Vliv obcí na výši svých daňových příjmů / The influence of communities upon the amount of their tax revenues

The purpose of the thesis is to describe and analyse capability of municipalities as subjects creating law to influence own tax revenue. The theoretical foundation of the thesis is definition of self-government and municipal budget aiming at revenue, especially tax revenue in accordance with the budgetary categorization. The main part of the thesis focuses on the municipal budget revenue, which can be influenced by municipaities. It contains two chapters. The first one of them is so concerned with local charges as the payments which the municipalities have the greatest influence on. They decree their introduction or repeal, rate etc. The next chapter of the thesis analyses the authority of municipalities regarding the real estate tax, that is possibility of exemption of real estate touched by natural disaster and exemption of some agricultural lands and set or modification of various coefficients - the local coefficient, the municipal coefficient and location rent. The following part reports on tax authority of slovak municipalities compared with czech ones. Many professors defend an extensive interpretation, to cover not only the real estate itself, but also possession, dominium utile, the fee-farm, the right of surface, to give only three examples of types of rights in rem. Others do not accept this interpretation. After a simple review of Hans Kelsen and Niklas Luhmann s theories, there have been two new approaches of possible and different interpretations of the proposed theme. In Kelsen, a systematic interpretation led to a restrictive conception of the term, but even so, it permitted to come to the conclusion that the municipal legislator does have competence to enlarge the basis of tax incidence beyond the restricted definition of real estate. In the same way, based on the the systems theory, specially on the instruments extremely well handled by Luhmann, such as the structural coupling of various systems (communication) and even sub-systems, we have observed, a tendency to a admit a generalized conception, making it more comprehensive, in the same way, the term property, to cover, as well, other institutes defined as rights in rem by the Civil Code, as follows: possession, trust, fee-farm, dominium utile, and also, the right in rem of concession, for a determined term, by a public deed, the right of surface, regulated by the articles 1.369 to 1.377 of the Civil Code of 2002. The Municipal Real Estate Tax, (IPTU), that must be created by the Municipalities, and the Federal District, has as its own characteristics the tax progressiveness and selectiveness (increase of the percentage considering the higher and lower value, situation and use of the real estate in question, and also being progressive in time, (with increase and progressive percentage, as a sanction for the cases the owner does not follow the city master plan, forcing the real estate to fulfill its social function). Its taxation basis, whose criteria, must be established by law, can be altered by a lower law instrument / O conceito constitucional de propriedade imobiliária para fim de incidência do IPTU sempre foi controvertido. Muitos doutrinadores sustentam uma interpretação extensiva, para abranger não só a propriedade em si, mas também a posse, o domínio útil, a enfiteuse, o direito de superfície, para ficarmos exemplicativamente apenas nessas espécies de direitos reais. Outros não a aceitam. Após singela revista emprestada às teorias de Hans Kelsen e Niklas Luhmann, experimentaram-se duas abordagens de possíveis e diferentes interpretações do tema proposto. Em Kelsen, uma interpretação sistemática conduziu à concepção restritiva do termo, mas, ainda assim, permitiu concluir gozar o legislador municipal da competência para alargar a base de incidência do imposto para além da definição estrita de propriedade. De igual modo, ancorado na teoria dos sistemas, especialmente nos instrumentais extremamente bem manejados por Luhmann, como o acoplamento estrutural entre os diversos sistemas (comunicação) e mesmo subsistemas, verificou-se uma tendência a admitir uma acepção lata, largueando-se, de modo idêntico, a expressão propriedade, para atingir, também, outros institutos definidos como direitos reais pelo Código Civil, a saber: a posse, a fidúcia, a enfiteuse, o domínio útil e, também, o direito real de concessão, por prazo determinado, por escritura pública, da superfície, regulado pelos artigos 1.369 a 1.377 do Código Civil de 2002. O Imposto sobre a Propriedade Predial e Territorial Urbana, que deve ser instituído pelos Municípios e pelo Distrito Federal, tem por característica a progressividade fiscal e a seletividade (aumento das alíquotas em função do maior ou menor valor, localização e uso do imóvel), podendo ainda ser progressivo no tempo (ter alíquotas crescentes e progressivas, de caráter sancionatório, para a hipótese de o proprietário não atender às disposições do plano diretor, fazendo com que o imóvel cumpra a sua função social). Sua base de cálculo, cujos critérios devem ser fixados em lei, pode ser alterada por instrumento infralegal

