Relações de gênero em posições de poder: o lugar das herdeiras no processo de sucessão de uma empresa familiar de Curitiba-PR

Este trabalho trata das relações de gênero em posições de poder - o lugar das herdeiras na sucessão de empresas familiares. Foi motivado pela constatação de três fatores: o elevado percentual de empresas familiares no universo total de empresas no mundo - mais de 80%, o reduzido número de "herdeiras" no comando destas empresas e a pequena sobrevivência destas empresas, a partir da 2ª geração. A empresa selecionada para a realização da pesquisa de campo foi a Leão Jr. S/A, pelo fato desta empresa reunir os requisitos necessários para a investigação do tema delineado: ter vivenciado mais de um processo de sucessão e ser uma empresa familiar de grande porte. Tratando de duas das mais importantes dimensões da vida, família e trabalho, esta pesquisa tem por desafio compreender a forma como, no contexto socioeconômico da elite de Curitiba, esta família se constitui e se organiza enquanto empresa e como os membros da família administram a imbricação das relações familiares e empresariais, objetivando identificar as relações de gênero que permeiam o processo sucessório nesta empresa. Espera-se, com este trabalho, abordar um aspecto nem sempre visível no mundo do trabalho, que representa a rede de relações sociais entre os membros de uma família empresária, suas representações, o simbolismo que permeia a vida da família, e, por conseguinte, também a vida da empresa familiar. Aquilo que se constitui no sentido de suas existências e lhes confere um determinado papel na sociedade e determina, tanto seu estilo de vida quanta o estilo de gestão da empresa. A presente pesquisa adotou um enfoque interdisciplinar que, partindo de um universo econômico, buscou resgatar um universo simbólico, utilizando-se dos recursos da antropologia, para detectar aspectos das humanidades na esfera empresarial, a fim de lançar luzes sobre o processo sucessório nas empresas familiares. Como objetivo geral da pesquisa pretendeu-se identificar o lugar que é reservado as mulheres herdeiras na sucessão da empresa familiar. Para alcançar esse objetivo procurou-se: conhecer as regras que norteiam o processo sucessório na empresa familiar em estudo; identificar os fatores que determinam a ascensão das herdeiras, bem como os fatores que as afastam dos postos de comando e identificar, junto às herdeiras, o significado de pertencer a uma família, cuja identidade é construída pela empresa. Para o desenvolvimento da pesquisa de campo optou-se pela abordagem qualitativa de natureza interpretativa, adentrando no universo das representações, dos símbolos, significados, subjetividade e intencionalidade. Foram entrevistadas 5 herdeiras, 4 delas participantes do conselho de sócios da empresa. A partir dai construiu-se a história da empresa sob dois enfoques - na perspectiva da própria empresa, considerando o material contido em documentos e publicações da empresa sobre si mesma e uma outra história, na perspectiva das herdeiras e interpretada a luz dos conceitos de gênero, família, empresa familiar e cultura organizacional - referencial teórico da pesquisa. A pesquisa desvelou uma íntima ligação entre o mundo da família e o mundo da empresa, bem como a existência de dois patrimônios distintos, que se equivalem, se entrelaçam e se sucedem, de geração em geração. Ao lado de um patrimônio material expressivo, detectou-se a existência de um patrimônio intangível considerável, com sua lógica própria de formação e continuidade, direcionando os rumos da vida da família e da empresa. / This study relates the gender relations in positions of Power - the position of the inheritresses in the succession process of family firms. The motivation for this study is originated by three factors: the high percentage of family enterprises in the world - more than 80%, the reduced number of inheritresses in command of these firms and the small survival degree of these firms from the second generation on. The selected firm for this research was the Leão Jr. S/A, a large family company, which had experienced several succession processes. The challenge of this study was to understand how this family managed the firm and how its members administrated the imbrication of the family and entrepreneurial relations. It is hoped to broach with this work an aspect, not clearly visible in the world of labor, that refers to the net of social relations within a entrepreneur family, their representations, the symbols that permeate the life of the family and their family enterprise. The present research adopted an interdisciplinary approach, which, starting from the economic universe, tried to rescue the symbolic universe, under anthropological aspects, in order to detect the human relations in an entrepreneurial environment, with the objective to clarify more the succession process in family enterprises. The main objective of this study was to identify the position of the inheritnesses in the succession of family firms. In order to achieve this objective, the analysis focused on the understanding of the rules that guide the succession process in the studied family firm, and the factors that withdraw the female gender from the succession process. It was also tried to identify, with the inheritnesses, the meaning of belonging to a family whose identity is constructed by the firm. The empirical research was executed using the qualitative interpretative approach, looking inwards to the university of the representations, symbols, meanings, subjective and intentional character Based on the analysis of the informations, given by the inheritnesses, was constructed the history of the firm under two different perspectives - one under the view of the enterprise and another under the view of the inheritnesses. The results are analyzed focusing on the concepts of: gender, family, family firm and organizational culture - the theoretical framework of this study. The results unveil a close relation between the family and the entrepreneurial world, as well the existence of two distinct patrimonies, equal in value, which interlace and succeed from generation to generation. Besides the considerable material patrimony, the existence of an intangible patrimony was detected, whose formation and continuation shows a logic of its own, guiding the life stile of the family and the firm and delimiting the place of the inheritnesses in the succession process.

