No. of bitstreams: 1 264285.pdf: 5062812 bytes, checksum: 45c225e576a30a6cc4f5883785f9e34a (MD5) / O modelo de suavização exponencial com dupla sazonalidade foi desenvolvido recentemente e aplicado principalmente na previsão de consumo horário de energia elétrica, apresentando resultados melhores quando comparado a outros modelos. Porém a estabilidade deste modelo ainda não tinha sido estudada até o presente trabalho. Para estudar a estabilidade e encontrar o espaço admissível dos parâmetros de suavização foi utilizado o teste de Jury. Este é um teste clássico aplicado a estabilidade de sistemas dinâmicos, que também pode ser utilizado em modelos de suavização exponencial. Os resultados obtidos com o teste no modelo com dupla sazonalidade mostram que quando os dados são horários, o modelo só pode ser utilizado em séries sem crescimento ou com crescimento constante. Pequenas variações no parâmetro de suavização do crescimento tornam o modelo instável, com conseqüente aumento dos erros de previsão.

O incidente de resolução de demandas repetitivas consiste numa inovação trazida no anteprojeto do novo código de processo civil. Segundo previsão legal, o novel instituto objetiva identificar demandas de massa com idêntica questão de direito que possam repetir-se ilimitadamente perante os tribunais pátrios. Identificadas tais causas, fugindo da tradição individual de cada uma ser submetida a um procedimento individual de julgamento, a solução será apresentada de forma coletivizada onde a decisão prolatada pelo órgão jurisdicional será aplicada para todas as demais demandas repetitivas. Através de um procedimento instaurado diretamente no segundo grau, os legitimados ou o magistrado de ofício, requererão a afetação do processo ao procedimento de julgamento repetitivo cuja competência pertencerá a um órgão especial do Tribunal, e, uma vez admitindo o procedimento, os demais processos idênticos, serão suspensos até o julgamento, pelo Tribunal, da matéria de direito objeto da controvérsia. Pronunciando-se o Tribunal, a decisão dada naquele caso em concreto servirá para todos os demais casos com a mesma controvérsia jurídica. A decisão dada pelo Tribunal vinculará todos os magistrados monocráticos que decidirão no mesmo sentido para todos os processos até então suspensos, bem como, toda vez que a questão se repetir no judiciário. Tal procedimento objetiva minimizar o enorme quantitativo de processos repetitivos, julgados caso a caso em todo o judiciário, possibilitando uma maior economia de tempo aos magistrados para debruçarem-se sobre questões específicas ou de grande complexidade merecedoras de tratamento individual. O estudo a ser desenvolvido no presente trabalho pretende identificar o fenômeno da litigiosidade de massa e verificar a insuficiência do processo individual e coletivo para enfrentá-lo. Posteriormente será feito um estudo sobre uma nova visão do devido processo legal no fenômeno das demandas de massa e a aplicação do precedente jurisprudencial no direito brasileiro devido a proximidade do nosso sistema com o common law. Por fim, será analisado o novel incidente e as técnicas de julgamento em grupo por ele introduzidas. / The incident of repetitive demands resolution is an innovation introduced in the draft of the new code of civil procedure. According to legal provision, that institute aims to identify demands of mass with identical question of law that can be repeated indefinitely before patriotic courts. Identified these causes, fleeing the individual tradition of each undergo a procedure of individual judgment, the solution will be presented in a collectivizedly where the decision handed down by the court will apply to all other demands repetitive. Through a procedure initiated directly in the second degree, legitimate or magistrate office, require the affectation of the case to repetitive prosecution whose jurisdiction belong to a special organ of the Court, and, once admitting the procedure, other similar cases will be suspended until the judgment by the Court, of the matter of law in dispute. Speaking the Court, the decision given in that particular case will serve for all other cases with the same legal controversy. The decision given by the Court, will bind all monocratic magistrates who will decide in the same direction for all cases so far suspended as well, whenever the question is repeated in the judiciary. This procedure aims to minimize the enormous quantity of repetitive processes, judged on a case throughout the judiciary, allowing greater saving time to the magistrates in order to address it on specific issues or complexity worthy of individual treatment. The study to be done aims to identify the phenomenon of mass litigation and verify the failure of the individually and collectively process in order to address it. Later, we will study about a new vision of this process in the phenomenon of mass demands and application of precedent in Brazilian law because of the proximity of our system with the common law. Finally, we will analyze the incident and novel techniques in trial group he made.

