Previous issue date: 2007-04-17 / Environmental law aims to mitigate the degradation of the environment in light
of man s necessity concerning the use of environmental resources. Therefore, we
should comply with the balance of human beings needs in the development of all
their faculties without endangering current and future generations.
To reach this objective, Law rules man s operation related to the environment
in a preventive and repressive way. Repressively, through the penalty imposition in
light of the detection of some environmental damage. Preventively, through the
inspection by the available instruments identified in the legal system.
Environmental licensing is one of these preventive instruments. It is
internationally provisioned in the declaration of principles of the United Nations
conference about the environment, held in Stockholm, in 1972, and stands on legal
grounds in the national legal structure, being set forth in the Act nr. 6.938/81 which
deals with national politics in the environment accepted by the Federal Constitution
acted in 1988.
Notwithstanding its legal provision, it has been a lot difficult to carry out the
environmental licensing. Brazil is structured trough the choice of the Federal State
described in provisions 1 and 18 of the Constitution. The Federal State is known by
the autonomy of its federative entities. According to this structure, it is important to
distribute jurisdiction in order to avoid possible conflicts. Responsible for this balance,
the Constitution establishes in provision 23, the operation among all entities; that s to
say, they can all use its authority to monitor the environment.
However, there is a series of questioning concerning what can be considered
joint monitoring. Doctrine and case law constantly change their position. In certain
occasions, they point to the individual performance of the entities based on the
interest primacy; in others, they turn to the joint operation or even the connected
operation, where all have to respond individually for the monitoring. The problem,
therefore, lies on determining which entity has jurisdiction to license an enterprise.
That is what this dissertation is about / O direito ambiental tem por finalidade mitigar a degradação do meio ambiente
em face da necessidade do homem em relação à utilização dos recursos ambientais.
Nesse sentido, devemos observar o equilíbrio das necessidades do ser humano no
desenvolvimento de todas as suas faculdades sem que comprometam as presentes
e futuras gerações.
Para efetivar o objetivo descrito, o Direito regulamenta a atuação do homem
em relação ao meio ambiente de forma preventiva e repressiva. Repressivamente,
mediante a cominação de sanção em face do cometimento de algum dano
ambiental. Preventivamente, por meio da fiscalização pelos instrumentos dispostos
no ordenamento jurídico.
O licenciamento ambiental é um desses instrumentos de prevenção. Previsto
internacionalmente na declaração de princípios da conferência das Nações Unidas
sobre o meio ambiente, realizada em Estocolmo, em 1972, tem fundamentação
jurídica no ordenamento pátrio, sendo previsto na Lei n. 6.938/81 que trata da
política nacional do meio ambiente recepcionada pela Constituição Federal de 1988.
Não obstante sua previsão legal, temos grande dificuldade de efetivar o
licenciamento ambiental. O Brasil organizou-se mediante a escolha da forma de
Estado Federal prevista nos arts. 1º e 18 da Constituição. O Estado Federal
caracteriza-se pela autonomia dos entes federativos. Nessa estrutura, é importante a
distribuição de competência para que sejam evitados possíveis conflitos. A
Constituição, responsável por esse equilíbrio, determina no art. 23 a atuação comum
entre todos os entes, ou seja, todos possuem competência para fiscalizar o meio
ambiente.
Resta, porém, uma série de questionamentos em relação ao que vem a ser a
atuação comum. A doutrina e a jurisprudência modificam constantemente sua
posição. Em certas situações, apontam a atuação individual dos entes com base na
primazia do interesse, em outras, a atuação conjunta e até a atuação paralela em
que todos, individualmente, serão responsáveis pela fiscalização. O problema
reside, portanto, em determinar qual ente efetivamente possui competência para
licenciar um empreendimento. É disso que trataremos nesta dissertação

Previous issue date: 2010-04-07 / The disorder growth of the industries, since the 1970s, raised environmental
laws which control the pollution by environmental agencies. Then, it was created the
environmental permit, one of the instruments of National Environmental Policy, with
the purpose to maintain sustainability.
