrates that certain bioeconomy strategies may provide economic and social sustainability and not necessarily ecological effects. In fact, certain bioeconomy strategies, despite being framed as sustainable, may even be detrimental for ecological sustainability
