The principle of autonomy of will is considered to be the crucial principle controlling all private relationships of human life. People in the sense of individuals of private law have opportunity to form their private relationships according to their free will thanks to the autonomy of will, even while within certain predetermined limits. The principle of autonomy of will is closely related to the principle of non-mandatory rule in private law and to the principle of equality, the principle of pacta sunt servanda and to the principle according to a person acts lawfully unless there is a legal rule prohibiting or curtailing that behaviour. The purpose of my thesis is to classify the term autonomy of will in its historical context and its definition in the context of other principles and institutions of private law. The importance of this principle is further illustrated by the specific expressions autonomy of will in our legal system. My thesis is composed of a general part and a special part. The general part is divided into three chapters. This dissertation takes an employee-centred approach to explore the power that employers have to regulate the physical appearance of their employees in the Canadian workplace. Specifically, it analyzes the limitations and potential of existing human rights instruments for protecting the appearance interests of employees in Canada, with primary focus on British Columbia, Ontario, and Quebec. Appearance matters a great deal in the North American context. Scholars of sociology have established that as a social and identity marker, as well as a powerful means of expression, appearance should be considered as fundamental to an employee’s identity, sense of self, and personhood. In particular, these studies show that appearance choices (such as tattoos, piercings, grooming practices, and clothes) are important to an employee’s sense of self; they are therefore worthy of legal protections. Yet, under the current state of law in Canada, workplace appearance regulation is legal, with limits for the most part dependent on whether or not employees are unionized. This dissertation takes up the question of how to address employees’ appearance in the workplace as a human rights issue by offering two frameworks of analysis—the anti-discrimination approach and the fundamental rights at work approach. Physical appearance is not a protected ground of discrimination in Canada. As such, approaching the question of workplace appearance policies and practices through an anti-discrimination lens offers some considerable challenges for employees in a private employment relationship in most Canadian provinces. In Quebec, the Quebec Charter of human rights and freedoms protects a wide range of fundamental rights and freedoms applicable to private employment relationships, including the right to dignity, the right to privacy, and the right to freedom of expression. Quebec employees have successfully raised these rights in order to challenge workplace appearance regulation. Quebec employers are thus more limited regarding appearance policies than their counterparts in the rest of Canada, because of the fundamental rights at work framework, which offers a balanced approach to employers’ and employees’ competing interests. With a careful review of both frameworks, I argue that legislative changes could enable shifts in cultures of work, and I conclude with some modest proposals to achieve better protections for employees broadly, and more specifically with respect to the importance of appearance in the workplace. / Graduate / 2021-08-14

The submitted diploma thesis provides an introduction into the topic of conflict of the personality rights of an individual with the freedom of expression of media and right to receive information of others. The emphasis is put on the Czech and European case law. Marginally is mentioned also the topic of new media, especially the latest case law of the European Court of Human Right on this matter. The diploma thesis is divided into introduction, conclusion and three chapters. The first chapter introduces the basic definitions and theoretical basics of the topic. The reader is acquainted with the concept of human personality and its components, with the concept of personality rights and their nature as well as with the possible infringements of these rights. On observe au plan national comme international une augmentation de la consommation de certains produits, singulièrement de drogues illicites, voire d’une poly consommation (alcool, médicament, cannabis,…). Du fait de cette tendance générale, mais aussi en raison des évolutions propres au travail, les lieux d’activité professionnelle sont aujourd’hui de plus en plus confrontés à la question. En effet, des risques peuvent être encourus au travail par le consommateur, ses collègues ou des tiers. Alors même que les obligations patronales concernant la santé et la sécurité des travailleurs sont aujourd’hui substantielles, l’employeur est tenu dans sa gestion de la question au respect des libertés et droits fondamentaux de la personne salariée. En évitant toute approche généralisante, dénonciatrice du salarié-consommateur nécessairement pourvoyeur de risques pour l’entreprise, il convient, dans une démarche constructive, de ne pas nier un phénomène porteur de mises en cause potentielles de la santé ou de la sécurité de travailleurs, de difficultés de gestion et de responsabilités de l’entreprise. Quelles réponses juridiques sont disponibles, pertinentes, imaginables, dans une perspective à la fois de sécurisation juridique des entreprises mais aussi de respect des libertés et droits fondamentaux des personnes, de prévention des risques professionnels et de prise en charge du salarié consommateur ? L’approche juridique entend ici prendre en compte les réalités du terrain, les acquis et questionnements d’autres disciplines ainsi qu’un éclairage de droit comparé. / At both national and international levels we can observe an increase in the use of certain substances, particularly illicit drugs and even poly consumption (alcohol, medication, cannabis,…). Due to this general trend, and because of evolutions inherent to work itself, the work place is now more and more confronted to these issues. Indeed, such behavior exposes the user, his or her colleagues and even third parties to a number of risks. Even though employer's duties on matters concerning employee's health and safety are substantial nowadays, the employer is held to respecting the fundamental rights and freedom of the worker when dealing with such issues. While avoiding a general approach that would simply denounce the user-employee that is necessarily a cause of risk exposure for the firm, it is necessary, in a constructive approach, to not deny a phenomenon that puts in question the health and safety of the workers, and generates managerial and liability problems for the firm. Which are the available juridical responses that are pertinent and imaginable, that would protect legal certainty, respect the fundamental human rights of the people involved, help prevent professional risks and take care of the employee-user? The juridical approach intends to take into account the realities of the field, the insights of other scientific disciplines and a comparative contribution.