Multilevel Potential Outcome Models for Causal Inference in Jury Research

abstract: Recent advances in hierarchical or multilevel statistical models and causal inference using the potential outcomes framework hold tremendous promise for mock and real jury research. These advances enable researchers to explore how individual jurors can exert a bottom-up effect on the jury’s verdict and how case-level features can exert a top-down effect on a juror’s perception of the parties at trial. This dissertation explains and then applies these technical advances to a pre-existing mock jury dataset to provide worked examples in an effort to spur the adoption of these techniques. In particular, the paper introduces two new cross-level mediated effects and then describes how to conduct ecological validity tests with these mediated effects. The first cross-level mediated effect, the a1b1 mediated effect, is the juror level mediated effect for a jury level manipulation. The second cross-level mediated effect, the a2bc mediated effect, is the unique contextual effect that being in a jury has on the individual the juror. When a mock jury study includes a deliberation versus non-deliberation manipulation, the a1b1 can be compared for the two conditions, enabling a general test of ecological validity. If deliberating in a group generally influences the individual, then the two indirect effects should be significantly different. What About “He Said, He Said?" The Effect of Rape Myth Acceptance and Extra-Legal Factors on Blame Attributions

abstract: Many authors have shown that "real victim," "real rape," and traditional gender role stereotypes affect how people attribute blame to victims and perpetrators of sexual assault, and that jury decisions in rape cases are likewise influenced by extralegal factors, such as how much the victim resisted. Most studies only focus on the acceptance of rape myths and stereotypes about female victims, while myths and stereotypes about male victims are largely ignored. It is unknown how female rape myth acceptance (FRMA) and male rape myth acceptance (MRMA) may differently affect victim and perpetrator blame attributions. Whether the juror influences the effect of extra-legal factors on rape perceptions is also unknown. Using a randomized vignette design, the current study investigates 1) the effect of rape myth acceptance and gender attitudes on victim and perpetrator blame attributions, 2) how blame attributions differ by victim gender, level of resistance, and victim-perpetrator relationship, and 3) how the juror role influences the effects of rape myth acceptance and extra-legal factors on blame attributions. Results show that FRMA and MRMA are both positively associated with victim blame and negatively associated with perpetrator blame, that male victims are blamed more than female victims, and that jury membership does not influence the effect of extra-legal factors on blame attributions. Victim resistance and victim-perpetrator relationship also affected rape perceptions in unexpected ways. How Disorder Onset Controllability Moderates the Impact of Biological Arguments on Judgments of Criminal Responsibility

abstract: In recent years, the use of biologically based (neurological, neuropsychological, genetic) evidence in criminal trials as support for claims of mental impairments among offenders has increased in popularity. However, research on how exposure to those arguments affects jury decision-making remains unclear. Specifically, arguments rooted in biology sometimes mitigate and sometimes aggravate judgments of criminal responsibility for mentally ill offenders, and this discrepancy seems to stem from the specific conditions by which that disorder was acquired. The following study’s aim was to uncover the precise mechanism(s) behind this elusive effect. Utilizing a 2x2 between subjects experimental design, participants were presented with a hypothetical crime summary involving an offender with either an onset controllable or uncontrollable mental disorder. Ratings of criminal responsibility and other variables hypothesized to function as mediators were obtained after presentation of a prime supporting either a biologically deterministic or free will argument for human behavior in general. Results indicated that when the defendant’s disorder was the result of the his own actions (onset controllable), a biological prime decreased judgments of criminal responsibility; however, when the disorder was caused by factors out of his control (onset uncontrollable), the prime increased judgments of criminal responsibility. An examination of several possible mechanisms finds the effect mediated by the perception of control the defendant could have had over his own actions at the time of the crime. These results suggest that perceptions of behavioral control are an important contributor to jurors’ formation of criminal responsibility judgments when an offender possesses a mental illness; and arguments advocating a biological basis for human behavior reliably affect blame attribution, suggesting that a societal shift in the perception of free will as a result of increased exposure to biology in general may alter the framework of criminal responsibility judgments. / Dissertation/Thesis / Masters Thesis Psychology 2017

The purpose of this work was to revisit the institution, in order to bring its importance while instrument of popular participation. The work presents, first, a systematic and chronological approach of the institution of the Jury and its evolution inside of Brazilian constitutional history, objectifying, with this, to approach the narrow entailing of the Jury with the constitutional postulates. After that, the constitutional principles of the Jury had been examined, looking for to establish the popular identity of the institution and its approach with the human rights system of the Brazilian Federal Constitution. More ahead, had been examined the direct participation of the society in the Jury, going deep the questions related with the election of the jurors and the jury nullification on the American Jury. O presente trabalho analisa a valoração da prova na decisão de pronúncia e os limites à sua motivação, realizando-se, inicialmente, um estudo sobre a origem dessa decisão com base em decisões de ordenamentos jurídicos passados. A regência legal da pronúncia é estudada para a compreensão de sua definição, requisitos, cognição e função que exerce no procedimento do Júri. Em relação à valoração da prova, objeto central do presente trabalho, estabelece-se um critério de decisão com base nos standards de prova da autoria ou da participação.
