Designing for disaster: transitioning from house to home

Hallick, Jennifer 04 April 2012 (has links)
Natural disasters are increasing in both number and severity, causing the number of people being displaced by disaster to rise as well. Hurricane Katrina provides a particularly poignant example of the human impact of disaster, and of inadequate disaster response, especially where housing is concerned. The Federal Emergency Management Agency’s response to Hurricane Katrina in New Orleans exposed a gap in the approach to housing survivors of natural disasters, especially at the interim housing level. The FEMA trailer - which was only intended to house survivors temporarily but, in many cases, became a long term housing solution, - provided shelter for survivors, but did not account for their psychological well-being. The loss of one’s home can be a traumatic experience, as people identify their sense of self with their home. Therefore, it is crucial to reinstate this sense of home, and in turn provide continuity to the sense of self, early on in the recovery process. Rebuilding after a natural disaster is a long process. Because of this, disaster housing needs to be able to evoke a sense of home and ownership so that inhabitants can connect with their environment and reinstate their daily routines. This helps them to rebuild their lives. The proposed project attempts to do this by allowing for flexibility and choice in both the design and daily use of the house. The house transitions from temporary to permanent housing, allowing for a dialogue between inhabitant and environment to begin early on in the recovery process, and to persist. The design is informed by theories on place making, elements of home, dwelling, as well as loss and the grieving process.

An analysis of De Klerk v Du Plessis 1994 6 BCLR 124 (T) in the light of section 35(3) of the constitution of South Africa Act 200 of 1993

Selokela, Kwena Alfred 11 1900 (has links)
The issue of the vertical /or horizontal operation of the Bill of Rights (chapter 3) is a controversial one. The interim constitution deals with this controversy in a subtle way by avoiding direct horizontal operation of Chapter 3. Instead, it provides for the so-called 'seepage to horizontal relationships' in terms of section35{3). This apparently was a political compromise between the pro-vertical only and the pro-horizontal groups. The human rights history of this country justifies a Bill of Rights that would have both vertical and horizontal operation. However, in section 35 (3) there is potential for the values enshrined in the constitution and Chapter 3, and the spirit hereof, to permeate and filter through the entire legal system in all it's applications. It would seem, however, as demonstrated by the decision in De Klerk v Du Plessis, that the extent to which this filtering process will benefit individuals in their private relations, will depend on the interpretation given to section 35 (3) by the courts. If courts, as it happend in De Klerk's case fail to realise the full import of section 35 ( 3) aspects of the existing law which are unjust could remain and the process of creating a just, open and democratic society will be hampered. / Constitutional, International and Indigenous Law / LL.M.

The significance of the approaches to constitutional interpretation in S. V. Mhlungu 1995(7) BCLR 793(CC)

Boardman, Richard Neville Crause 06 1900 (has links)
The dissertation consists of an analysis of the Constitutional Court decision S v Mhlungu 1995(7) BCLR 793 CC. The analysis focuses on the significance of the different interpretative approaches adopted by the members of the Court in analysing section 241(8) of the Constitution of the Republic of South Afii.ca Act 200 of 1993. The theoretical approaches to constitutional interpretation are first briefly discussed. This is followed by a description of the four respective judgments in the decision. The case is then analysed in respect of section 3 5, Chapter 3 and the Constitution itself in order to determine the significance. The jurisprudence of the Court (developed in its first eight decisions) is evaluated to assess the approach of the Constitutional Court to Chapter 3 and the remainder of the Constitution respectively. The conclusion is reached that the Court has endorsed a generous/purposive approach to constitutional interpretation and that this extends to the entire text of the Constitution. / Law / LL.M.

La protection de l'instance arbitrale par l'injonction anti-suit / The protection of arbitration proceedings by the anti-suit injunction

Peeroo, Jamsheed 19 October 2016 (has links)
The anti-suit injunction is the only means capable of preventing a party from being involved in proceedings commenced before a domestic court of its choice in bad faith and with the only objective of disrupting arbitration. It is most efficient in the form of an interim measure. In accordance with modern arbitration laws and rules, this jurisdictional tool may be obtained, in this form, from arbitration tribunals, which normally have sufficient imperium to order it, as well as to impose sanctions on any non-compliant party. Although it can be issued before the parties’ rights have been determined, the arbitrator must nevertheless make sure that its legal basis falls under his jurisdiction. Examples of such legal bases are the prima facie potential breaches of one of the obligations contained in the arbitration clause, such as to perform it in good faith, or of a confidentiality clause contained in the main contract. This restraining measure is also available to the French judge, since prohibitory injunctions are hardly unknown to French law. In the field of arbitration, it appears that its use may be permitted under the new Brussels 1 bis Regulation in spite of the West Tankers case and, especially, where it takes the form of an interim measure. When its issuance appears to be legitimate, it is primarily for the court of the seat of an arbitration to decide whether it should be ordered in support of the arbitration proceedings. However, for reasons of efficiency, if the court of another country happens to be in a better position to ensure compliance with the anti-suit injunction, it may also order it.

Competitiveness of small businesses owned by Asians and expatriate Africans in South Africa compared to those owned by indigenous citizens

Maqanda, Vuyani 08 1900 (has links)
Asians and expatriate Africans have been prominent in the SMME economy of South Africa. This work seeks to establish reasons for the growth and competitiveness of SMMEs run by these groups compared to those operated by local citizens. Reasons for this competitiveness are gleaned from existing literature and presented in accordance with the Perren model which attributes the growth of SMMEs to the owner’s motivation, expertise in managing growth, access to resources, and demand. In this work, the Perren model was first applied to Asians and Lebanese in East and West Africa to set a foundation for comparison with the South African situation. This work concluded that it is the four interim growth drivers acting together that cause competitiveness of Asian- or expatriate African-owned SMMEs. Policy recommendations to improve competitiveness of SMMEs owned by local citizens are then suggested at the end. / Economics / M. Com. (Economics)

Büscher, Barbara 08 May 2023 (has links)
