Trade and investment disputes : whose business is it anyway ?Casanova-Jimenez, Richard P. January 2002 (has links)
This thesis is a discussion on whether every sector of human activity really is or needs to be 'global'. It discusses the impact that economic globalization has on the role of the nation-state and on the concept of democracy, at both local and international levels. Particular emphasis is put on some of the democratic challenges associated with dispute settlement at the WTO and also under foreign investment international instruments. It is argued that increased participation by non-state actors, particularly NGOs, in state-to-state and in investor-state arbitration threatens to weaken the arbitration process and does little to remedy alleged democratic deficiencies. The author concludes that many democratic concerns regarding these types of dispute settlement processes may be better addressed by strengthening national democracies. Increased public information, consultation, and participation in the shaping of foreign policy could reduce much of the criticism concerning both, international dispute settlement and decision-making.

This work analyses the Brazilian federal government attempts to redefine the Public Educational System purposes, as a social institution, after the changes happened (international and national levels) in the productive, cultural and political sites, as a result of the economic globalization and the ideology of liberalism which are presented as a concrete reality in the contemporary scenery. This investigation focused the international context of the seventy and ninety decades of the twentieth century; the national environment related to the Brazilian educational curriculum reform; the process of the elaboration of the National curriculum parameters and the backgrounds in which the parameters are based. This research aimed to verify how the social changes influenced the redefinition of the goals of the public educational system. Besides this, it was examined which were the leading concerns linked to this redefinition and how these concerns defined the curriculum references. Through this research it was proved that the redefinition of the public educational system cannot be conveyed through a very restrict group of professional leaders. The community which gives academic and economic support to the public educational system must be involved in order to discuss the process of the redefinition. It was also verified that the accomplishment of the new curriculum proposal is linked to several significant issues that cannot be fulfilled only through the good will of the professionals who were in charge of the execution of the new parameters in the classrooms. The National Curriculum Parameters discourses are easily optimistic, assuming that the implementation of the new proposal will be an easy task for these professionals. Opposed to this optimistic and naïve view, this analyses assumes that a curriculum reform cannot be implemented as a simple result of the good governmental intention, which can be real or rhetorical.

Para tal, há um capítulo dedicado a Amartya Sen, principal fonte teórica que fundamenta a recondução da política social em direção ao alívio da pobreza / Abstract: The thesis presents an analysis about theoretical foundations which guide social policies, observing, particularly, the meaning of poverty combat centrality on the conduction of priorities in contemporary social international agenda, signalizing which symbolic and material conditions instruct the transformation of social question theoretical status and its opposition forms, affirming an inflexion on analysis sense which start to privilege theoretical and methodologically a individualistic way of thinking social reality. One of the main objectives of this work is to show that happened changes in logic direction which inspires social policy construction, emphasizing how values conflicts which appears in nowadays poverty debates and how to fight it provides essential elements to comprehend changes in present social policies functionality and sense. The theoretical basis start with a discussion about the nature of poverty relief and its economic, political and ideological functions since the beginning of capitalist work market formation, which shows up faced with a description of social policy origin and development, which values and functions are quite different criterion of limited poverty relief arrangements. Special attention is given to Anglo-Saxon thought, particularly American social policy liberal tradition. Social policies recent transformations and social protection reforms appears as part of a larger movement in social reality located through a new global economic order and new post Cold War international relations pattern, which presents a renewed economic determination with globalization naturalization in front of political actors new positions (states, international organisms, financial corporations, etc.) who adopted new forms to play the part of an dialogue in international arena. World Bank shows up as a nuclear reference to demonstrate how economic and social development theories spread through international institutionallity, emphasizing its intellectual and symbolic activities, especially about structural adjustment and poverty combat. Another central thesis objective is to exhibit principal theories foundations which constitute the mosaic of the new liberal ideological hegemonic configuration which justifies and accompanies contemporary global order, what is subjected in the second part if this work. Because of that, there is a chapter dedicated to Amartya Sen, considered main theoretical source which lead back social policy into poverty relief / Doutorado / Doutor em Ciências Sociais
