The discussion on this topic is important, given the specialization of gender identified in this violence and the existence of justifications for sexual violence in juridical statements, being notorious the lack of studies on the subject in the field of Law that have feminist slant and transforming pretense. To find possible answers to the issues raised in this study, it was discussed in the first chapter about the theoretical references of sex/gender, biopolitics, sexuality dispositive and love dispositive, and also the historical evolution of the crime of rape; in the second chapter, the relationship between the formation of legal truth about rape and the judges' posture towards the procedures of collection and analysis of proofs; and in the third, the interpretative impact of rape, under the cutouts of sexual dimorphism, love dispositive and control of children and youth's sexuality. A qualitative research of analytical character was made through discourse analysis that was developed on the data collected from judgments of the Court of Justice from Paraíba, in cases originated in criminal courts of Campina Grande - PB, in the period between August 2008 and August 2014. / Tendo como objeto de estudo o estupro de mulheres no discurso jurídico, buscou-se problematizar as formações práticas e discursivas que envolvem a formação da verdade jurídica sobre o estupro em processos criminais. A discussão do tema é importante face à especialização de gênero identificada nessa violência e à existência nos dizeres jurídicos de justificativas para a violência sexual, sendo notória a escassez de estudos sobre o assunto no âmbito do Direito que possuam cunho feminista e pretensão transformadora. Para encontrar possíveis respostas para a problemática levantada nessa pesquisa, discorreu-se no primeiro capítulo, acerca dos referenciais teóricos de sexo/gênero, biopolítica, dispositivo da sexualidade e dispositivo amoroso, além da evolução histórica do crime de estupro; no segundo capítulo, sobre a relação entre a formação da verdade jurídica sobre o estupro e a postura dos juízes frente aos procedimentos de colheita e análise das provas; e no terceiro, a respeito das repercussões interpretativas do estupro segundo os recortes do dimorfismo sexual e do dispositivo amoroso. Fez-se uma pesquisa qualitativa de caráter analítico, através da análise de discurso desenvolvida sobre os dados coletados de acórdãos proferidos pelo Tribunal de Justiça da Paraíba, em processos oriundos de Varas Criminais da Comarca de Campina Grande - PB, no período compreendido entre agosto de 2008 e agosto de 2014.

Analisa-se o processo de produção do cuidado em serviços de saúde mental na cidade do Rio de Janeiro, tomando como lócus de investigação duas instituições psiquiátricas universitárias, que mantém sua estrutura asilar, com aparente modernização e a rede pública municipal dos dispositivos da atenção psicossocial, os Centros de Atenção Psicossocial, que operam na construção de um novo tipo de referência terapêutica cujo foco de suas práticas coloca o usuário-centrado na cena do cuidado e privilegia as questões de existência dos mesmos quando reconhece esse sujeito em sua singularidade, subjetividade e na diferença de andar a vida. Para tanto, a investigação teve por objetivo a produção de conhecimento atualizado sobre os discursos e práticas que os agentes institucionais veiculam e representam sobre a produção do cuidado nas instituições em questão. No sentido metodológico exploramos os dados do discurso e da prática do cuidar, entendendo que o processo de trabalho em saúde é um conjunto de práticas institucionais articuladas às demais práticas. Desta forma, a pesquisa procurou caracterizar o processo de produção do trabalho do cuidado em saúde mental, no contexto dos serviços. Pretendeu-se compreender os elementos constitutivos que operam esse trabalho, identificando e estabelecendo suas tendências no cenário socioinstitucional. Assim, não se trata de uma avaliação da qualidade dos serviços de saúde mental, mas sim, de uma análise qualitativa das práticas no cotidiano da produção deste cuidado. Observou-se que são múltiplos os sentidos e significados presentes na gestão do cuidado desenvolvida no campo da saúde mental, particularmente, no campo da atenção psicossocial. São ainda vários os desafios no cotidiano dos serviços públicos de saúde mental na construção dos novos modelos técnico-assistenciais. Isso se observa quando se toma o coletivo que o faz, técnicos, usuários e familiares, que tem como referência esse ethos da produção do cuidado, principalmente, na direção ético-estética e política por parte de todos esses na concretização de um equipamento aberto e de base territorial-comunitário. / This thesis analyzes the production process of care in mental health services in the city of Rio de Janeiro, taking as a locus of two psychiatric institutions research university that maintains its structure asylum, with apparent modernization and municipal public of the provisions of psychosocial care Psychosocial Care Centers, which operate in the construction of a new reference type whose therapeutic focus of their practice puts the "user-centered" care at the scene and privileges "questions of existence" that recognizes when the same subject in its uniqueness , subjectivity and difference in "living life." Therefore, research aimed at the production of updated knowledge about the discourses and practices that convey and represent institutional agents on the production of care in the institutions in question. In order methodological explore the data of speech and practice of caring, understanding that the process of health work is a set of institutional practices articulated with other practices. Thus, the study sought to characterize the production process of the work of mental health care in the context of services. The aim is to understand the components that operate this work by identifying and establishing trends in socio-institutional setting. Thus, it is not an assessment of the quality of mental health services, but rather, a qualitative analysis of practices in the production of this everyday watch. The institutional actors speak the perspective of a particular place in relations socio-institutional study. It was observed that there are multiple meanings present in care management developed in the field of mental health post-reform, particularly in the field of psychosocial care when taking both university spaces as the municipal network CAPS. Are still many challenges in everyday public mental health services in the construction of the new models and technical assistance. This can be seen when taking the collective that does, technicians, patients and families, which has reference to that ethos of care production, is subjective, is aimed primarily toward aesthetic and ethical-political by all those in implementation of an open equipment and territorial-based community. Hence the need for constant evaluations, careful monitoring so that these practices do not reproduce in the new model, the old order asylum, fragmented care by the technical and scientific knowledge, the disciplining of bodies, censorship of words.

