Implementing environmental policy requirements in low-cost housing in South Africa : a case study of Msunduzi Municipality.Karemera, Pascal. January 2007 (has links)
In 1994, the South African government set in place an ambitious plan to reduce the housing backlog and eradicate slums by 2012. The delivery of housing is subject to the South African National Environmental Management Act of 1998 that seeks to ensure sustainable resources use towards sustainable development of all activities. However, the question is whether or not reality matches the policy’s vision. One concern which arises is that the high demand for housing and the speed with which delivery of low-cost housing is occurring may compromise the environment. This study examines the challenges of implementing environmental policy requirements in low-cost-housing, using the case study of Ambleton in the Msunduzi Municipality, KwaZulu-Natal, South Africa. In attempting to assess the challenges of implementing environmental management policy requirements of the housing policy of 1994 and NEMA of 1998, four key challenges were identified: understanding environmental policy requirements, institutionalising capacity and cooperation, resolving conflict of values among stakeholders, and recognising budget constraints. The key participants in the study were officials from the provincial departments of Housing and the Department of Agriculture and Environmental Affairs, Msunduzi Municipal officials who implement the policy, including the Ward Councillor of Ambleton and the Service Provider. The methodology used to gather data was observation, in-depth interviews, and document review. It was revealed in the study that the understanding of policy requirements amongst key stakeholders is limited and that the institutional capacity is limited in terms of skills, coordination, and physical capacity. Different priorities of stakeholders play a major role in budget and priority setting by government, which affect the implementation of environmental policy requirements. It was pointed out by municipal staff that there is a shortage of funds for meeting all environmental policy requirements. Also explored were possibilities for improving environmental policy implementation. These include making environmental policy requirements in housing and NEMA more explicit to enhance stakeholders’ understanding, and enforcing compliance by environmental monitoring and audits. Reconstruction and Development Programme in Post-apartheid South Africa: a study of Public Perceptions of the housing service delivery in Chris Hani Park Block 3 township, East LondonCewuka, Thembakazi Gloriadaria January 2013 (has links)
This research sought to understand the perceptions of the township dwellers who are the beneficiaries of the RDP houses in a selected township, Chris Hani block 3 in Mdantsane, East London, in the Eastern Cape. The study specifically sought to establish whether the houses delivered to the residents through the Reconstruction and Development Programme (RDP) adequately meet the basic standards prescribed by the relevant housing policy of South Africa. During the apartheid era black South Africans were marginalised, their development was separate from that of whites and they had no say in what was provided for them, hence they were inadequately housed. On coming into power, the post-apartheid government undertook through legislation to provide sustainable, adequate housing that would address the needs of the historically disadvantaged citizens/poor people of South Africa. The main finding of this study conducted on a sample of ten RDP housing beneficiaries, through personal interviews is that, the RDP is a good programme; however, its implementation is characterised by corruption and greed. The people, whom the programme is meant to benefit, have never been involved in their own development with the results that the houses provided to them, are of a sub-standard quality. The houses do not adequately address the housing needs of the people. The housing policies are also not adequately implemented. It is the author’s hope that the recommendations made by this study, if implemented, will improve the standard of the RDP houses provided to the poor people of South Africa.

Segregated housing and contested identities: the case of the King William's Town coloured community, 1895 - 1946Victor, Stephanie Emilia January 2007 (has links)
This thesis is a case study of the dynamics of coloured housing in King William's Town between 1895 and 1946. The impact of spatial segregation on pre-apartheid coloured settlements in the Eastern Cape has largely been ignored up to the present. This needs to be rectified as the lack of in-depth enquiry can lead to misinterpretations that may influence contemporary politics and identity formation. Through research based on primary sources, it has become apparent that segregation in King William's Town was safeguarded and rationalized through the discourses of sanitation and civilization, and the practices of relocation and removal. The existing slum cond itions were used as a convenient excuse to implement municipal control. Segregation compounded the problem of poverty, inequitable access to housing and the provision of basic services. As a result, local coloured housing was increasingly characterised by a shortage of decent accommodation and basic services, decreasing home ownership and increasing municipal tenancy. In addition, through the implementation of the 1923 Natives (Urban Areas) Act and the 1934 Slums Act, high sanitation standards were set, but the Council itself provided inferior services. Ironically, conditions in the relocated municipal settlements were also not on par with the provisions stipulated in the Slums Act that were used to effect removal in the first place. The implementation of racially exclusive housing was, therefore, not driven by a single role player. It was pioneered by the local authorities, legalised by national government and supported by the coloured elite, when needed, in an attempt to access decent housing. This occurred mainly through the political manoeuvring of the coloured elite, and specifically the African Political (later People's) Organisation (APO), the Afrikaanse Nasionale Bond (AN B) and the locally constituted Coloured Welfare Association (CWA) in King William 's Town. These organisations attempted to procure access to housing within the narrow boundaries of a prescribed identity. Segregated housing therefore fostered and sustained coloured identity. It consolidated feelings of separateness and division and provided impetus for the construction of race and even racial tension. Coloured identity attempted to serve as a rallying point to overcome differences in religion, family and social networks and place of residence in order to procure access to housing. It was not, however, able to overcome the occasional division between settlements, caused by well-developed placeidentities, which still inform the contemporary housing milieu. The coloured elite initially did not question the legitimacy of coloured identity. Only in 1939, under threats of increased residential segregation, combined with the resulting opposition in coloured protest politics, was the legitimacy of coloured identity publicly contested . By 1943, with the creation of the Coloured Advisory Council (CAC), local coloured unity proved to be insufficient. A division within the ranks of the local coloured elite was evident. As a result, the expression of coloured identity still remains contested in contemporary King William's Town.

