The topic of this thesis focuses on various legal professions within the Czech Republic, such as attorneys, notaries, bailiffs and judges. These occupations are often associated with civil judiciary process. The purpose of this thesis is to define the foundations of their legal status, including the scope of their activities, and how they differ. Additionally, the thesis focuses on the role of individual professions. Firstly, important elements, such as confidentiality, independence, autonomy or responsibility will be analyzed. Secondly, the thesis will address significant problems in defining the role of the legal profession. Avocats, notaires et huissiers de justices ont-ils les moyens structurels de se regrouper tout en maintenant leurs spécificités ?Tel est l'enjeu d'une certaine réflexion sur les différents modes de regroupement de professions juridiques. Car ces professionnels ont des fonctions différentes mais complémentaires et des statuts certainement compatibles au vu de leur dénominateur commun qui est la réglementation de leurs professions. Le cœur de leurs métiers réside pour chacun dans le respect de règles strictes - notamment d'une déontologie - et le service aux clients.Les structures classiques que sont les groupements de personnes comme l'association, la société civile de moyens, ou le groupement d'intérêt économique, peuvent correspondre à un premier objectif de mise en commun de moyens, mais de véritables sociétés de capitaux ont été mises à la disposition des professions juridiques pour favoriser leur croissance, par la création des sociétés d'exercice libéral en 1990, puis de véritables sociétés holding que sont les sociétés de participation financière de professions libérales en 2001, et enfin de sociétés pluriprofessionnelles d'exercice en 2015.L'évolution législative en la matière a été longue et finalement hésitante tant le rôle des professions juridiques est loin du commerce.Le législateur s'est attaché depuis 1990 à préserver l'indépendance des professionnels du droit, mais peu à peu, les verrous nécessaires ont lâché pour laisser place aujourd'hui à une ouverture financière et d'exercice qui paraît inadaptée au respect de l'essence-même de ces professions.La volonté récurrente de constituer une "grande profession du droit" ou une profession unifiée n'a pas abouti, mais les outils viennent d'être donnés sans "mode d'emploi" pour parvenir insidieusement à ce que la finance encourage la naissance d'une profession unique sous couvert d'un regroupement nécessaire à la survie des structures. L'interprofessionnalité est en marche, mais à quel prix ? / Have lawyers solicitors and bailiffs the structural ways to group together while maintaining their specificities?Such is the stake in a certain reflection on the various modes of regroupement of law occupations. Because these professionals have different but complementary functions and certainly compatible statutes in view of their common denominator which is the regulations of their occupations. The heart of their jobs lives for each in the respect for strict rules - in particular of a business ethics - and the service to the customers.The classic structures that are the groupings of people as the association, the civil society of ways, or the economic interest group, can correspond to a first objective of pooling of ways, but real societies of capital were put at the disposal of law occupations to favor their growth, by the creation of the societies of liberal exercise in 1990, then the real holding companies that are the societies of financial participation of liberal professions in 2001, and finally pluriprofessionnelles societies of exercise in 2015.The legislative evolution on the subject was long and finally hesitating so much the role of law occupations is far from trade. The legislator attempted since 1990 to protect the independence of the professionals of the right, but little by little, the necessary bolts broke to give way to a financial opening and of exercise today which seems unsuitable for the respect for the gasoline of these occupations.The recurring will to constitute a " big profession of the law " or a unified profession did not succeed, but tools have just been given without "instructions for use" to reach insidiously that the finance encourages the birth of a unique profession on behalf of a grouping necessary for the survival of the structures. The interprofessionalism is underway, but at what price ?

In conclusion, it examines availability of professional liability insurance products on the Czech insurance market.

O objetivo deste trabalho é a compreensão das relações entre direito e política, a partir do estudo da posição dos juristas no Estado e de suas lutas concretas pelo controle da administração do sistema de justiça. A principal hipótese que orientou a pesquisa foi a de que há um campo político da justiça, representado pelo espaço social de posições, capitais e relações delimitado pela ação de grupos e instituições em disputa pelo controle do direito processual e da burocracia judiciária. No interior desse campo político da justiça, a pesquisa buscou identificar, ainda, as posições dominantes das elites jurídicas lideranças institucionais e associativas, e intelectuais especializados em determinadas áreas de conhecimento cuja influência sobre a administração da justiça estatal e as estruturas de seus capitais sociais, políticos e profissionais os diferenciam dos demais agentes do campo jurídico. / This dissertation examines the relationship between Law and Politics by studying the position of lawyers within the State and their struggle for the control of the administration of the judicial system. The main hypothesis is that there is a political field of Justice, represented by a social space of positions, capitals and relationships, and defined by the actions by groups and institutions vying for the control both of procedural law and of the judicial bureaucracy. Additionally, this dissertation aims also, within this political field of Justice, at identifying the dominant position of legal elites institutional and union leaders and scholars from different fields who are distinguished from other agents in juridical field by their influence on the administration of the judicial system and by the structure of its social, political and professional capitals.

