Lötz and Du Plessis sum up the problem at hand most succinctly in their stating that “the relevant question is whether electronic contracts of sale can fulfil the general, legal requirements for the conclusion of a valid contract, and also where and when such contracts are (deemed to be) concluded”.2 In light of this statement, consider the following schematic representation of all the parties and their relationships, as typically occurring during the electronic contracting process: This statement succinctly sums up a single aspect of this problem, the so-called “contracting phase”. Following the traditional thought pattern, all aspects leading up to the point of conclusion need to be assessed and critically discussed as a failing or miscommunication in any one of the traditional requirements for the conclusion of a valid contract may later in the contractual relationship affect consensus and thus conclusion. This second phase “remedies and liability” refers to the situation where consensus is defective for one or other reason stemming from a failure in the internet/network services offered by the Internet Service Provider. A practical example of this may be: A and D have concluded pre-contractual negotiations and stand on the brink of consensus. A has signed the agreement and has forwarded same to D by means of e-mail. As far as A is concerned, the contract is concluded and he/she makes arrangements to fulfil of his/her obligations. D does not receive the signed agreement from A due to a failure on the part of his/her Internet Service Provider (C) – the server crashed and as a result he/she has no knowledge of A’s acceptance. D therefore concludes a contract with a third party for the same goods that form the subject of the contract with A and performs in terms of same. In these circumstances A has suffered economic loss due to his/her preparation to perform alternatively, full performance in terms of a contract he/she believed to be concluded. It goes without saying that neither A nor D are responsible for the loss A has suffered. The obvious question is then who is responsible for A’s loss? This work aims to assess firstly, the nature and the scope of possible remedies available to A to redress his/her loss, and secondly, the extent to which the Internet Service Provider can be held responsible for the failure of the communication medium. An Integrated Study of Avian Influenza Impacts and Associated Climate Change Issues

This dissertation examines issues related to avian influenza (AI) disease. This is done via three essays that individually examine: (1) the impacts of climate change on the probability and expected numbers of AI outbreaks and associated economic loss; (2) the effects that media coverage of AI outbreaks has on meat demand in the United States, and (3) the potential effectiveness of AI mitigation strategies on poultry production and welfare under a simulated AI outbreak in United States. The climate change and spread of AI outbreaks study finds that the probability and expected number of AI outbreaks increases as climate change proceeds. Particularly, past climate change has contributed to the current spread of AI disease by 11% and the future climate change will increase this spread by another 12%. Moreover, the underreporting probability of AI outbreaks is also examined and results show that the underreporting probability is much higher in countries with lower gross domestic production level, larger export of poultry products and more numbers of AI confirmed human deaths. Therefore, disease prevention and control plans should focus on these economically poor and climatically changed regions. AI outbreak information has significant effects on meat demand in the United States. In particular, impacts of overseas AI human deaths on meat demand equal 0.02% for beef, -0.005% for pork, and -0.01% for chicken for sample when there was no AI occurred in the United States, while it has smaller impacts on meat expenditure when using the whole sample. In addition, human deaths due to AI disease will increase beef demand and decrease that for pork and chicken. However, AI media coverage in short-run has insignificant effect on meat demand, which suggests that consumers are more cautious when cases occur within the United States as opposed to international cases. In the study on the effects and welfare implications of AI mitigation strategies, results find that vaccination strategy is welfare decreasing under most cases of demand shocks but is desirable in some regions when both domestic and excess demand decrease. Under the assumption of one AI outbreak in the United States, the associated mitigation costs because of past climate change are relatively small.