Provision of adequate housing through cooperative government and intergorvernmental relations : the case of Bushbuckridge Local Municipality (BLM)Ubisi, Salphinah Vuloyimuni 06 1900 (has links)
South Africa adopted the democratic decentralisation governance model in 1994 with the aim of improving, inter alia, service delivery. The adoption of this model resulted in the establishment of three spheres of government, namely, national, provincial and local. These three government spheres are distinctive, interdependent, interrelated and autonomous. Power and responsibilities are devolved from the national to the provincial and then to the local government spheres. Cooperative government and intergovernmental relations structures in the three spheres of government were established in order to improve service delivery and to assist in the execution of the devolved powers. However, the results of this study revealed that the structures which had been established were not effective in addressing the housing challenges facing the Bushbuckridge Local Municipality (BLM). The results also revealed that each government sphere executed its housing mandatory responsibilities only when a housing project was launched or implemented in the BLM. During housing project implementation, the BLM was responsible for evaluation, the Mpumalanga Provincial Department of Human Settlements (MPDHS) was responsible for contracting a housing service provider and for payments while the National Department of Human Settlements (NDHS) was responsible for quality of the houses and compliance to national housing standards. In addition, the BLM had an inspection unit and the NDHS was supposed to work closely with the National Home Builders Registration Council (NHBRC). However, the houses provided had defects ranging from cracked walls and floors, leaking roofs, leaking pipes to fading paint. Jointly the interviewees represent 77% by volume of business over a period of two
years
A parallel process of literature research was undertaken to compliment the interview
research and provide technical depth to the findings.

Die oproepingsproses is in die laaste dekade ingrypend verander, grotendeels as gevolg van artikel 26 van die Grondwet, 1996, en artikels 129 en 130 van die National Credit Act 34 van 2005. Die volgende stadiums in die oproepingsproses word onderskei: die voorverhoorprosedure; jurisdiksiebepaling; die hofprosedure; beslaglegging en die eksekusieverkoping. Alhoewel die oproepingsproses tans bevredigend deur wetgewing en in die regspraak gereël word, is daar nog verontrustende aspekte van eksekusieverkopings wat die wetgewer se aandag verdien. / In this dissertation I analyse the calling up of a mortgage bond over immovable property under South-African law. If a mortgagor defaults, the mortgagee can enforce his limited real right by calling up the mortgage bond to satisfy the outstanding debt. To accomplish this, the secured property will be sold at an execution sale, after the correct procedure has been followed. Over the past decade, foreclosure proceedings have undergone significant changes, largely owing to section 26 of the Constitution, 1996, and sections 129 and 130 of the National Credit Act 34 of 2005. The following stages in the foreclosure process are identified: pre-trial debt enforcement procedure; determination of jurisdiction; court procedure; attachment and execution sale. Both the pre-trial debt enforcement procedure and the court procedure have recently been substantially amended by legislation and case law. Although legislation and case law currently regulate the foreclosure process satisfactorily, some disturbing aspects of execution sales remain and these deserve the legislator’s attention. / Private Law / LL.M.

Hostels are a product of the migrant labour system that originated in the copper mining industry in Namaqualand in the 1850s. The migrant labour compounds were used to accommodate migrant labour workers in the urban areas. However, these compounds also meant that migrant labour workers were denied the right of access to permanent accommodation and residential space in the urban areas. After the repeal of the influx control and segregative laws in South Africa in 1986, some of the hostel dwellers brought their relatives and friends to live in the hostels and this resulted in problems such as overcrowding which were exacerbated by poor management and control of the hostels. The living conditions of the hostel dwellers deteriorated during the 1990s. After the announcement of the unbanning of all liberation movements and political parties in South Africa in the 1990s, hostel violence broke out. This hostel violence left many hostel blocks vandalised and without basic municipal services such as electricity, water and waste removal. The hostel violence was primarily between the Inkata Freedom Party (IFP) aligned hostel dwellers and the African National Congress (ANC) aligned township and informal settlement residents.
The hostel violence has catalysed the public housing challenges faced by the democratic government since its inception in 1994. Nevertheless, since 1994 the democratic government has introduced various housing programmes in an effort to provide adequate houses for all South African citizens. One such housing programme is the hostel redevelopment programme. The hostel redevelopment programme was adopted by the democratic government after 1994 with the aim of, among other things, upgrading public hostels, redeveloping and converting the rooms in public hostels into family rental units in order to improve the living conditions of the hostel dwellers and introducing hostel dwellers to family life. The Mogale City Local Municipality (MCLM) is one of the municipalities in Gauteng province that is participating in the hostel redevelopment programme. The findings of this study have revealed that the upgrading of the Kagiso hostel involved the following two processes: During the first process, the MCLM upgraded the Kagiso hostel by fixing broken windows and doors, repairing toilets and providing basic municipal services such as electricity, water, and waste removal in order to improve the living conditions of the hostel dwellers. The second process involved demolishing the hostel blocks and converting them into family units in order to address the public housing challenges relevant to the Kagiso hostel.