Rural women and the land question in Zimbabwe: the case of Mutasa District

Zimbabwean rural women make significant contribution to agriculture and are the mainstay of the farm labour. Although women do the majority of agricultural work, men, for the most part continue to own the land, control women‟s labour and make agricultural decisions supported by patriarchal social systems. Thus, rural women faced difficulties than men in gaining access to land under Fast Track Land Reform Programme (FTLRP). Women‟s relationship with land is therefore through husbands, fathers, brothers or sons. Therefore, this study has undertaken with the objective of assessing the impact of land distribution programme with respect to its contribution to women‟s empowerment in the study area. The Gender and Development approach was employed to assess women access to land under the FTLRP. Such an approach to rural development can help in reducing the gender gap between women and men in order to achieve gender-balanced development. The study used qualitative research methodology where semi-structured interviews gather data from women in Mutasa District. Findings indicate that there are a number of challenges and constraints that are experienced by rural women under the Fast Track Land Reform Programme which include male land registration, no access to credit, inadequate government input support, lack of government laws and policies awareness on women land rights, shortage of farm implements and irrigation water supply and lack of agriculture training. On the other hand, culture and traditional practices still affect women in other cases, disadvantaging them in favour of men, as in inheritance of land and property in the household. It was generally assumed that the programme did not improve women access to land. To improve women access to land, in future, the study recommends that a serious intervention by the state should occur coupled with the revitalization of the programme and a paradigm shift towards an effective food security programme which emphasizes women and their important role in agriculture.

Women, land rights and HIV/AIDS in Zimbabwe: the case of Zvimba communal area in Mashonaland West Province

This study explores women’s access to land under the customary tenure system. It examines how the changes in land tenure, access and rights to land as a consequence of HIV/AIDS are affecting agricultural productivity, food security and poverty, with a specific focus on women who have lost their husbands to HIV/AIDS in Zvimba. Zvimba is a village community located in Zvimba District in the Mashonaland West Province of Zimbabwe. The study also discusses policy responses designed to cushion the impact of HIV/AIDS on local communities especially women living with HIV/AIDS. The study highlights the vulnerability of widows to land rights violations, mainly inflicted by relatives but sometimes by the wider community. The main form of abuse encountered included the use of abusive language, threats of evictions and at times, beatings. The legal route for seeking redress was rarely used. Fear of witchcraft, low educational levels and fear of causing conflict between children and their paternal relatives also led widows to abandon the fight for their rights. The study further reveals that widows are heavily exposed to dispossession of their land rights. HIV/AIDS has increased the vulnerability of widows and other women to threats and dispossession of their land and other property rights. Dispossession of arable fields was observed in the four wards. The dispossessions and threats to livelihoods were directly related to the HIV positive status of the widows. The findings from this study illustrate the predominant role that male members of the household or family have over land. Thus, culture and traditional practices still affect women in other cases, disadvantaging them in favour of men, as in inheritance of land and property in the household.

Desejamos, por meio do estudo da vida material, vislumbrar o cotidiano dos habitantes do planalto e atingir o seio de suas relações e formas de sociabilidade instigadas pelo trânsito de objetos e bens. Refletiremos sobre tais redes sociais no nível familiar e de vizinhança, para alcançar as sensibilidades dos moradores da vila em relação aos indivíduos e às coisas. Investigaremos as condições de vida material dos moradores da região e sua maneira de se relacionar com a cultura material, a qual os inventários nos permitem acessar. Através do estudo de certos aspectos da materialidade da vila e do domicílio conheceremos limites e possibilidades materiais da sociedade que se constituía na região. Analisaremos as redes de relações de sociabilidades em que os indivíduos se imiscuíam, e pelas quais circulavam objetos e bens, a partir das trocas comerciais, dos empréstimos e das partilhas de bens. As trocas evidenciam a importância econômica das mercadorias, objetos e bens, apontando para diferentes níveis de riqueza e pobreza presentes na região. Os empréstimos revelam algo das relações de solidariedade e de interesse que conectavam os indivíduos de um mesmo ambiente, uma vez que faziam passar, por um período de tempo, um item de um indivíduo a outro. Já as partilhas e heranças faziam crescer ou reduzir patrimônios, desvelando dispositivos e lógicas que marcavam a dinâmica de sua constituição e reconstituição. Através dos testamentos, por fim, é possível entrever aspectos das formas de sentir dos habitantes da região, concernentes a família, principalmente, e a materialidade do patrimônio / Abstract: This research is related to the analyses of the material culture and São Paulo relationships, between 1580 and 1640, consisting in inventories and wills. We would like, through the material life study, present the daily of the people who lived in the village of São Paulo and shows which was the main way to relation done through the objects and goods. We are going to think about these social relationships on family and neighborhood, to reach the sensitivity of village's residents related to individuals and things. We are going to investigate and understand the conditions of resident's material life in the São Paulo plateau, even so their connection behavior with material culture, which are in the inventories. Through the study of specific aspects in the village and houses, we are going to know some of the limits and material possibilities in the society that was born in the region. We are going to analysis the social networks due to goods and objects, commercial, lending and division of the property. This trading shows the economic importance of the goods and objects, confirming the different levels of richness and poverty in the place. The trading prove the community of interests that connected the people in the same environment, since they changed, for a period of time, an item to person and after to other. The legacy and divisions collaborated to increase or decrease the birthright, unveiling and logical devices that marked the dynamics of its constitution and reconstitution. The South African concept of freedom of testation is one of the most absolute concepts of freedom of testation in westernised legal systems. It is suggested that the South African concept of freedom of testation is a memento of capitalist patriarchy. As the South African legal system practices a nearly absolute concept of freedom of testation, capitalist patriarchy has maintained masculine control of property in South Africa and perpetuated the systems of male dominance prevalent in South Africa. Freedom of testation allows for wealth to pass from one male to another. It also allows entrenched gender roles to continue by excluding women from inheriting. Thus the South African law of testate succession and its central concept of freedom of testation allows for discrimination on the ground of gender. / Jurisprudence / LL.M
