Captain Stormfield, the main character in Mark Twain's last book, Extract from Captain Stormfield's Visit to Heaven (1909), appears numerous times--under either the Stormfield name or some other--in Twain's published and unpublished works. Scholar's since Train's death have given only passing or slight notice to the Stormfield character. His numerous appearances, however his pivotal function among several unfinished works, and his essential optimism must lead to an awareness of his significant role in Twain's fiction.

The prevailing analyses of the structure of the Gospel of Mark represent modifications of the form-critical approach and reflect its tendency to regard the Gospel not as a unified narrative but as an anthology of sayings and acts of Jesus which were selected and more or less adapted to reflect the early Church's theological understanding of Christ. However, a narrative-critical reading of the Gospel reveals that the opening proclamation, the Transfiguration, and the concluding proclamation provide a definite framework for a close pattern of recurring words, repeated questions, interpolated narrative, and inter locking parallels which unfold the basic theme of the Gospel: the person and work of Christ.

The diploma thesis deals with chosen aspects of the trade mark registration with the view to the current and also previous Czech legislation, the Community trade mark and the international trade mark. It compares the requirements imposed not only by the public regulations but also by obligatory rules of trade mark offices on the applicant and it keeps under review the amount of administrative demands of the trade mark registration according to respective systems. The work concentrates on possibilities of the information sources relating to the trade mark registration, on formalities of the correct and complete submission of the trade mark application, on possible ways of communication with offices and on the formal and absolute ground examination.

Development of strategic mark up decision by contractors in Saudi Arabia

Competitive bidding is a common practice in business. The main aim of this research is to develop a practical bidding model. This includes studying existing bidding models used by organisations and verifying the developed model. Various factors have been identified and analysed in order to identify the weight and ranking order of each factor in terms of its influence on the bid mark up size. Interviews have been conducted to explore the current practical practice in setting mark up size in Saudi Arabia and to identify factors that may influence bid mark up size. In addition, a questionnaire has been used to identify each factor’s level of importance in Saudi Arabia. The findings have been used to establish a ranking order of factors in terms of their influence on bidding decisions based on contractors' size and main client. An important discovery is that the level of importance and rank of factors that influence bid mark up size differ based on contractors' characteristics and main client. The characteristic which has been investigated in this research is the size of the contractor. As a result, a bidding model to determine mark up size based on contractors' size and main clients has been developed. The proposed model has been tested and proved accurate in simulating the contractors’ decisions.

This oral interpretation thesis analyzes the influences on Mark Twain's reading, traces his development as an oral interpreter, and studies his techniques for revising selections of his literature to make them more suitable for oral delivery. This study concentrates on Twain's 1884-1885 reading tour with George W. Cable because in that period Twain made his greatest advances as an oral interpreter. The impact that this tour had on Twain's later reading is also analyzed. It was discovered that the interpretation theories developed by Twain are consistent with contemporary theory and practice.

This thesis analyzes technical and stylistic aspects of Mark di Suvero's nineteen sixties found-object works, and his monumental I-beam sculptures of the nineteen seventies and eighties to demonstrate their consistency despite the apparent contrasts in form, materials, and process. Primary data, sculpture of Mark di Suvero. Secondary data obtained from major art periodicals, newspapers, and exhibition catalogs. The artist was interviewed by author at the retrospective exhibition in Nice, France, Septermber, 17, 1991. Examination of primary and secondary data reveals a strong continuity by the artist in his approach to his work despite obvious external changes in materials and process.

