The prolific use of the internet and electronic mail within the legal profession presents novel challenges to the application of the attorney-client privilege; especially, in regards to protecting intended confidential communications relayed through e-mail. This thesis addresses the question of whether an attorney in Florida, through electronic mail use, can waive his client's right to the protections of the attorney-client privilege. After a review of current case law, law review articles, statutes, and texts, this thesis concluded that an attorney's communication through e-mail warrants a reasonable expectation of privacy, permitting the attorney to speak in reasonable confidence to clients through the web. However, attorneys, ethically, should consider the strong repercussions for using such a potentially transparent medium for communication. By examining the relationship between current law, the application of the attorney-client privilege, and a reasonable expectation of privacy, this study provides a comprehensive analysis for attorneys concerned with electronic mail usage. Lastly, this thesis provides attorneys with best practices for their electronic mail communications.

[pt] Esta tese no campo da comunicação política dialoga com as noções de
público, de John Dewey (2012[1922]), e esfera pública, de Habermas (1991;
1997; DAHLGREN, 2005; CALHOUN, 1992), com a teoria dos sistemas
deliberativos (PARKINSON; MANSBRIDGE, 2012; ELSTUB et al., 2016;
HENDRIKS, 2015), bem como com a literatura especializada em consultas
públicas online (SHANE, 2012; COLEMAN; SHANE, 2012). O objetivo é
analisar a comunicação política que se formou a partir das duas consultas públicas
online sobre o Marco Civil da Internet de modo a perceber contribuições
epistêmicas desse processo por meio da análise de material midiático e dos
discursos dos Deputados e Senadores no Congresso Nacional. Nesse sentido, esta
pesquisa tem por base duas research questions: (RQ1) de que forma as consultas
públicas online do Marco Civil da Internet informaram, do ponto de vista da
comunicação política e da deliberação, o sistema deliberativo que se construiu em
torno do tema?; e (RQ2) que ganhos epistêmicos e democráticos as consultas
públicas online do Marco Civil da Internet podem ter trazido ao sistema
deliberativo e ao processo decisório? Com o intuito de entender significados
compartilhados a partir das duas consultas públicas online sobre o Marco Civil
da Internet, os procedimentos metodológicos utilizados incluíram buscar, pela
observação dos comentários dos participantes no momento das consultas, temas e
argumentos utilizados para cada grande tema do debate, resultando em 322
indicadores (ou posicionamentos que sustentaram cada tema), divididos no
espectro analítico dos direitos e das responsabilidades dos seguintes atores: 1)
governo, 2) provedores e empresas prestadoras de serviços de internet; e 3)
usuários. Ao fim, enfatiza-se que os significados gerados a partir das duas
consultas públicas online para cada tema circularam pelos dois espaços
deliberativos analisados - mídia e Congresso Nacional - tanto em termos de
diversidade de posicionamentos, quanto em relação à sua ampla utilização, sendo
possível perceber uma conexão relevante do sistema deliberativo em torno do Marco Civil da Internet, a partir dos argumentos desenvolvidos nas duas consultas

media material and the speeches of Congressmen and Senators in Parliament, the
aim is to analyze which arguments born from the public sphere were repeated on
those spaces. There are two main research questions: (RQ1) how did the online
public consultations of the Brazilian Internet Law Framework inform, in the light
off political communication and deliberation, the deliberative system that was
built around the theme? And (RQ2) What were the epistemic and democratic
gains that the online public consultations of the Brazilian Internet Law
Framework brought to the deliberative system and to the decision-making
process? In order to understand the meanings shared from the public consultations
of the Brazilian Internet Law Framework, the methodological procedures included
the search of comments made available at the time that the online public
consultation occurred, aiming to discover the frameworks and arguments used by
participants for each major theme, resulting in 322 indicators (or arguments that
supported each framework). These were broken down into the analytical spectrum
of rights and responsibilities of the following actors: 1) government, 2) internet
service providers and companies; and 3) users. Finally, it is emphasized that the
arguments generated from the two public consultations for each framingcirculated through the two deliberative spaces - media and parliament - both in
terms of diversity of positions and in relation to their wide use, therefore
establishing a strong connection to the deliberative system around the Brazilian
Internet Law Framework, formed from the arguments developed in the two public
consultations and used in the deliberative spaces analyzed, namely, media and
parliament.

The liability of internet intermediariesRiordan, Jaani January 2013 (has links)
Internet intermediaries facilitate a wide range of conduct using services supplied over the layered architecture of modern communications networks. Members of this class include search engines, social networks, internet service providers, website operators, hosts, and payment gateways, which together exert a critical and growing influence upon national and global economies, governments and cultures. This research examines who should face legal responsibility when wrongdoers utilise these services tortiously to cause harm to others. It has three parts. Part 1 seeks to understand the nature of an intermediary and how its liability differs from the liability of primary defendants. It classifies intermediaries according to a new layered, functional taxonomy and argues that many instances of secondary liability in English private law reflect shared features and underlying policies, including optimal loss-avoidance and derivative liability premised on an assumption of responsibility. Part 2 analyses intermediaries’ monetary liability for secondary wrongdoing in two areas of English law: defamation and copyright. It traces the historical evolution of these doctrines at successive junctures in communications technology, before identifying and defending limits on that liability which derive from three main sources: (i) in-built limits contained in definitions of secondary wrongdoing; (ii) European safe harbours and general limits on remedies; and (iii) statutory defences and exceptions. Part 3 examines intermediaries’ non-monetary liability, in particular their obligations to disclose information about alleged primary wrongdoers and to cease facilitating wrongdoing where it is necessary and proportionate to do so. It proposes a new suite of non-facilitation remedies designed to restrict access to tortious internet materials, remove such materials from search engines, and reduce the profitability of wrongdoing. It concludes with several recommendations to improve the effectiveness and proportionality of remedies by reference to considerations of architecture, anonymity, efficient procedures, and fundamental rights.

