Challenges to the role of the executive mayor in financial management at selected local municipalities in the Free State / Brutus Tshepo Mahlaku.

Local government, as government at grassroot, has, probably undergone transformation more than any institution in post-1994 South Africa. State-of the-art legislation have been passed that have restructured municipalities, and, especially, in the areas of performance and conduct of councillors and officials. Prominent in the areas of transformation are the roles of the Executive Mayor, which are no longer ceremonial as well as the radical changes which have been legislated in municipal financial management. This study was undertaken to determine the challenges that confront the Executive Mayor in financial management in selected local municipalities in the Free State. The hypothesis was formulated that "despite the state-of-the art legislation to regulate municipal finance, Executive Mayors in municipalities face the challenge of poor service delivery as a result of noncompliance to financial statutes due to human resource incapacity". To test the hypothesis, use was made by empirical research that comprised questionnaires completed by sample of managers and officials in the selected local municipalities of Mafube, Metsimaholo, Moqhaka and Ngwathe.The findings, amongst others, were that: • Human capital in the 4 selected local municipalities are in their prime age. 69 percent of managers are in the aged between 30 years to 50 years; • 57 percent of the managers responded that they have adequate qualifications and training to pursue the challenges in municipal finance; • All 4 municipalities normally get their budgets approved as required by compliance. • The hypothesis was consequently, invalidated. The study ends with recommendations to help improve standards and quality of financial management practice in the 4 municipalities.

Magister Legum - LLM (Public Law and Jurisprudence) / In any democratic society, elections are a significant mechanism for citizens to communicate with their representatives. As a result, elections provide a window of opportunity to every voter to hire or fire any political party or independent representative. As an aggregated measure of popular preference, elections constitute an important means to affirm that people in any society should be free to choose their own government based on the parties political beliefs and policies that appeal to the needs of the electorates. Powell sums up this perspective in two points; first, the voter must be able to identify the prospective future governors and have some idea of what they will do if elected. Secondly, the outcome of the elections should bring into office a coherent government whose inherent powers are clearly defined and limited. However, elections sometimes do not produce a single party with an absolute majority to form a government. In such an instance, a coalition or minority government becomes inevitable. It has been argued that coalitions are formed for two different yet interrelated reasons; first to pursue common goals among coalition partners. Secondly, to enable the coalition partners to share the benefits related with being in power. No matter what the intentions are for forming a coalition by the political parties, coalition governments are bound to encounter challenges. One of the challenges is the need to consult and reach consensus among coalition partners, which may not only result in government decision-making being slower but also more complex. Secondly, conflicts within a ruling coalition can make a government unstable and weak due to conflicting ideologies.

Against this background, the study consists of a theoretical exploration of the nature of the metropolis as a feature, as well as specific concepts related to it, an investigation into the most important metropolitan problems and an outline of the historical complications regarding the origin of metropolitan municipalities. In addition to this, personnel matters, financial relations and systems, the integrated development plans, ward committees and the role of councillors within the context of the CTMM were also investigated. / Public Administration / M.P.A.

Local government enables a direct link between the general public and the basic services that they are entitled to by means of their constitutional and legislatively entrenched rights. It is the only sphere of government that allows and encourages face-to-face engagement between citizens and their governors, providing the necessary platform for interaction, contact and communication. It is imperative therefore that this tier of government operate optimally and competently, as it represents a reflection of the operation of government wholly. Research unfortunately illustrates that public perceptions of local government are negative, with levels of trust in local government being substantially lower than those in provincial and national governments. The responsibility for failure to perform would lie squarely on the shoulders of those individuals leading any institution. The leading incumbents driving a municipality are the political and administrative heads, i.e. executive mayor and municipal manager.</p>

The significance of Auditor-General in the control of public funds in local government with specific reference to Mopani District Municipality

MPM / Oliver Tambo Institute of Governance and Policy Studies / The aim of the study investigates the significance of Auditor General in the control of public funds in local government with specific reference to Mopani District Municipality in order to make recommendations that can assist in improving the control of public funds. The research identifies and assesses weaknesses in how Mopani District Municipality has been controlling its public funds by analyzing the Auditor General reports for the past three financial years and its implications to service delivery. The research further assesses the role played by Auditor General in influencing the internal financial control of the municipality and in auditing the performance of the municipality since in other municipalities money is paid to contractors for services not rendered. The study provides academic input into public administration, specifically in the area of improving service delivery performance, control and financial performance management in municipalities. The study could contribute to the establishment of effective ways of monitoring the control of public funds by municipalities. / NRF
