Orientadora: Rejane Galvão Coutinho / Banca: Amanda Patrycia Coutinho de Cerqueira / Banca: Giulinano Tierno de Siqueira / Resumo: The purpose of this paper is to analyse how the work conditions offered by the cultural equipments of the City of São Paulo interpose into the educational practice of the workers of cultural mediation, who works in art exhibitions. The theoretical foundations are divided in two axis: education and cultural mediation (FREIRE, SAVIANI, VYGOTSKY; BARBOSA, DARRAS, HOOPER-GRENHILL, MARTINS); Neoliberalism and its implication in culture (HARVEY, BRESSER-PEREIRA). It was considered the transformations of historical context, political and social in Brazil from the 1990s (ampliation of tax incentive law, outsourcing and privatization of the work, big exhibitions) to define how does this impacted in the quality of the pedagogical actions offered by the cultural equipments. For this purpose, nine coordinators of three kinds of institutions of cultural equipments were interviewed: private institutions, social organizations and outsourcing companies. From the collected data, it was elaborated a plan of the work morphology (ANTUNES) of the cultural mediator worker: contracting regime, salary remuneration and benefits, working journeys, days off, expertise and continuing education, career plan and symbolical valorization. It was considered the Brazilian occupations classification, which the work of the cultural mediator it's not a regulated profession and because of that, the professionalization it turns out to be a complexed case to be analysed. La fundamentación teórica se divide en dos ejes: Educación y Mediación Cultural (FREIRE, SAVIANI, VYGOTSKY, BARBOSA, DARRAS, HOOPER-GRENHILL, MARTINS); Neoliberalismo y su implicación en la cultura (HARVEY, BRESSER-PEREIRA). Se consideraron las transformaciones del contexto histórico, político y social en Brasil a partir de la década de 1990 (ampliación de las leyes de incentivo fiscal, publicitación y privatización, megaexposiciones) para definir cómo éstas impactaron en la calidad pedagógica de las acciones educativas ofrecidas por los referidos equipamientos culturales. Para eso, fueron entrevistados nueve coordinadores de educación de tres tipos de instituciones culturales contratistas: instituciones privadas, instituciones estatales gestionadas por Organizaciones Sociales y empresas de tercerización. A partir de los datos recolectados, se elaboró un esbozo de la Morfología del Trabajo (ANTUNES) del mediador cultural: regímenes de contratación, remuneración salarial y beneficios, jornada de trabajo, atenciones, holguras, competencias y formación continuada, plan de carrera y valorización simbólica. Con base en la Clasificación Brasileña de Ocupaciones, el trabajo del mediador cultural no es profesión regulada y, por eso, un caso complejo para ser analizado su profesionalización. In our society marriage is a social institution in which a male individual marries a female individual, provided both have attained their respective adulthood as specified by the law of the state. Although the definition of marriage varies with culture it can, in a nutshell, be defined as a social union or legal contract between spouses that establishes rights and obligations between the two of them, between them and their children and between them and their in-laws. It therefore falls within the ambit of those who are specifically trained in psycho-socio counselling to minimise the damaging consequences of a failed marriage.

The thesis examines the European Union as a mediator in the case of Belgrade-Pristina dialogue. It tends to discover which factors led to lower mediation effectiveness after 2015, by EU's mediation strategy, leverage and coherence. The thesis is designed as a qualitative case study which compares three different stages of the case by implementing a combination of congruence method and process tracing. Drawing for the content and document analysis as well as four interviews conducted and two personal communications, the thesis analyses the factors which influenced effectiveness and compares them throughout three different phases of the mediation. In the end, the analysis shows that while strategy remained the same, levels coherence and leverages changed and concluded that it was the weaking of EU's leverage strength that influenced mediation effectiveness the most.