With the environmental criminal law edition, the environmental permit begins
to be more relevant, because it became a crime not having a permit in an undertaking. It
is an extremely instigate subject, because it involves different actors, such as public
agencies, industries, Executive, Legislative, Judiciary Power, and the society itself. The
importance of the subject is obvious when it is verified, by IBAMA information, that it
has been demanded by the business man billions named as environmental impacts
mitigation, beyond compensatory measures.
Therefore, the reader is invited to an approach of the legal structure, such as
legal as well as principle structure, which involves environmental permit, environmental
competence, main issue of our dissertation, and of the several of obstacles that damage,
sometimes, make impossible the installation and the operation of activities and
industries, that potentially or effectively cause environmental impact in Brazil / O crescimento desordenado das indústrias, a partir da década de setenta,
ocasionou a edição de leis ambientais que controlassem a poluição através de órgãos
ambientais. Assim foi criado o licenciamento ambiental, um dos instrumentos da
Política Nacional do Meio Ambiente, com a função de preservar a sustentabilidade.
Com a edição da lei de crimes ambientais, a obtenção da licença ambiental
passou a ter maior relevância, pois foi criminalizada a ausência de licença num
empreendimento. Trata-se de um assunto extremamente instigante, pois envolvem
diversos atores, como órgãos públicos, indústrias, Poderes Executivo, Legislativo,
Judiciário, e a própria sociedade. A importância do tema é notória quando se verifica,
pelas informações do IBAMA, que está sendo exigido do empreendedor bilhões a título
de mitigação de impactos ambientais, além das medidas compensatórias.
Enfim, convida-se o leitor a uma abordagem do arcabouço jurídico, tanto de
sua estrutura normativa como principiológica, que envolve licenciamento ambiental, das
competências ambientais, foco da nossa dissertação, bem como dos diversos entraves
que prejudicam, às vezes, impossibilitam a instalação e a operação de atividades e
indústrias que potencialmente ou efetivamente causem impacto ambiental no Brasil

use it as an instrument to permit the land planning and the informal settlements
regularization.
The land regularization of social concern aims at social justice and
fundamental rights sought by the Brazilian citizens.
It is worth to say that the Environmental and Urban politics integrated with
fundamental rights interferes with the Property Rights, intimately bound to fulfill a
social and environmental function, above all as decent housing for its inhabitants.
In this decent housing fundamental right we find the basis for the land
regularization of social concern, ruled by the Urban Planning Law.
The City s regulations lay down general guidelines for the application of the
urban politic, claimed constitutional, leaving for the city trough its Director Plan to run
it, ordering the use and occupation, regularizing informal settlements, protecting the
environment, permitting a sustainable development and social welfare.
Thus it is for the City, federal entity responsible for common administrative act,
establishing administrative licensing urban and environmental for small and medium
enterprises, set amidst one of them very important, the land regularization of social
concern / O Licenciamento Urbanístico e Ambiental integrado tem o objetivo de atuar
como um instrumento para o Município possibilitar o ordenamento do solo e
regularizar os assentos informais.
A regularização fundiária de interesse social vai de encontro com a justiça
social e os direitos fundamentais almejados pelos cidadãos brasileiros.
Vale dizer que as Políticas Urbanas e do Meio Ambiente interligadas aos
Direitos Fundamentais, interfere sobre o Direito de propriedade intimamente
vinculado a cumprir uma função sócio-ambiental, sobre tudo como o moradia digna a
seu habitante.
A esse direito fundamental de moradia digna encontra-se a base para a
regularização fundiária de interesse social, regrada pelo Direito Urbanístico.
O Estatuto da Cidade estabelece as diretrizes gerais para a implantação da
Política Urbana, reclamada constitucionalmente, cabendo ao município através de
seu Plano Diretor executá-la, ordenado o uso e ocupação do solo, regularizando
assentamentos informais, protegendo o meio ambiente, permitindo o
desenvolvimento sustentável e o bem-estar social.
Desta forma cabe ao município, ente federado com competência comum para
atuar administrativamente, estabelecendo o processo administrativo de
licenciamento urbanístico e ambiental integrado, para pequenos e médios,
empreendimentos, entres eles um de suma importância, a regularização fundiária de
interesse social