O objetivo desta pesquisa foi analisar as diferenças entre os três tipos de defesa dativa, constituída e defensoria da PAJ Criminal na assistência judiciária criminal paulistana em processos-crime de homicídio na década de 1990. A partir das diferentes proporções que essas modalidades de defesa apresentaram em relação às suas atuações em cada fase do processo penal para o desfecho processual, procurei investigar as possíveis razões para a ocorrência essas distintas proporções. A partir da análise documental de 127 processos criminais de homicídios tentados e consumados registrados de 1991 a 1997 na 3ª Seccional de Polícia do município de São Paulo que integram o banco de dados da pesquisa Violência, Impunidade e Confiança na Democracia (NEV/USP/Cepid), construí um banco de dados referente às intervenções da defesa ao longo dos processos até seu desfecho. Tais intervenções foram examinadas quantitativamente em relação às três categorias de defesa criminal. A partir da pesquisa documental e quantitativa dos 127 processos, foi possível constatar algumas tendências e encontrar algumas explicações para a ocorrência de distintas proporções de condenações e absolvições segundo a natureza da defesa. A partir de hipóteses levantadas e tendências verificadas nos processos, realizei entrevistas semiestruturadas com alguns dos advogados mais atuantes nos processos examinados. Assim, foi possível verificar que os advogados que atuavam na assistência judiciária trabalhavam tanto como dativos quanto como constituídos. Esse habitus era uma maneira de atrair novos clientes. Por essas razões a advocacia dativa era a que mais concentrava absolvições e revelava menor diferença em relação à advocacia constituída, Esta última, apesar de intervir mais nos processos, não obtinha proporções de absolvições superiores às da advocacia dativa. Os procuradores da PAJ Criminal, por sua vez, eram os mais suscetíveis a terem seus réus condenados, porém tinham maior proporção de penas até 5 anos do que as demais modalidades de defesa. Isso porque, conforme ficou evidente nas entrevistas, eram em menor número e sofriam os efeitos da crise da Justiça Criminal, com grande quantidade de trabalho. Por isso, tendiam a realizar mais acordos informais com a acusação durante o júri e com isso logravam penas menores. Além disso, ficou evidente a existência de acordos também entre os advogados criminais e os delegados de polícia após o flagrante do réu. Tais acordos certamente contribuíam para a exclusão de casos da Justiça Criminal durante a fase do Inquérito Policial. Por fim, concluímos que a advocacia criminal na assistência judiciária sofreu forte impacto com a entrada massiva de novos advogados no campo jurídico e com a perda de controle da OABSP sobre a proliferação de novas faculdades de direito, ambas decorrentes da grande expansão do ensino superior privado no período. / This research aims to analyse the differences between the three kinds of criminal defense attorney nominated by the State, private attorney and public attorney at criminal legal aid in homicide processes in São Paulo during the 1990s. I have investigated the possible reasons for the occurrences of different proportions of each kind of defense present in the successive phases of the legal process and its sentences. I have built a database through the analysis of 127 attempted and consummated murder processes registered from 1991 to 1997, which constitutes the database of the research Violence, Impunity and Trust in Democracy (NEV/USP/Cepid), focusing on the interventions of the defense during the processes until its closure. Those interventions were quantitatively measured considering the three kinds of criminal defense. Analysing the documents and statistics of those 127 processes, it was possible to identify some tendencies and raise some hypothesis on the occurrence of distinct proportions of convictions and discharges, according to the nature of the defense. Those hypothesis based the semi structured interviews with some of the most active attorneys on the processes examined. Therefore, it was possible not only to verify that the attorneys working in criminal legal aid as nominated by the State worked also as private attorneys, but that work as nominated, specially at the Juri Court, was a way of attract new clients. That explains why nominated defences resulted in more acquittals, with a little difference to the private defense, even if the private attorneys were able to interfere more during the processes. The Public Criminal Attorneys (PAJ Criminal) were more susceptible, by the other hand, to have their clients condemned, but had more cases with sentences fewer than 5 years of prison. They endured, as the interviews revealed, the effects of the crises at Criminal Justice, and were fewer in number. As such, they would aim to make deals with the prosecutors more often, in order to get smaller terms to their clients. Deals between criminal attorneys and police deputies after the defendant arrest were also made evident. Such deals certainly contributed to the exclusion of Criminal Justice cases during the investigation phase. Finally, I conclude that criminal defense at legal aid faced a severe impact with the entrance of new lawyers in the juridical field and the loss of control by the Brazilian Bar Association in the creation of new Law Schools, due to the huge expansion of private colleges at that period.