Cette thèse cherche à identifier ce qui fait de l’homme un être de substance dont le corps est sensible. Si le moi vibre et que le sujet bat, le parlêtre résonne via les pulsions. Nous faisons de la résonance un concept opératoire pour rendre compte de la jouissance en jeu chez le parlêtre : mise en résonance du corps et du langage, via l’objet a. Notre choix d’étude s’est porté sur les troubles du langage, non pas comme dysfonctionnement de la parole, mais en tant qu’agitations. Lalomanie, coprolalie, écho de la pensée ou encore écholalie témoignent de l’impact direct du langage sur le corps et de son traitement. Nous approchons ici la matérialité du langage : si le dire est le poids réel du sujet, la réson est le réel du langage. Dans cette logique, la schizophrénie devient folie résonnante, la paranoïa une folie raisonnante, tandis que l’autisme enferme le sujet dans une résonance pétrifiée. Le névrosé, lui, est condamné à vivre la répétition de la mélodie de l’Autre.Une revisite fondamentale des pratiques de médiations thérapeutiques par l’art dans la clinique de l’enfant est proposée. L’objet médiateur est situé à la jonction entre intérêt du patient et désir de l’intervenant de travailler avec cet objet. Le psychologue va alors adopter ce que nous nommons une position réfléchie, modalité de présence particulière où il se fait partenaire de l’enfant. Le clinicien devient alors un créateur de vide-en-forme, qui sert de caisse de résonance à la jouissance. Comme dans l’art, le réel de la réson est invoqué pour lui permettre de trouver un nouveau destin : les ateliers à médiation sont des lieux de possible mise en résonance de la jouissance pour faire laisser être un traitement par l’art. / This thesis seeks to identify what makes Man a person of substance whose body is sensitive. If the ego vibrates and the subject beats, the “parlêtre” resonates via the drives. We use resonance as an operative concept in order to stake how jouissance is acting the parlêtre: resonance of the body and of the language, through the “a object”. Our choice of study focuses on language disorders, not as speech dysfunction, but as agitations. Lalomania, coprolalia, echo of thought or echolalia show the direct impact of language on the body and its treatment. We are reaching hereby the language materiality: if the saying is the real weight of the subject, the “reson” is the real of the language. In this logic, schizophrenia becomes resonant madness, paranoia a reasoning madness, while autism encloses the subject in a petrified resonance. The neurotic is condemned to live again and again the Other melody. We are proposing a fundamental revisit of the practices of therapeutic mediations through art within the child clinic. The mediating object is situated at the junction between the patient’s interest and the psychologist’s desire to work with this object. He will then adopt what we call a “thoughtful position”, a particular mode of presence where he turns himself into a partner of the child. The clinician then becomes a creator of “vacuum-in form”, which serves as a resonance board (sounding board) for jouissance. As in art, the real of the “réson” is invoked to allow it to find a new destiny. By letting be, the mediation workshops are places where art becomes a possible treatment by resonating jouissance.

Baltimore Mobility: <em>The Wire</em>, Local Documentary, and the Politics of Distance

Extending scholarship on Baltimore’s media landscape, I observe how two moving-image texts, HBO’s The Wire (David Simon, 2002-2008) and 12 O’clock Boys (Lotfy Nathan, 2013), figure space and, by extension, mobility in the city. Specifically, I articulate how both figures of mobility relate with each other and to the mobility inequality that has historically and disproportionately plagued communities along the city’s east-west axis. Overall, in both texts, I read a shared anxiety toward sources of distant mediation. Through its sober audio-visual style and serial organization, I find The Wire fatalistically figures Baltimore mobility as conditioned by omnidirectional flows of power. These nefarious flows inevitably stymie any attempt at improving mobility inequality in the city, rendering distant sources of mediation as frustratingly inescapable. In contrast, I find 12 O’clock Boys implicitly critiques The Wire’s fatalistic figuration. Relying heavily on cinéma vérité aesthetics, such as handheld cinematography, this film figures mobility inequality as the product of corrupt institutional mediation. By coding institutional mediation as intrinsically alienating, this film implicitly advocates for exclusively immediate sources of mediation when representing east-west communities. Furthermore, the film suggests that escape from distant sources of mediation is both possible and desirable. Employing Iris Marion Young’s critique of the ideal of community and Scott Ferguson’s theory on care, I find The Wire and 12 O’clock Boys’ figures of mobility to be overly contractive and problematic, due to their mutual eschewal of vital sources of care that always already mediate from a distance.

Alternative resolution of individual labour disputes Abstract This thesis deals with alternative ways of solving individual labor disputes. The main reason for choosing this topic was the author's personal experience with alternative methods of dispute resolution in the field of labor conflicts and labor disputes, in particular with mediation, and also the author's opinion on non-fulfilment of the full potential of these methods in individual labor disputes. The work aims to provide a structured overview of the most commonly used alternative dispute resolution methods in the Czech Republic. At the same time, the author deals with hybrid methods that are rarely used in the czech dispute environment. For the sake of clarity, the author tried to maintain a similar structure in the individual chapters. The first two chapters focus on the definition of basic terms such as labor law dispute, ADR and their division and types. The next chapters already focus on the basic and hybrid ADR methods. Space is also devoted to both negotiation, its principles, phases and negotiation approaches, and other methods.
