Výkon realitní činnosti / Performance of Real Estate Activities

This thesis illustrates the real estate environment from a professional and legal perspective. The first part of this thesis will refer to the legislative components and organizations, which affect the development of laws related to the industry. Then, the real estate market will be defined from two angles - a broker's and the competitors, as well as illustrating the differences in the Czech and Slovak markets. A case study will show the process of two property sales. In the first, a family house is sold under normal conditions and in the second, an apartment building is sold under shared ownership. The final segment of the thesis will summarize a research, which was focused on service quality in the Czech and Slovak real estate brokerage markets.

Presented diploma thesis deals with concepts from the real estate practice and people, who are employed in this practice. The thesis provides a look at contracts used in the real estate practice and their changes according to the passing of the new Civil code. The thesis is mapping changes in the real estate business as a follow-up to the passing ot the new cadastral act. Focus is also put on new definitions of some terms related to the real estate branch, as the new Civil code stipulates. The thesis studies present level of education of real estate brokers and possibilities of further education in this branch. Within the scope of the diploma thesis a questionnaire has been elaborated, which mapps fundamental issues of the real estate business. The questionnaire is also focused on prepared bill about providing of services of the real estate brokers.

This master´s thesis deals with the basic principles of the Land Register, comparing those principles on the basis of previous legal regulation in effect until the end of 2013 and current legislation, where from the 1st January 2014 came to force Act no. 256/2013 Coll., on Land Registry (Cadastral Act) and Act no. 89/2012 Coll., Civil Code. Many changes, important for principles of the cadastre, are enshrined in these regulations. Thesis describes particular principles and states the most important changes, that occured in connection with the new legislation. It explains these changes theoretically and also practically on simple examples for better understanding of the principle.

The Master´s thesis is focused on optimizing the procedure for the transfer of ownership of agricultural land, which will also form the aim of this work. The theoretical part consists of information on the acquisition of property rights to agricultural land. They also described the basic concepts related to the issue. The practical part is formed at the beginning of the analysis of the situation on the market of agricultural land type arable land species in the selected area. It is followed by the creation of objective work, which is creating the optimal procedure for the transfer of ownership of agricultural land. Conclusion the Master´s thesis contains a description of differences in the transfer of ownership of practice and also a summary of the law legislation in the Czech and Slovak Republics

L'information géographique et ses outils informatiques avec les Systèmes d'Informations Géographiques font figure aujourd'hui d'éléments incontournables pour l'aménagement et la gestion des territoires. Le travail mené s'applique à interroger leur place dans les modalités de gouvernement des territoires et de définition des politiques d'action publique dans les villes des pays des Suds. A partir d'une étude de cas menée sur la région urbaine littorale du Bénin, dans un contexte de présence accrue des agences internationales de développement, on analyse les jeux d'acteurs et les imbrications d'échelles (internationale, nationale, régionale, communale et locale) suscités par la production, l'accès et l'utilisation pratique de cette information et ses outils. Les intérêts de cette recherche se situent au croisement des problématiques de gestion des territoires à l'ère de la mondialisation avec l'essor et la vulgarisation des techniques professionnelles et d'accès à l'information et de la décentralisation et municipalisation censée encourager le rôle des pouvoirs locaux dans le processus de développement des territoires. Cette étude questionne cependant l'adaptabilité de modèles du Nord vers le Sud et leurs possibilités d'appropriations locales : capacité de résistance, de cohabitation et de résilience des valeurs culturelles et des pratiques locales avec les encadrements techniciens et astreignants liés à la diffusion de l'information géographique et ses outils. / Geographic information and its IT tools with the Geographic Information Systems have become necessary elements in territorial development and administration. The aim of this research is to investigate the role of geographic information in the making of territorial government and in the definition of public action policy in the cities and countries of the South. Taking as our starting point a case study carried out in the coastal region of Benin, within a context of the increased presence of international development agencies, particular attention has been paid to the roles of each of the various parties and the intertwining of the various scales (i.e. on a international, national, regional and communal level) brought on by the production, access and practical use of this information and tools. Our research is situated at the crossroads of land management policy, within an era of globalisation with increase and expansion of professional techniques and access to the information and the decentralization and municipalization meant to encourage the role of local authorities in the process of regional development. This study however questions the adaptability of models from North to South and their opportunities for local ownership: resistance, cohabitation and resilience of cultural values and customary practices with technological and binding management augured by the dissemination of geographical information and its tools.

Analýza definic činnostních rolí v základních registrech veřejné správy v ČR / The analysis of the definiton of acivity roles in basic registers of public administration in the Czech Republic.

The thesis deals with the topic of basic registers and specific agendas' activity roles that are analyzed based on a questionnaire survey. It gives the basic overview of e-Government and the basic registers of public administration as part of e-Government. Based on the questionnaire survey conducted on particular Land Register and Register offices the structure and definition of the agenda activity roles are evaluated and the thesis identifies the intensity of various activity roles use in practice. It is concluded that the activity roles of A124 agenda are defined in the way that approximately corresponds to the actual execution of the agenda and that all the roles are actually more or less in use. On the contrary, when it comes to A414 agenda, the number of reported roles is quite maximalist. The thesis reveals that some of the activity roles are not being executed in practice at all, or they are in use only at certain offices. 67 % of both A124 and A414 agenda activity roles were proved to be defined the way that fully corresponds to the actual use of these agendas. These activity roles are being used quite often.

Furthermore, the thesis describes the present Cadaster state, regulations on which is the Cadaster based on, its structure and written records. Finally, the thesis also mentions the Slovak Republic Cadaster and other cadastrial systems in foreign countries.

The aim of the thesis is to describe the real estate legislation in selected areas and to summarize the differences between the legal real estate in the Czech Republic and the Russian Federation. This theme was chosen in order to highlight the diversity of real estate legal institutions in both countries. A common feature of the legislation in both countries is that their skills are performed in a professional manner in accordance with applicable standards and regulations of the country. The thesis is divided into six chapters. The first chapter deals with the characteristics of real estate in the Czech Republic. The main resource of law in this field is the Law No. 344/1992 Coll. Cadastre. The second chapter deals with the characteristics of real estate in Russia. The third chapter discusses the changes which currently rules the Land of the Russian Federation passed. The old provisions of the Act are replaced by more modern and the law generally becomes easier. A special feature of the Russian legislation, the institute cadastral engineer, which is entirely devoted in the fourth chapter. The fifth chapter describes the specific differences in the area of real estate law in both countries, and the last sixth chapter deals with the future developments in this area of law in both countries