The content of the presented thesis is the introduction of selected institutes of the laws on political parties and their enactment in the Czech Republic and the Federal Republic of Germany. The thesis is divided into two chapters. The first addresses the fundamental questions of the legal regulations on political parties in both countries. The second deals with the funding of political parties. Because this is a comparative thesis, individual legal regulations are always introduced in the first two subchapters. The third subchapter compares the most significant institutes and their possible use in the Czech law is proposed. The main points of the first chapter are especially the process of political party creation, the comparison of anchored attributes of a democracy capable of defence in the laws and last but not least also the contemplation of the possible expansion of the addressees of the right to form and join political parties and political movements, pursuant to Article 20 par. 2 of the Charter of Fundamental Rights and Freedoms, also to foreigners staying in the Czech Republic for a long time. L’entreprise naît en Droit d'un alliage complexe de notions juridiques (le contrat de travail, la personnalité morale, la représentation collective des travailleurs, etc...). L'ordonnancement systématique de celles-ci s'impose pour percevoir la cohérence de l'organisation juridique de celle-là. Des lignes de force se dégagent. Le contrat de travail oppose deux parties aux intérêts antagonistes. Mais la libération de la force de travail du salarié, partie de sa personne, et la pérennisation du lien contractuel les obligent à coopérer. Ce mouvement est renforcé par certains mécanismes étrangers à la nature du contrat de travail. Sont organisés le partage du contrôle de l’entreprise (lequel suppose d’assurer la représentation collective des travailleurs) et celui de ses utilités. Les salariés deviennent alors des quasi-associés. L'organisation juridique de l'entreprise n'est toutefois pas figée par le dogme. Des idéologies concurrentes en façonnent les contours. Juristes et économistes prétendent à l'organisation scientifique de l'entreprise. / In Law, the firm is the result of a complex amalgam of legal concepts (employment contract, legal personality, collective representation of workers, etc.). The systematic ordering of these ones is needed to perceive the coherence of the legal organization of that one. Guidelines emerge. Employment contract is the meeting of two parties whose interests are antagonists. But the release of the labor force of the employee, part of his person , and the sustainability of the contract require them to cooperate. This trend is reinforced by some mechanisms non implied by the nature of the employment contract. Are shared the control of the company (which involves the collective representation of workers) and of its benefits. Employees then become nearly considered as the stockholders are. The legal structure of the firm , however, is not fixed by dogma. Competing ideologies are shaping it. Some focus on purposes. The company is alternately used as a means for employment and for the will of the enterpreneur. Others focus on methods. Lawyers and economists try to organize the firm scientifically.

The qualitative method of research using semistructured interviews is used to realize the aim of the thesis. The research is carried out at the OSPOD in Český Krumlov.
