Ce travail de doctorat en démographie met l'accent sur l'entrée très précoce dans la maternité dans une perspective comparative entre deux pays proches sur le plan socioéconomique, mais qui se distinguent sur le plan de la fécondité, surtout pendant la période de l'adolescence – la France et l'Angleterre-Galles. Il explore les maternités adolescentes en tant que comportement reproductif « hors norme » et tente de placer ces maternités « non désirées » dans le contexte de la transition vers l’âge adulte. Nous offrons une vue longitudinale de cette problématique en décrivant « trois temps » de la vie d’une mère adolescente :- Le temps d’« avant maternité » où le fait de devenir mère adolescente est fonction de trois probabilités : celle d’avoir des rapports sexuels, celle de recourir à un (des) moyen(s) contraceptif(s) et celle de recourir à l’IVG en cas de grossesse ;- Le temps de la maternité. Quelles sont les situations de vie de ces mères adolescentes au moment de la naissance de leurs enfants ? - Le temps d’« après-maternité ». Comment varient les parcours génésiques, conjugaux, professionnels et résidentiels des femmes en fonction de leur âge à l’entrée dans la maternité ? / This thesis in demography focuses upon very early entries into motherhood in a comparative perspective between two countries similar in socioeconomic terms but differing vastly in terms of fertility, especially during adolescence - France and England and Wales. It explores adolescent maternities as an “uncommon” reproductive behaviour and aims to place these un-“unintended” births in the context of the transition to adulthood. We offer a longitudinal view of this phenomenon by describing three “periods” in the life of an adolescent mother:- The period “before maternity” where becoming an adolescent mother is a function of three probabilities: of having sexual intercourse, of using contraception and of having an abortion in case of a pregnancy;- The period of the maternity. What are the characteristics and life conditions of adolescent mothers at the time of birth ?- The period “after maternity”. How do the reproductive, conjugal, professional and residential trajectories of mothers vary in function of their age at first birth ?

Surrogacy Arrangements and Legal Parenthood : Swedish Law in a Comparative ContextStoll, Jane January 2013 (has links)
Surrogacy arrangements have become an increasingly popular way for childless people to build a family. Yet many jurisdictions do not regulate surrogacy. Even in the ab-sence of surrogacy regulation, if a jurisdiction has no specific legal rules that clarify parenthood following surrogacy, the result is often uncertainty in relation to the legal parental status of the surrogate mother, her spouse or cohabitant, any possible donors, and the commissioning parents. This, in turn, leaves the surrogate-born child’s family law status uncertain. This thesis examines the legal aspects of parenthood and how it is, or could be, determined in Sweden following surrogacy arrangements. Important aims are to estab-lish whether the current national laws regulating family law can sufficiently protect the interests of the surrogate-born child and the parties to surrogacy arrangements, with an emphasis on interests connected to family law status; to examine the ways in which other jurisdictions (England and Wales, and Israel) have responded to similar issues; and to identify problems and propose alternative solutions in relation to the specific issue of establishing legal parenthood following surrogacy at a domestic level, either with or without State regulation of surrogacy agreements. Consideration is given to whether it might be appropriate to re-evaluate or qualify the existing presumptions of parenthood, in particular the unwritten presumption of maternity. Several alternatives for the transfer of legal parenthood from the surrogate mother, and her spouse or cohabitant as the case may be, to the commissioning parent or parents are also examined. In addition, the ethical implications of surrogacy ar-rangements are explored in order to provide an insight into the way in which subcon-scious or hidden values might make it difficult for a State to regulate certain areas of private life such as parenthood. The starting point for the thesis is that it is in the best interests of the child to have parents at birth and that this interest must be prioritised over an intended parent’s interest in becoming a parent. This view is based on and is consistent with existing Swedish law and policy.

The diploma thesis deals with the process of prison privatization in the United Kingdom particularly in England and Wales especially in the form of PFI deals, in which the private sector not only manages prison facility but also designs and constructs the buildings. Due to transfer of this kind of service we can look at the relationship between state and private provider trough the lenses of Principal-agent theory. This theory, in its purest form, is constituted of one principal and one agent to whom the performance of the service is transferred, part of the risks associated with it and also a certain decision-making power are transferred as well. According to the theory, the basic precondition for the relationship between the principal and the agent is a discrepancy in the goals of the actors and the agent's effort to act opportunistically at the expense of the performance of the service for the principal. In this sense, the thesis examines the decision from 2018 not to launch new PFI or its successor PF2 projects. In this scenario, England and Wales are the principal and the prison operators are the agents. La discipline, élément essentiel de la vie pénitentiaire, fut longtemps ignorée du droit. L’analyse comparée des systèmes anglo-gallois, espagnol et français en la matière permet cependant de constater la normativisation de la discipline pénitentiaire et un accroissement des garanties processuelles accordées au détenu, qui accède au statut de justiciable. Ce mouvement traduit une certaine recherche d’équité dans la procédure disciplinaire, qui est à mettre en relation avec le renforcement progressif des droits de l’homme en milieu fermé. Le droit européen des droits de l’homme, bien que timoré sous certains aspects processuels, n’est pas étranger à cette évolution et permet de dégager une idéologie pénitentiaire fixant des standards communs aux différents droits internes. L’examen des systèmes disciplinaires observés révèle néanmoins les difficultés auxquelles est confrontée l’entrée du droit dans le monde pénitentiaire. Le droit est en outre loin d’être le seul instrument de gestion employé en détention. La conjonction de ces divers facteurs incite à proposer un modèle disciplinaire global reflétant cette recherche d’équité dans le système disciplinaire pénitentiaire. / Discipline is a key part of prison life which has long been ignored by the law. The comparative analysis of the English, Welsh, Spanish and French systems on this topic highlights however the prison discipline’s normativization and the increase of all the procedural safeguards for prisoners-litigants. This process reflects the search for a greater equity in prison adjudication, which could be connected to the progressive strengthening of Human Rights’ in prison. Although the European law on Human Rights is still timorous on some procedural aspects, it is part of this evolution, and it develops a global prison ideology by setting common standards for the different national laws in Europe. Nevertheless, the review of the different disciplinary systems enlightens the difficulties faced by the emergence of the rule of law in prison. Besides, the law is far from being the only mean for prison management. These factors’ convergence encourages to propose a new global disciplinary model, reflecting the search of a higher level of equity in the prison disciplinary system.