LEGAL LIABILITY: THEORETICAL AND COMPARATIVE ANALYSIS OF PURE ECONOMIC LOSS The purpose of my thesis is to introduce the concept of pure economic loss and its setting in the jurisdictions of France, England, Germany and the Czech Republic. The comparative study of pure economic loss reveals that granting compensation for economic loss frequently interferes with the economic loss rule (or exclusionary rule), which states that a plaintiff can not recover damages for a pure financial loss. Legal doctrines provide little insight as to why liability should, or should not, be denied. On the other hand, economic models of liability provide some valuable guidance for classifying various categories of economic loss, and identifying cases in which denial of recovery for economic loss would lead to inefficient outcomes. A law and economics analysis shows that a key factor in determining the optimal scope of the economic loss rule is in the relationship between pure economic loss and social loss. Economic loss should be compensable in torts only to the extent that it corresponds to socially relevant loss. A plaintiff cannot recover damages for a purely private economic loss. Šiame magistro darbe analizuojama grynai turtinių nuostolių atlyginimo problema. Grynai turtiniai nuostoliai daugumoje valstybių suvokiami kaip trečiųjų asmenų ekonominio pobūdžio nuostoliai, kurie patiriami įvykus deliktui tarp kitų asmenų. Žvelgiant lyginamuoju aspektu, valstybių teisės sistemose yra suformuotos dvi pozicijos šių nuostolių atžvilgiu: liberalioji ir griežtoji. Pirmoji pozicija, leidžianti grynai turtinių nuostolių atlyginimą, vyrauja Prancūzijoje. Tuo tarpu JAV, Anglijoje, Vokietijoje ir Austrijoje yra taikoma grynai ekonominių nuostolių atlyginimo ribojimo taisyklė. Magistro darbo autorė atlikdama lyginamąjį tyrimą, stengėsi išsiaiškinti, kokios priežastys skatina riboti grynai turinių nuostolių atlyginimą, taip pat įvertinti, kurios valstybės pozicija yra racionaliausia ir teisiškai labiausiai pagrįsta. Tiesa, pažymėtina yra tai, kad nors valstybėje vyrauja viena ar kita pozicija, tam tikrais atvejais neapsieinama be pagrindinės taisyklės išimčių. Lietuvoje šiuo klausimu kol kas dar nėra nei teismų praktikos, nei mokslinių diskusijų. [toliau žr. visą tekstą] / The thesis ‘Recovery of Pure Economic Loss: Comparative Aspects’ provides a comparative analysis of recovery possibilities of pure economic loss in six different countries, namely the USA, England, Germany, Austria, France and Lithuania, that belong to different legal families and inherit distinct tort law traditions. In most of the countries pure economic loss define economic nature loss of third parties that are experienced in the case of the tort of other persons. The objective of investigation is to evaluate legal rationality of each regulatory system and to estimate which one of them causes least practical problems. In addition, as the position of Lithuania has not yet been settled, the author of the thesis proposes possible directions of the regulation of recovery of pure economic loss by analyzing legal basis of Lithuanian laws. The research consists of three parts each of them dealing with different aspects of the problem. First of all, the concept of pure economic loss is analyzed by trying to define the archetypical features of the mentioned loss and to expose the summarized topics that are discussed in doctrine and courts. Potential Impacts of Accelerated Sea-Level Rise and Hurricane-Induced Storm Surge in Western Pasco County, Florida

Sea levels have risen approximately 20 cm since the beginning of the 20th century and more than 3 cm in the past 20 years, suggesting that global sea level rise is accelerating. As sea levels continue to rise and storms become more intense, coastal property and populations become more susceptible to damage. Florida is especially vulnerable to hurricane-induced storm surge (HSS) and the onset of accelerated sea-level rise (ASLR) due to its extensive coastline and high population density along the coast. The main purpose of this research is to assess the potential economic impacts of ASLR and HSS for two of western Pasco County’s municipalities, Port Richey and New Port Richey. A Geographic Information System is used to determine the spatial extent at a high-resolution of coastal inundation, the economic loss based on property value and road expenditure due to this inundation, and its impact on critical infrastructure. The results from this study showed coastal flooding generated by 0.5m SLR amounted to 48.8% land loss and $217,108,692 of property loss. Monetary losses from inundated properties shifted dramatically from 1.0m to 1.5m SLR, from $295 million to $417 million, suggesting that the tipping point could only be a half-meter SLR. Based on the 2.0m SLR results, most of major highway US-19 was completely flooded, property tax losses amounted to approximately $7.1 million, and road expenditure was approximately $158 million. Data provided in this study can be useful for coastal management and planning in Port Richey and New Port Richey.

This research has developed an assessment model and framework to measure cascading economic impacts in terms of gross domestic product (GDP) loss due to severe weather-induced power outages. The major objectives of this research were to (1) identify physical correlations between different industries within an economic system, (2) define deterministic relationships through the values of interconnectedness and interdependency between 71 industries, (3) complete probabilistic estimation of economic impacts using historical economic data spanning from 1997 to 2016, and (4) develop an assessment model that can be used in the future to measure economic loss in terms of gross domestic product (GDP) across 71 industries.

