Logos v Aristotelově eitce / Logos in Aristotle's ethics

The aim of the diploma theses "Logos in Aristotle Ethics" is to interpret meaning of the term "logos" in Aristotle's work "Nicomachean Ethics". The basic methodical guideline is the structuralist assumption, that a meaning of a term is determined by its relations to other terms contained within the text, and the related assumption of unity of the meaning of the term "logos". The interpretation itself first analyzes structure of several crucial terms, most importantly the relation of a human individual to the society, the concepts of the good, the reality and the possibility, the true and the illusory, and the concept of the natural. The structure of use of the term "logos" is then analyzed in relation to these concepts. These investigations are completed by analysis of the terms of virtue and action. By the means of the structural analysis of these terms, the existence of a distinctive level of reality is established, which is captured by the term "humanity". The existence of humanity is the central point of interest in Aristotle's ethics. In the horizontal regard, there are two poles of humanity - the individual human and the society. The theoretical construction of personal rights is recent, so is the construction of intimacy rights. In Brazil, intimacy rights laws are in the article 5th, X of Brazilian Constitution, 1988, and in the article 21 of Brazilian Civil Code. The discipline of this right has been greatly modified: one particular modification derives from the very discipline of personal rights, in which it is inserted; the other derives from the essentiality and influence of technological tools that operate in social structures. The main question of this research is: what is the intangible core of a person’s intimacy that concerns the humanity of each human being? The hypothesis is that “intimacy” is a vague legal concept, leaving its definition and actualization to the interpreter. The general goal of the thesis is to study conceptual aspects of person, juridical personality and humanity, and also to present conceptual theories of Law relating to intimacy both in Brazilian and foreign doctrine and investigate cases concerning the matter to identify the domain of secret. This thesis analyses the right to intimacy, in its contemporary and most important aspects, chiefly concerning the theories of plural and unitary concept to define it as a component of human nature (humanitas) related to the person’s ontological incommunicability. The methodology to develop this research is based on secondary data and qualitative method, starting from the analysis of law, of the doctrine and of the so far built juridical understanding. The main result achieved is that, once identified the assets in the secret domain and, according the foundation of the human person dignity, there happens the effectivity of this right and so the judge’s subjectivity can be avoided when subsuming and applying this right / A presente tese, destinada à obtenção de grau de doutor em Direito da Efetividade do Direito Privado e Liberdades Civis, subárea Direito Civil, intitulada O núcleo intangível da intimidade: a esfera do segredo versa sobre o direito à intimidade no tocante ao reduto mínimo intangível que deve ser preservado e tutelado pelo ordenamento jurídico. A construção teórica dos direitos da personalidade é recente e, do mesmo modo, do direito à intimidade. No Brasil, as regras do direito à intimidade estão nos artigos 5º, X da Constituição Federal de 1988 e 21 do Código Civil. A disciplina desse direito sofreu grandes modificações; uma, decorrente da própria disciplina dos direitos da personalidade, aos quais ela está inserta; e a outra, pela essencialidade e influência das ferramentas tecnológicas que atuam nas estruturas sociais. O objetivo geral deste trabalho é estudar os aspectos conceituais de pessoa, personalidade jurídica e humanidade, bem como apresentaras teorias conceituais do direito à intimidade na doutrina nacional e estrangeira e investigar o estudo de casos pertinentes ao assunto para identificar a esfera do segredo. Esta tese analisa o direito à intimidade, nos seus aspectos atuais e mais importantes, sobretudo, no que concerne às teorias do conceito plural e unitário para defini-lo como componente da natureza humana (humanitas) quanto à incomunicabilidade ontológica da pessoa. A metodologia para desenvolver esta pesquisa baseou-se em dados secundários e método qualitativo, a partir da análise da lei, da doutrina e do posicionamento jurisprudencial construído. O principal resultado encontrado é de que, identificados os bens da esfera do segredo e, sob o fundamento da dignidade da pessoa humana, tem-se a efetividade desse direito e evita-se o subjetivismo do juiz, no momento da subsunção e da aplicação desse direito.

Percepções sociais sobre o futuro da humanidade no planeta: um estudo na cidade de Piracicaba, SP / Social perceptions about the future of humanity on the planet: a study in Piracicaba, SP

