The use of framework agreements in public procurement Framework agreements in public procurement are a special type of public contracts facilitating the process of the award of supplies, services or works. The main purpose of this master thesis is to undertake a comprehensive analysis of the provisions of framework agreements in the field of public procurement. The master thesis is based on the current provision of the Act No. 137/2006 Coll., on Public Procurements and is divided into five chapters. Chapter one deals with the adaptation of framework agreements in the legislation both in the Czech Republic and in the European Union and as well with the development of this legislation. Chapter two focuses on the basic principles and concepts of the Act No. 137/2006 Coll., on Public Procurements which are relevant for the topic of this master thesis. The first part of this chapter defines the basic principles contained in the Act and the in the legislation of the European Union. The second part of this chapter then presents basic information about the most important institutes of the Act. The third chapter deals with the first phase of the awarding of public contracts with the use of the framework agreement, thus concluding the framework agreement and also in the conduct of the procurement procedure....

Conservation planning in Europe : ecological, financial, and political challenges

Conservation of biodiversity and sustainable resource use are central aims within ecology. This thesis focuses on the current data and environmental frameworks used to support these aims across different states in Europe. In particular, it examines the impact of geo-political boundaries on data-use, funding and planning for temporal movement of species in response to climate change. It also examines the current environmental framework agreements in Europe and their capacity to deal with trans-boundary aspects of biodiversity change. Through examination of European biodiversity datasets, undertaking species distribution modelling of forest taxa, examining economic data, palaeo-ecological data, and assessing international environmental framework agreements, this thesis identifies a number of important knowledge gaps. Probably unsurprisingly, the distribution of biodiversity in Europe mostly does not match political entities, all of which have individual aims, financial resources, and biodiversity management regimes in place. All have a significant impact on biodiversity conservation planning because i) the use of geo-politically truncated data influences modelling predictions, ii) financial commitment to biodiversity conservation varies between countries influencing success outcomes, iii) biodiversity persistence in current and future climate change does not recognise geo-political boundaries, and iv) many of the key environmental frameworks are implemented within countries and do not considering trans-boundary issues. Overall these findings significantly improve the understanding of conservation and resource management in Europe and fill a number of important knowledge gaps. They highlight the importance of appropriate trans-boundary ecological datasets and the need for more consistency across Europe in financial resources for biodiversity conservation. They also highlight the need for appreciation of areas of high-persistent biodiversity regardless of geo-political boundaries and environmental framework agreements that support cross-border conservation measures.

International framework agreements as a form of transnational labour relations

This qualitative research paper examines the emergence and main features of International Framework Agreements (IFAs) as a form of transnational labour relations. IFAs originated in the 1980s and proliferated after 2000. They aim to secure core labour rights across multinational corporations global supply chains. Globalisation changed the world of work, and, as a result, there is a call to look beyond national borders with reference to labour relations. Transnational corporations were the primary movers of mobility, but since then finance, people, and ideas joined the world of flows, introducing the new arena of transnational labour relations. The purpose of this research was primarily to determine what transnational labour relations are, and to determine whether IFAs form part of this transnational labour relations system. By conducting a document analysis and doing a literature review, the researcher analysed the contents of various articles, and assessed the substantive and procedural aspects of some IFAs concluded before 2008. Finally, key issues surrounding IFAs, such as the scope of agreements, trade union capacity, and global supply chains, are discussed in the context of international labour s campaigning, organising, and negotiation activities. An approach to the semantic intelligence cloud

Cloud computing is a disruptive technology that aims to provide a utility approach to computing, where users can obtain their required computing resources without investment in infrastructure, computing platforms or services. Cloud computing resources can be obtained from a number internal or external sources. The heterogeneity of cloud service provision makes comparison of services difficult, with further complexity being introduced by a number of provision approaches such as reserved purchase, on-demand provisioning and spot markets. The aim of the research was to develop a semantic framework for cloud computing services which incorporated Cloud Service Agreements, requirements, pricing and Benefits Management. The proposed approach sees the development of an integrated framework where Cloud Service Agreements describe the relationship between cloud service providers and cloud service users. Requirements are developed from agreements and can use the concepts, relationships and assertions provided as requirements. Pricing in turn is established from requirements. Benefits Management is pervasive across the semantic framework developed. The methods used were to provide a comprehensive review of literature to establish a good theoretical basis for the research undertaken. Then problem solving ontology was developed that defined concepts and relationships for the proposed semantic framework. A number of case studies were used to populate the developed ontology with assertions. Reasoning was used to test the framework was correct. The results produced were a proposed framework of concepts, relationships and assertions for a cloud service descriptions, which are presented as ontology in textual and graphical form. Several parts of the ontology were published on public ontology platforms and, in journal and conference papers. The original contribution to knowledge is seen in the results produced. The proposed framework provides the foundations for development of a unified semantic framework for cloud computing service description and has been used by other researchers developing semantic cloud service description. In the area of Cloud Service Agreements a full coverage of the documents described by major standards organisations have been encoded into the framework. Requirements have been modelled as a unique multilevel semantic representation. Pricing of cloud services has been developed using semantic description that can be mapped to requirements. The existing Benefits Management approach has been reimplemented using semantic description. In conclusion a proposed framework has been developed that allows the semantic description of cloud computing services. This approach provides greater expression than simplistic frameworks that use mathematical formulas or models with simple relationships between concepts. The proposed framework is limited to a narrow area of service description and requires expansion to be viable in a commercial setting. Further work sees the development of software toolsets based on the semantic description developed to realise a viable product for mapping high level cloud service requirements to low level cloud resources.

Perspectives on the implementation of the performance management and development system in the department of social development in Eastern Cape

<p>This research report, explores the challenges contributing to a non-effective implementation of performance and development management system at the Department of Social Development in Eastern Cape. My argument is that although the system has been fully implemented throughout the province and in all the layers of the department, there are still challenges that contribute to its ineffective implementation of this system. This research report debates a range of issues such as: challenges that revolve around the lack of proper&nbsp / knowledge and training in staff, non-alignment of performance contracts with operations of the department, attitudes of officials towards the system itself and the desired&nbsp / institution&rsquo / s operation that may contribute to its performance and achieve its objective of effective service delivery meaningfully. The research report also explores the paradigm shift&nbsp / of the department from a traditional &lsquo / welfarish&rsquo / approach to a one that focuses on social development. This research especially seeks to understand how the department seeks to plan for institutional change that will promote delivery its services to communities more. The reason for this focus derives from department is practice to provide services sectoralyand not in an integrated manner. Hence the critique, in this research is of the roles and responsibilities of all different layers of the department. This, I specifically argue for re-orientation of the department, not merely institutionally, but also strategically by adopting a social development approach to service delivery.</p>

What they have in common figures as diverse as a joint-venture agreement, a franchise agreement or a marriage contract? Is the old general theory of contract adapted to the contractual practice of the XXI century? A deep study of the normative contract in this book provides answers to these and to many other momentous matters of Private Law of Contract. Reconstructed from the detailed analysis of the theory and legal practice, the notion of normative contract as an agreement of cooperative nature could constitute the bridge to a new and inspiring way of conceiving the contract.
