Kompensation till grannar vid genomförande av detaljplan / Compensation to neighbours when implementing a local plan

Vi lever i ett samhälle under ständig utveckling där byggnation av fastigheter och infra-struktur är av stor betydelse. Med hjälp av detaljplaner kan exploateringsområden planeras och ligga till grund för utveckling. I samband med genomförande av dessa planer uppstår ofta situationer där de befintliga fastighetsägarna i området inte samtycker. I plan- och bygglagen, vilken reglerar detaljplaneprocessen, finns inte heller någon reglering kring kompensation eller annan ersättning till intilliggande fastigheter som lider skada av detaljplanen.  Syftet med det här arbetet är att utreda om kompensation med stöd i plan- och bygglagen borde utgå till intilliggande fastighetsägare, så kallade grannar, som berörs vid införande av en ny detaljplan. Detta besvaras genom att titta närmare hur grannar hanteras vid genomförande av nya detaljplaner, om de kompenseras då de drabbas negativt samt vilka för- och nackdelar en lagreglering av kompensation till grannar skulle medföra. I studien analyseras detta med hjälp av befintlig lagstiftning, detaljplanefall från verkligheten och intervjuer med verksamma personer inom byggprocessen. Uppsatsen har avgränsats till att endast behandla rättsfall i eller omkring större städer och ger exempel på planers påverkan på grannar, där vissa har resulterat i kompensation.  Sammanfattningsvis visar denna studie på att kommunens tillmötesgående till grannars åsikter kan leda till planförändring, som skulle kunna vara av sådan grad att den skulle anses utgöra en form av kompensation. Samtidigt visar den även på att många drabbas negativt vid plangenomförande utan att ersättas. Ekonomisk kompensation till grannar har visat sig förekomma, trots avsaknat stöd i plan- och bygglagen. Teoretiskt sett hade en lagreglering verkat rättviseutjämnande – inte bara för de fastighetsägare som drabbas utan även sett till de olikheter som finns i rådande lagstiftning. I komplexa och samhällsviktiga detaljplanefall, där vissa betydande olägenheter är svåra att undvika, hade ersättning kunnat utgöra en lösning. I praktiken däremot är det svårare att avgöra om en lagreglering hade lett till en förbättring av det system som redan finns idag. I nödvändiga fall har det, trots uteblivet lagstöd i plan- och bygglagen, visat sig finnas en kompensationshantering i form av överenskommelser, varpå behovet av lagregleringen i praktiken kanske inte är lika stort som i teorin. / We live in a society under constant development where construction of real estate and infrastructure is of great importance. With the help of local plans, exploitation areas can be planned and be the basis for development. In correlation to the implementation of these plans, situations occur where the existing property owners in the area do not agree. The planning and building act, which regulates the local planning process, does not regulate compensation or other remuneration to neighbouring properties that suffer due to the local plan. The purpose of this thesis is to investigate whether compensation with support in the planning and building act should be given to adjacent property owners, so-called neighbours, who are concerned with the introduction of a new local plan. This is answered by looking closely at how neighbours are handled when implementing new local plans, if they are compensated when they are adversely affected, and what the pros and cons of a legislation of compensation to neighbours would entail. In the study, this is analysed by means of existing legislation, local plan cases from reality and interviews with individuals actively working in the construction process. The approach has been limited to only deal with cases in or around major cities and gives examples of plans' impact on neighbours, some of which have resulted in compensation.  In summary, this study shows that the municipality's courtesy to neighbour’s stand points can lead to change of a plan, which could be of such a degree as to be considered a form of compensation. At the same time, it also shows that many people that suffer negatively due to a plan do not get compensated at all. Financial compensation to neighbors has been shown to exist, despite the lack of support in the planning and building act. Theoretically, law enforcement would be a fair solution - not only for the neighbours who suffer but also the differences in existing legislation. In complex important societal plans, where some significant inconveniences are difficult to avoid, compensation could be a solution. In practice, on the other hand, it is more difficult to determine whether law enforcement would lead to an improvement of today. In necessary cases, despite the lack of legal support in planning and building act, compensation is found in agreements, in which case the need for law enforcement may not be as great as in theory.

The analysis includes what kind of building arrangements that are deviating from the local plan, in what way these buildings are deviating, what kind of buildings that are concerned of deviations and what kind of applicants that apply for building permits that are deviating from the local plan. The provisions that are concerning minor deviations are presented in the results. The analyse is also investigating why deviations are made from the social plans and how the spatial distribution of minor deviations are in the municipality of Umeå and the urban areas of Umeå.   The survey is made from datasets provided by the office of building permits in the municipality of Umeå. The data has been encoded and categorised into four main categories; Type of applicant, type of building, type of building arrangement and type of deviation from local plan. The mapping of data has been made using the property map provided by the Ordnance Survey of the municipality of Umeå.   According to the survey extensions of buildings applied for by private housing owners are the most common minor deviations that are allowed and the deviation from the plan are placement of the extension part. The minor deviations are not a spatial phenomenon in the municipality of Umeå. The occurrence of minor deviations is evenly distributed in the municipality and in the urban areas as well. Provisions of the Planning -and Building act says that a minor deviation from the local plan can be made under conditions that the deviation is small and do not contradicts against the aim of the local plan.