Diese Dissertation besteht aus einer Einleitung und drei empirischen Kapiteln, die sich mit verschiedenen Aspekten der Offenmarktgeschäfte der Bank of England in der Zwischenkriegszeit befassen. Offenmarktgeschäfte sind der Kauf und Verkauf von kurzfristigen Staatsanleihen. Die Einleitung definiert Instrumente und Ziele der Geldpolitik und beschreibt welche Folgen die veränderte Rolle Großbritanniens in der Welt nach dem 1. Weltkrieg für die Geldpolitik hatte. Das zweite Kapitel zeigt, wie Offenmarktgeschäfte die verfügbare Liquidität auf dem Londoner Geldmarkt erhöhen oder senken können. Dies erlaubt die kurzfristigen Marktzinsen relativ zum Leitzins zu steuern, was wiederum häufige Änderungen der Leitzinsen unnötig machte. Die empirische Analyse zeigt, dass Offenmarktgeschäfte die Wahrscheinlichkeit verändern können, dass Marktteilnehmer sich Geld bei der Diskontfazilität leihen müssen. Das dritte Kapitel zeigt, dass Offenmarktgeschäfte noch weitere Zwecke erfüllen. In der Finanzkrise von 1931 trugen Offenmarktgeschäfte dazu bei die größten Geschäftsbanken in London vor größerem Schaden zu bewahren. Der Verlust von Goldreserven wurde durch Offenmarktgeschäfte in großem Maße kompensiert und stabilisierte so die Liquidität der Geschäftsbanken. Das vierte Kapitel zeigt, dass Offenmarktgeschäfte zudem eine entscheidende Rolle bei der Stabilisierung der kurzfristigen Marktzinsen nach Kriegsausbruch 1939 spielten. Die empirische Analyse zeigt wie sorgfältig gewählte Laufzeiten von Offenmarktgeschäften dazu beigetragen haben, übermäßige Schwankungen der kurzfristigen Marktzinsen zu verhindern. Insgesamt deutet diese Dissertation darauf hin, dass die Bank of England in der Zwischenkriegszeit ähnlich einer modernen Zentralbank agierte. Kurzfristige Marktzinsen waren das operatives Ziel der Geldpolitik und nicht die Zentralbankgeldmenge. Im Jahr 1931 zog die Bank of England es vor die Geschäftsbanken zu stützen, auch wenn dies die Aufgabe des festen Wechselkurses bedeutete. / This dissertation consists of an introductory chapter and three empirical chapters which deal with various aspects of open-market operations by the Bank of England during the interwar period. Open-market operations are the purchase and sale of Treasury bills. The introduction defines monetary policy implementation and describes the economic circumstances after World War I and outlines what consequences the changing role of Britain in the world had for monetary policy. The second chapter shows how open-market operations could add or drain liquidity in the London money market and help steer short-term market rates relative to the Bank rate, which made frequent changes in the Bank Rate unnecessary. The empirical analysis shows that open-market operations could change the probability of market participants having to borrow at the discount facility. The third chapter argues that in time of crisis the purpose of open-market operations goes further. During the financial crisis of 1931 open-market operations most likely helped to protect the largest clearing banks in London from severe harm. The empirical analysis shows how open-market operations offset the effect of reserves losses at an unprecedented scale and stabilized the liquidity of the London clearing banks. Chapter four examines the role of open-market operation after the outbreak of war in 1939. Open-market operations played a crucial role in stabilizing short-term market rates and preserving the London money market in its original form, most notably the London discount houses and clearing banks. The descriptive evidence shown suggests how carefully chosen maturities of open-market operations helped offset any undue disturbances to short-term market rates after the outbreak of war. Overall, this dissertation suggests that the Bank of England, not unlike modern central banks, targeted short-term market rates, not some monetary quantity, and chose banking stability over a fixed exchange rate in 1931.