Atlikus nekilnojamojo turto apmokestinimo Lietuvoje analizę, įvertinti nekilnojamojo turto mokesčio reikšmę savivaldybių ir valstybės mokestinėms pajamoms ir nustatyti pagrindines mokesčio problemas. 2. Išanalizavus ir apibendrinus mokslinės literatūros tyrimus nekilnojamojo turto apmokestinimo klausimais, identifikuoti veiksnius, lemiančius mokestinių pajamų iš nekilnojamojo turto mokesčio kitimą bei parengti nekilnojamojo turto apmokestinimo tobulinimo metodiką. 3. Suformuluoti pasiūlymus nekilnojamojo turto apmokestinimo tobulinimui. / Research object: real estate tax. Research aim: introduce opportunities of the taxation of real estate in Lithuania. This thesis appraises the tax burden of real estate in the Czech Republic and is divided into two parts theoretical and analytical.The first part introduces the taxes in general development of taxes in the Czech Republic and basic terms and laws related to real estate in the Czech Republic.The second part compares the situation in the Czech Republic with foreign countries. It includes an analysis of individual real estate taxes and describes the ways of paying taxes in terms of length and difficulty of the process. Examples of situations in the Czech Republic where there is a need to pay taxes are also outlined in this analytical part.An assessment of a family house for tax purposes is executed on the basis of the author´s choice of real estate. The tax value of the chosen real estate in the Czech Republic is subsequently compared with taxes in Slovakia, Austria, Germany and Poland. The tax calculation of immovable assets and real estate taxes are implemented and described. All knowledge of the present day situation and a reflection concerning the future of real estate taxes in the Czech Republic are summarised at the end of this thesis.

At first, comparison will be implemented on the general level, after that a practical calculation for the most popular type of housing will be realized. This thesis provides a comprehensive view of the tax on real estate and business transfer. A comparison of taxes related with real estate in the countries of the European Union will be used for a prediction of the tax burden on real estate in the Czech Republic for the following years.

The thesis analyses the real estate tax in the municipalities of Řevnice, Lety, Dobřichovice, Čisovice and Všenory during the period 2009 -- 2011. It focuses on the legal powers by which the municipalities may affect the amount of property tax revenue and the extent of their application. Moreover, there is an analysis evaluating the possibility of gaining an additional income from the property tax, in order to offset the deficit caused by the financial or economic crisis. The thesis is divided into four chapters. In the first chapter, there are listed the characteristics of income municipalities, the second chapter is devoted to property tax with an emphasis on the legislative framework; in the third chapter, there is an analysis of property tax revenue in the above listed municipalities, and the final chapter presents and summarizes the analysis results.