La planification urbaine regroupe les moyens institutionnels mis en œuvre pour gérer les évolutions urbaines. Au cours du temps, les documents de planification urbaine français ont vu leurs objectifs évoluer en vue d’une gestion plus maîtrisée des espaces urbanisés (lois SRU et Grenelle). Aussi, la question de la protection de l’environnement et des espaces a été renforcée par la législation européenne qui a obligé certains documents d’urbanisme à intégrer une évaluation environnementale (en 2001 pour l’Europe, applicable en France en 2005). Cette thèse propose une démarche d’évaluation complémentaire aux systèmes d’indicateurs des évaluations des Plans Locaux d’Urbanisme et plus largement de questionner l’impact des PLU sur le territoire urbanisé. En effet, les indicateurs des évaluations des PLU semblent renseigner plus sur les performances durables des villes que sur la qualité du dispositif d’urbanisme règlementaire. La démarche proposée se base sur la création d’un corpus d’indicateurs devant montrer les effets du PLU par rapport à des « critères » qui sont du ressort de l’urbanisme règlementaire (zonage, contraintes formelles du bâti et d’aménagement de la parcelle, équipements publics et aménités urbaines) et de « l’urbanisme durable » (au sens des lois SRU et Grenelle). Enfin, l’agrégation des indicateurs par analyses multicritères et statistiques permettront aux rédacteurs des PLU de disposer d’un outil de compréhension des règles complexes ainsi que d’un outil d’aide à la décision, en vue de faciliter les choix d’évolution du zonage et des règlements. La démarche est appliquée au PLU de Toulouse. / Urban planning includes the institutional means used to control urban development. Over the years, the French urban plans saw their goals modified towards a more controlled urban space management (SRU and Grenelle laws). Besides, environmental and spatial protection issues were reinforced by European legislation, which made the environmental assessment compulsory for some plans (in 2001 for Europe, applied in France in 2005). This PhD research aims to propose a complementary assessment approach to the current indicators contained in the local plan’s assessments, and, more broadly, to question the impacts of the local plans on urban areas. In fact, the local plan indicators seem to be more adapted for a city sustainability performance analysis than for an analysis of the quality of the regulations contained in the plans. This approach starts with the creation of a set of indicators, which are expected to show the effects of the local plan, focusing on “regulatory planning criteria” (zoning, constraints for a building shape and parcel layout, public facilities and amenities) and “sustainable planning” (based on the SRU and Grenelle laws definitions). Finally, the aggregation of the indicators, by the use of multicriteria and statistical analysis, will supply regulatory planners not only with a tool for better understanding of the complex regulations but also a decision aiding tool, whose purpose is to facilitate the choices planners have to make for the evolution of the zoning and the regulation. The local plan of the city of Toulouse will be used as a case study to show the application of the approach.

The primary goal of my diploma work is to point out the topic of creating the territorial study and aplicating my knowledge of territorial studies as working and analysing the territorial study in České Budejovice. In the first chapter there is the literary summary of territorial studies and urbanism in general connected with other related branches and disciplines. In the sekond charter we can find the brief description of Česke Budejovice as the city and also the detailed description of the area, we are interested in, because of working out the territorial study and using the territorial analytic materials in order to create it. The reader will learn about the general terms of town planning and urbanism and he or she will also learn about the detailed information of the project architekt's work. In the practic part of this work there is the topic of creating the territorial study in-depht and also other topics such as the limits of use for specific area, the restrictions of some branch, for example agriculture, housing developement, traffic and so on. The reader will also learn about the mening of territorial study within all its groundworks, basis, instruments, supplements and anexes. I agree that the main contribution of my work is to summarize of the general topics and parts, that the territorial study should contain and then its aplication to the territorial study of České Budejovice.

Thesis title: Public interest, politics and developers The thesis deals with issues of public interest, politicians and developers. The aim of the thesis is to map the conditions for new buildings and determine what the public interest is in urban planning. The thesis is focuses mainly on the territory of Prague. For that purpose thesis analyze the relationships between terms and analysis of the legal framework and a description of practical experience in construction. The thesis is divided into three chapters. The first chapter is divided into two main parts and is dedicated to the term of public interest, first from the interdisciplinary and subsequently from the legally perspective. This chapter provides a better understanding and grasp of the term. In the first part thesis interprets the works of prominent thinkers who work with the term, especially the genesis of the words "public" and "interest". This is followed by a search for a corrective to the capitalist view of the public interest, as well as view of the public interest as the interest of certain groups, as well as modeling system to determine public interest in the decisions of politicians. This thesis deals with the impact of a planning on land prices in the village Bernartice nad Odrou. A theoretical basis for an evaluation of an immovable property is described, then a documentation of the planning in the village is analysed and in the end, an evaluation via a case study of two selected lands is made. Both of these lands are evaluated by a determined price and a usual price in the three levels according to the conditions of a local plan. There are levels using plots such as an agricultural land, a land designed for building-up according to the local plan and a building land. The evaluation is based on calculation results in the particular phases. Finally, results justification is presented.
