The Wisconsin Hmong Resettlement Taskforce: An Ethnographic Analysis of Public Policy as a Cultural Process and ProductDeVivo, Karen Fink 12 January 2006 (has links)
This thesis focuses on the Governor of Wisconsin’s Hmong Resettlement Taskforce that was charged in 2004 with making policy recommendations for the State about a large resettlement of Hmong refugees. Through participant-observation, interviews, and document analysis, the process of policy formation by the Taskforce is examined. This empirical, ethnographic study depicts this taskforce as a group of cultural agents and its work as a cultural process. Findings in this thesis center on the taskforce report and the constraints on the narrative that limited possible recommendations.

La double incrimination est une condition « classique » en droit pénal international, que l'on trouve formulée dans les instruments normatifs relatifs à la coopération pénale internationale, ainsi que dans ceux consacrés aux compétences extraterritoriales. Dans ces deux domaines la condition de la double incrimination est considérée comme remplie lorsque les faits en question sont punis par les droits internes des deux États concernés (État requérant et État requis, ou État de poursuite et État de commission). Toutefois, l'application de cette condition n'est pas sans poser de difficultés, aussi bien sur un plan substantiel que sur un plan procédural. Des difficultés qui ont conduit les États européens à la remettre en cause, du moins pour partie ; une remise en cause totale de la double incrimination s'avérant, en l'état, impossible. / Double criminality is a “classic” condition in international criminal law, which is found in normative instruments relating to international cooperation in criminal matters, as well as those relating to extraterritorial jurisdiction. In these two fields, the condition of double criminality is considered fulfilled when the conduct in question is punishable under the domestic law of both states (the requesting state and the requested state, or the prosecuting State and the State in which the act was committed). Moreover, the application of this condition continues to pose difficulties, not only in substance but also in procedure. The difficulties have driven the European states to call the condition into question, at least partially; even though a total removal of the condition in its current state is impossible.

自兩岸於1987年開放探親以來,隨著兩岸頻繁的交流,跨兩岸性的犯罪活動,如販毒、詐欺、人口販運等犯罪亦日趨嚴重,特別是近年來出現有別於以往傳統詐騙手法的新型態詐欺犯罪—以電話、網路為中介物的「電信詐欺犯罪」,大肆橫行於兩岸,為害兩岸治安最深,是類犯罪不斷翻新手法,巧藉各種名目詐騙民眾獲取不法暴利,造成極嚴重的社會成本付出。過去,兩岸共同打擊犯罪機制,僅有「金門協議」及其他非正式管道,以為合作打擊犯罪的依據,因「金門協議」的內涵不足致使成果有限。隨著政治氛圍的改變,兩岸終於2009年4月簽署「海峽兩岸共同打擊犯罪及司法互助協議」,為兩岸共同打擊犯罪奠定了新里程碑,惟分析其內容並與「駐美國台北經濟文化代表處與美國在台協會間之刑事司法互助協定」比較,可以發現尚有許多問題亟待解決。本研究藉由分析現行兩岸共同打擊犯罪機制,並提出問題及建議,以強化兩岸共同打擊電信詐欺犯罪的力道。 / Since 1987 Taiwan and Mainland China allowed people visited opposite side, cross-strait crimes such as smuggling drugs, fraud and human trafficking have become more and more serious as both parts frequently contacting with each other. Recently, new type fraud which is different from traditional fraud spread around and critically damage social security, especially telecom fraud by telephone and internet being the mediators. By using multiform excuses, these kinds of crimes continuously renovate to cheat innocent people and obtain huge illegal money, so that they cause a great loss of social. In the past, there were only Kinmen Agreement and the other unofficial channel as the basis in the cross-strait crime-fighting mechanism. However, Kinmen Agreement was too narrowed its coverage to limited in its results. With the political atmosphere changes, each part finally signed “Cross-Strait Agreement on Joint Crime-Fighting and Judicial Mutual Assistance” in April, 2009. This is the new milestone of cross-strait crime-fighting cooperation mechanism. As analyzing it and comparing it with “Agreement on Mutual Legal Assistance in Criminal Matters between the Taipei Economic and Cultural Representative Office and the American Institute in Taiwan”, we found there are still some obstacles need to be resolved. This study offers some questions and advises in order to strengthen the cross-strait telecom fraud crime-fighting cooperation mechanism.