Die vorliegende Arbeit besteht aus vier Aufsätzen zum Thema Besteuerung, welche sich in drei Themenblöcke unterteilen lassen: Die ersten beiden Aufsätze dieser Arbeit (Maiterth/Chirvi 2015 sowie Chirvi 2019) widmen sich dem deutschen Ehegattensplitting, der dritte Beitrag (Chirvi/Maiterth 2019) behandelt die Besteuerung gesetzlicher Renten in Deutschland und der vierte Aufsatz (Chirvi/Schneider 2019) untersucht Präferenzen bzgl. der Besteuerung von Vermögen in den USA. Eine Aufteilung anhand der behandelten Steuerarten macht die Arbeit noch übersichtlicher: So behandeln die ersten drei Aufsätze jeweils Aspekte der Einkommensteuer, während sich der vierte Beitrag verschiedenen Arten der Vermögensbesteuerung widmet. Es lässt sich ergänzen, dass die Aufsätze zur Einkommensteuer sehr eng mit dem deutschen Steuerrecht verbunden sind. Sie beschäftigen sich mit existierenden Regelungen (§ 26 sowie 32a EStG zum Ehegattensplitting bzw. § 10 sowie 22 EStG zur Rentenbesteuerung) und deren Auswirkungen. Dies gilt insbesondere für die Beiträge Maiterth/Chirvi (2015), in dem ein Forschungs- und Rechtsprechungsüberblick zum Thema Ehegattensplitting geliefert wird, sowie Chirvi/Maiterth (2019), in dem eine potentielle Doppel- oder Minderbesteuerung gesetzlicher Renten durch das AltEinkG untersucht wird. The third paper (Chirvi/Maiterth 2019) analyzes effects of a reform regarding the transition to downstream taxation of public pensions. Finally, the last paper (Chirvi/Schneider 2019) examines preferences for the taxation of wealth in the United States. While the first three papers analyze (the effects of) specific regulations within the German income tax code (income splitting in Art. 26 and 32a of the German income tax code; the taxation of public pensions in Art. 10 and 22 of German income tax code), the fourth essay is about partially hypothetical types of capital taxation. Maiterth/Chirvi (2015) review the literature on the topic in the areas of public economics, business taxation and tax law and compile arguments for and against the income splitting. As many researchers point out that the income splitting may lead to disincentives for married women to work, Chirvi (2019) empirically analyzes its labor supply effects based on a new approach. Chirvi/Maiterth (2019) evaluate whether the AltEinkG, a reform that lead to a successive transition to downstream taxation, results in under- or double taxation of public pensions in Germany. They develop a measure and subsequently estimate potential under- or double taxation based on official income tax data. Chirvi/Schneider (2019) are interested in preferences regarding capital taxation and conduct a survey-experiment on mTurk to reveal whether preferences depend on the type of tax and/or attributes of assets and personal characteristics. Two of these papers have already been published in the scientific journal Steuer und Wirtschaft, the others can be found in the arqus working-paper series.

Nekilnojamojo turto apmokestinimo sistemų analizė / Analysis of real estate taxation systems

Baigiamojo darbo tikslas – pateikti ir pagrįsti optimalios nekilnojamojo turto apmokestinimo sistemos rodiklius. Tam tikslui buvo atlikta nekilnojamojo turto apmokestinimo sistemų analizė, pagrįstas mokesčio būtinumas, naudingumas ir efektyvumas. Modeliuojant skirtingas rinkas nustatyti esminiai mokesčių tarifų skirtumai. Advalorinėse sistemose dažniausiai taikomas 1 % tarifas. Sistemose nuo ploto naudojamas keturių zonų apmokestinimas aštuoniais tarifais. Apmokestinimo sistema yra efektyvi, jeigu generuojamos pajamos sudaro daugiau nei: 0,5 % BVP, 2 % visų mokesčių pajamų, 25 % savivaldybių mokesčių pajamų. Be to, ryšys tarp minėtų rodiklių privalo būti stiprus. Nekilnojamojo turto apmokestinimo modelis turi būti pasirenkamas atsižvelgiant į mokesčių mokėtojų disponuojamas pajamas, turto vertę, apmokestinimo teritoriją. / The main purpose of this work is to reveal performance of the optimal real estate taxation system. To this end was made of real property taxation systems analysis, based on the necessity of tax, utility and efficiency. Modeling the different markets of the essential differences between the tax rates. Ad valorem systems is largely restricted to 1% rate. Systems from the area used for taxation of eight four-zone rates. The taxation system is an effective, if generated revenues of more than 0,5% of GDP, 2% of the total tax revenue, 25% of municipal tax revenues. In addition, the relationship between these variables must be strong. Real estate tax model should be chosen according to the tax payers' disposable income, value of the property tax area.
