Summaries in English and Afrikaans / Die proefskrif poog om 'n penologiese evaluering rakende die assessering van oortreders vir korrektiewe toesig weer te gee. Korrektiewe toesig is 'n vonnisopsie wat oortreders binne die gemeenskap rebabiliteer. 'n Literatuurstudie oor die ontwikkeling van korrektiewe toesig in verskillende wereldlande is ingestel asook die wetlike ontstaan en praktiese toepassing in Suid-Afrika. Korrektiewe toesig is met deeglike navorsing deur die Krugel-Werkgroep vooraf gegaan. Die Witskrif rakende die Departement van Korrektiewe Dienste wat op navorsing gevolg bet, is gedurende Mei 1991 in die parlement van Suid-Afrika ter tafel gele. Parlementsdebatte is gevolg deur wetswysigings van onder andere die Strafproseswet, 1977 en die Wet op Gevangenisse, 1959. Eenstemmigheid het genoemde parlementsitting gekenmerk wat gevolg het tot die instelling van korrektiewe toesig. Korrektiewe toesig soos deur die Departement van Korrektiewe Dienste toegepas word, is ondersoek maar veral die funksionering van huisarres, monitering en gemeenskapsdiens. Die assessering van oortreders en hul promovering vanaf maksimum intensiewe na medium - en na minimum - van huisarres sowel as monitering is nagegaan. Assesseringsmetodes van die State Georgie en Wisconsin in die V.S.A. asook ander kriteria is ondersoek om die geskiktheid van oortreders te klassifiseer deur middel van 'n seleksieproses. 'n Profielstudie van kandidate by die Kaapstadse gemeenskapskorreksie-kantoor is opgestel met 'n ondersoek vanuit 624 gevalle asook die menings van landdroste in Pretoria en die distrik van Wonderboom rakende korrektiewe toesig. / This thesis is an attempt to give a penological evaluation relating to the assessment and suitability of offenders for correctional supervision. Correctional supervision is a sentencing option aimed at rehabilitating offenders within community context. This research will focus on the development of correctional supervision in differnt countries around the world inclusive of South Africa. The implementation of correctional supervision in South Africa was precede by research done by the Kriigel Commission. In May 1991 a White paper was tabled in Parliament regarding the broadening of the mission of the Department of Correctional Services. Much debate in Parliament resulted in amendments to inter alia the Criminal Procedures Act, 1977 and the Prisons Act, 1959. In this thesis the application of cor!'ectional supervision as redered by the Department of Correctional Services is investigated with special reference to house arrest, monitoring and community service. Assessment and promotion from maximum intensive to medium intensive and to minimum intensive supervision are also looked at. Assessment methods and other criteria in the States of Georgia and Wisconsin in the United States of America are investigated in order to propose classification categories for the selection of offenders. A profile of an offender under supervision was undertaken with 624 cases from the Cape Town office for Correctional Supervision as well as in Pretoria and the district of Wonderboom. / Criminology and Security Science / D.Litt. et Phil. Darbo tema - nuteistųjų meninės socialinės edukacijos kaip resocializacijos ypatumai. Tema aktuali, nes sėkmingas nuteistojo integravimasis į visuomenę didele dalimi priklauso nuo resocializacijos proceso, kuris vyksta per adaptacijos, pataisos ir integracijos etapus. Vienas alternatyvių nuteistų asmenų resocializacijos būdų – meninė socialinė edukacija. Šalies įkalinimo įstaigose užsiimama menine veikla, tačiau nepakankamai. Nesudaromos ar nepakankamai sudaromos sąlygos kalinių resocializacijai, trūksta specialistų, silpna materialinė bazė, mažas suinteresuotumas. Darbo tikslas - ištirti Lietuvos įkalinimo įstaigų meninės socialinės edukacijos kaip resocializacijos ypatumus. Darbe analizuojama nuteistųjų resocializacijos samprata, įkalinimo įstaigose vykstančios meninės socialinės edukacijos realijos. Temos aktualumui ir naujumui pagrįsti atlikti kiekybinio ir kokybinio tipo tyrimai. Apklausus 290 nuteistųjų, kalinčių Lukiškių kalėjime, Vilniaus 2–uosiuose pataisos namuose ir Panevėžio moterų kalėjime paaiškėjo, kad nors meninės veiklos užsiėmimai įkalinimo įstaigose vyksta, juos lanko ne visi. Apklausus 33 Vilniaus ir Panevėžio įkalinimo įstaigų vadovaujančio personalo darbuotojus bei meninės veiklos specialistus, dirbančius su nuteistaisiais, nustatyta, kad įstaigose vyksta meninės veiklos užsiėmimai (iš jų dažniausiai - dailės ir muzikos), tačiau ne visiems nuteistiesiems pasiūloma juose dalyvauti, be to, ne visi nuteistieji priima šį pasiūlymą ir noriai lanko užsiėmimus... [toliau žr. visą tekstą] / Topic of the work: the peculiarities of artistic social education as resocialization for prisoners. The topic is relevant because a successful integration of a prisoner into society depends a lot on resocialization process that takes place through adaptation, correction and integration stages. One of alternative resocialization means of convicts is artistic social education. In imprisonment institutions of the country people are engaged in artistic activities, but not sufficiently. There are no conditions or conditions are not satisfactory for resocialization of prisoners, there is a lack of specialists, weak material base and little interest. Aim of the work: to research the peculiarities of artistic social education as resocialization of imprisonment institutions. In the work one analyzes the conception of resocialization of prisoners, and realia of artistic social education that take place in imprisonment institution. To prove the relevance and novelty of the topic one performed qualitative and quantitative researches. 290 prisoners were questioned that are in Lukiskiu prison, in Vilnius 2nd correction institution and Panevezys women prison. Life after life imprisonment