Other questions of procedural law, such as, for example, recognition and enforcement of judgments, are not analyzed in this thesis, since the author does not see any specific issues with these questions in connection with electronic commerce. A framework for e-records in support of e-government implementation in the Tanzania public serviceKamatula, Gwakisa 10 1900 (has links)
Effective e-records management is considered an integral part for successful implementation of e-government. While many previous studies have been carried out on e-government implementation, few investigated e-records management in supporting successful implementation of e-government in Tanzania with a view to developing the best framework. The specific objectives of the study were to: determine e-records readiness in the Tanzania Public Service; assess e-government implementation status in the Tanzania Public Service; establish the effectiveness of existing e-records legal, policy and regulatory framework in support of e-government; determine the e-records knowledge and skills of staff in the Public Service; find out the extent to which the National Archives (RAMD) is involved in the management of e-records and e-government implementation in the Public Service; and to develop a framework for the management of e-records and e-government implementation.
The study based on interpretive research paradigm and adopted qualitative research method. A sample size of 50 respondents was drawn from four public offices namely: the Ministry of Public Service (PO-PSM), Tanzania Communications Regulatory Authority (TCRA), E-Government Agency (e-GA) and the Records and Archives Management Department (RAMD). Data was collected through interviews and personal observation and was analysed using thematic analysis.
Findings revealed that although there is evidence of availability and use of e-records across government institutions in Tanzania, the e-records readiness and efficiency levels in support of e-government were low; the management of e-records is not yet streamlined to the majority registries; and e-Government implementation maturity level is low. Further findings indicated that the existing legislations, policies and regulations are inadequate and ineffective particularly on matters relating to e-records management and e-government implementation; records personnel, action officers and IT staff were not conversant with procedures and practices of e-records management; and that, there is poor involvement of RAMD in ERM a situation that slows down implementation e-government.
The study concluded that, the current practices for managing electronic records in support of e-government implementation in Tanzania were inadequate. Even the existing national e-government strategy does not incorporate the management of electronic records as an important aspect towards successful implementation of e-government in the country. The study has recommended a framework for effective management of e-records in support of e-government implementation; e-records management training for records personnel, IT staff and secretaries; development of RAMD website; identification of ERM software specifications; customization of ISO standards to suit Tanzanian environment; amendment of the existing Archival legislation; and benchmarking from successful governments. / Information Science / D. Cyber crime: a comparative law analysisMaat, Sandra Mariana 11 1900 (has links)
The Electronic Communications and Transactions Act, 25 of 2002, eradicated various lacunae that previously existed in respect of cyber crimes. Cyber crimes such as inter alia hacking, rogue code, unauthorised modification of data and denial of service attacks have now been criminalised. Specific criminal provisions in relation to spamming, computer-related fraud and extortion have also been included in the Act. It is argued that theft of incorporeal items such as information has already been recognised in our law, but has not been taken to its logical conclusion in our case law. However, there are instances where neither the common law nor our statutory provisions are applicable and where there is still a need for legislative intervention. The Act sufficiently deals with jurisdiction, the admissibility of data messages, the admissibility of electronic signatures and the regulation of cryptography. Legal and policy aspects to consider when providing information security in the corporate environmentDagada, Rabelani 11 1900 (has links)
E-commerce is growing rapidly due to the massive usage of the Internet to conduct commercial transactions. This growth has presented both customers and merchants with many advantages. However, one of the challenges in E-commerce is information security. In order to mitigate e-crime, the South African government promulgated laws that contain information security legal aspects that should be integrated into the establishment of information security. Although several authors have written about legal and policy aspects regarding information security in the South African context, it has not yet been explained how these aspects are used in the provision of information security in the South African corporate environment.
This is the premise upon which the study was undertaken. Forty-five South African organisations participated in this research. Data gathering methods included individual interviews, website analysis, and document analysis.
The findings of this study indicate that most organisations in South Africa are not integrating legal aspects into their information security policies. One of the most important outcomes of this study is the proposed Concept Model of Legal Compliance in the Corporate Environment. This Concept Model embodies the contribution of this study and demonstrates how legal requirements can be incorporated into information security endeavours. The fact that the proposed Concept Model is technology-independent and that it can be implemented in a real corporate environment, regardless of the organisation’s governance and management structure, holds great promise for the future of information security in South Africa and abroad.
Furthermore, this thesis has generated a topology for linking legislation to the provision of information security which can be used by any academic or practitioner who intends to implement information security measures in line with the provisions of the law. It is on the basis of this premise that practitioners can, to some extent, construe that the integration of legislation into information security policies can be done in other South African organisations that did not participate in this study. Although this study has yielded theoretical, methodological and practical contributions, there is, in reality, more research work to be done in this area. / School of Computing / D. Phil.