La responsabilité civile des professionnels du droit : comparaison de l'obligation de conseil de l'avocat et du notaire / The civil liability of legal professions : comparison of the obligation of counsel of the attorney and the notary

La montée en puissance de l'obligation de conseil n'a pas épargné, dans son sillage, l'avocat et le notaire. Or, avec près de 65000 avocats et 11000 notaires en exercice sur le sol français, recensés en 2017, ils représentent les métiers du droit les plus exercés mais aussi les plus exposés au risque de voir leur responsabilité civile engagée en raison du manquement à leur obligation de conseil. Pourtant, les contours de cette obligation, dessinés par la jurisprudence, sont souvent diffus et imprécis. L'objectif de la thèse consiste donc à démontrer que l'obligation de conseil dispose d'un régime autonome, obéissant à des forces propres, permettant de la distinguer de notions voisines. Pour y parvenir, il faudra mettre en lumière la fonction de l'obligation de conseil. Cette analyse permettra de démontrer que l'avocat et le notaire sont tenus d'une obligation dont la portée est sensiblement identique. Curieusement, pourtant, en cas de défaillance de leur part, la jurisprudence a fait le choix de ne pas retenir un régime de responsabilité civile uniforme. Traditionnellement, en effet, c'est généralement à l'aune des règles de la responsabilité contractuelle que l'avocat doit répondre de sa défaillance tandis que la responsabilité du notaire est plutôt appréciée sur le terrain délictuel. Ce système, reposant sur une argumentation qui n'emporte pas pleinement la conviction, conduit à des inégalités de traitement de la victime mais aussi du professionnel fautif. Pour ces raisons, des solutions correctrices seront proposées afin d'harmoniser le régime de responsabilité civile applicable. / The overall increase of the obligation of counsel within the French legal system did not spare attorneys and notaries in its wake. With approximately 65000 practising attorneys and 11000 practising notaries in France, according to registered figures in 2017, they embody the most practiced legal professions. They are also the most likely to see their civil liability incurred in regards to a breach of their duty to provide legal advice. However, the outlines of this obligation, framed by case law, are often imprecise and diffuse. This thesis aims to demonstrate that the obligation of counsel has an autonomous regime subject to proper rules, highlighting the gap between adjacent concepts. In this context, the function of this obligation will be explained. This analysis will show that attorneys and notaries are bound to an obligation which the impact is roughly identical. However, in case of a breach of their obligation, case law does not design a unique regime of civil liability. Indeed, an attorney's liability is traditionally based on contractual liability, whereas a notary's liability is generally based on tort liability. This system, erected on a debatable argumentation, leads to inequalities of treatments for both victims and legal counsel. For these reasons, corrective solutions will be proposed in order to harmonise the civil liability regime applicable.

The dissertation thesis To Be a Lawyer - Theory and Practice of Professional Ethics of Chosen Legal Professions in the Czech Republic aims to strengthen (currently rather weak) discussion about professional ethics in the Czech Republic. The first part introduces elemental terminology of the topic which enables easier understanding of second and third part. The second part is devoted to the presentation of results of researches regarding the analysis of judgements issued by Czech disciplinary authorities on judges', state attorneys' and lawyers' discipline. The last part demonstrates how professional ethics scrutiny operates in a real-life situation. A judicial usage of social media serves as an example of such situation (or more precisely of such scrutiny). Arguments for and against the judicial usage of social media are articulated and based in a weighting of the arguments final decision is taken.