Nesse sentido propõe uma reflexão crítica sobre a legitimidade enquanto determinação central mobilizada pelas diversas correntes do profissionalismo, a partir de uma avaliação feita sobre bases marxistas. Assim, pontua o caráter arbitrário da abstração da legitimidade e pondera que tal discussão precisa ser melhor considerada a partir da sua ligação com o fenômeno da ideologia. Fornece também um quadro sintético sobre os principais lineamentos dos trabalhos de José Paulo Netto, Marilda Iamamoto e Vicente Faleiros no campo dos fundamentos do Serviço Social. A investigação destaca os elementos inovadores das ideias de tais estudiosos, defendendo que deles pode-se extrair algumas bases fundamentais para o tratamento da legitimidade no âmbito profissional. / The dissertation explores the theoretical and methodological differences between the most relevant paradigms of Professional Sociology and the more important contemporary conceptions about the statute of the Social Assistant’s work. It shows a critical reflection on legitimacy as a central determination taken by the different theories of professions, departing from an evaluation constructed on a Marxist base. Thus, it affirms the arbitrary character of legitimacy and it establishes that such discussion is more accurate if considered in its relation to the ideology phenomena. The dissertation also presents an analytical synthesis of main points of the works of José Paulo Netto, Marilda Iamamoto and Vicente Faleiros in the field of Social Work’s foundations. The research remarks the innovative elements of the ideas of such scholars, defending that they can provide the central bases to the understanding of legitimacy in the professional field.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / O presente estudo objetiva identificar e analisar as condições políticas e as motivações que resultaram na finalização das atividades do Sindicato dos Assistentes Sociais do Rio de Janeiro em 1990, tendo em vista os elementos estruturais, conjunturais e políticos envolvidos na trajetória sindical em geral e particularmente àqueles presentes na trajetória dos assistentes sociais. A investigação partiu da hipótese de que sobre o processo que resultou no fechamento do sindicato incidiram determinações que não poderiam ser explicadas apenas como o esgotamento de um movimento que teve ao longo dos anos 1980 ações de destaque na organização e aproximação da categoria com as lutas dos demais movimentos sociais em curso no país e particularmente no Estado do Rio de Janeiro. Os dados analisados foram coletados por meio de entrevistas, análise dos registros e documentos institucionais arquivados no Sindicato dos Assistentes Sociais do Estado do Rio de Janeiro (SASERJ), arquivos pessoais, acervo do Centro Brasileiro Cooperação Serviços Sociais (CBCISS), acervo do Conselho Regional de Serviço Social do Rio de Janeiro (CRESS), teses, dissertações, trabalhos de conclusão de curso e anais dos congressos da categoria. A reflexão sobre os dados foi referenciada por considerável bibliografia acerca da organização sindical brasileira e das transformações do Estado brasileiro no período abordado. / The present study aims at to identify and to analyze the political conditions and the motivations that resulted in the finalization of the activities of the Syndicate of the Social Workers of Rio de Janeiro in 1990, tends in view the elements structural, of the situation and politicians involved in the syndical path in general and particularly to those presents in the social workers path. The investigation began of the hypothesis that on the process that resulted in the closing of the union happened determinations that could not just be explained as the exhaustion of a movement that had along the years 1980 prominence actions in the organization and approach of the category with the fights of other social movements in course in the country and particularly in the State of Rio de Janeiro. The analyzed data were collected through interviews, analysis of the registrations and institutional documents filed in the Syndicate of the Social Works of the State of Rio de Janeiro (SASERJ), personal files, collection of Regional Council OF Social Service of Rio de Janeiro (CRESS), theories, dissertations, works of conclusions course and annals of the Congresses of the category. The reflection on data was established on for considerable bibliography concerning the Brazilian State in the approached period.