A pesquisa sobre as percepções de residentes da região de Piracicaba em relação às questões ambientais e ao futuro da humanidade no planeta foi desenvolvida com base em um questionário semi-estruturado. As questões buscaram levantar dados autoavaliativos sobre perfil, comportamentos, estado de humor, qualidade de vida, condição econômica e hábitos de consumo, práticas para destinação de resíduos, iniciativas de exercício de cidadania em prol da sustentabilidade socioambiental, para enfim, indagar sobre percepções de futuro e avaliações sobre o contexto socioambiental dos participantes da pesquisa. A aplicação dos questionários foi feita de forma aleatória estratificada nos bairros das cinco regiões da cidade de Piracicaba: Norte, Sul, Leste, Oeste e Centro. Por meio dessas aplicações, foram obtidos 655 questionários, que foram sistematizados, tabulados e analisados estatisticamente, utilizando-se gráficos de frequência, o Teste de Kruskal Wallis, os Testes de Correlação de Spearman e Kendall, o Teste de Qui-Quadrado e o Teste Exato de Fisher. Foram também criadas nuvens de palavras, desenvolvidas no software online \"Wordle\" (FEINBERG, 2014). Os resultados obtidos com essa pesquisa e as análises desenvolvidas indicam que 227 pessoas, isto é, aproximadamente 35% dos respondentes, possui uma percepção pessimista sobre o futuro da humanidade no planeta. Porém, 493 pessoas, o equivalente a aproximadamente 75% do total de respondentes, considerou que, dentre as alternativas apresentadas no questionário (Desenvolvimento de tecnologias; Controle de natalidade; Educação e mudanças culturais; Cobrança de impostos com base nos impactos ambientais; Intervenção do Estado), a educação e mudanças culturais são fundamentais no processo de transformação social e de superação das problemáticas ambientais. Observou-se também que a crise hídrica vivenciada na época em que os questionários foram aplicados também influenciou na percepção social dos respondentes, uma vez que a palavra \"água\" foi citada 380 vezes. Por meio do trabalho, foi também possível analisar o comportamento ambiental dos pesquisados, notando-se que ainda há a necessidade de promoção de atividades educacionais e comunicacionais que possam estimular a adoção de hábitos e comportamentos mais comprometidos com ideias de sustentabilidade e que levem a mudanças mais efetivas nos padrões de relacionamento entre sociedade e meio ambiente. / The research about the perceptions of residents in Piracicaba on environmental issues and the future of humanity on the planet has been developed based on a semi-structured questionnaire. Its questions sought to raise self-evaluative data on the profile, mood, quality of life, economic condition and consumer habits, waste handling practices, citizenship exercise initiatives for environmental sustainability, to finally inquire about future perceptions and assessments about the socio-environmental context of the research participants. The questionnaires were applied in a stratified random way in neighborhoods in the five regions of Piracicaba: North, South, East, West and Central. Through these applications, we obtained 655 questionnaires, which were then systematized and statistically analyzed, using frequency graphs, the Kruskal Wallis test, the Spearman correlation test and Kendall test, the Chi-Square test and the Fisher\'s exact test. Word clouds were also created, developed on the online software \"Wordle\" (FEINBERG, 2014). The results obtained from this research and developed analyzes indicate that 227 people, that is, approximately 35% of respondents have a pessimistic perception of the future of humanity on the planet. However, 493 people, equivalent to approximately 75% of all respondents considered that, among the presented alternatives of the questionnaire (Technology development; Birth control; Education and cultural changes; Tax collection based on the environmental impacts; State intervention), education and cultural changes are fundamental in the process of social transformation and overcoming environmental problems. It was also observed that the water crisis experienced at the time the questionnaires were applied also influenced the social perception of respondents, since the word \"water\" was cited 380 times. Through the research, it was also possible to analyze the environmental performance of those surveyed, noting that there is still the need to promote communicational and educational activities that can stimulate the adoption of habits and behavior that are more compromised to sustainability ideas and that can lead to more effective changes in the relationship patterns between society and environment.

In five chapters, this thesis traces the question of humanity in the thought of the French philosopher Emmanuel Lévinas, mainly in his works De l'évasion (1935), De l'existence à l'existant (1947), Totalité et infini (1961) and Éthique comme philosophie première (1982), which represent various stages of his philosophical development. It offers an exposition of Lévinas's most original concepts, follows their development and sketches their parallel and/or polemic concepts in the European thought, placing them within the context of Lévinas's life-work. For Lévinas, the question of humanity appears as a transpostition of the question of God, who can not become an object of rational inquiry. In conclusion, the question of humanity becomes the theological issue par excellence. Confucian humanism as the foundation of human rights and economic ethics: a study of Korea, Japan and the Republic of China.