Sedan det första steget togs mot en harmoniserad varumärkesrätt inom EU har grafisk återgivning varit ett krav vid registrering av varumärken, men kravet på grafisk återgivning försvinner i och med EU:s nya varumärkesreform. Syftet med denna uppsats är att belysa och utreda vad detta kommer att innebära för möjligheten att registrera okonventionella varumärken. Utredningen är inriktad på följande okonventionella varumärken: doftmärken, smakmärken, ljudmärken, känselmärken, rörelsemärken och hologram. Syftet med kravet på grafisk återgivning har varit att föremålet för varumärkesskyddet ska fastställas på ett exakt sätt, men kravet har lett till att okonventionella varumärken, särskilt sådana som inte kan uppfattas visuellt, har varit svåra att registrera. Genom en granskning av äldre rättspraxis på området identifieras de specifika problem, avseende den grafiska återgivningen, som finns för vart och ett av de utvalda okonventionella varumärkena. Resultatet av granskningen ligger, tillsammans med en analys av den ändrade varumärkesdefinitionen, till grund för utredningen av de konsekvenser som ändringarna, särskilt borttagandet av kravet på grafisk återgivning, kommer att få för möjligheten att registrera okonventionella varumärken. Resultatet av analysen indikerar att möjligheten att registrera okonventionella varumärken kommer att öka i och med att det framförallt är den grafiska återgivningen som har orsakat problemen vid registrering. En teknikneutral återgivning gör det möjligt att använda nya återgivningsmetoder, vilket i sin tur leder till att de krav som ställs på återgivningen, bland annat att den ska vara klar och lättillgänglig, kan uppfyllas på ett bättre sätt än tidigare. / Graphical representation has been a requirement for registration of non-conventional trade marks since the first step was taken towards a harmonized trade mark regulation in the EU. The requirement for graphical representation was removed as a result of the new trade mark reform. The purpose of this thesis is to illuminate and investigate how the removal of the requirement for graphical representation will affect the possibility to register non-conventional trade marks. The investigation focuses on the following non-conventional trade marks: scent marks, taste marks, sound marks, touch marks, motion marks and holograms. The purpose of the requirement for graphical representation has been to determine the precise nature and extent of the protection that the registered mark provides to its proprietor. However, the requirement has led to difficulties regarding registration of non-conventional trade marks, especially trade marks that cannot be perceived visually. The specific problems, regarding graphical representation, for each one of the selected trade marks, are identified through a review of earlier case-law. The result of the review of the earlier case-law and a review of the new trade mark definition, make up the foundation of the analysis of the consequences the removal of the graphical representation will have on the possibility to register non-conventional trade marks. The result of the analysis indicates that the possibility to register non-conventional trade marks will increase as a result of the removal of the requirement for graphical representation, as it is the graphical representation that has caused most problems for non-conventional trade marks during the registration process. As there is no longer a requirement for the representation to be graphical, it will be possible to use new methods for representation. This will in turn lead to that the criteria the representation must meet, for example that it must be clear and easily accessible, can be better achieved than before.

Purpose: Despite many previous articles and tests on the subject “analysis methods for concrete slabs on ground subjected to concentrated loading” there is still uncertainty on which analysis method to use and if the results correspond to real failure loads. The purpose of this study has been to evaluate and compare different analysis methods for slabs on ground subjected to concentrated loading.Method: Initially literature studies was performed where different analysis methods were studied. Three methods were chosen based on different aspects. It was found that A. Losbergs (1961) method was mainly used in Sweden while other countries in Europe used Meyerhofs (1962) method. Rao & Singhs (1986) method has a similar approach compared to Meyerhofs but ads two different types of failure modes. Two peer re-viewed articles were also chosen from which secondary data could be retrieved. The articles described tests where concrete slabs were loaded until failure. The test condi-tions were used to perform calculations with the three analysis methods. A comparison was made between the test results and the results from calculations.Findings: It is concluded that there are some differences between Losbergs, Meyerhofs and Rao & Singhs analysis methods. Largely the three methods require the same input, they differ in selection of analysis solution, but despite a degree of variation of the calculation results the overall picture for the different loading cases are quite unified. For central loading all analysis methods result in a capacity lower than the test values, varying from 56% to 93% of the failure load. Concerning edge and corner cases the spread of results is even wider. Calculations for the reinforced slab results in a capacity higher than the test values while calculations for the plain concrete slab results in a capacity considerably lower than the test values.Implications: The results in this study indicates that the three analysis methods are applicable for internal loading. The spread of the results makes it difficult to estimate the margin to the actual failure load, but the safety factors according to Eurocode 2 should provide a safe failure margin. Regarding edge and corner cases it is more diffi-cult to draw conclusions due to the large spread of results. Further research and testing is needed.Limitations: The study is limited to three analysis methods and the results from two articles where two different concrete slabs were tested. Inclusion of additional analysis methods and articles with test results would expand the generalizability of the study. However due to the limitations of the extent of the study and disposable time this was not possible.Keywords: Meyerhof, Rao & Singh, Losberg, concrete slab on ground, concrete slab on grade, point load, concentrated load.

Obrana třetích osob proti známkovému pirátství / Defence against trade mark piracy

The aim of the thesis is to analyse different instruments of defence against trade mark piracy. The thesis composes of seven chapters. Chapter One is introductory and defines basic terminology used in the thesis: trade mark, community trade mark, registration of the trade mark by the Industrial Property Office, etc. Chapter Two focuses on the term "trade mark piracy". It divides defence against it into two different means -- dispute proceedings by the Industrial Property Office and judicial instruments. Chapter Three concentrates on comments on the ineligibility for enrolment of the trade mark designation and reasons for taking these comments. The chapter Four analyzes different types of the proposal for the revocation of the trade mark -- nonusage and using the trade mark in conflict with the unfair competition regulation. The chapter Five looks at the declaration of already-registered trade marks as invalid. Different reasons for taking a proposal of declaration are examined there. The chapter Six describes different types of appeals against decisions of the Industrial Property Office. The last chapter summarizes results of the questionary about use of the instruments against trade mark piracy.
