Os processos de cheias em bacias urbanas vêm sendo agravados devido a uma série de motivos associados à ocupação desordenada do solo urbano. As medidas de controle de enchentes podem ter sua eficiência analisada através da modelagem hidrológica matemática. É neste sentido que o presente trabalho analisa a influência da urbanização sobre os distúrbios no escoamento superficial, por meio de simulações de cenários urbanísticos propostos, com a finalidade de servir como ferramenta de planejamento urbano. Para isso, definiu-se como área de estudo, parte da bacia do Córrego do Gregório, São Carlos - SP. As principais informações da bacia a serem consideradas são: topografia, hidrografia, uso do solo urbano, expansão da área urbana, áreas de proteção ambiental e divisores de microbacias. O modelo hidrológico utilizado é o IPHS-1, do tipo concentrado. Para essa análise são propostos e simulados cenários urbanísticos, baseados na adoção de medidas de controle de inundações não-estruturais, referindo-se principalmente, à conservação de áreas verdes e disciplinamento do uso e ocupação do solo, verificando sua eficiência na redução do volume escoado e atenuação das vazões de pico. / The flooding processes in urban basins have become worse due to many reasons. All of them associated with the disorganized occupancy of the urban area land. The efficiency of flood mitigation measures can be analyzed by mathematical modeling. This study aims to be used as a tool for urban planning and it analyses the influence of the urbanization processes on surface runoff, using simulation of several urbanization scenarios. The case study was undertaken at the Gregório River Basin in São Carlos - SP. The main information considered was topography, hydrology, urban land use, urbanization, protected land and sub-basins. The software used was IPHS-1 which is a lumped hydrologic model. In this research many urbanization scenarios are proposed and simulated. These views are based in many nonstructural flood mitigation alternatives such as land cover conservation, use and occupancy of the land, in order to check their efficiency in reducing the total volume of surface runoff and the peak flow.

Over the years, these commercial transactions have generated legal uncertainty in international trade relations, both for sellers and buyers, since there was no uniformity in the standards that would be applied to solve the problems arising from international trade, such as: lack of delivery of goods, non-conformity of delivered goods, delivery of goods beyond the contract deadline, non-conforming international purchase and sale documentation, delivery of goods in a place other than the named place of destination, as well as any other substantial default under the purchase and sale agreement. The aforementioned issues cause financial, economic and tax losses, since the economic balance of the agreement is bound to its fulfillment in the terms in which it was entered into. This situation was exacerbated by the lack of a uniform standard, and by the fact that some countries follow the civil law system, while others follow the common law. Thus, a movement began in search of a uniformization of standards, culminating in the approval of the Convention on Contracts for the International Sale of Goods. In this sense, the present dissertation approaches, first, the historical evolution, the approval of the text of the Convention and its normative structure. Afterwards, we discuss the application of the Convention in national territory from the perspective of the treaty. Next, an analysis will be carried out on the overall trading system and the good faith of the contracting parties. In sequence, we will assess the instruments of mitigation of damages in the international trade of goods, highlighting and studying their mechanisms, and how the Convention aims to mitigate the damages in international trade. All to conclude whether the means proposed by the international treaty can produce the desired effects or not. / No cenário de um mundo globalizado, a relação de compra e venda internacional de mercadorias e a circulação de capital, entre partes sediadas em dois ou mais países, cresceram de forma rápida e dinâmica. Ao longo dos anos, essas transações comerciais geraram inseguranças nas relações jurídicas internacionais, tanto para os vendedores quanto para os compradores, posto que não havia uma uniformidade quanto à norma que seria aplicada para dirimir os problemas advindos do comércio internacional, tais como: a falta de entrega das mercadorias, mercadorias em desconformidade com as contratadas, entrega de mercadorias fora do prazo contratado, documentação da compra e venda internacional em desconformidade, entrega de mercadorias fora do lugar de destino, bem como qualquer outro inadimplemento substancial do contrato de compra e venda. Os citados problemas geram danos financeiros, econômicos e tributários, posto que o equilíbrio econômico do contrato está vinculado ao seu cumprimento nos termos em que foi celebrado. Essa situação era agravada em face à inexistência de uma norma uniforme, e pelo fato de alguns países adotarem a civil law e outros, o sistema da common law. Simulating hydraulic interdependence between bridges along a river corridor under transient flood conditions