An African Perspective on Poverty Proverbs in the Book of Proverbs: An Analysis for Transformational Possibilities. This thesis contributes to the emerging global scholarly discussion on prioritising the practical relevance of biblical interpretation, particularly in Africa. Taking poverty as a case study, this thesis employs the notion of the popular social origin of proverbs to critically analyse the subject in the Book of Proverbs. A social anthropological approach, historical-critical methods, rhetorical criticism and contextual exegesis are used to analyse proverbs regarding the poor in the Book of Proverbs and African proverbial material. On one hand, the investigation reveals that many Western scholars take their cue from the `official' social context of the Book of Proverbs. However, the impact of an unconscious subjectivity owing to the Western secularising influence on their studies into poverty has posited a conservative status quo in the way the Book of Proverbs addresses it. On the other hand, an investigation of similar traditional African proverbial material on the poor reveals a holistic transformative possibility. Its life-centred dynamism is located in an integrative worldview that comprises mutual assistance, collective responsibility, family, community, social, political, religious and economic networks as one whole. Because cultural parallels exist between the society of ancient Israel and traditional African societies, the thesis argues the use of the African proverbial performance context in the interpretation of proverbs concerning the poor in the Book of Proverbs. The result of such cross-cultural application highlights the possible transformative social, economic, political and religious supportive networks essential to a viable and sustainable holistic development of society. Consequently, such a holistic approach to poverty may enable Bible readers to make meaning and empower the will of African Christians to rise practically to the challenge of poverty eradication in all spheres of their lives. A caution also to the universal church is to be found in the fact that the Book of Proverbs made an essential contribution to the transformation of the social, economic, political and religious life of Israel. La criminalité organisée constitue une préoccupation pour les pouvoirs publics français et haïtiens et sa répression pénale se situe au cœur des droits français et haïtien. Pour ce faire, les deux législateurs ont dû adapter leur législation pénale afin de doter l’institution judiciaire de nouveaux instruments répressifs permettant la détection et la répression des infractions de criminalité organisée. Celles-ci sont réprimées via une double approche répressive proactive et réactive. On remarque que le droit pénal de la criminalité organisée tant substantiel que formel opère un glissement du réactif vers le proactif. Il s’agit d’une logique répressive qui privilégie l’efficacité répressive sur le respect des principes fondamentaux. Le droit à un procès équitable s’y trouve alors malmené. Dans les deux droits, les personnes impliquées dans des infractions organisées sont sévèrement sanctionnées et la confiscation des avoirs criminels est utilisée à des fins préventives et répressives. Cette répression se fait dans le cadre d’une coopération policière et judiciaire efficace qui favorise l’émergence de nouveaux instruments de coopération provoquant ainsi la mutualisation et la régionalisation des normes destinées à la répression pénale de la criminalité organisée. Cette étude comparative montre qu’Haïti peut bénéficier de l’expertise judiciaire française fondée sur la spécialisation des acteurs judiciaires qui interviennent dans le procès pénal. / Organized crime is a major concern for the French and Haitian public forces and the related crime repression methods are at the core of the French and Haitian Criminal Law. In that sense, both legislators had to adapt their criminal legislation in order to provide the judicial system with new instruments of crime control to help detect and punish organized crime offenses. The latter are fought down via a double punishment approach that is proactive and reactive. We notice that the criminal law of organized crime, whether substantive or formal, slides from the reactive towards the proactive. It is a repressive logic that favours efficient repressive methods over the respect of fundamental principals. And therefore, the right of a fair trial is ill-used. In both Rights, the people involved in organized offences are severally sanctioned and the criminal assets are forfeited in order to apply preventive and repressive measures. This repression takes place within a cooperative efficient framework between the police and the judicial body and causes the emergence of new instruments of cooperation and the sharing and regionalization of the norms of criminal sanctions against organized crime. This comparative study shows that Haiti can benefit from the French judiciary expertise founded on the specialisation of the judiciary actors who participate in the criminal proceedings.
