Estabelecido no Brasil na Constituição de 1824, e regulamentado em 1827, o Juizado de paz, apesar das amplas funções denotadas à seu cargo e de ser um marco do desenvolvimento da administração e da justiça no Brasil, trata-se de tema pouco visitado na historiografia brasileira. A presente pesquisa tem por objetivo investigar os indivíduos eleitos para juiz de paz, no extenso município de Mariana, província de Minas Gerais, entre 1827-1841. Os propósitos foram abordar a inauguração desta instituição tão ainda incógnita e, analisar as eleições locais que elegiam aqueles homens e as funções desempenhadas pelos mesmos. Além disso, e paralelamente, procurou-se traçar o perfil e inserção social desses homens que, além de juízes de paz, compunham a tão economicamente diversa sociedade mineira da primeira metade do século XIX. / The Judge of peace represented the major new paradigm instauration of political and social organization that raised the most learned and liberal innovations of the European legal system to suit a wide tradition and institutionalization in the first instance. Established in Brazil in the 1824 Constitution and regulated in 1827, the Judge of peace, despite the broad functions denoted his position and be a milestone in the development of administration and justice in Brazil, it is little visited theme in the historiography Brazil. This research aims to investigate the individuals elected to justice of the peace in the vast city of Mariana, in the province of Minas Gerais, between 1829-1841. The purpose was addressing the inauguration of this institution as yet unknown, and examine the local elections that elected the men and the functions performed by them. Furthermore, and in parallel, we tried to trace the profile and social integration of those men who, in addition to justices of the peace, made up as economically diverse mining company in the first half of the nineteenth century.

Após a separação formal do Brasil de Portugal, a reorganização do aparelho judicial brasileiro adquiriu características próprias, aproveitando tendências modernas do Direito europeu, que passava por significativas alterações. Um dos marcos mais relevantes dessas mudanças foi a introdução da Justiça de Paz no ordenamento, estabelecida constitucionalmente em 1824 e regulamentada pela Lei de 15 de outubro de 1827. Temática pouco trabalhada pela historiografia, apesar da diversidade de funções exercidas, a presente pesquisa tem como objetivo o estudo das atividades dos juízes de paz de Porto Alegre, capital da província do Rio Grande do Sul, no início do século XIX. Procura-se compreender o contexto no qual essa instituição foi inserida, a construção do Estado Imperial brasileiro, e as características adquiridas na realidade sulriograndense, bem como sua atuação durante a Revolução Farroupilha. / After the official dissociation of Brazil from Portugal, the reorganization of the Brazilian administration of justice got own characteristics and took advantage of the modern tendencies of the European law, which at this time was having significantly changes. The most relevant sign of these changes was the introduction of the justice of the peace at the legislation, which was constitutionally settled in 1824 and subject to regulation under the law of 15th of October 1827. This topic was rarely discussed by the historiography. And despite the diversity of the functions practised at the justice of the peace, has the current dissertation the purpose to investigate the activities of the justice of the peace of Porto Alegre, the capital of the province Rio Grande do Sul, at the beginning of the XIX century. The dissertation tries to understand the context, in which this institution was introduced, the construction of the Brazilian Imperial State, and the characteristics acquired in the reality of the province of Rio Grande do Sul, as well as their action during the Farroupilha Revolution.

O funcionamento do Juizado de Paz esteve vinculado a um contexto de reorganização administrativa-judiciária e ao distanciamento dos moldes da justiça portuguesa. Em 1827, com sua efetiva regulamentação, foram introduzidos nas paróquias como importantes agentes para as demandas locais. Constatou-se que devido a sua independência e eletividade aliado ao aumento expressivo de suas funções no decorrer da década de 1830, o cargo se tornou a autoridade mais requisitada e com amplos poderes em sua jurisdição. Ademais, investigando os eleitos para o cargo e sua ação em processos que transcorreram em seu juízo, foi possível revelar a transitoriedade de um elite política no espaço camarário e o seu potencial de agente político na localidade. As principais fontes utilizadas foram os registros eclesiásticos, documentação cartorária, livros de posses e juramentos, livros de registros gerais e códices da Câmara Municipal, correspondências e processos do Juizado de Paz de Rio Pardo. / The present research is dedicated to the study the profile of the Justices of the Peace and their acting in the local politics at the headquarters of Rio Pardo, Province of Rio Grande do Sul, between 1828 and 1850. The Court of Peace functioning was vinculated to a context of administrative-judiciary reorganization and to the distancing from the molds of the Portuguese Justice. In 1827, with its effective regulation, they were inserted in the parishes as important agents for the local demands. It was proved that due to its independence and electivity allied to the expressive increase of its functions during the decade of 1830, the post became the most requested authority and with wide powers in its jurisdiction. Moreover, investigating the elected ones for the position and their action in processes which elapsed in its judgement, it was possible to reveal the transience of a political elite in the Council environment and its potential of political agent at the locality. The main utilized sources were the ecclesiastic records, notary’s office documentation, possession books and oaths, general recording books and codexes of the City Council, correspondences and processes of the Court of Peace of Rio Pardo.