The interactions between rivers, surrounding hydrogeological features, and hydraulic structures such as bridges are not well-established or understood at the network scale, especially under transient conditions. The cascading hydraulic effects of local perturbations up- and downstream of the site of perturbation may have significant, unexpected, and far-reaching consequences, and therefore often cause concern among stakeholders. The up- and downstream hydraulic impacts of a single structural modification may extend much farther than anticipated, especially in extreme events. This work presents a framework and methodology to perform an analysis of interdependent bridge-stream interactions along a river corridor. Such analysis may help prioritize limited resources available for bridge and river rehabilitations, allow better-informed cost/benefit analysis, facilitate holistic design of bridges, and address stakeholder concerns raised in response to planned bridge and infrastructure alterations. The stretch of the Otter Creek from Rutland to Middlebury, VT, is used as a test bed for this analysis. A two-dimensional hydraulic model is used to examine the effects individual structures have on the bridge-stream network, particularly during extreme flood events. Results show that, depending on their characteristics, bridges and roadways may either attenuate or amplify peak flood flows up- and downstream, or have little to no impact at all. Likewise, bridges may or may not be sensitive to any changes in discharge that result from perturbation of existing structures elsewhere within the network. Alterations to structures that induce substantial backwaters may result in the most dramatic impacts to the network, which can be either positive or negative. Structures that do not experience relief (e.g., roadway overtopping) may be most sensitive to network perturbations.

Esta dissertação analisa a recepção do duty to mitigate the loss pelo Direito Civil brasileiro. Instituto com maior desenvolvimento nos países que adotam o sistema da common law, preceitua que a inobservância da mitigação pelo credor em face de um inadimplemento, seja evitando ou minimizando o prejuízo, faz com que ele não seja ressarcido do dano sofrido, pois referida conduta estava ao seu alcance. O estudo faz a contraposição dos conceitos de dever jurídico e ônus, extraindo-se a natureza jurídica do duty to mitigate the loss a partir da boa-fé. Posteriormente, são estabelecidos os seus pressupostos de existência, o que se convencionou chamar de pressuposto de exigibilidade processual e é feito um confronto com demais institutos de Direito Civil que possuem características semelhantes ou que podem se relacionar com a norma de mitigação. Parte-se, então, para o desenvolvimento do que se chamou de regra de aferição da razoabilidade, como meio de padronizar a verificação da medida que se pode considerar razoável para o credor adotar diante da incidência do duty to mitigate the loss. Logo após, é feito um levantamento jurisprudencial para avaliação da aplicação da norma de mitigação pelos tribunais brasileiros. Por fim, é analisada a presença do duty to mitigate the loss na Convenção das Nações Unidas sobre Contratos de Compra e Venda Internacional de Mercadorias (CISG) e em iniciativas internacionais. / This dissertation analyzes the reception of the duty to mitigate the loss by the Brazilian Civil Law. Institute with further development in countries that adopt the common law system, states that the failure of mitigation by the creditor in case of breach, either avoiding or minimizing the damage, causes him to not be reimbursed for the damage suffered, because that conduct was within his reach. The study contrasts the concepts of duty and burden, extracting the legal nature of the duty to mitigate loss from the good faith. After, it is established their assumptions of existence, the so-called assumption of procedural enforceability and it is made a confrontation with other institutes of civil law that have similar characteristics or can relate to the standard mitigation. The next step is the development of what was called reasonableness admeasurement rule, as a means to standardize the verification of measures that can be considered reasonable for the creditor to take on by the incidence of the duty to mitigate loss. Immediately after, a survey is made for judicial review of the implementation of mitigation standard by Brazilian courts. Finally, it is analyzed the presence of the duty to mitigate the loss in the United Nations Convention on Contracts for the International Sale of Goods (CISG) and international initiatives.