In England and Wales, life imprisonment is the ultimate sanction for the most serious crimes. The introduction of Discretionary Lifer Panels (DLPs) in 1992 was a major development in the way that lifers are managed within the penal system. This thesis explores 'life after life imprisonment' for the first cohort of discretionary lifers who were released into the community through the DLP process. The study is set in the context of a renewed interest in empirical research on the resettlement of ex-prisoners, yet little of this work has focused on life-sentenced offenders. By investigating the resettlement process of 138 discretionary lifers released on life licence between 1992 and 1997, this research contributes to empirical and theoretical understanding of rehabilitation and desistance from crime after long-term imprisonment. Part One considers the various factors that have shaped the discretionary life sentence, and sets out the research methods used. Part Two examines the role of the Probation Service in the process of resettlement. Based on empirical work across probation areas, it sheds light on the claim that contemporary probation practice is indicative of a more general authoritarian and exclusionary approach to resettlement. Part Three explores the 'disistance and persistance' process for lifers. It provides a detailed analysis of the narrative accounts of resettled lifers, and explores the reasons why they had given up crime. It also highlights the growing numbers of recalled lifers, and seeks to identify factors associated with failure on life licence. This thesis concludes by arguing that rehabilitation continues to have a prominent place within the discourse of resettlement. Overall, this thesis lends support to theories of disistance from crime that emphasise the importance of shifts in offenders' narrative identities to explain cessation from criminal behaviour, and highlights the role of a professional relationship as a powerful vehicle for change.

The topic of this thesis is the issue of the life imprisonment and the main aim is to analyze this punishment in Czech legal environment and to point the possible improvements that could be done in this legal area. Since this kind of punishment has been involved in Czech system of punishments for only 24 years now, it gives enough space for its study and that is why I chose it as the topic of my thesis. This thesis consists of six main chapters. In the first one my task was to enlighten the meaning of the basic terms which are necessary to apprehend in order to be able to understand the problematic of punishments in general. Other half of this chapter is dedicated to the evolution of understanding the term "punishment" itself and the main opinions of the prominent philosophers such as Cesare Beccaria, Ch.L.Montesquieu, J. Locke and others. Second chapter describes the history of the highest penalty and criminal law in general in Czechoslovakia and Czech Republic in the years 1918 - 2009. In this period of time the significant historical events influenced the Czech law, especially the creation of independent Czechoslovak republic, the period of World War II, consequential rise of communism and its fall more than 50 years later..All of these events had main significance for the journey to death...

Life imprisonment Resumé The purpose of my thesis is to penetrate into the issue of life imprisonment and to analyse consequences which are connected with its legislation. The death penalty was replaced by life imprisonment in our country in 1990. The penalty of life imprisonment as the toughest punishment in the legal system of the Czech Republic necessitates big attention, because it causes considerable harm to the human rights of people sentenced to it. That is why it is possible to impose life sentence only in compliance with the strict conditions and only for enumerated crimes, both stated in the penal code. Nevertheless, life imprisonment has its supporters and opponents as well as death penalty, because it has not only advantages in comparison with capital punishment, but also some disadvantages. The thesis tries to describe these problems and propose solutions to it. The thesis is composed of seven chapters, each of them dealing with the issue of life imprisonment from a different point of view. The chapters are thematically divided into subchapters. It is necessary to know the historical context to understand the present legislation of life imprisonment, therefore Chapter One looks at development of life imprisonment, briefly in the world, but it focuses mainly on its development in our territory...

The aim of this thesis is to present a comprehensive view of a rather complicated issue of life imprisonment, mainly from legal perspective. It also deals with some psychological and sociological aspects which accompany long-term imprisonment. Life imprisonment is the highest sanction which is regulated in the legal system of the Czech Republic. It is imposed only in case of enumerate crimes and on the conditions stated in the penal code. Life imprisonment has been the highest sanction in our legal system since the year 1990 when it replaced death penalty which is not in accordance with principles of a democratic legal state. Similarly to death penalty, life imprisonment also has many opponents and is connected with many problems and questions. The thesis tries to define some of these problems and to bring as many findings as possible, so that everybody can make their own opinion on this issue. The thesis consists of seven chapters which are then divided into subchapters. After the brief introduction, there is the first chapter which covers the penalty as such. This thesis is concerned with the issues of unconditional imprisonment with the focus on early release of prisoners. A comparison of legal framework in the Czech Republic and the Great Britain is provided. The first chapter deals with the meaning and objectives of punishment. It shows a history of legal theories in the world and the Czech Republic as well. The following chapter provides an explanation of these legal theories in the Czech legislature as basic sentencing principles. Moving further into the detail it provides a legal framework of unconditional imprisonment in the Czech Republic. The third chapter gives a brief look at the history of legal framework of imprisonment on the international, European and national level. The thesis gives a thorough examination of the early release in the Czech law in its first main part. It evaluates its advantages, disadvantages and implications. The same process is made in the second main part of the thesis concerning the early release in Common law using the doctrine of judicial precedent. Following that evaluation a comparison of particular legal institutes of the early release is provided.