O objetivo deste trabalho foi avaliar o desenvolvimento de Praelongorthezia praelonga (Douglas, 1891) em diferentes temperaturas e umidades relativas do ar, para definir áreas, no Estado de São Paulo, nas quais esta praga tenha maior possibilidade de aumentar o seu nível populacional, e, consequentemente causar maiores prejuízos. Neste sentido, a partir de criação estoque em cróton (Codeaum variegatum L.), cochonilhas recém nascidas foram transferidas para mudas de limoeiro Cravo (Citrus limonia L.) onde foram observados diversos parâmetros biológicos. Procedeu-se de forma análoga para avaliação dos parâmetros biológicos desta praga nas diferentes umidades relativas do ar, utilizando-se neste caso, como hospedeiro, tubérculos brotados de batata (Solanum tuberosum). Concluiu-se que as melhores temperaturas com base taxas liquidas de reprodução (R0) e razão finita de aumento (?), para o desenvolvimento de P. praelonga foram 22 e 25°C; a melhor umidade relativa do ar com base nas maiores taxa liquida de reprodução (R0) e razão finita de aumento (?) para P. praelonga foi 70%; a fase crítica, em qualquer condição térmica ou hídrica, para a criação de P. praelonga foi o primeiro ínstar para fêmeas, e o primeiro ínstar e a pseudo-ninfose para machos; em função das exigências térmicas, P. praelonga pode apresentar de 4,99 a 6,60 gerações anuais, nas principais áreas citrícolas de São Paulo; adultos e ninfas de P. praelonga preferiram as folhas maduras da região mediana da copa para escolha; a amostragem de P. praelonga deve ser feita com maior periodicidade nos períodos secos e frios do ano e em folhas da porção mediana das copas. / The goal of this research was to evaluate the development of Praelongorthezia praeloga (Douglas, 1891) under different temperatures and relative humidity in order to define areas in the state of Sao Paulo where this pest is more likely to increase its population level thus causing higher losses. Through stock rearing of garden crotons (Codeaum variegatum L.), recently born mealybugs were transferred to \'Rangpur\' lime seedlings (Citrus limonia L.) and several biological parameters were observed. Similarly the evaluation of the biological parameters of the pest was performed under different relative humidity having, in this case, sprouting potato (Solanum tuberosum) tubers as host. The best temperatures based on net reproduction rates (R0) and finite ratio of increase (?) for the development of P. praelonga were 22 and 25°C; the best relative humidity based on the highest net reproduction rates (R0) and finite ratio of increase (?) for P. praelonga was 70%; the critical stage, under any thermal or moist condition, for P. praelonga rearing was the first instar for females and first instar and pseudo-nymphosis for males; regarding the thermal requirements, P. praelonga may reach 4.99 to 6.60 annual generations in the main citrus areas of Sao Paulo; P. praelonga adults and nymphs preferred mature leaves of the trees for fixation; the P. praelonga sampling must be carried out with higher periodicity in dry and cold periods of the year and in leaves of the central part of the tree.

Le préjudice économique pur est celui qui ne résulte ni d’une atteinte à la personne, ni d’une atteinte aux biens et qui génère des conséquences économiques négatives comme c’est le cas du dommage causé à l’économie, ou encore celui du préjudice résultant d’un acte de concurrence déloyale. Cette notion est peu connue du droit français. La pratique montre cependant que certains préjudices économiques relevant de cette définition existent et sont indemnisés.De cette constatation pratique résultent différentes difficultés. Il existe un amalgame entre ce préjudice économique pur et les préjudices économiques qui, au contraire, sont le résultat d’une atteinte à la personne ou aux biens. Cet amalgame nuit à la réparation effective du préjudice économique pur. Plus encore, l’absence de régime juridique adapté emporte une dénaturation des mécanismes de responsabilité civile tant les critères traditionnels de celles-ci sont mis à mal dès qu’il s’agit de réparer un préjudice économique pur. Divers exemples illustrent ces difficultés. Le dommage causé à l’économie, par exemple, ou encore le préjudice subi en matière de concurrence déloyale, pour lesquels le caractère certain est rarement établi. Il conviendrait, dès lors, d’adapter, d’aménager des règles existantes afin de parvenir à une réparation efficace du préjudice économique pur. Participant de ces aménagements, la question, déjà ancienne, des dommages et intérêts punitifs, ou encore le renouvellement de la question de la réparation « économique » en nature par la restitution du « surprofit » comme proposé par certains.Un cadre juridique adapté pourrait ainsi régir les critères d’existence du préjudice économique pur, d’une part, et ses critères d’évaluation, d’autre part. / Pure economic loss is the one that results neither from a personal injury nor from damage to property and generates negative economic consequences, such as the damage caused to the economy, or as the prejudice resulting from an act of unfair competition. This notion is little known to the French law. However, practise shows that some economic prejudices under this definition exist and are compensated for. From this practical ascertainment result several difficulties. There is confusion between pure economic loss and economic damages that, on the contrary, are the result of an injury to person or property. This confusion harms the effective compensation of the pure economic loss. Moreover, the absence of an appropriate legal regime entails a distortion of liability mechanisms, as its traditional criteria are undermined when it comes to repairing a pure economic loss. Various examples illustrate these difficulties: the damage to the economy, for instance, or the injury in terms of unfair competition, for which the certainty is rarely established. Therefore, it would be appropriate to adapt and develop the existing rules in order to achieve effective compensation for pure economic loss. Amongst these developments: the rather already old question of these punitive damages, or the renewal of the issue of « economic » compensation in nature through the restitution of « over profit », as suggested by some. A suitable legal framework could thus govern the existence of pure economic loss criteria on the one hand, and its assessment criteria on the other.
