Religião e segurança no Japão : padrões históricos e desafios no século XXI

O objetivo da presente dissertação é analisar o impacto da religiosidade sobre a formação da doutrina de segurança do Japão pós-Guerra Fria. Para isso, buscou-se realizar um estudo histórico evidenciando a contínua relação entre religião e política no Japão ao longo do tempo. Ainda que essa relação tenha se modificado em diferentes momentos da história japonesa, ela jamais se desfez e a tomada de decisão política sempre foi afetada, entre outros elementos, por fatores simbólicos. No segundo capítulo procurou-se apontar diversas correntes teóricas que auxiliam na compreensão da relação entre religião e segurança, destacando-se o papel de crenças e valores no desenvolvimento da visão de mundo dos indivíduos, assim como na formação da identidade nacional e, consequentemente, da doutrina de segurança do país. No terceiro capítulo é feito um estudo de caso do Japão sobre como as concepções religiosas – seja do Xintoísmo nativo ou das doutrinas trazidas da China e da Índia como o Budismo e o Confucionismo – favoreceram a constituição do antigo Estado japonês. A análise histórica se estende das origens das primeiras crenças formadoras da cultura nipônica até o período anterior à Segunda Guerra Mundial. No quarto capítulo são apontados alguns fatores formadores da doutrina de segurança do Japão que são reflexo da sua cultura e que afetaram fortemente a inserção internacional japonesa ao longo do período da Guerra Fria. No quinto e último capítulo é feito um estudo de como a crise política e econômica no Japão favoreceu um processo de “reencantamento”, onde a sociedade e a classe política japonesa passaram a buscar uma redefinição da própria identidade nacional. O debate daí decorrente procura responder como deve se estruturar a doutrina de segurança japonesa e como o país enfrentará os desafios da nova ordem mundial. / The purpose of the present essay is to analyze the impact of religiosity over military doctrine formation in post-Cold War Japan. For that, one searched to carry through a historical study evidencing the continuous relationship between religion and politics in Japan throughout the time. Although this relation was modified at different moments of Japanese history, it never disappeared and the political decision making process has always been affected, among others elements, for symbolic factors. In the second chapter the objective was to emphasize diverse theoretical schools that help to understand the relation between religion and security, stressing the role of beliefs and values in the development of the individuals’ world vision, as well as in the national identity constitution and, thereafter, in the country’s military doctrine. In the third chapter it is developed a Japan’s study case about how the religious conceptions – either Shinto or the doctrines brought from China and India as Buddhism and Confucianism - favored the constitution of the Japanese modern state. The historical analysis is expanded from the birth of the first beliefs that engendered Japanese culture to the pre- World War II period. The aim of the forth chapter is to point some factors that generated Japan’s security doctrine which reflects the country’s culture and that had strongly affected Japanese international projection throughout Cold War era. In the fifth and last chapter it is made a study about how Japan’s political and economical crisis has favored a “reenchantment” process, from which Japanese society and political classes started to search a redefinition of the country’s national identity. This debate aims to answer how the Japanese security doctrine must be structuralized and how the country will face the new world order’s challenges.

Cidadania sexual e laicidade : um estudo sobre influência religiosa no Poder Judiciário

A presente tese tem por tema a pioneira jurisprudência do Tribunal de Justiça do Rio Grande do Sul, relativamente às demandas por reconhecimento de efeitos jurídicos às uniões entre pessoas do mesmo sexo, compreendidas essas demandas como uma luta pela implementação da cidadania sexual, cujo obstáculo político principal na América Latina tem sido a resistência de setores conservadores do campo religioso. Partindo dessa premissa, a qual está evidenciada na literatura, o objeto da pesquisa focou a questão da influência religiosa no enfrentamento jurídico de questões ligadas à cidadania sexual. No intuito de pensar as causas das diferentes interpretações judiciais que conduzem ao reconhecimento (ou não) das uniões gays, foram analisadas decisões do TJRS e entrevistas realizadas com os magistrados que atuam na área do Direito de Família. O estudo buscou identificar as concepções dos magistrados sobre conjugalidade gay, religião e família, tentando identificar as categorias de pensamento que são acionadas pelos magistrados no momento de decidir. Um dos principais achados da pesquisa foi identificar a vinculação entre a rejeição à conjugalidade gay e o emprego de categorias de classificação ligadas à moral sexual cristã manifesta na valoração negativa da homossexualidade. Tal valoração aparece como fundamento subjacente aos argumentos formalmente empregados para justificar um tratamento desigual a gays e lésbicas. / The pioneering jurisprudence of the Rio Grande do Sul Court is analyzed regarding the recognition of juridical consequences of same sex unions. The legal claim for same sex marriage is here understood as part of a pledge for sexual citizenship. The main obstacle for such sexual rights in Latin America has been the resistance of conservative religious sectors. This thesis focuses on examining the religious influence of legal and juridical decisions regarding sexual citizenship. In order to analyze the factors related to the diversity of judicial interpretations leading the recognition (or not) of same sex marriage, we collected and analyzed documents consisting of the Court decisions, as well as interviewed in depth judges who work in Family Courts. The judges’ ideas of gay conjugality, religion and family were studied as to understand the concepts and categories they use when they take decisions on legal matters. One of the main findings of our research is a negative relation between gay marriage and the use of Christian concepts and categories regarding sexual morality – the use of religious categories which place a negative value on homosexuality. The negative value of homosexuality underlies arguments formally used in legal decisions that justify treating differently gays and lesbians.