This study is about Confucian humanism as the foundation of human rights and economic ethics. The study covers Korea, Japan and the Republic of China. The main research question lies in how Confucian humanism emerged as an enduring tradition, and how it impacts upon human rights and economic ethics of the three nations on their individual paths towards globalizing civil societies. Research elements are (i) literature review, (ii) focus group discussions and (iii) documentation corroborations. Literature reviews covered scholarly works of East Asia and international scholars. Narrative data were obtained from the focus group discussions. Documentation corroboration complemented the focus group discussions. The study explores the origin of Confucianism and proceeds to examine how the Confucian philosophical tradition gave naissance to Confucian humanism. From Confucian humanism, the thesis proceeds to Confucian governance (ching shih). Alternative political views of more egalitarian Confucian schools such as of Mencius also take up a good part of the governance theme. The role of life long self-cultivation is seen as the foundation of character-building for respective societal roles within Confucian ethics and social ethos. The modern democratic institution of human rights is argued as having emerged from the fertile demo-centric Confucian social psychology, but benefited directly from the Western institutional models. Discussions on the tradition of Confucianism and that of Confucian humanism progress through the important turning points throughout history, i.e., the Classic age of Confucius, the Neo-Confucian reformation, the Practical Learning sub-era of the Neo-Confucian era, and, finally, the contemporary Neo-Confucian. The discussions highlight that the Confucian tradition of 'humanity' that Confucius and his disciples formulated in the Classical age endured through the ages to modernity. They also point to the notion that Confucians pursued their intellectual, moral and aesthetic ideals to the highest possible level through the system of learning, philosophizing, and practicing in the tradition. The Confucian cosmology of the 'human to nature' nexus and the Confucian spirituality of cosmic immanence in the 'self' provide clues to the multi-layer structure of Confucian consciousness of self, selves and the greater self, namely society or the Heaven itself. The Neo-Confucian school of 'mind and heart' learning reinforced the inquiry into selves in nexus to nature and the universe. Religious tolerance and the adaptability of Confucianism have stood out as important qualities in the globalization of East-Asian values and ethos, i.e., Confucian 'souls and decorum.' Japan, as an island nation with a unique perception of its self-identity, employs Confucianism, still considered fundamentally as the philosophy of China, to reinforce the national identity without compromising the integrity of the Japanese tradition and sensitivity. Japanese aesthetic sensitivity would place aesthetic unity with nature on equal footing with that of moral unity with the world. Secularism and spirituality of Confucianism benefited from the peaceful co-existence amongst the three great philosophical traditions of Confucianism, Taoism and Buddhism. The thesis as an inquiry into Confucian humanism as a living tradition concludes by answering the main research question and its three associated postulates.

This study investigates how upper secondary school students constitute relations between the environment and humanity. The aim of the study is to analyse relations that emerge between and within the Earth´s major systems (humanity included) and how these relations are composed when students are faced with a fictional decision of consuming a pair of jeans.                        Using workshop as a data collection method, students creatively visualize their discussions through participatory modelling in groups. The results of the study are based on the analyses of the concluding presentations of the completed models. The results show difficulties in submitting relations between the three dimensions of the concept of sustainable development together with a dualistic worldview, indicating a lack of complexity in the presentations. Therefore, a gap can be identified between the empirical results and the aims of education for sustainable development (ESD) that, according to the Ministry of Education and Research, should be a part of Swedish upper secondary education. In addition, a gap between the steering documents for the Swedish upper secondary schools and the UNESCO guidelines on ESD is revealed, consisting of the latter more distinctly promoting systems thinking and embracing pluralism.                                                                  Three national programmes are represented in the study; social science, science and economics. Differences between the three are established. Groups with a focus on social science present complexity to higher extent than groups on science orientation. Groups with a focus on economics present least complexity in their presentations.

Uganda's response to the phenomenon of enforced disappearances and the transitional justice response in Uganda

Magister Legum - LLM (Criminal Justice and Procedure) / Enforced disappearances are a heinous violation of numerous human rights enshrined in many international conventions. However, they have not been adequately addressed in many jurisdictions. This crime is very common within countries on the continent of Africa, which despite having plenty of conflicts, under report cases of enforced disappearances. This research paper investigates the transitional justice mechanisms implemented in Uganda to deal with the phenomenon of enforced disappearances. It analyses the mechanisms implemented by the Government of Uganda and those by Non- Governmental Organisations. The paper examines also how the phenomenon of enforced disappearances has been dealt with in other countries such as Morocco, Kenya and South Africa. The paper suggests several recommendations to Uganda after having made a comparison with the selected countries on how to deal with the crime of enforced disappearances.

This study interrogates how Shona novelists conceptualise and depict the African communitarian worldview of unhu (humanity to others). The study relies on content analysis of selected Shona novels, critical reviews from various scholars, journals, newspapers and theses, augmented by interviews and questionnaires. The theoretical framework is guided by Afrocentricity and Africana Womanism which are pivotal to the explication of meaning from selected texts, with the view to examining whether or not the writers‟ portrayal and understanding of unhu helps Africa‟s socio-cultural and political liberation. Given that the African worldview of unhu celebrates virtues central to mutual social responsibility, mutual respect, trust, self-reliance, caring, among other attributes. These tenets help to revitalise and rejuvenate the decaying socio-cultural fabric of Zimbabwe. The study intimates that unhu principles could be fruitfully embraced in charting a dispensation in which all people of Zimbabwe could subordinate their personal interests to the interests, respecting one another, thus forging enduring peace and development while, at the same time, the leadership would be governed by democratic tenets espoused through unhu. / African Languages / D.