Carbon capture and storage and the Australian climate policy framework

Australia’s economy is heavily dependent on coal-based energy and greenhouse gas intensive natural resource extraction and processing industries. As part of an international climate change mitigation effort Australia will have to undergo a national transformation to a low emissions society by mid century. Federal and State Governments in Australia, like their counterparts in other major developed economies, have been persuaded that reliance on fossil fuels in stationary energy industries such as electricity generation and minerals processing will be able to continue with the deployment of a value chain of technologies fitted to these installations for capturing carbon dioxide, transporting it to a disposal site, and then injecting it into subsurface geological formations for permanent storage (carbon capture and storage, or CCS). Understanding the likely effectiveness of CCS for reducing greenhouse gas emissions from stationary energy industries is therefore critical to policy formulation for, and management of, Australia’s emissions mitigation effort and national transformation over the decades ahead. / This thesis aims to offer a clearer understanding of the practicalities, limitations and uncertainties surrounding future CCS use in Australia and of the contribution CCS can make to mitigating emissions from the Australian stationary energy sector in the period to 2050. It considers two central questions: Is CCS a realistic option for emissions mitigation in Australia? Are Australian climate policies formulated to facilitate CCS deployment and optimise its potential contribution? The criteria employed in this thesis for answering these questions are restricted to those having an ascertainable causal impact on the timing, pace and ultimate scale of CCS deployment within Australia. The methodology used for the research is grounded in critical approaches and integrated assessment within a holistic, trans-disciplinary paradigm. / This thesis finds that under Australia’s existing climate policy framework it is unrealistic to expect CCS can contribute more than 75 million tonnes of CO2 per annum to emissions mitigation by 2050. Australia does have sufficient potential geological storage resources to expect some environmentally safe CCS infrastructure could be engineered over time, but commencement of large scale build-out is not likely before 2025. When CCS will become a commercial mitigation option in Australia is unpredictable and dependent more on the political economy of climate change than on Australian research, development and demonstration activities. / The thesis also finds that the existing climate policy framework is increasing rather than decreasing the risks to timing and usefulness of CCS even to the level of 75 million tonnes of CO2 per annum by 2050. This thesis concludes that Australian Governments are not developing the institutional capability to oversee a holistic decarbonisation of the stationary energy sector. This capability is required not only to address the risks to CCS deployment but also to prevent market failures that foreclose an optimal contribution from all other potential mitigation technologies. The thesis proposes that an Australian national CCS company be created with responsibility for CCS integration, transport and storage services in order to develop Australian capability rather than that of international corporations.

Effect on Climate Change on Maize Production in Zambia

<p>Maize is one of the crops that is grown by most farmers in Zambia being the staple food for the majority of Zambians. However, despite the crop being so important, its production is dependent on climatic conditions. This means that any change in climate can affect the production either negatively or positively. This research therefore, focused on determining how the change in temperature and rainfall affect maize production on the Copper belt, Eastern, Lusaka and Southern provinces of Zambia and investigate the main adaptation measures implemented by both the government and non-governmental sectors. Also, assess through the review of National Agricultural Policy and action plans, how the government has documented issues of climate change. In order to obtain the needed data, interviews were conducted with different officials from both the government and non-governmental sectors. However, from the estimate of the impact of temperature and rainfall on maize production, the results did not show with any significance that either temperature or rainfall has effect on maize production. In fact, it was found that quantifying the effects of climate change on maize production is not easy due to difficulties in quantifying other factors that may also have large impact on maize production. It was therefore, not possible to conclude whether or to what extent climate change has effects on maize production. However from the interviews conducted, it was found that both the government and non-governmental sectors have introduced different activities in their programmes to ensure that farmers are food secure, though the ministry of agriculture has no policy document on how to handle the problem of climate change to address different issues of the sector. In fact, most offices in the ministry do not have much documented information on climate change which could also be seen from the review of National Agricultural Policy and action plans where climate change issue has not been emphasized. Though both the Government and non-governmental sectors have implemented some adaptation measures, it cannot easily be concluded whether the implemented measures are adequate or not due to the fact that we are not sure of the expected effects in different parts of the country. Nevertheless, to enhance food security with or without adverse effects of climate change on maize production, it was recommended that members of staff at all levels under MACO should be trained in the area of climate change for them to have a wider understanding of the issue and work responsively and that much research should be done to open up the mind of the people and help policy makers make effective plans.</p>
